ZONING ADMINISTRATOR: Scott Hess STAFF MEMBERS: MINUTES• REGULAR AGENDA ITEMS: Mike Connor The Minutes of the August 14, 1991 Zoning Administrator Meeting were approved. ITEM 1: LOT LINE ADJUSTMENT NO, 91-2 Applicant: Harvey A. Greenleaf 7702 Yukon Drive Huntington Beach, CA 92648 Request: To relocate the existing lot line between 7692 and 7702 Yukon Drive pursuant to Section 9811.3.1 of the Huntington Beach Ordinance Code Location: 7692 and 7702 Yukon Drive Mike Connor, Staff Planner, reported that the lot has an irregular configuration; therefore, the owner requested the relocation of the lot line. Staff said that the two lots meet code requirements and recommended approval with findings and suggested conditions of approval. Mr. Greenleaf, owner of one of the two properties was present, and concurred with the staff report. LOT LINE ADJUSTMENT NO. 91-2 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The lot line adjustment will not create a nonconforming parcel. 2. The lot line adjustment will not create a nonconforming yard requirement. 3. The lot line adjustment will not sever existing structures on the two lots. 4. The lot line adjustment will not allow a greater number of dwelling units than allowed by the code prior to the adjustment. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Lot Line Adjustment received by the Department of Community Development on July 22, 1991, shall be the approved layout. 2. Monuments for the newly -established property lines shall be readjusted in compliance with the Subdivision Map Act. A record of survey shall be completed to verify the location of the newly placed monuments. 3. Authentic data on the bearings on the adjusted line shall be shown on a plat map which shall be certified by the City Engineer prior to recordation. 4. Said plat map shall be recorded with the County Recorder prior to the issuance of a certificate of compliance for the structure and/or structures upon subject properties. A copy of the recorded document shall be submitted to the Department of Community Development for the file. ITEM 2: USE PERMIT NO. 91-3 Applicant: Denise Fish 18782 Beach Blvd. Huntington Beach, CA 92646 Request: To permit a One Day Temporary Outdoor Event - Emergency Services Fair - March 14, 1992 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 18782 Beach Blvd. ZA Minutes - 8/28/91 -2- (0674d) 1 1 Mike Connor, Staff Planner, reported that the request is for an Emergency Services Fair, sponsored by International House of Pancakes to be held on Saturday, September 7, 1992 from 1 PM to 5 PM. Staff reported that subsequent to the agenda being posted, the applicant requested that the date of the event be changed to March 14, 1992. Staff recommended approval with the change of the date to March 14, 1992 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED Denise Fish, Manager of International House of Pancakes, was present. She said the event will have booths for blood pressure, earthquake preparedness, first aid, DARE Program, Outreach Program and will have representatives from City Fire and Police departments. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 91-39 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the Emergency Services Fair will not be detrimental to: a. The general welfare of persons residing or working in the vicinity; The proposed event is only one day in length. b. Property and improvements in the vicinity of such use or building. All proposed improvements are temporary. 2. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. The event is in conjunction with an existing restaurant which is consistent with the General Commercial Land Use Designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, received and dated July 25, 1991 shall be the conceptually approved layout with the modifications described herein: a. The layout at the front of the building shall be used. b. The layout at the rear of the building shall not be used. 2. No tents shall be permitted without prior consent of the Zoning Administrator and the Fire Department. ZA Minutes - 8/28/91 -3- (0674d) 3. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. 4. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 5. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 6. The applicant shall obtain permits for any balloons or temporary signs. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke this Use Permit 91-39 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 3: TENTATIVE PARCEL MAP NO. 89-155 (A Six Month extension of time) Applicant: John B. Abell, Inc. 140 W. Orange Covina, CA 91723 Request: A six month extension of time for Tentative Parcel Map No. 89-115 to legalize an existing lot. Location: 17251 Beach Blvd. Tiffany Allevato, Staff Planner, reported that the applicant had indicated he had problems with his business and therefore requested the extension of time. Staff said all previous conditions of approval would apply and that Public Works had requested a change in condition number 9 of the original approval to read: "All vehicular access rights along Beach Boulevard be relinquished to the City of Huntington Beach except at approved driveway locations". Staff recommended approval with added conditions of approval. ZA Minutes - 8/28/91 -4- (0674d) LJ TENTATIVE PARCEL MAP NO. 89-155 (SIX MONTH EXTENSION OF TIME) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. Conditions of Approval: 1. All previous conditions of Tentative Parcel Map No. 89-155 still apply with the exception of Condition #9. a. Condition #9 shall read: All vehicular access rights along Beach Blvd. shall be released and relinquished to the City of Huntington Beach except at approved driveway locations. 2. Tentative Parcel Map 89-155 shall expire November 19, 1991. ITEM 4: USE PERMIT NO. 89-57 Applicant: Luis Lopez 7412 Count Circle Huntington Beach, CA 92647 Request: A one (1) year extension of time for Use Permit No. 89-57 to construct a 10,031 square foot industrial building. Location: 5540 Buckingham Tiffany Allevato, Staff Planner, reported that the applicant requested a one year extension of time due to his being out of the country. Staff advised that all previous conditions of approval would apply and that Public Work's requested condition number 12 be changed to read "The Traffic Impact Fee shall be paid prior to final inspection". Staff recommended approval with the added condition of approval. USE PERMIT NO. 89-57 (EXTENSION OF TIME) WAS APPROVED FOR SIX MONTHS BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. Conditions of Approval: 1. All previous conditions of Use Permit No. 89-57 still apply with the exception of Condition #12 which shall read: "The Traffic Impact Fee shall be paid prior to final inspection." 2. Use Permit 89-57 shall expire May 21, 1992.
