PUBLIC HEARING ITEMS B-1 CONDITIONAL USE PERMIT NO. 91-28/LOT LINE ADJUSTMENT NO. 91-1: APPLICANT: Mark Keller/Farhad Rezai LOCATION: Seabridge Center, 8052 Adams Avenue Conditional Use Permit No. 91-28/Lot Line Adjustment No. 91-01 is a request to construct a new parking lot with compact parking at Seabridge Center located on the southeast corner of Beach Boulevard and Adams Avenue pursuant to Section D of the Seabridge Specific Plan. Although this item was scheduled for action on September 4, 1991, new information concerning ownership has resulted in a need for continuance so that proper authorization for the application can be obtained. In case authorization is not received, the applicant has also submitted a revised plan which may not require the approval of the other property owner. Staff recommends continuance of this item to September 17, 1991 so that the revised plan can be sufficiently analyzed. STAFF RECOMMENDATION: Staff recommends that the Planning Commission continue Conditional Use Permit No. 91-28/Lot Line Adjustment No. 91-01 to the September 17, 1991 Planning Commission Meeting. At the present time, approval of this item is contingent upon either the Planning Commission's approval of Conditional Use Permit No. 91-28 to redesign the parking lot or an agreement with the adjoining property owner of the office building for joint use parking. These items are not ready for Planning Commission action on September 4 and must be continued to the September 17, 1991 Planning Commission meeting. A MOTION WAS MADE BY BOURGUIGNON, SECOND BY SHOMAKER, TO CONTINUE CONDTIONAL USE PERMIT NO. 91-37 TO THE SEPTEMBER 17, 1991 PLANNING COMMISSION MEETING, AS REQUESTED BY STAFF, BY THE FOLLOWING VOTE: AYES: Richardson, Bourguignon, NOES: None ABSENT: None ABSTAIN: None MOTION PASSED Newman, Shomaker, Kirkland, Dettloff, Leipzig B-3 RECONSIDERATION OF THE PLANNING COMMISSION'S APPROVAL OF ZONE CHANGE NO, 91-2/TENTATIVE PARCEL MAP NO, 89-322/USE PERMIT NO. 90-63/ENVIRONMENTAL ASSESSMENT NO. 91-13: APPLICANT: Stevinson Porto and Pierce, Inc. LOCATION: 2810 Huntington Street Zone Change No. 91-2, Tentative Parcel Map No. 89-322, and Use Permit No. 90-63 is a request for a zone change from R2 (Medium Density Residential) to R3 (Medium -High Density Residential) on a remnant 2,580 square foot parcel. If approved, the 2,580 square foot subject parcel will be combined with an existing 19,030 square foot R3 parcel to allow the addition of two (2) apartment units to an existing 13 unit apartment complex. The Planning Commission approved the project on July 23, 1991. At the following meeting of August 6, 1991, however, the Commission voted to schedule the item for reconsideration on September 4, 1991. Reasons cited for reconsideration were concerns regarding the provision of parking for the adjacent 13 unit apartment complex. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Zone Change No. 91-2, Tentative Parcel Map No. 89-322 and Use Permit No. 90-63 with all previous findings and conditions of approval to remain in effect. THE PUBLIC HEARING WAS OPENED. PC Minutes - 9/4/91 -3- (2290d) Michael A. Porto, Applicant, reiterated major facts regarding the project. Mr. Porto stated that they did have an alternative plan that they are willing to use that creates more parking. They are also willing the go with staff's recommendation, but need to compromise on site coverage. Harry Monck, 303 Cleveland, spoke in opposition to the project. Mr. Monck is concerned with a high density project next to single family, the additional noise and parking. Tom Lazear, 7321 Coho, spoke in support of the project. Mr. Lazear feels the project will be an asset to the neighborhood. Ronald Novkov, 17132 Englewood Circle, spoke in support of the project. Mr. Novkov feels the project will improve the vacant lot. Debbie Dreier, 308 Cleveland, spoke in opposition to the project. Her concerns included noise and traffic and apartments bringing a lower class of people to the area. Andy Yeiser, 302 Cleveland, spoke in opposition to the project. He was concerned with the higher density and eliminating green space. Don Stephens, 7401 Seabluff Drive, spoke in support of the project. Mr. Stephens feels it will upgrade the neighborhood. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. A discussion ensued among the Commission regarding open space, current property maintenance, density and parking. The Commission felt that a better design could by developed and asked staff to do so and continued this item to the first meeting in October. A MOTION WAS MADE BY BOURGUIGNON, SECOND BY LEIPZIG, TO CONTINUE THE RECONSIDERATION OF THE PLANNING COMMISSION'S APPROVAL OF ZONE CHANGE NO. 91-2/TENTATIVE PARCEL MAP NO. 89-322/USE PERMIT NO. 90-63/NEGATIVE DECLARATION NO. 91-13, TO THE OCTOBER 8, 1991, PLANNING COMMISSION MEETING, IN ORDER FOR STAFF TO DEVELOP ALTERNATIVE PLANS, BY THE FOLLOWING VOTE: AYES: Richardson, Newman, NOES: Kirkland, Dettloff ABSENT: None ABSTAIN: None MOTION PASSED Shomaker, Bourguignon, Leipzig 1 PC Minutes - 9/4/91 -4- (2290d) B-4 CONDITIONAL USE PERMIT NO 91-11 (CONTINUED FROM THE AUGUST 20, 1991 PLANNING COMMISSION MEETING): APPLICANT: Haim Katzir/Rabbi Berkowitz LOCATION: 5432 Heil Avenue (Southwest corner of Heil Avenue at Graham Street) Conditional Use Permit No. 91-11 is a request to permit the establishment of religious services, adult education classes and nursery/daycare facilities with joint use parking pursuant to Section 9630.(c) of the Huntington Beach Ordinance Code. This item was continued at the applicant's request to address parking concerns and to amend the submitted site plan. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No. 91-11 with findings and suggested Conditions of Approval for a maximum of five (5) years to September 14, 1996. THE PUBLIC HEARING WAS OPENED. Rabbi Aron David Berkowitz, spoke in support of the project. He stated that they have always gotten along well with their neighbors. He also stated that most of his parishoners walked to church so parking would not be a problem. Barry Tabachnick, 5702 Clark Drive, spoke in support of the project. He also stated parking would not be a problem. David Ichinaga, 16551 Graham Street, spoke in opposition to the request. His concerns were traffic noise and conjestion. Haim Katzir, 5702 Clark Drive, spoke in support of the project. He stated they had a small congregation which typically walked to church. David Israelsky, 16612 Graham Place, spoke in support of the project. Gary Nakase, 16521 Graham Place, spoke in opposition to the project. Jim Bent, 16552 Graham Place, spoke in opposition to the project. His concerns included traffic noise and safety problems. Kevin Kelter, 16562 Graham Place, spoke in opposition to the project. He was concerned with additional traffic. Jerry Abshier, 5471 Heil, spoke in opposition to the project. He submitted a petition of opposition for area residents. PC Minutes - 9/4/91 -5- (2290d) Monique Lott, 5401 Heil, spoke in opposition to the project. She was concerned with the additional traffic and noise. Gayle McAllen, 5402 Meadow Circle, spoke in support of the project. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Commission discussed modifications to the conditions of approval. They wished the hours of operation to be put in the conditions. Also changes were made regarding parking agreement and mitigation. The location, site layout, and design of the proposed church with joint use parking properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. 2. The combination and relationship of one church to another are properly integrated. The close proximity of the joint use parking lot and excess parking will provide adequate parking and, therefore, are properly integrated. 3. The access to and parking for the proposed church with joint use parking does not create an undue traffic problem. The joint use parking demand indicates an excess of parking and, therefore, will not impact the neighborhood. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO 91-11: 1. The site plan, floor plans, and elevations received and dated August 14, 1991 shall be the conceptually approved layout with the following modifications: a. The site plan shall indicate the location of the single family residence to the southeast of the subject property. PC Minutes - 9/4/91 -6- (2290d) b. The floor plans shall indicate the use of the two (2) rooms on the east side of the building as religious services only and the two rooms on the west side of the building as classrooms only. 2. Prior to issuance of Certificate of Occupancy, the applicant/owner shall complete the following: a. Joint use parking shall require that a Joint Use Parking Agreement be recorded between property owners prior to issuance of permits or occupancy. The Agreement shall provide parking for five (5) years. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development. b. Submit a Parking Management Plan for review and approval by the Community Development Department which contains parking space designations for participants/employees. The Parking Management Plan shall also identify key religious dates for both churches and coordinate activities to avoid conflicts. c. Compliance with all conditions of approval specified herein shall be accomplished. d. Submit a set of revised plans pursuant to Condition No. 1. 