ACTING ZONING ADMINISTRATOR: Mike Strange STAFF MEMBERS• MINUTES• REGULAR AGENDA ITEMS: ITEM 1: USE PERMIT NO. 91-24 Mike Connor The Minutes of the September 24, 1991 Zoning Administrator Meeting were continued to the October 9, 1991 Zoning Administrator Meeting. Applicant: Gregory Pitcher, AIA. 890 W. Baker Street Costa Mesa, CA 92626 Request: To permit a 3,650 square foot addition to an existing retail center with exterior facade improvements, and revised parking and landscaping. In addition, the request includes a permit to operate a Pep Boys automobile parts and accessories store with minor automobile repair pursuant to Section 9220.1(c) of the Huntington Beach Ordinance Code. A Special Permit has been initiated to permit 99 compact parking stalls. Location: 19002 Brookhurst (Previously National Lumber Building) Mike Connor, Staff Planner, reported that the center has been at the location for twenty-five years. Staff advised that the proposal is for three parts: 1) facade remodel; 2) 3,650 square foot addition for retail and service bays; and, 3) auto service and repair. Staff said a number of letters had been received from homeowners who stated concerns about the noise that would be generated from the service bays, people working on cars in the parking lot, waste disposal, hours of operation, and impacts on the value of their homes. Staff said he had been working with the applicant and homeowners and had mitigated the concerns. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Iry Chase, representing the applicant, said they had worked with staff and had addressed all concerns of staff and the neighbors. Larry Reeves, architect for the project, spoke in support of the request. Raymond Howl, no address given, said he had visited an existing Pep Boys site and was concerned because workers listened to loud music while performing repairs. Janice Lamont, 10071 Kukui, asked questions regarding alley access and deliveries. Janet Knapp, 19101 Kipahulu, asked staff who she could notify if a noise problem occurred. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 91-24 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The facade remodel, building addition and automobile parts and service businesses will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. All potential impacts including noise, safety, appearance and use will be regulated and monitored to prevent potential impacts to area residents. b. Property and improvements in the vicinity of such use or building. The proposed remodel and building addition will enhance the architecture, on -site circulation and landscaping within the center, resulting in a development which is compatible with surrounding land uses. 2. The proposal is consistent with the goals and objectives of the City's General Plan and Land Use Map. The proposed automotive parts and service center is consistent with the general commercial land use designation in the general plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated September 22, 1991 shall be the conceptually approved layout. ZA Minutes - 10/2/91 -2- (1033d) 2. A revised site plan depicting the modifications shown on the staff aleternative shall be submitted. 3 The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. Prior to issuance of Building Permits, the following plans and items shall be submitted and/or completed by the applicant: a. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. b. A Landscape Construction Set submitted to the Departments of Community Development and Public Works. The landscape construction set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect which includes all proposed/existing plant materials (location, type, size, quantity), irrigation plan, grading plan and approved site plan, and copy of conditions of approval. The landscape plan shall be in conformance with Section 9608 and 9220.9 of the Huntington Beach Ordinance Code . The set must be complete and approved by both departments prior to issuance of building permits. c. A planned sign program shall be approved for all signing. Said program shall be approved prior to the first sign request. Freestanding signs shall identify name of center or major tenant only. The remaining portion of Building No. 2 shall be allotted advertising space on the new freestanding pole signs on Garfield and Brookhurst to prevent the need for a special sign permit. d. Driveway approaches shall be a minimum of twenty-seven feet (271) in width and shall be of radius type construction. e. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. f. The subject property shall enter into irrevocable reciprocal driveway and parking easement(s) between the subject site and adjacent properties. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development prior to occupancy. ZA Minutes - 10/2/91 -3- (1033d) g. All applicable Public Works fees shall be paid. 5. On -site fire hydrants shall be provided in number and at locations specified by the Fire Department. 6. The automatic fire sprinkler system shall be improved and updated and shall be approved and installed pursuant to Fire Department regulations. 7. Plans shall indicate that service bays shall be provided with noise baffles in the ceiling and walls. 8. Prior to issuance of a Certificate of Occupancy: a. The eight (8) foot high sound wall shall be installed behind the delivery area and shall extend from the westerly property line of 10021 Kukui Drive to the easterly property line of 10041 Kukui Drive. b. All facade, landscaping and parking improvements shall be in place inspected and approved by the Department of Community Development. c. The parking lot shall be resealed and restriped to match the approved site plan. d. All signs shall meet the standards of the Huntington Beach Ordinance Code and approved planned sign program. Existing roof signs on Buildings 3 and 4 shall be permitted to remain until the current leases expire at which time these signs shall be removed and replaced with conforming signs. e. Delivery area shall be enclosed per the approved plan and shall be equipped with a "boot" to attach to delivery trucks. f. Noise baffles in the service bay shall be in place. g. Trash cans shall be provided in the landscape pockets around the Pep Boys Store. h. Eight (8) foot high gates shall be provided to block access to the south of Building 2. i. Landscape screening such as climbing vines shall be provided on the south side of Building 2. j. The existing second story windows on Building 2 shall be permanently removed. k. The applicant/owner shall be responsible for paying the Traffic Impact Fee adopted by the City Council, prior to issuance of a Certificate of Occupancy and/or final building permit approval. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. M. Signs shall be posted in the parking lot stating "Automobile Repairs Are Not Permitted in the Parking Area" n. Signs shall be posted in the delivery area that read "No Horn Blowing" and "Shut Off Engines When Unloading" 9. Operation: a. Business hours shall be limited to 8:00 AM to 9:00 PM Monday thru Friday and 8:00 AM to 8:00 PM Saturday and 8:00 AM to 6:00 PM Sunday. b. Delivery hours shall be limited to the hours of 8:00 AM to 6:00 PM Monday thru Friday and no deliveries shall be permitted on Saturdays, Sundays or Holidays. c. Service bay doors shall be closed at 9:00 PM each evening. d. No radios shall be permitted in the service area. e. Radios in the delivery area shall be turned down or off while the delivery doors are open. No radios shall be permitted outside of the building. f. No outdoor public address system shall be permitted. g. The Pep Boys Store shall maintain a recycling center for all customers who provide proof that the used oil, transmission, radiator or other automotive fluids were purchased at the store. h. The Pep Boys Store shall be responsible for patrolling the lot for persons working on their vehicles and picking up automobile related trash and debris. i. No delivery trucks shall be permitted to be left overnight. j. The rear alley behind building No. 2 and 3 shall not be used for outdoor storage of any kind. k. The gates at the ends of the alley shall be kept locked at all times with the exception of regular maintenance. 1. All landscaping shall be properly maintained and kept clean of all trash and debris. M. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. ZA Minutes - 10/2/91 -5- (1033d) n. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. o. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. p. All repair work shall be conducted wholly within the building. 10. Conditions of approval shall be printed verbatim on all working drawings submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District.' 4. The major identification sign shall be removed or altered to comply with Article 961 within ninety (90) days of the approval date. 5. Landscaping shall comply with Section 9608 of the Huntington Beach Ordinance Code. 6. A review of the use shall be conducted within six (6) months of the date that Pep Boys opens for business to verify compliance with all conditions of approval and applicable Articles of the Huntington Beach Ordinance Code. If, at that time, there is a violation of these conditions or code sections, Use Permit No. 91-24 may become null and void. 7. The Zoning Administrator reserves the right to revoke this Use Permit No. 91-24 if any violation of these conditions of the Huntington Beach Ordinance Code occurs. ITEM 2: CONDITIONAL EXCEPTION NO, 91-15 Applicant: Alfred J. Bilotti 6452 Newbury Drive Huntington Beach, CA 92647 ZA Minutes - 10/2/91 -6- (1033d) Ll Request: To permit a second story addition with a five (5) foot front setback in lieu of fifteen (15) feet as required by Section 9110.6 of the Huntington Beach Ordinance Code. Location: 6452 Newbury Drive Mike Connor, Staff Planner, reported that the applicant had requested a continuance and staff supported that request. No one was present to speak on the item. CONDITIONAL EXCEPTION NO. 91-15 WAS CONTINUED TO THE OCTOBER 16, 1991 ZONING ADMINISTRATOR MEETING BY THE ZONING ADMINISTRATOR. ITEM 3: USE PERMIT NO, 91-48 Applicant: Clayton Strehlow 5701 Jane Street Westminster, CA 92683 Request: To permit a Temporary Outdoor Event for a Pumpkin Patch with a pony ride and farm animals from October 10, 1991 through October 31, 1991, pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 6001 Edinger Mike Connor, Staff Planner, reported that the applicant is proposing to use some of the existing parking spaces within the center. Staff did not have concerns with the request and recommended approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Clayton Strehlow, applicant, spoke in support of the request. He said that the ponies are provided by a private school and that the majority of the proceeds from the pony rides will be returned to the school. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 91-48 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event will not be detrimental to: ZA Minutes - 10/2/91 -7- (1033d) a. The general welfare of persons residing or working in the vicinity. All properties in the immediate vicinity are commercial or educational. b. Property and improvements in the vicinity of such use or building. All improvements are temporary. 2. The granting of Use Permit No. 91-48 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated September 24, 1991 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 4. The applicant shall obtain permits necessary permits for temporary signs. 5. The applicant shall obtain clearance from the Public Liability Claims Coordinator, Administrative Services Department, and/or shall provide a Certificate of Insurance and Hold Harmless Agreement to be executed at least five (5) days prior to the event. 6. Fire extinguishers shall be provided in number and locations specified by the Fire Department. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes,'Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 91-48 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of thirty (30) days prior to the event. Failure to provide adequate notice shall result in denial of the request.
