MINUTES: The Minutes of October 30, 1991
Zoning Administrator Meeting were
approved.
REGULAR AGENDA ITEMS:
ITEM 1: USE PERMIT NO, 91-50
Applicant: EDK Construction
6312 Heil Ave.
Huntington Beach, CA 92647
Request: To permit a 441 square foot addition to an
existing detached garage with nonconforming rear
yard setbacks pursuant to Section 9652.0 of the
Huntington Beach Ordinance Code. The garage will
have a five (5) foot rear yard setback in lieu of
seven and one half (7.5) feet after alley
dedication.

Mike Connor, Staff Planner, reported that the existing two car
detached garage has a side entry door and the applicant's proposal is
to expand the garage and relocate the entry to the alley. Staff
advised that some existing vegetation will be required to be removed
because it blocks the street view from the alley. The existing
trellis was constructed without building permits. The applicant will
be required to obtain building permits.
Public Works will require a 2-1/2 foot alley dedication, a 20 foot
radius dedication at the intersection of 9th Street and Walnut
Avenue, the removal of the existing driveway on Walnut, and pave 2
1/2 feet of alley. Staff concluded by recommending approval with
findings and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Mrs. Allen, the owner of the property, was present, said that they
had been out of the country and the shrubs had grown out of control.
She agreed to the conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 91-50 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The addition to an existing non -conforming garage, due to a
reduced rear yard setback, will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity. ,The proposed garage addition is located adjacent
to an alley and a street.
b. Property and improvements in the vicinity of such use or
building. The proposed garage addition meets the minimum
side setbacks from adjacent properties and is within the
height requirements for an accessory structure.
2. The proposal is.consistent with the goals and objectives of the
City's General Plan and Land Use Map. The garage is an
accessory structure to the single family residence which is
permitted within the Medium Density Residential Land Use
designation in the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
October 2, 1991 shall be the conceptually approved layout.
2. A revised site plan shall be submitted depicting the
modifications described herein:
a. The triangdiar area created by measuring from the
intersection of the alley and the sidewalk ten (10) feet
along the alley and the sidewalk shall be cleared of all
vegetation over 24 inches high for traffic visibility
purposes.
b. The existing garage door shall remain open between the
existing garage and the proposed addition.
c. The interior dimension of the garage shall be minimum
eighteen feet wide by nineteen feet deep.

3 The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
4. Prior to issuance of building permits:
a. The applicant shall obtain building permits for the trellis
patio cover constructed without permits.
b. A covenant to hold parcels as one shall be signed by the
property owner and recorded with the Orange County Recorder.
5. The following Public Works Requirements shall be completed
prior to final inspection:
a. Two and one half (2 1/2) feet shall be dedicated along the
alley and paved to Public Work's standards.
b. A twenty foot radius at the intersection of Walnut Avenue
and Ninth Street shall be dedicated to the City of
Huntington Beach.
c. The existing driveway on Walnut Avenue shall be removed and
replaced with curb, gutter and sidewalk which shall be
constructed to Public Work's standards.
6. Any oil wells (active, idle, abandoned, etc) on property to be
dedicated to the City shall be abandoned pursuant to Fire
Department standards by the property owner, at the cost of the
property owner, prior to City Acceptance of such property.
7. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
8. Proposed structures shall be architecturally compatible with
existing structures.
9. Conditions of approval shall be printed verbatim on all working
drawings submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.

2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The Zoning Administrator reserves the right to revoke this Use
Permit No. 91-50 if any violation of these conditions of the
Huntington Beach Ordinance Code occurs.
