Zoning Administrator Meeting were
approved.
REGULAR AGENDA ITEMS:
ITEM 1: USE PERMIT NO, 91-52
Applicant: William Patterson

Pasadena, CA 91101
Request: To permit the facade remodel of an existing retail
center and to increase landscaping within the
parking area.
Location: 19101 Magnolia Street (K-Mart Center)
Mike Connor, Staff Planner, reported that the proposal is for a
facade remodel and upgrade to coincide with the new K-Mart image.
Also included in the proposal is a canopy along the front of the
building and additional landscaping. Reciprocal access with the
center to the south was required pursuant to the original approval;
however it was never completed. Staff stated that the reciprocal
access should be required as a condition of approval.
Staff advised that a special permit is also requested to allow twenty
percent of the required parking spaces be compact -spaces. Staff said
that the site exceeds the parking spaces required by Code. Staff
concluded by recommending approval with findings and suggested
conditions of approval.
THE PUBLIC HEARING WAS OPENED.
William Patterson, the applicant, presented a revised site plan which
depicted increased landscaping along Magnolia Avenue and landscape
islands throughout the parking lot. He said the revised plan has
over 700 parking spaces and Code requires 617 spaces. He requested
approval of the revised plan with the understanding that the parking
and landscaping meet zoning code requirements.
Thomas Ryan, 8852 Luss Drive, said that the improvements would
benefit the community.
Morton Wein, 19101 Magnolia Street, spoke in support of the request
stating that the reciprocal access to the southerly parcel was
critical.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 91-52 WITH SPECIAL PERMITS WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL USE PERMIT NO, 91-52:
1. The facade remodel of an existing retail center with increased
landscaping will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity. The proposed facade remodel and increased
landscaping will not result in any increased traffic or
noise. It will provide better circulation on -site and
between adjoining parcels due to reciprocal access
easements.
b. Property and improvements in the vicinity of such use or
building. The facade remodel and increased landscaping
will result in an improved appearance and will improve the
general area.
2. The proposal is consistent with the goals and objectives of
the City's General Plan and Land Use Map. The existing retail
establishments are consistent with the General Commercial Land
Use Designation in'the General Plan.
FINDINGS FOR APPROVAL FOR THE SPECIAL PERMIT TO ALLOW FOR UP TO 20
PERCENT COMPACT SIZE PARKING SPACES:
1. The special permit to allow for up to twenty percent (20%)
compact size parking spaces will not adversely affect the
circulation and safety of the use, structure or site, or
adjacent land uses. The compact parking spaces will be
dispersed throughout the site and will be designed to meet
code requirements for size and circulation.

2. The special permit to allow for up to twenty percent (20%)
compact size parking spaces will result in a more effective
and efficient circulation pattern and parking layout. The
compact spaces will allow the site to be designed to provide
parking spaces in excess of the minimum required by code.
3. The special permit to allow for up to twenty percent (20%)
compact size parking spaces will enhance the general
appearance of the development and its surroundings. The
compact spaces will be dispersed throughout the site and will
allow for additional landscaping on site.
4. The special permit to allow for up to twenty percent (20%)
compact size parking spaces will not be detrimental to the
general public health, safety, welfare, or convenience, nor
injurious to property values in the vicinity. The compact
spaces will allow the site to be designed to provide parking
spaces in excess of the minimum required by code and will be
designed to meet code requirements for size and circulation.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
October 9, 1991 shall be the conceptually approved layout with
the following modifications:
a. Convert the two rows of compact spaces to standards spaces
near the entrance of the K-Mart building.
b. Add a minimum 10' x 10' planter area adjacent to the south
and west side of the Blockbuster property lines.
c. Provide two points of'vehicular accessways along the
southern property line to the adjoining southerly lot.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, or building
elevations are proposed as a result of the plan check
process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. Prior to issuance of building permits, the following plans and
items shall be submitted and/or completed by the applicant:
a. A Planned Sign Program shall be submitted to the Planning
Division for review. The program shall be approved prior
to issuance of any sign permits and/or installation of any
signs. The Planned Sign Program shall address uniformity
amongst all wall signs for the center. In addition, it
shall indicate how the freestanding sign -will be brought
into conformance with the sign code.

b. Rooftop Mechanical Equipment Plan. Said plan shall
indicate screening of all rooftop mechanical equipment and
shall delineate the type of material proposed to screen
said equipment.
c. A Landscape Construction Set shall be submitted to the
Departments of Community Development and Public Works.
The landscape construction set shall include a landscape
plan prepared and signed by a State Licensed Landscape
Architect which includes all proposed/existing plant
materials (location, type, size, quantity), irrigation
plan, grading plan and approved site plan, and copy of
conditions of approval. The landscape plan shall be in
conformance with Section 9608 and 9220.9 of the Huntington
Beach Ordinance Code .
d. The subject property shall enter into irrevocable
reciprocal driveway and parking easement(s) between the
subject site and adjacent properties to the north and
south. A copy of the legal instrument shall be approved
by the City Attorney as to form and content and, when
approved, shall be recorded in the Office of the County
Recorder. A copy shall be filed with the Department of
Community Development prior to issuance of building
permits.
e. Revised plan pursuant to Condition # 1 above submitted to
the Planning Division for the file.
Installation of required landscaping and irrigation systems
shall be completed prior to final inspection/within six (6)
months of the date building permits are issued.
The non -conforming freestanding sign shall be modified to
conform with sign code and the Planned Sign Program within six
months of this entitlement approval.
The existing automatic fire sprinkler system shall be improved
to comply with Federal and Local Fire Department regulations.
Service roads and fire lanes, as determined by the Fire
Department, shall be posted and marked.
Fire access lanes shall be maintained. If fire lane
violations occur and the services of the Fire Department are
required, the applicant will be liable for expenses incurred.
There shall be no outside -storage of vehicles, vehicle parts,
equipment or trailers.
All automobile repair work shall be conducted wholly within
the building.

11. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
12. If lighting is included in the parking lot, high-pressure
sodium vapor lamps shall be used for energy savings. All
outside lighting shall be directed to prevent "spillage" onto
adjacent properties.
13. Conditions of approval shall be printed verbatim on all
working drawings submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the
South Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke this Use
Permit No. 91-52 if any violation of these conditions of the
Huntington Beach Ordinance Code occurs.
ITEM 2: LOT LINE ADJUSTMENT NO, 91-3
Applicant: Walden & Associates

Request: To adjust a property line between Lot Nos. 23
and 24 of Tract No. 7421 pursuant to Section
9811.3.1 of the Huntington Beach Ordinance
Code. This will result in an approximately
2,050 square foot area shifting from Lot No. 23
to Lot No. 24.

Mike Connor, Staff Planner, reported that Lot No. 24 backs up to the
Seacliff Golf Course and an oil island to the east. Lot No. 23 is
owned by Pacific Coast Homes and they no longer need the property.
Staff concluded by recommending approval stating that the lot line
adjustment would not have an impact on the approved frontage for Lot
No. 23 and would improve the lot area and open space for Lot No. 24.
THE PUBLIC HEARING WAS OPENED.
Richard Loyd, Pacific Coast Homes, advised that Pacific Coast Homes
had negotiated with the owner of Lot 24 because a portion of the lot
was no longer needed.

There were no other persons present to speak for or against the
request and the public hearing was closed.
LOT LINE ADJUSTMENT NO. 91-3 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The lot line adjustment will'not create a nonconforming ;
parcel. Both of the parcels will exceed the minimum 6,000
square'foot lot area and the lot line adjustment will not
affect the existing lot frontages.
2. The lot line adjustment will not create a nonconforming yard
requirement. The expansion of Lot 24 of Tract 7421 will
provide for greater side yard setbacks and open space. There
are no structures currently on Lot 23 and any proposed
structures will be required to meet all setback and open space
requirements.
3. The lot line adjustment will not sever existing structures on
the two lots. There are no existing structures on Lot 23 and
Lot 24 will be expanded.
4. The lot line adjustment will not allow a greater number of
dwelling units than allowed by the code prior to the
adjustment. Only one unit per lot is permitted by code for R1
lots. The lot line adjustment will not increase the number of
lots.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) ;
FOR ANY PURPOSE:
1. The Lot Line Adjustment received by the Department of
Community Development on July 22, 1991, shall be the approved
layout.
2. Monuments for the newly -established property lines shall be
readjusted in compliance with the Subdivision Map Act. A
record of survey shall be completed to verify the location of
the newly placed monuments.
3. Authentic data on the bearings of the adjusted line shall be
shown on a plat map which shall be certified by the City
Engineer prior to recordation.
4. Said plat map shall be recorded with the County Recorder prior
to the issuance of a certificate of compliance for the
structure and/or structures upon the subject properties. A
copy of the recorded document shall be submitted to the
Department of Community Development for the file.

ITEM 3: USE PERMIT NO. 91-54
Applicant: Sandy King

Request: To permit a three (3) day Temporary Outdoor Event,
Pre -Holiday Sale with Banners, Balloons, Elves and a
mini -blimp on November 15, 16 and 17, 1991 pursuant
to Section 9730.64 of the Huntington Beach Ordinance
Code.
Location: 18501-18691 Main Street
Mike Connor, Staff Planner, reported that the request is for a three
day outdoor event for a pre -holiday sale at the Sher Five Points
Center. Staff recommended that the elves be restricted to within
the center and not be allowed to walk along Main Street, and the
mini -blimp not be illuminated. Staff concluded by recommending
approval with findings and conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Walter Brown, representing the applicant, advised that the
mini -blimp would be provided by the KEZY radio station and the
requested illumination was a battery powered light placed on the top
of the blimp.
There were no other persons present to speak for or against the
request and the public hearing was closed.
FINDINGS FOR APPROVAL:
1. The temporary outdoor event for a pre -holiday sale will not be
detrimental to:
a. The general welfare of persons residing or working in the
vicinity. The event is planned to increase business in the
center. No off -site impacts are anticipated. .
b. Property and improvements in the vicinity of such use or
building. All improvements are temporary.
2. The granting of Use Permit No. 91-54 will not adversely affect
the General Plan of the City of Huntington Beach. Retail
businesses are permitted within the General Commercial Land Use
Designation in the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated October 31, 1991 shall be the
conceptually approved layout.
2. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.

3. The applicant shall obtain clearance from the Public Liability
Claims Coordinator, Administrative Services Department, and/or
shall provide a Certificate of Insurance and Hold Harmless
Agreement to be executed at least five (5) days prior to the
event.
4. The elves shall not be used to encourage vehicles driving on
Main Street to enter the center. The elves shall be restricted
to the sidewalk in front of the stores and shall not be
permitted along the sidewalk along Main Street.
INFORMATION OF SPECIFIC CODE REQUIREMENTS:
1. The event shall comply with all applicable provisions of the
Ordinance Codes, Building Division and Fire Department.
2. The applicant shall meet all applicable local, State and
Federal Fire Codes, Ordinances and standards.
3. The Zoning Administrator reserves the right to revoke Use
Permit No. 91-54 if any violations of these conditions or the
Huntington Beach Ordinance Code occurs.
4. The applicant shall submit all future temporary outdoor event
applications a minimum of thirty (30) days prior to the event.
Failure to provide adequate notice shall result in denial of
the request.

THE NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR ON
