Mayor Silva called the adjourned regular meetings of the City Council and the
Redevelopment Agency of the City of Huntington Beach to order at 5:30 p.m.

FORCE COMMITTEE
Phil Inglee,. Citizen's Budget Task Force Committee Chairman, presented a slide
report. He distributed the material presented on the slides to Council and to
the City Clerk. He stated the budget problem, a suggested solution, and four
points to avoid future capital funding miscalculations. He stated he believed
a long term (five year) Strategic Financial Plan must be developed and updated
annually by a Joint Citizens & City Management Task Force.

IN CONJUNCTION WITH NEGATIVE DECLARATION NO. 91-9 - (DENSITY BONUS/OTHER
INCENTIVES ORDINANCE) - ORDINANCE NO. 3130 INTRODUCTION (430.50)
In answer to Councilmember Winchell's ..inquiry as to whether or not Section
3(b) (Duration of Affordability) in Ordinance No. 3130 reflected state law,
the Community Development Director stated that it was state law.
Councilmember MacAllister questioned why Ordinance No. 3130 was going forward
before the Affordable Housing Strategy.

In answer to Councilmember Green's inquiry pertaining to land grading, the
City Engineer stated that Garfield Avenue was torn up for utility relocations
within existing public right-of-way.

Police Chief Ron Lowenberg stated the location of the "Out of Bounds" Sports
Bar was at Brookhurst Street and Atlanta Avenue and that it was near a
residential neighborhood.
CONSENT CALENDAR ITEMS TO BE REMOVED FOR DISMSSION AT 7 PM MEETING
Councilmember MacAllister stated he would remove from the Consent Calendar the
item pertaining to the construction of the beach parking lot below bluffs for
separate discussion at the 7 p.m. meeting.
Councilmember Winchell stated she would be removing from the Consent Calendar
the items pertaining to the Beach Parking Lot and Resolution Nos. 6343, 6344,
and 6345 for further discussion at the 7 p.m. meeting.

FLAG CEREMONY AND_ NVOCATION
The Flag Ceremony and invocation was conducted by the The Huntington Beach
Search and Rescue Explorer Post 563, official color guard for the City of
Huntington Beach. Program sponsored by the City of Huntington Beach Police
and Fire Departments, is open to all high school age students.
VISITORS FROM SISTER CITY, WAITEKER_E__NEW ZEALAND
Mayor Silva introduced Deputy Mayor Bruce McNaughton and his wife, Shirley,
from Sister City Waitekere, New Zealand, who were visiting Huntington Beach.
PRESENTATION - $20,000 TO THE HB ART CENTER EOUNDATION & ART CENTER PROJECT -
SOUTHERN CALIFORNIA EDISON COMPANY
Vice Chair Dr. Gerald Chapman of the Huntington Beach Art Center Foundation
and Elaine Keeley, Chair of the Allied Arts Board, joined Mayor Jim Silva and
Michael Mudd to accept a $20,000 contribution to the Huntington Beach Art
Center Foundation and the City for the Art Center Project from H. Fred
Michelson, General Manager, Orange County Region of the Southern California
Edison Company.
PRESENTATION - BLOOD DONATION PLAQUES TO CITY EMPLOYEES - MENDEZ & 14CREYNOLDS
Mayor Silva presented plaques to City Employees, Arthur Mendez, Telecommunica-
tion Technician; and Ward McReynolds, Senior Water Inspector; who had donated
5 gallons of blood during their lifetime to the American Red Cross.

