approved.
ITEM 1: COASTAL DEVELOPMENT PERMIT NO, 91-30:
Applicant: Mark Sutter, AIA Architect

Request: To permit the remodel and 918 square foot addition
to an existing three (3) story residence pursuant
to Section 989.5.2 of the Huntington Beach
Ordinance Code.
Location:
16601 Nalu Circle
Mike Connor, Staff Planner, reported that the property is located in
Huntington Harbor and is at the end of a cul-de-sac. The tract was
orginally approved for a ten foot, front yard setback variance for
most properties and the proposed addition includes a ten foot front
yard setback. The third floor will be altered to relocate the
existing staircase and add an elevator. The proposal will not affect
any public coastal views or access. Staff concluded by recommending
approval, which include deletion of the proposed columns, with
findings and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Mark Sutter, Architect, advised that the house is an existing two
story with a loft space. He said the request is for a 918 square
foot addition with facade and interior improvements.
Clarence Laney, 16602 Nalu Circle, said that every house on Nalu
Circle has been or is the process of being remodeled, and that
construction has been on -going for 4-1/2 years. He stated that he
was not opposed to the request but was concerned about the possible
negative impacts created by the contractor during construction such
as blocking vehicular access to his residence by construction
vehicles parked in the street.
Mrs. Laney, 16602 Nalu Circle, said they have had problems with
workers blocking driveways, loud radios and rude attitudes.
Mrs. Yolanda, Zanchi, the property owner spoke in favor of the
request.
There were no other persons present to speak for or against the
request and the public hearing was closed.
COASTAL DEVELOPMENT PERMIT NO. 91-30 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL
COMMISSION.
FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO, 91-30:
1. The request to permit the remodel and 918 square foot addition
to an existing three-story residence conforms with the plans,
policies, requirements and standards of The Coastal Element of
the General Plan. The proposed remodel and addition will have
no impact upon public coastal views or access because there are
no existing public coastal views across the property.
2. Coastal Development Permit No. 91-30 for the remodel and 918
square foot addition to an existing residence is consistent
with the CZ suffix zoning requirements, the R1 Zoning District,
as well as other provisions of the Huntington Beach Ordinance
Code applicable to the property. The proposed remodel and
addition will meet all applicable provisions of code.

3. At the time of occupancy, the proposed remodel and addition to
an existing three-story single family residence will be
provided with infrastructure in a manner that is consistent
with the Coastal Element of the General Plan. The proposed
remodel and addition will not require any additional
infrastructure. All necessary infrastructure is currently in
place.
4. The proposed remodel and addition to an existing three story
residence conforms with the public access and public recreation
policies of Chapter 3 of the California Coastal Act. There are
no existing or proposed public coastal views or access
corridors relating to the subject property, therefore no
impacts are anticipated.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
August 26, 1991 shall be the conceptually approved layout with
the following modifications:
A. The loft shall be designed to meet the requirements of the
Building Division and the Uniform Building Code.
B. Natural gas shall be stubbed in at the locations of
cooking facilities, water heaters, and central heating
units.
C. Low -volume heads shall be used on all spigots and water
faucets.
2. The Fire Department requirements are:
a. Automatic sprinkler systems shall be installed throughout
to comply with Huntington Beach Fire Department and
Uniform Building Code standards.
b. A two (2) inch water meter shall be installed in
compliance with the Water Department standards.
3. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
4. All proposed dock and ramp improvements shall require separate
permits for the improvements located within the public
waterways.
5. All proposed cantilevered deck improvements require separate
permits for the improvements.

6. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
7 Prior to issuance of building permits it is recommended that
the applicant obtain a letter of approval from the Huntington
Harbour Property Owners Association -Architectural Review
Committee for the proposed work.
8. All conditions of approval shall be printed verbatim on plans
submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The Zoning Administrator reserves the right to revoke Coastal
Development Permit No. 91-30 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
ITEM 2: USE PERMIT NO. 91-47
Applicant: Michael Daley

Huntington Beach, CA 92649-2500
Request: To permit an existing five (5) foot six (6) inch high
fence within the front fifteen (15) foot setback which
is typically restricted to a maximum height of 42
inches. The fence is located along the front property
line and it is being processed pursuant to Section
9771(L) of the Huntington Beach Ordinance Code.
Location: 3682 Seascape
Mike Connor, Staff Planner, reported that the property is located on
Trinidad Island. A five foot, six inch high fence was constructed
along the front property line without building permits by a
contractor that the applicant hired. Staff advised that there are a
number of similar fences in the immediate neighborhood; however, no
variances or use permits to allow the fences were found. Staff
concluded by recommending denial.
THE PUBLIC HEARING WAS OPENED.
Michael Daley, the applicant, said that they had hired a licensed
contractor who advised that the fence was legal prior to
constructing the fence. Mr. Daley provided a letter from the
homeowners association approving the request and advised that six of
the eight neighbors affected by the fence are in favor of the
fence.

There were no other persons present to speak for or against the
request and the public hearing was closed.
Scott Hess, the Zoning Administrator, said he would approve the
request with findings because no written or verbal opposition was
received by the City, the fence ranges from 4-1/2 to 5-1/2 feet and
it is generally compatible with surrounding fences in the area.
USE PERMIT NO. 91-47 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The construction of a wrought iron fence which ranges in size
from four (4) feet six (6) inches high to five (5) feet six
(6) inches high in the front setback area (along the front
property line) will not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity. There were no objections either written
or verbal received from any of the surrounding
neighbors. In addition there were six (6) letters
received from the area property owners in support of the
request and an additional letter of approval from the
Trinidad Island Architectural Review Chairman.
b. Property and improvements in the vicinity of such use or
building. The fence is similar to other fences in the
neighborhood in terms of materials and colors.
2. The maximum five (5) foot six (6) inch high wrought iron
fence is consistent with the goals and objectives of the
City's General Plan and Land Use Map. The fence is an
accessory structure to a single family residence which is
compatible with the Low Density Residential Land Use
Designation in the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan and elevations received and dated September 24,
1991 shall be the conceptually approved layout.
2. The wrought iron fence shall be maintained with a dark color
to assure that the fence blends in with other fences in the
neighborhood.
3. The fence shall remain at least 70% clear (open) of all
vegetation or other obstructions to prevent the front yard
from having a "walled -in" appearance.

4. The applicant shall obtain building permits for the wrought
iron fence (constructed without permits) within thirty (30)
days of its approval and the fence shall receive its final
inspection within thirty (30) days thereafter.
5. Conditions of approval shall be printed verbatim on all
working drawings submitted for plancheck.

COMPLAINT WITH THE STATE CONTRACTOR'S BOARD RELATIVE TO THE ILLEGAL
FENCE CONSTRUCTION.
THE MEETING WAS ADJOURNED AT 1:45 PM BY THE ZONING ADMINISTRATOR TO
THE NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR ON
WEDNESDAY, NOVEMBER 6, 1991, AT 1:30 PM.