3. The Public Works Department requirements are as follows: a. The developer will be responsible for the payment of the Traffic Impact Fees at the time of Certificate of Occupancy. b. Ingress and egress to be from Graham Place only. 4. Fire Department Requirements are as follows: a. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances, and standards. 5. The facility's hours of operation shall be as follows: Religious Services Monday - Friday 6:30 AM - 7:30 AM Religious Services Saturday 9:00 AM - 1:00 PM Religious Services Sunday 8:00 AM - 9:30 AM Hebrew School Tuesday - Thursday 4:00 PM - 6:00 PM Adult Education Two (2) evenings per wk. 7:30 PM - 9:30 PM Day Care Monday - Friday 6:00 AM - 6:00 PM The applicant shall submit an adult education curriculum establishing the days of operation prior to Certificate of Occupancy. PC Minutes - 9/4/91 -7- (2290d) 6. The development shall comply with all applicable provisions of the Ordinance Code, Building Division and Fire Department. 7. A review of the use shall be conducted within six (6) months of the issuance of Certificate of Occupancy and, thereafter, on a yearly basis up to five (5) years to verify compliance with all conditions of approval and applicable Articles of the Huntington Beach Ordinance Code. If, at any time, there is a violation of these conditions or code sections, Conditional Use Permit No. 91-11 may become null and void. 8. Conditional Use Permit No. 91-11 shall be effective for a maximum period of five (5) years to September 14, 1996. 9. Conditional Use Permit No. 91-11 shall be non -transferable. 10. This conditional use permit shall run with the applicant. Any additional activities beyond those proposed, changes in the floor areas or alterations to the site and buildings shall require the review and approval of the conditional use permit process. 11. The Planning Commission reserves the right to revise the terms of this conditional use permit if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 12. This conditional use permit shall not become effective for any purpose until an "Acceptance of Conditions" form has been properly executed by the applicant and an authorized representative of the owner of the property and returned to the Planning Division. 13. Conditional Use Permit No. 91-11 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. B-5 CONDITIONAL USE PERMIT N0, 91-40: APPLICANT: Maria Rubino/Services for Developmentally Disabled of Long Beach, Inc. LOCATION: 15241-15245 Springdale Street Conditional Use Permit No. 91-40 is a request to permit a day program for developmentally disabled adults to operate in an industrial complex. Section 9630.P. permits a Personal Enrichment Service greater than 2,500 square feet to operate in any district except residential districts subject to conditional use permit approval by the Planning Commission. Personal Enrichment Service is defined in the Huntington Beach Ordinance Code as "Provision of PC Minutes - 9/4/91 -8- (2290d) I instructional services or facilities, including but not limited to, fine arts, crafts, dance or music studios, driving schools, and business or trade schools except those leading to a degree as defined by the State of California Education Code." STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No. 91-40 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Maria Rubino, Applicant, spoke in support of the project. She stated they had no negative response from adjacent businesses. Helen Dolas, spoke in support of the project. Silvia Eastabrook, spoke in support of the project. She state the facilities meet their requirements and the neighbors did support them. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. A MOTION WAS MADE BY BOURGUIGNON, SECOND BY RICHARDSON, TO APPROVE CONDITIONAL USE PERMIT NO. 91-40 WITH FINDINGS AND CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Richardson, Bourguignon, NOES: None ABSENT: None ABSTAIN: None MOTION PASSED Newman, Shomaker, Kirkland, Dettloff, Leipzig FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO, 91-40: 1. The location, site layout, and design of the proposed instructional day program properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. By restriping three compact parking spaces for handicapped parking, proper circulation, loading, and unloading will be provided. 