EVENT
Kirk Kirkland, Judge of the American Heart Association event, stated he had
warrants to cardiac arrest Councilmembers Moulton -Patterson, Winchell,
MacAllister, and Mayor Silva be be sentenced or make bail at the event,
Friday, February 7, 1992.
Larry Smith spoke in opposition to city employee salary increases during the
recession years.
Clare Hansen, past president of the Friends of the Children's Library
President, spoke in support of the library expansion. She stated she and
other volunteers had provided programs and resources that had enhanced the
school curriculum. She stated that as a role model she had shown volunteerism
to be a strong part of the community. She requested that the Council listen
to three future volunteers.
Andria_Oroeger stated she had researched her social studies report and found
that there were only three books on her subject and none were available. She
also stated that material she had researched on another occasion had been out-
dated and that there was a lack of space for quiet study.
Kendra Baird reported that the children's section of the library was very
crowded and noisy. She stated that computers were not always available.
Tracy Jessner stated there were not enough copies of books, and that the
auditorium was not large enough.
Heather Hansen presented the Council with gifts (small shovels).
Lines Jessner, Friends of the Children's Library President, requested that the
Children's Wing be made a reality now.
N4ncy Huebotter, Orange County California Geneology Society President, stated
that there were 14,000 volumes in the research collection housed in the
Huntington Beach Library. She stated that 500 individuals per month or 25
people per day visit the library to research geneology and that the library
serves as research center for geneologists. She stated that they are out of
space, cannot expand their collection and that they have to turn people away
from the meetings. She urged expansion of the library.
Jack Bowland, Home Council representative, spoke in support of the expansion
of the Children's Wing of the library but stated he was concerned about
finances and asked how the city was paying the debt service on the Certifi-
cates of Participation while the project was being built. He suggested that
the city defease $8.2 million and use $2 million to provide books, computers,
and support services for the children.
The City Administrator stated that staff would answer revenue questions at the
time of the presentation.
Tom Every, Century 21 co --owner, spoke in support of library funding.
John Valenzuela, Library Patrons representative, spoke in support of the
Central Library Expansion.

Phil De Barros, Huntington Beach Playhouse President, stated the Playhouse was
continuing their quest for a new home and would like to relocate in the
library.
Norma Gibbs encouraged Council to go ahead with the Central Library Expansion.
Suzanne Beukema, formation of Downtown Business Association Chairman, distri-
buted a list of supporters and other material to the Council. She requested a
public hearing to review the pros and cons of the organization.
The City Administrator stated staff would return February 3, 1992 for Council
to select options for the process.
Councilmember Winchell requested that the report include the option that
reflects the recommendations of the formation committee.
Abdul Memon, Downtown Merchants Association President, spoke in support of the
Downtown Business Association.
Dr. Paul Selecky, Phillip Falcetti, Kirk Kirkland, Huntington Valley Chapter
of Heart Association representative; Mary m , Harold Campbell, Marilyn
Cowan and spoke in support of the Smoking Ordinance Amendment.
Ray Rockoff requested a continuance of the appointment to the General Plan
Advisory Committee to consider a geographical distribution of the members.
George Arnold spoke in opposition to the appointment to the General Plan

Ari Gati, owner of the "Hot Dog It" cart on Main Street and Pacific Coast
Highway, spoke in support of the item pertaining to carts and kiosks stating
they give a village atmosphere. He suggested that a committee be established
to develop guidelines and policies regarding vending permits on the main strip
promenade, and he stated he would like to be a member.
Nancy Wylie, Downtown Merchants' Guild Executive Officer, distributed material
to the Council and spoke in opposition to any sidewalk sales and outdoor
vendors.
Dave Sullivan, Huntington Beach Tomorrow, spoke pertaining to the method of
calculating retirement salaries.

Patti Clasen spoke in opposition to CalTrans restriping Pacific Coast Highway
stating that it would mean more traffic and it would not create the desired
ambiance in the City of Huntington Beach.
Dgn Harvey spoke in opposition of Pacific Coast Highway having six lanes of
traffic stating that he believed it was an experiment CalTrans was doing in
Huntington Beach.
Diana Williams stated she lived in the neighborhood behind the "Out Of Bounds"
Sports Bar and was opposed to the item pertaining to their entertainment per-
mit. She stated that driving in the area was unsafe because of the customers
of the bar. (Mrs. Williams stated that she wished to speak at this time
rather than at the public hearing because of the late hour for her daughter
who was present.)
Renee Williams stated she felt unsafe in her neighborhood because of the "Out
Of Bounds" Sports Bar and spoke in opposition
Mike Mott spoke in opposition to the restriping Pacific Coast Highway stating
he believed it would create a bottleneck at both ends of the city.
Edwards Karens, Meredith Gardens Homeowners' Association Civic Affairs
Chairman, spoke regarding city spending practices, salary raises, and retire-
ment spiking.
Councilmember Moulton -Patterson requested a staff report on calculating
retirement pensions.

