ACTING ZONING ADMINISTRATOR: Mike Strnage STAFF MEMBERS: MINUTES• REGULAR AGENDA ITEMS: Mike Connor Center California The Minutes of October 9, 1991 Zoning Administrator Meetings were continued to the Zoning Administrator Meeting of October 23, 1991. ITEM 1: CONDITIONAL EXCEPTION NO. 91-15 (CONTINUED FROM THE OCTOBER 2. 1991 ZONING ADMINISTRATOR MEETING) Applicant: Alfred J. Bilotti 6452 Newbury Drive Huntington Beach, CA 92647 Request: To permit a second story addition with a five (5) foot ten (10) inch front setback in lieu of fifteen (15) feet as required by Section 9110.6 of the Huntington Beach Ordinance Code. Location: 6452 Newbury Drive Mike Connor, Staff Planner, reported that the request is to permit a second story addition over the garage of an existing two story residence. He advised that the garage setback in the front is at seven (7) feet ten (10) inches. The addition includes a seating area which cantilevers two (2) feet toward the front which would result in a five (5) foot ten (10) inch front setback. Staff advised that the architecture is not compatible with other homes in the area and that there are no exceptional circumstances for granting the variance. Staff also advised that one letter had been received from a neighbor in opposition to the addition. Staff concluded by recommending denial with findings. THE PUBLIC HEARING WAS CLOSED. No one was present to speak for or against the item and the public hearing was closed. CONDITIONAL EXCEPTION NO. NO. 91-15 WAS DENIED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS. THE ZONING ADMINISTRATOR STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR DENIAL: 1. The construction of a second story addition with a five (5) foot ten (10) inch front setback will be detrimental to: a. The general welfare of persons residing in the vicinity; the reduced front setback will reduce the view and afternoon sun for the front courtyard on the adjacent property. b. Property and improvements in the vicinity of such use or building. The proposed second story addition with a five (5) foot ten (10) inch setback from the front property line will not be compatible with the surrounding R1 neighborhood which'is typified by houses with no second story living area over garages and garages set back 22 feet from the front property line. 2. There are no'special circumstances applicable to the subject property, including size, shape, topography, location or surroundings,* that the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. The subject property is rectangular in shape and possesses no unique topography, and is located within a standard R1 neighborhood. 3. The granting of Conditional Exception No. 91-15 for a reduced front yard setback is not necessary in order to preserve the enjoyment of one or more substantial property rights. An addition could be constructed at the rear of the property that could meet all requirements of the code. 4. The granting of Conditional Exception No. 91-15 for a reduced front yard setback will be materially detrimental to the public welfare, or injurious to property in the same zone classifications. The proposed second story addition with a five (5) foot ten (10) inch setback from the front property line will not be compatible with the surrounding R1 neighborhood which is typified by houses with no second story living area over garages and garages set back 22 feet from the front property line. I. ZA Minutes - 10/16/91 -2- (1209d) 11 ITEM 2• CONDITIONAL EXCEPTION NO. 90-47 - (ONE YEAR EXTENSION OF TIME Applicant: P.A.C. Consulting and Design 202 West Lincoln Ave., Suite F Orange, CA 91720 Request: To permit a one year extension of time for a request to permit a five (5) foot exterior side yard setback in lieu of ten (10) feet as required by Section 9110.8(b) of the Huntington Beach Ordinance Code. Location: 9601 Castine Drive Mike Connor, Staff Planner, reported that the request is for a one year extension of time and recommended approval of the request. CONDITIONAL EXCEPTION NO. NO. 90-46 (ONE YEAR EXTENSION OF TIME) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING ADDED CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. Conditions of Approval: 1. All previous conditions of approval shall apply from the Zoning Administrator letter dated October 24, 1990. 2. Conditional Exception No. 90-47 shall expire November 5, 1992 unless an extension is granted by the Zoning Administrator. Only one (1) additional one year extension may be granted. THE MEETING WAS ADJOURNED AT 2:50 PM BY THE ZONING ADMINISTRATOR TO A STUDY SESSION ON MONDAY, OCTOBER 21, 1991 AT 4:00 PM AND THEN TO THE NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR ON WEDNESDAY, OCTOBER 24, 1991, AT 1:30 PM.