2. The combination and relationship of one proposed use to another on the site are properly integrated. The use will take place entirely within a building and will utilize parking directly adjacent to the building. PC Minutes - 9/4/91 MZ (2290d) 3. The access to and parking for the proposed personal enrichment service does not create an undue traffic problem. With proper design of a handicapped parking, loading and unloading zone no traffic problems are anticipated. CONDITIONS OF APPROVAL USE PERMIT NO. 91-40: 1. The site plan, floor plans, and elevations received and dated July 12, 1991 shall be the conceptually approved layout with the following modifications: a. A handicapped access ramp indeicated on the north side of the building. b. Depict a restriping detail replacing the three compact parking spaces on the north side of the building with handicapped striping. 2. Prior to final building permit approval or issuance of a Certificate of Occupancy, the following shall be completed: a. A handicapped access ramp will be constructed on the north side of the building. b. The three compact parking spaces on the north side of the building will be restriped for handicapped parking after removal of the existing planter. 3. The Encore Program van shall be parked in a designated handicapped parking space when remaining on -site overnight. 4. The Building Division requirements are as follows: a. Building to be handicapped accessible including parking, access into building, passage through each room and restrooms. 5. The Fire Department requirements are as follows: a. Install smoke detectors throughout the facility. b. Install panic hardware and remove keyed dead bolts. c. Post all exits. d. Provide minimum of three, 2A-10BC fire extinguishers. e. Have fire sprinkler system inspected and certified. f. Eliminate the use of extension cords. g. Conduct monthly fire drills and keep log. h. Post an emergency pre -fire plan. A Certificate to Operate shall be issued by the Department of Development as required by Section 9730.80 of the Huntington Beach Ordinance Code. 7. The Planning Commission reserves the right to modify the terms of Conditional Use Permit No. 91-40 if any violation of these conditions or the Huntington Beach ordinance Code occurs. 8. Conditional Use Permit No. 91-40 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Division a minimum 30 days prior to the expiration date. B-6 CONDITIONAL USE PERMIT NO. 91-30 WITH A REQUEST FOR A JOINT USE OF PARKING AGREEMENT: APPLICANT: Gang Xu, Sakura Japanese Restaurant LOCATION: 8052 Adams Avenue Conditional Use Permit No. 91-30 is a request to permit live entertainment including a disc jockey, live band, and dancing at a bona fide eating establishment, Sakura Japanese Restaurant, pursuant to Section 9.220.12 of the Huntington Beach Ordinance Code. TAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No. 91-30 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Mark Hyams, Manager of Sakura, spoke in support of the request. He stated that they needed to proceed with entertainment approval as they were already open for business. Barbara Taylor, 20062 Bayfront Lane No. 203, spoke in opposition to the request. She submitted an petition of opposition for area residents with concerns of excessive noise in parking lot. Margaret Ferrin, 20062 Bayfront Lane No. 101, spoke in opposition to the request. Her concerns were also excessive noise in the parking parking lot. PC Minutes - 9/4/91 -11- (2290d) Ed Buck, 20321 Sea Bright, adjacent business owner spoke in opposition to the request. Concerned with noise and late hour partying in the parking lot. Robert Hilton, 20062 Bayfront Lane No. 201, spoke in opposition to the request. His concern was excessive noise in the parking lot. The location, site layout and design of the proposed live entertainment properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. 2. The combination and relationship of one proposed use to another on a site are properly integrated. 3. The access to and parking for the proposed live entertainment does not create an undue traffic problem. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO, 91-30: 1. The site plan and floor plan received and dated August 27, 1991 shall be the conceptually approved layout with the following modifications: a. The designated 16 foot by 17 foot dance floor will be removed from the floor plan. 2. No dancing shall be permitted until such time as three (3) additional parking spaces can be provided on -site or a joint use parking agreement with the other tenant in the center has been approved by the Planning Commission. 