The Mayor announced that this was the day and hour set for a public hearing to
consider the following appeal continued open from 1/6/92:

APPLICANT: City of Huntington Beach Redevelopment Agency/Lang Lampert
Architects
APPELLANT: Lang Lampert Architects/Abdelmuti Development Co.
LOCATION: 101 Main Street (Northwest corner of Main Street at Pacific Coast
Highway)
ZONE: Downtown Specific Plan No. 3 - Visitor Serving Commercial
RE E T: To permit the construction of a 48,060 square foot four (4) story
commercial/office building with special permits for site coverage, upper story
setbacks and adherence to the five (5) foot build to line. The proposal also
includes a 141 space parking and one (1) loading space variance.

APPEAL: The appellant is appealing the specific condition of approval
(Condition #11 which requires that the proposed tower height be lowered four
(4) feet from 89 feet to 85 feet and the requirement that a minimum four (4)
foot upper story setback shall be provided along the two (2) sheer walls on
Main Street and Pacific Coast Highway from the second floor facade to the
third floor facade.
ENVIRONMENTAL STATUS: The proposed project is covered by Draft Environmental
Impact Report No. 89-6.
COASTAL STATUS: Appealable
This project is in the appealable portion of the coastal zone.
Under the provisions of the Huntington Beach Ordinance Code, the action taken
by the City Council is final unless an appeal is filed to the Coastal
Commission by the applicant or an aggrieved party. Said appeal must be in
writing and must set forth in detail the actions and grounds by and upon which
the applicant or interested party deems himself aggrieved. Said appeal must
be submitted to the Coastal Commission office within ten (10) working days of
the date of the Council's action. There is no fee for the appeal of a coastal
development permit. An aggrieved person may file an appeal to the Coastal
Commission within ten (10) working days, pursuant to Section 30603 of the
Public Resources Code, in writing to: California Coastal Commission, 245 W.
Broadway, Suite 380, POB 1450, Long Beach, California 90801-1450, Attention:
Theresa Henry, (213) 590-5071.
The Coastal Commission review period will commence after the City appeal
period has ended and no appeals have been filed. Applicants will be notified
by the Coastal Commission as to the date of the conclusion of the Coastal
Commission review. Applicant are advised not to begin construction prior to
that date.
Legal notice as provided to the City Clerk's Office by staff had been mailed,
published, and posted. No communications or written protests were received on
the matter.
The Community Development Director presented a staff report.
Howard Zelefsky, Planning Director, reported using a wall drawing, slide and a
model.
The Mayor declared the public hearing open.
Dianne Easterling spoke in opposition to Conditional Use Permit No. 91-39 with
special permits.
Bob Biddle, representing Huntington Beach Tomorrow, spoke in opposition to
Conditional Use Permit No. 91-39 with special permits.
David Lana, architect for the project, addressed the comments made in opposi-
tion to the project and stated the towers were an effort to be in balance with
the building across the street.
There being no one present to speak further on the matter and there being no
further protests filed, either oral or written, the hearing was closed by the
Mayor.
The City Administrator reported on the parking requirement. 9 G

