approved.
REGULAR AGENDA ITEMS:
ITEM 1: USE PERMIT NO, 91-

Request: To permit a 1,997 square foot Bagel Shop in an
existing retail center pursuant to Section
9220.1(c)R of the Huntington Beach Ordinance Code.
Location: 5840 A Edinger Ave. (Marina Village Center)
Mike Connor made a brief presentation of the project and reported
that an existing variance, approved in 1985 for the center, allows
10% of the building area to be counted at the warehouse parking ratio
rather than retail parking ratio. He advised that although ten
additional parking spaces would be required by Code as a result of
this development, the 1985 variance negates the need for additional
spaces.
THE PUBLIC.HEARING WAS OPENED.
James Cleary, the applicant, was present and concurred with the
suggested conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 91-55 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the 1,997
square foot bagel shop in an existing retail center will not be
detrimental to:
a. The general welfare of persons residing or working in the
vicinity. The proposed bagel shop will not have an adverse
impact on parking due to Conditional Exception No. 85-30
which permitted ten percent (10%) of the building area to
be counted as warehouse for parking purposes and because an
informal parking survey, by staff, revealed that there is
sufficient parking in the immediate vicinity of the
proposed bagel shop. In addition, the bagel shop would
have a morning peak hour parking demand as opposed to all
other restaurants in the center which will have peak hour
parking demand in the afternoon or evening.
b. Property and improvements in the vicinity of such use or
building. All improvements for the proposed bagel shop
will be on the interior of the existing building.
2. The proposed bagel shop is consistent with the goals and
objectives of the City's General Plan and Land Use Map. The
restaurant is consistent with the general commercial land use
designation in the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
November 7, 1991 shall be the conceptually approved layout.
2 The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
4. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.

5. Low -volume heads shall be used on all spigots and water faucets.
6. Conditions of approval shall be printed verbatim on all working
drawings submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke this Use
Permit No. 91-55 if any violation of these conditions of the
Huntington Beach Ordinance Code occurs.