3. A parking lot security guard shall be on duty during all live entertainment events to monitor parking, trash and noise. PC Minutes - 9/4/91 -12- (2290d) 1 4. The hours of operation for live entertainment shall be: Sunday - Thursday 9:00 PM - 12:00 AM Friday - Saturday 9:00 PM - 1:30 AM 5. A review of the use shall be conducted within six (6) months of the issuance of the Entertainment Permit approval to verify compliance with all conditions of approval and applicable Articles of the Huntington Beach Ordinance Code. If, at that time, there is a violation of these conditions or code sections, Conditional Use Permit No. 91-30 may become null and void. 6. The Planning Commission reserves the right to modify the terms of this Conditional Use Permit No. 91-30 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 7. This Conditional Use Permit No 91-30 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. B-7 CONDITIONAL USE PERMIT NO. 91-41: APPLICANT: Leo N. Owen LOCATION: 21422 Lemontree Lane Conditional Use Permit No. 91-41 is a request to permit an existing 650 square foot second unit (granny unit) to an existing two story single family residence pursuant to Section 9110.3 of the Huntington Beach Ordinance Code. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional use Permit No. 91-41 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Paul Petti, 9632 Indian Wells Circle, spoke in opposition to the request. Ruth Ann Carlson, neighbor, spoke in support of the request. Leo Owen, Applicant, stated he was there to answer any questions the Commission may have. The location, site layout, and design of the proposed 650 square foot second unit addition properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. The proposed addition conforms to code and will be provided with adequate access and on -site parking. 2. The combination and relationship of the 650 square foot second unit addition to the existing single family residence are properly integrated. The proposed addition is within the original residence and maintains the appearance of an architecturally unified whole structure. 3. The access to and parking for the proposed 650 square foot second unit addition does not create an undue traffic or parking problem. The site is provided with six (6) on -site parking spaces. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO, 91-41: 1. The site plan, floor plans and elevations received and dated August 26, 1991 shall be the conceptually approved layout. 2. The applicant/owner shall complete the following and submit evidence of completion in writing to the Community Development Department: a. D-2 SIX MONTH REVIEW OF CONDITIONAL USE PERMIT NO 90-6 HUNTINGTON CENTRAL PARK EQUESTRIAN CENTER: APPLICANT: National Equestrian Centers LOCATION: West side of Goldenwest Street, between Talbert and Ellis Avenue. Conditional Use Permit No. 90-6, a request to expand the Huntington Central Park Equestrian Center, was approved by the Planning Commission on March 20, 1990. Condition No. 24 of Conditional Use Permit No. 90-6 required that a six month review be conducted by the Planning Commission. PC Minutes - 9/4/91 -17- (2290d) k. On December 4, 1990, the review was conducted by the Planning Commission. At that time, the staff reported that approximately eight conditions of approval had not been complied with by the applicant, and that some conditions were permitted to be bonded. After review by the Planning Commission, the Commission voted to allow the applicant 60 days in which to comply with the outstanding conditions of approval. On February 5, 1991, the Planning Commission again reviewed Conditional Use Permit No. 90-6. At that time, the staff reported that the applicant was making substantial progress on the outstanding conditions of approval including grading and security lighting. On March 19, 1991, the Planning Commission conducted another review of the Equestrian Center. At that time, they approved the review and scheduled an additional 6 month review to evaluate restroom facilities and the status of the bonded items. This transmittal constitutes that review. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve the six (6) month review and not schedule any additional reviews. The Commission made the following additions: • Original Condition of Approval No. 4 shall be deleted to require no additional restroom facilities. • Each 12 months bring back update to the Planning Commission on bonded improvements.