A motion was made by Moulton -Patterson, seconded by Silva, to deny the appeal,
to uphold the Planning Commission's approval of Conditional Use Permit No.
91-39 with Special permits as modified by the Planning Commission, Coastal
Development Permit No. 91-21, Conditional Exception (Variance) No. 91-45,
Tentative Parcel Map No. 91-235 and Environmental Impact Report No. 89-6 with
the following findings and suggested conditions of approval: (See Page 14 for
vote of approval.)
Findings for Appr v 1 Development Permit No. 1:
1. The proposed four (4) story commercial/office building conforms with the
plans, policies, requirements and standards of the Coastal Element of the
Gneral Plan.
2. The coastal development permit is consistent with the CZ suffix zoning
requirements, the Downtown Specific Plan, and other provisions of the
Huntington Beach Ordinance Code applicable to the property.
3. At the time of occupancy, the proposed four (4) story commercial/office
building can be provided with infrastructure in a manner that is consis-
tent with the Coastal Element of the General Plan.
4. The proposed four (4) story commercial/office building conforms with the
public access and public recreation policies of Chapter 3 of the
California Coastal Act.
5. Approval of Conditional Exception (Variance) No. 91-45 will result in no
modification of the requirement of the C-LUP.
Findings for A r 1- Conditional Use Permit No. 91-32:
1. The establishment, maintenance and operation of a 48,060 square foot four
(4) story commercial/office building will not be detrimental to the
general welfare of persons residing or working in the vicinity nor to
property and improvements in the vicinity of such use or building.
Findings for Approval - Special Permits:
1. The following special permits promote a better urban environment by
adapting the Downtown Specific Plan, District No. 3 requirements which
enhance the area and provide a compatible project with the surrounding
area:
a. An increase of site coverage from 60 percent to 76 percent;
b. A reduction of the required upper story setbacks along Pacific Coast
Highway and Main Street and interior property line; and
C. Construction within the five (5) foot build -to line on Pacific Coast
Highway and two (2) feet behind the five (5) foot build -to line on
Main Street.
2. The requested special permits provide for maximum use of aesthetically
pleasing types of architecture and building layout, and promote a pedes-
trian/urban atmosphere.

3.
The requested special permits will not be detrimental to the general
health, welfare, safety and convenience, and not detrimental and injur-
ious to the value of property and improvements of the neighborhood or of
the City in general. The building bulk, building mass and overall pro-
ject design are properly addressed and will not be a detriment to the
surrounding neighborhood.
4.
The requested special permits are consistent with the objectives of the
Downtown Specific Plan, District 3 standards in achieving a development
compatible with the surrounding environment. The proposed project pro-
vides a better living environment and an aesthetically pleasing project
through design implementation, and promotes a pedestrian/urban atmoshpere.
Findings
for Approval - Conditional Exception (Variance) No. 91-45:
1.
Due to the fact that the subject project is only a small part of a larger
project, there are exceptional and extraordinary circumstances or condi-
tions applicable to the land, buildings and premises involved that do not
apply generally to the property of class of uses in the same district.
2.
The conditional exception (variance) to allow parking and loading areas
to be provided at a later date in conjunction with a larger project is
necessary for the preservation of substantial property rights.
3.
The granting of a conditional exception (variance) to allow parking and
loading areas to be provided at a later date in conjunction with a larger
project will not be materially detrimental to the public health, safety
and welfare or injurious to the conforming land, property or improvements
in the neighborhood of the property for which the conditional exception
(variance) is sought.
4.
The applicant is willing and able to carry out the purposes for which the
conditional exception (variance) is sought and will proceed to do so
without delay.
5. Sufficient conditions of approval have been phased on the project to
ensure that the code required amount of parking and loading areas will be
provided prior to occupancy of the building.
Findings for Approval - Tentative Parcel Map No. 91-235:
1. The proposed consolidation of nine (9) parcels into one (1) parcel and
alley vacation for purposes of commercial/office uses is in compliance
with the size and shape of property necessary for that type of
development.
2. The General Plan has set forth provisions for this type of land use as
well as objectives for implementation of this type of use.
3. The property was previously studied for this type of land use (mixed
commercial/office) at the time the land use designation of Downtown
Specific Plan, District No. 3, Visitor Serving Commercial was placed on
the subject property.

