approved.

Request: To permit the remodel and second story addition to an
existing single story residence with nonconforming
setbacks pursuant to Section 9652(c) of the
Huntington Beach Ordinance Code.
Location: 205 Joliet
Mike Connor, Staff Planner, reported that the existing structure has
a three foot eleven inch (3' 11") sideyard setback from the property
line in lieu of the 5 foot (51) required by Code. The second story
addition would be constructed at the existing non -conforming setback
to provide structural stability. Staff advised that the Building
Division requested that a bay window be removed in order to comply
with setback requirements and Public Works Department requested a
grading plan, street improvements and a two and one-half foot
(2 1/2') alley dedication. Staff also reported that a letter had
been received from the adjoining property owner who resides on the
side with the non -conforming setback supporting the addition. Staff
concluded by recommending approval with findings and conditions.
THE PUBLIC HEARING WAS OPENED.
Jeff Vinzant, the owner, was present and concurred with staff's
recommended conditions of approval.
Scott Hess, Zoning Administrator, said he would approve the request
because the addition was an improvement to the existing home and
neighborhood.
USE PERMIT NO. 91-31 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT
ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE
PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The remodel and second story addition to an existing
nonconforming residence will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity; All first story additions will meet code and
the second story addition is only nineteen feet along the
nonconforming setback.
b. Property and improvements in the vicinity of such use or

2. The proposal is consistent with the goals and objectives of
the City's General Plan and Land Use Map. The proposed
remodel and second story addition to an existing single family
residence will meet the requirements of the Medium Density
Residential Land Use Designation of the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
July 19, 1991 shall be the conceptually approved layout.
2 The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. Prior to issuance of building permits, the following plans and
items shall be submitted and/or completed by the applicant:
a. A covenant to hold Lots 24 and 25 of Block 1002 of the
Vista Del Mar Tract as one parcel shall be approved by the
Department of Community Development and recorded with the
County Assessor's office.

c. A grading plan shall be reviewed and approved by the
Department of Public Works and Community Development.
d. The property owner shall sign, notarize, and record with
the County Recorder a "Letter of Agreement" assuring that
the single family residence will be maintained as one (1)
dwelling unit.
4. Any oil wells (active, idle, abandoned, etc) on property to
be dedicated to the City shall be abandoned pursuant to Fire
Department standards by the property owner, at the cost of the
property owner, prior to City Acceptance of such property."
5. Street improvements shall be constructed to the satisfaction
of the Public Works Department.
6. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
7. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
8. Low -volume heads shall be used on all spigots and water
faucets.
9. All applicable Public Works fees shall be paid prior to
issuance of building permits.
10. Conditions of approval shall be printed verbatim on all
working drawings submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the
South Coast Air Quality Management District (AQMD). The AQMD
shall be notified in writing of any demolition at least ten
(10) days prior to said demolition.
4. The Zoning Administrator reserves the right to revoke this Use
Permit No. 91-31 if any violation of these conditions of the
Huntington Beach Ordinance Code occurs.

THE MEETING WAS ADJOURNED AT 1:40 PM BY THE ZONING ADMINISTRATOR TO
A STUDY SESSION ON MONDAY, JULY 29, 1991 AT 4:00 PM AND THEN TO THE
NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR ON
WEDNESDAY, JULY 31, 1991, AT 1:30 PM.
