The Minutes of the December 11, 1991
Zoning Administrator Meeting were
approved.
ITEM 1: TENTATIVE PARCEL MAP NO. 89-155 (Extension of Time):
Applicant: John Abell, Inc.

Property Owner: D. T. Ritz Resources

San Gabriel, CA 91775
Request: To permit a six month extension of Tentative
Parcel Map No. 89-155 which is a request to
legalize an existing lot.
Location: 17251 Beach Blvd.
Wayne Carvalho, Staff Planner, displayed a site plan and explained
that the reason for the six month extension of time was due to plan
check revisions and recent receipt of utility company approval. The
final map is anticipated to go before the City Council in the next
couple of months.
The applicant's representative stated that the final map is being
revised and will be submitted within one and one-half months.
Scott Hess, Zoning Administrator, required that the reciprocal
access easement (271) be depicted on the final map.
THE PUBLIC HEARING WAS OPENED.
There was no one present to speak for or against the request and the
public hearing was closed.
TENTATIVE PARCEL MAP NO. 89-155 REQUEST FOR EXTENSION OF TIME WAS
APPROVED BY THE ZONING ADMINISTRATOR FOR A PERIOD NOT TO EXCEED SIX
(6) MONTHS WITH THE PREVIOUS CONDITIONS OF APPROVAL TO REMAIN IN
EFFECT AS WELL AS ADDED CONDITIONS OF APPROVAL. HE STATED THAT ALL
ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE
PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
CONDITIONS OF APPROVAL:
1. All previous conditions on Tentative Parcel Map No. 89-155
still apply.
ADDED CONDITIONS:
2. Final Parcel Map No. 89-155 shall depict the twenty-seven (27)
foot reciprocal access easement for vehicular and pedestrian
ingress and egress between the properties located to the north
and south.
3. The subject property shall enter into an irrevocable reciprocal
driveway and parking easement between the subject site and
adjacent properties. A copy of the legal instrument shall be
approved by the Community Development Department and the City
Attorney as to form and content and, when approved, shall be
recorded in the Office of the County Recorder. A copy shall be
filed with the Department of Community Development prior to the
release of Final Parcel Map No. 89-155.
4. Tentative Parcel Map 89-155 shall expire May 19, 1992.
ITEM 2• ADMINISTRATIVE REVIEW NO, 91-11:

Request: To permit a sales office and model home complex
pursuant to Section 9730.32 of the Huntington
Beach Ordinance Code
Location: 8314 Atlanta Avenue
Mike Connor, Staff Planner, made a brief presentation of the
proposed project stating that it included three model homes and a
sales office. Approximately 27 parking spaces are available along
the west property line for customer parking. He also stated that a
$1,000 bond is required for each model home and sales office and

that handicapped access must be provided to the sales office. In
addition, the fire department is requiring that the alarm system be
fully operational and that the fire lanes be constructed and clear
of obstructions prior to the sales office opening.
Staff recommended approval of the request with conditions.
Dennis Nelson, representing the applicant, was present and spoke in
support of the request.
ADMINISTRATIVE REVIEW NO. 91-11 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL HE STATED
THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED
TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and signage received and dated
November 27, 1991 shall be the conceptually approved layout.
2. The office use shall be discontinued within thirty (30) days
following sale of the last on -site unit. A cash bond of one
thousand dollars ($1000) shall be posted with the City for
the sales office and for each model home to guarantee
compliance with all provisions of this code and the
Huntington Beach Building Code. Such model homes shall only
serve Tract No. 14322.

The administrative review permit may be subject to review by
the Zoning Administrator one (1) year after issuance to
insure compliance with all City codes.
4.
The sales office shall not be converted or expanded into a
general business office for the contractor or developer.
5.
Fire access lanes shall be maintained. If fire lane
violations occur and the services of the Fire Department are
required, the applicant will be liable for expenses incurred.
6.
The applicant shall obtain clearance from the Public
Liability Claims Coordinator, Administrative Services
Department, and/or shall provide a Certificate of Insurance
and Hold Harmless Agreement to be executed at least five (5)
days prior opening the sales office.
7.
Fire Department Conditions shall be as follows:
a. The fire alarm system shall be completed prior to the
opening of the models or the sales office.
b. Fire lanes shall be completed and clear of obstructions
prior to the opening of the models or the sales office.
8.
Handicapped access to the sales office shall be provided
prior to the opening of the sales office or the model homes.
The access shall be reviewed and approved by the Building
Division.

INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions
of the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The Zoning Administrator reserves the right to revoke this
Administrative Review No. 91-11 if any violation of these
conditions of the Huntington Beach Ordinance Code occurs.
ITEM NO 3• USE PERMIT NO 91-51/DRAFT NEGATIVE DECLARATION NO,

Request:
To permit a wholesale nursery with a 28,800
square foot shade structure on a two acre
parcel pursuant to Section 9101(c)(1) of the
Huntington Beach Ordinance Code.
Location:
West side of Edwards Street approximately 330
feet south of Ellis Avenue.
Mike Connor, Staff Planner, made a brief presentation stating that
is requesting that the City approve the shade
the applicant
structure and wholesale nursery on a permanent basis. Staff
however, is recommending that the permit be limited to a maximum of
five (5) years because
the site is located within the Holly Seacliff
Specific Plan area
and that the proposed wholesale nursery may not
be compatible with
the Estate Residential district proposed for the
area.
In addition, staff
recommended that there be no fertilizers or
perticides stored
on site. Staff recommended approval with findings
and conditions.
THE PUBLIC HEARING WAS OPENED.
Tim Woodson, applicant, was present and spoke in favor of the
request.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 91-51/DRAFT NEGATIVE DECLARATION NO. 91-38 WAS
APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND
CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE
ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.

FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the wholesale
nursery will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity. The proposed nursery will have minimal traffic
or noise impacts due to the passive nature of the use.
b. Property and improvements in the vicinity of such use or
building. The proposed nursery will meet all minimum
setbacks and height restrictions. The shade structure will
be screened from view of adjacent residences by Ficus trees.
2. The proposal is consistent with the goals and objectives of the
City's General Plan and Land use Map. The proposed nursery is
compatible with the residential agriculturally zoned property
which is consistent with the estate residential land use
designation in the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
October 2, 1991 shall be the conceptually approved layout.
2. A revised site plan shall be submitted depicting the
modifications described herein:
a. Employee parking shall be a minimum nine (9) feet wide by
nineteen (19) feet deep. A minimum of five (5) spaces
shall be provided.
b. The site plan shall be revised to reflect the ultimate
right-of-way of Edwards Avenue.
c. The front fence shall be set back a minimum of twenty (20)
feet from the ultimate right-of-way of Edwards Avenue.
d. Fire lanes shall be designed to meet Fire Department
requirements.
3 The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, or building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
4. The Ficus trees around the perimeter of the property shall be
in place prior to issuance of building permits for the shade
structure. Photographs of the Ficus trees in place shall be
submitted to the Planning Division for the file.

5. Drainage and/or grading plans shall be submitted for review and
approval by the Public Works Department prior to any grading
activities.-
6. The applicant shall obtain any required permits and pay all
fees required by the Water Department.
7. If security lighting is included, it shall be directed to
prevent "spillage" onto adjacent properties.
8. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
9. All soils stored on site shall be covered or placed in
containers to prevent wind and water soils erosion. The soils
shall be located at the western end of the property centered
between the north and south property lines.
10. No fertilizers or pesticides shall be stored on site.
11. All fertilizers shall be in granular form and shall be hand
placed into plants.
12. Pesticides shall be applied by hand on each tree individually.
13. All watering shall be done by a drip irrigation system to
minimize water useage and soil erosion.
14. Any deliveries and all work on site shall be limited to the
hours of Monday - Sunday 7:00 AM to 4:00 PM.
15. The use shall be permitted for a maximum of five (5) years.
Any request for an extension beyond five (5) years shall be
submitted at least six (6) months prior to the expiration date.
16. Conditions of approval shall be printed verbatim on all working
drawings submitted for plan check.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke this Use
Permit No. 91-51 if any violation of these conditions or the
Huntington Beach Ordinance Code occurs.