No. 9.1-45:
1. The site plan, floor plans and elevations received and dated October 24,
1991 shall be the conceptually approved layout with the foi1ovi,ng modifl-
cations:
a. Maximum tower height shall be 85 feet.
b. The public access stairways along the northeast side of the building
shall be designed to allow handicap access between the alley and
Main Street and to minimize visual obstruction.
C. The applicant shall provide a minimum four (4) ,foot 'upper. story set-
back along the sheer walls on Main Street and Pacific Coast Highway
from the second floor facade to the third floor facade.
2. The interim parking plan dated October 14, 1991 shall be the conceptually
approved layout.
3. All mitigation measures outlined in Environmental Impact Report No. 89-6
(Attachment No. 7) shall be complied with and in accordance with the
Mitigation Monitoring Program.
4. Prior to submittal for building permits, the applicant/owner shall
complete the following:
a. Submit three copies of the site plan to the Planning Division for
addressing purposes. If street names are necessary, submit proposal
to Fire Department for review and approval.
b. Depict all utility apparatus, such as but not limitedtobackflow
devices and Edison transformers, on the site plan. They shall be
prohibited in the front and exterior yard setbacks unless properly
screened by landscaping or other method as approved by the Community
Development Director.
C. Floor plans shall depict natural gas and 220V electrical shall be
stubbed in at the location of clothes dryers; natural gas shall be
stubbed in at the locations of cooking facilities, water heaters,
and central heating units; and low -volume heads shall be used on all
spigots and water faucets.
d. If foil -type insulation is to be used, a fire retardant type shall
be installed as approved by the Building Department and indicated on
the floor plans.
e. Elevations shall depict colors and building materials as approved by
the Design Review Board on October 24, 1991.
f. All rooftop mechanical equipment shall be screened from any view.
Said screening shall be architecturally compatible with the building
in terms of materials and colors. If screening is not designed
specifically into the building, a rooftop mechanical equipment plan
must be submitted showing screening and must be approved.

g. If outdoor lighting is included, high-pressure sodium vapor lamps or
similar energy savings lamps shall be used. All outside lighting
shall be directed to prevent "spillage" onto adjacent properties and
shall be noted on the site plan and elevations.
h. A detailed soils analysis shall be prepared by a registered Soils
Engineer. This analysis shall include on -site soil sampling and
laboratory testing of materials to provide detailed recommendations
regarding grading, soil corrosivity, fill properties, foundations,
retaining walls, streets, and utilities.
I. The Design Review Board shall review and approve the following:
1. Revised site plan and elevations as modified pursuant to
Condition No. 1.
J. Maximum separation between building wall and property line shall not
exceed two inches (211
).
k. The site plan shall include (or reference page) all conditions of
approval imposed on the project printed verbatim.
5. Prior to issuance of building permits, the applicant/owner shall complete
the following:
a. Submit copy of the revised site plan, floor plans and elevations
pursuant to Condition No. 1 for review and approval and inclusion in
the entitlement file.
b. A Landscape Construction Set must be submitted to the Departments of
Community Development and Public Works and must be approved. The
Landscape Construction Set shall include a landscape plan prepared
and signed by a State Licensed Landscape Architect and which
includes all proposed/existing plant materials (location, type,
size, quantity), an irrigation plan, a grading plan, an approved
site plan, and a copy of the entitlement conditions of approval.
The landscape plans shall be in conformance with Section 9607 and
the Downtown Specific Plan and the Main Street Improvement Plans of
the Huntington Beach Ordinance Code. The set must be approved by
both departments prior to issuance of building permits.
C. A grading plan shall be submitted to the Department of Public Works
for review and it must be approved (by issuance of a grading
permit). A plan for silt control for all water runoff from the
property during construction and initial operation of the project
may be required if deemed necessary by the Director of Public Works.
d. Hydrology and hydraulic studies shall be submitted for Public Works
approval.
e. All applicable Public Works fees shall be paid.
f. An interim parking and/or building materials storage plan shall be
submitted to the Department of Community Development to assure ade-
quate parking is available for employees, customers, contractors,
etc., during the project's construction phase.

g. A planned sign program shall be submitted and approved for 'all sign-
ing. Said program shall be approved and reviewed. by the -Planning

6. The Public Works Department requirements are as follows:
a. Coordinate street improvements with approved Mein Streetu.improvement
plans.
b. A traffic signal on the Pacific Coast Highway and Main Street corner
will be relocated.
c. A traffic impact fee shall be paid prior to final i,nipectioii.
d. Drainage flows from adjacent properties shall not be`obis tructed.
Flows shall be accommodated per Public Works Department requirements.
e. On -site drainage shall not be directed to adjacent properties, but
shall be handled by a Public Works Department approved method.
f. Submit a soils report for Public Works approval.
g. The catch basin on Pacific Coast Highway near Main Street intersec-
tion shall remain. Coordination with Caltrans will determine what
corner radius will be permitted adjacent to the catch basin.
h. The existing 16 inch sewer and water lines which are located at the
alley parallel with Pacific Coast Highway shall be relocated.
I. Abandon approximately 150 linear feet each of water and sewerline
within alley (parallel to Pacific Coast Highway).
J. Prepare construction plans for the relocation of existing sewerline
(approximately 130 linear feet) and installing a new tie-in at
Walnut.
k. The existing water and sewer lines, which will be abandoned, may
remain and be filled with concrete.
1. No trees will be allowed within Caltrans (Pacific Coast Highway)
right-of-way.
M. Trees on Main Street to be located 7 feet back of curb face.
n. Coordinate with Caltrans to construct the northwesterly curb return
of Pacific Coast Highway and Main Street.
o. Prepare one topographic map from field survey utilizing "Record
Drawings" prepared by others. Includes site specific topo required
for design purposes such as top of curb measurements and flowlines
of existing manholes.
p. Prepare one set of legal descriptions and exhibit for easement of
new sewer main in alley.

q. Curb, gutter and sidewalk on Main Street will be replaced. The curb
and gutter on Pacific Coast Highway may remain. The sidewalk on
Pacific Coast Highway will be replaced.
r. Approximately half of Main Street will have to be repaved with
asphalt (within new construction area).
7. Fire Department Requirements are as follows:
a. Automatic sprinkler systems will be installed throughout to comply
with Huntington Beach Fire Department and Uniform Building Code
Standards. Shop drawings will be submitted to and approved by the
Fire Department prior to installation.
b. A Class III wet standpipe system (combination) will be installed to
comply with Huntington Beach Fire Department and Uniform Building
Code Standards. Shop drawings will be submitted to and approved by
the Fire Department prior to installation.
C. A fire alarm system will be installed to comply with Huntington
Beach Fire Department and Uniform Fire Code Standards. Shop draw-
ings will be submitted to and approved by the Fire Department prior
to installation. The system will provide the following:
1. Water flow, valve tamper and trouble detection
2. 24 hour supervision
3. Smoke Detectors
4. Annunciation
5. Audible Alarms
d. One (1) fire hydrant will be installed prior to combustible con-
struction. Shop drawings will be submitted to the Public Works
Department and approved by the Fire Department prior to installation.
e. Elevators will be sized to accommodate an ambulance gurney. Minimum
six (6) feet, eight (8) inches wide by four (4) feet, (3) inches
deep with minimum of 42 inch opening.
f. Address numbers will be installed to comply with City Specification
No. 428. The size of the numbers will be the following:
1. The number for the building will be sized a minimum of ten (10)
inches with a brush stroke of one and one-half (1-112) inches.
2. Individual units will be sized a minimum of four (4) inches with
a brush stroke of one-half (1/2) inch.
g. Submit to the Fire Department for approval a Fire Protection Plan
containing requirements of Fire Department Specification No. 426.
h. The project will comply with all provisions of Huntington Beach
Municipal Code Title 17.04.085 and City Specification No. 429 for
new construction within the methane gas overlay districts.
8. All proposed interior office space layouts shall be reviewed and approved
by the Redevelopment Agency prior to issuance of building permits or
certificate. of occupancy whichever occurs first.

9. A shoring plan shall be submitted to the Building Department prior to
issuance of building permits to insure proper construction of the pro-
posed structure in relation to adjacent existing structure.
10. Should the office floor area be converted into residential units, a mini-
mum of 15% of the units shall be provided to moderate and low income
households. Of those 15%, 40% must be available to very low income
households.
11. The proposed restaurant use shall have no walk-up or pick up window.
12. Any new restaurant use (greater than 12 seats) shall require the review
and approval of a conditional use permit by the Planning Commission.
13. Any proposed alcohol sales shall require the review and approval of a
conditional use permit by the Planning Commission."
14. No basement area shall be permitted without the approval of the Community
Development Director.
15. The proposed public improvements along Main Street and Pacific Coast
Highway shall be maintained by the applicant through an agreement between
the Public Works Department and the applicant/property owner and shall be
reviewed as to form and content by the City Attorney's Office prior to
approval of the public improvement plan.
16. The 10 foot public access easement shall be maintained by the applicant/
property owner through Convents, Conditions and Restrictions (CC&R's) and
which shall be approved as to form and content by the City Attorney's
Office.
17. Prior to issuance of building permits, a parking plan depicting the
temporary and permanent location of all required parking and loading
spaces shall be submitted for review and approval by the City Council and
Planning Commission.
18. Prior to issuance of Certificates of Occupancy all code required parking
and loading spaces shall be constructed and available for the project.
The spaces shall be available either within a Main -Pier Phase II parking
structure or in combination with a 65 space temporary parking lot and
off -site parking spaces within 350 feet. Certificate of Occupancy may be
released as parking spaces become available.
19. The development shall comply with all applicable provisions of the
Ordinance Code, Building Division, and Fire Department.
20. All building spoils, such as unusable lumber, wire, pipe, and other
surplus or unusable material, shall be disposed of at an off -site
facility equipped to handle them.
21. Installation of required landscaping and irrigation systems shall be
completed prior to final inspection/within twelve (12) months.
22. During construction, the applicant shall:
a. Use water trucks or sprinkler systems in all areas where vehicles
travel to keep damp enough to prevent dust raised when leaving the

b. Net down areas in the late morning and after work is completed for
the day;
c. Use low sulfur fuel (.05% by weight) for construction equipment;
d. Attempt to phase and schedule construction activities to avoid high

23. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM.
Construction shall be prohibited Sundays and Federal holidays.
24. Prior to final building permit approval or issuance of a Certificate of
Occupancy, the fallowing shall be completed:
a. All improvements (including landscaping) to the property shall be
completed in accordance with the approved plans and conditions of
approval specified herein.
b. Final Parcel Map No. 91-235 shall be recorded with the County
Recorders Office and a copy submitted to Planning Division prior to
Certificate of Occupancy or final inspection.
C. Compliance with all conditions of approval specified herein shall be
accomplished.
25. The Planning Commission reserves the right to revoke Conditional Use
Permit No. 91-39, Coastal Development Permit No. 91-21, Conditional
Exception (Variance) No. 91-45, Tentative Parcel Map. No. 91-235 and
Environmental Impact Report No. 89-6 if any violation of these conditions
or the Huntington Beach Ordinance Code occurs.
26. This conditional use permit shall not become effective for any purpose
until an "Acceptance of Conditions" form has been properly executed by
the applicant and an authorized representative of the owner of the
property, and returned to the Planning Division.
27. Conditional Use Permit No. 91-39, Coastal Development Permit No. 91-21,
Conditional Exception (Variance) No. 91-45, Tentative Parcel Map No.
91-235 and Environmental Impact Report No. 89-6 shall become null and
void unless exercised within one (1) year of the date of final approval,
or such extension of time as may be granted by the Planning Commission
pursuant to a written request submitted to the Planning Department a
minimum 30 days prior to the expiration date.
28. All low and moderate income residential units displaced by the project
shall be replaced within the City within four (4) years of demolition.
The replacement units must remain available at an affordable housing cost
to low or moderate income persons for the duration of the redevelopment
plan. Prior to issuance of Certificate of Occupancy, the applicant shall
submit a plan to the Director identifying where and how the required
units shall be provided."

units for lower, very low, and elderly households.
b. "Promote and, where possible, require the continued affordability of

5.0) This code amendment provides a mechanism to grant density
bonuses and other incentives to developers who agree to construct
affordable units.

3. Code Amendment No. 91-2 will not be detrimental to policies contained
within the Coastal Act. Individual projects will require a coastal
development permit, a conditional use permit and an environmental analy-
sis. Therefore, projects proposed in the Coastal Zone will require a
through analysis as to their compliance with the Coastal Act.

Jim Gartner, architect, spoke in support of the appeal of Planning
Commission's denial of Conditional Use Permit No. 91-35 and presented a copy
of the building permit on a slide. He stated that a noise expert had stated
there was no noise impact from Mr. Hassan's home.
Roy Richardson stated he wished to speak last to present his testimony.
Dr. Donna Geor9p stated she had lived in the neighborhood of the person
requesting the Conditional Exception (Variance) No. 91-28 for 22 years and
that the second floor of Emad Hassan's home eliminated the privacy in her back
yard. She also stated that the second floor compounded the noise from Warner
Avenue. She distributed a photograph showing how it impacted her residence.
Donna Klein spoke in opposition to the appeal and stated that the building was
designated invalid twice and that the mistake was in need of correction.
uck Rgince spoke in opposition to the appeal and stated that the second
story of the home of Emad Hassan obstructed his view.
Terrance__ RM, real tor, spoke in opposition to the appeal and stated that the
view obstruction caused by the second story of the home of Emad Hassan meant a
decline of property value. He showed a photograph.
Susan Winn, representing home owners in the area, stated that Council had been
given a petition bearing signatures of approximately 125 persons in opposition
to the appeal of Planning Commission's denial of Conditional Use Permit
No. 91-35.
Larry Price spoke in opposition to the appeal and stated that the second story
of the home of Emad Hassan obstructed his view.
Daniel Denney stated he did not believe a variance on the home of Emad Hassan
should be accepted when he and his neighbors had conformed to the code in that
neighborhood.
Mike Hartfield presented slides of the surrounding homes of Emad Hassan to the
Council to show the lost view of the Price home, and he spoke in opposition to
the appeal.
Dan Hartfelder stated he was the original architect on the project and that
the code did not define the special point to determine the height of the
building.
Nick Titov spoke in support of the appeal of Planning Commission's denial of
Conditional Use Permit No. 91-35 and stated that Mr. Hassan's home was an
asset to the neighborhood.
George Armstrong, developer of the subdivision, spoke in support of the appeal
of Planning Commission's denial of Conditional Use Permit No. 91-35.

Mark SaLW, counsel for appellant, stated the petition in opposition was not
valid because it went beyond 300 feet of the residence.
Discussion was held between Council and Mark Bailey.
Ali Hassan, appellant, spoke in support of the appeal and stated his home was
built according to the Uniform Building Code on the viewgraph. He showed a
letter from the Planning Department in support of his intention.
Robert Schultz, attorney for Emad Hassan, spoke in support of the appeal and
distributed material to the Council. He referred to Page 9 of the late
communication.
Jeff Richard, attorney for Chuck Reince, stated there were no vested rights
and that he believed the permit was invalid.
Ron Pattinson, consultant for Chuck Reince, requested that Council uphold the
Planning Commission decision to deny Conditional Use Permit No. 91-35.
There being no one present to speak further on the matter and there being no
further protests filed, either oral or written, the hearing was closed by the

safety factor in daytime for children which is an accident waiting to happen,
car alarms, proximity to residences and debri.
Scott Richard spoke in support of the appeal to denial of the Entertainment
Permit for "Out of Bounds" Sports Bar.
Paul Jakse stated he was speaking for Mrs. Marianne Larson and that he was in
support of the "Out of Bounds" sports bar entertainment permit.
Marianne Lar , owner of Out of Bounds, stated that the complaints referenced
went back to 1985 before she owned the bar.

(City Council) CENTRAL LIBRARY EXPANSION - APPROVE (600.10)
The City Clerk presented a communication from the Library Services Director
regarding the Central Library Expansion.
The City Administrator presented a staff report using slides.
A motion was made by MacAllister, seconded by Kelly, to:
1. Utilize up to $5,000,000 of the 1986/89 unused COP proceeds as temporary
financing for the Library Expansion Project.

2. Accept the lowest qualified bid and award the contract to Gentosi
Brothers Contractors.
3. Authorize the Director of Public Works to expend $6,136,500 to cover
contract costs of $5,830.000, estimated construction change orders of
$291,500, and anticipated incidental expenditures of $15,000.
The motion carried by the following roll call vote:
AYES: Robitaille, Moulton -Patterson, Winchell, Silva, Green
NOES: MacAllister, Kelly
ABSENT: None
On motion by MacAllister, second Winchell, Council unanimously approved to
continue the following items to the January 27, 1992 City Council meeting:
