ITEM 1- USE PERMIT NO 91-75 (continued from January 15. 1992
Zoning Administrator Meeting
Applicant: Teddy Bear
Box 5692
Huntington Beach, CA 92615
Request: To permit a one day party (from 6:00 p.m. to
1:00 a.m.) with live entertainment January 24,
1992 within the existing suite formerly occupied
by MacArthur Park Restaurant
Location: 16390 Pacific Coast Highway (Formerly MacArthur
Park Restaurant in Peter's Landing)
Mike Connor, Staff Planner, reported that the applicant will have
five to six security guards on duty the evening of the party. Staff
recommended approval with findings and suggested conditions of
approval.
THE PUBLIC HEARING WAS OPENED.
Cindy Hulfond, representing the applicant, was present and concurred
with the recommended conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 91-7 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO
CALENDAR (2) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the a one (1)
night party in a vacant restaurant will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity. The party will be located in an existing
building which was formerly a restaurant.
b. Property and improvements in the vicinity of such use or
building. No improvements are proposed.
2. The proposal for a one (1) night party in a vacant restaurant
is consistent with the goals and objectives of the City's
General Plan and Land Use Map. The one (1) night party is
consistent with the Visitor Serving Commercial Lan Use
Designation in the General Plan.
3. Approval of Use Permit No. 91-65 shall be for the evening on
January 8, 1992 only. Any further one night parties shall
require approval of additional use permit requests. Any
further applications shall be submitted to the Planning
Division at least thirty (30) days prior to the event to allow
for sufficient processing time.
4. The party shall be limited to the hours of 6:00 p.m. to 1:00
a.m.
5. Security guards shall be placed outside to patrol the parking
lot to prevent patrons from making excessive noise when
entering or leaving the party.
6. The applicant shall obtain clearance from the Public Liability
Claims Coordinator, Administrative Services Department, and/or
shall provide a Certificate of Insurance and Hold Harmless
Agreement to be executed at least five (5) days prior to the
event.

SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
December 26, 1992 shall be the conceptually approved layout.
2. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The Zoning Administrator reserves the right to revoke this Use
Permit No. 91-65 if any violation of these conditions of the
Huntington Beach Ordinance Code occurs.
ITEM 2: USE PERMIT NO, 91-61
Applicant: Michael J. Del Monaco
13282 Taft Avenue
Garden Grove, CA 92643
Request: To permit a seven foot (7') high fence over a two to
four foot (2'-4') high retaining wall on the side and
rear property lines; and a three foot (3') high wrought
iron fence over a three foot (3') high retaining wall on
the front property line pursuant to Section 9771 (1) of
the Huntington Beach Ordinance Code..
Location: 7702 Yukon Drive
Mike Connor, Staff Planner, reported that the applicant had
constructed a retaining wall with a wrought iron fence along the
front property line and a gate across the driveway. Staff advised
that the fence and gate did not meet setback requirements of the
code. Staff recommended approval of the side and rear yard fence
and recommended that the front fence gates be modified to open onto
the property and not into the public right-of-way. Also, that the
wrought iron fence be moved back three feet onto the property.
THE PUBLIC HEARING WAS OPENED.
Bud Greenleaf, 7702 Yukon, said the fence was constructed six years
ago and that his contractor advised him that the fence met City
codes. He said it would be very costly to move the fence.

Mehran Ahrestani, 18442 Manitoba Lane, was present and spoke in
support of the request. He said that Mr. Greenleaf's property was
adjacent to his and that the fence enhances the neighborhood.
Mike Del Monaco, the applicant, was present and spoke in support of
the request.
Scott Hess, Zoning Administrator continued the public hearing open
for one week directing staff to research the Code to determine if
the fence was legal when constructed.
USE PERMIT NO. 91-61 WAS CONTINUED TO THE ZONING ADMINISTRATOR
MEETING OF JANUARY 29, 1992 WITH THE PUBLIC HEARING LEFT OPEN, BY
THE ZONING ADMINISTRATOR.
ITEM 3: COASTAL DEVELOPMENT PERMIT NO, 91-37
Applicant: Gary C. Gorman
9122 Christine Drive
Huntington Beach, CA 92646
Request: To permit a 221 square foot first story addition to
an existing one story residence pursuant to Section
989.5.2 of the Huntington Beach Ordinance Code.
Location: 9122 Christine Drive
Mike Connor, Staff Planner, reported that the property backs up to
the flood control channel and is within the Coastal Zone. The
proposed addition meets open space, site coverage and setback
requirements and will not impact coastal views or access. Staff
concluded by recommending approval with findings and suggested
conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Gary Gorman, the applicant, was present and concurred with the
suggested conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
COASTAL DEVELOPMENT PERMIT NO. 91-37 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL
COMMISSION.

FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO. 91-37:
1. The request to permit the remodel and 221 square foot addition
to an existing one-story single family residence conforms with.
the plans, policies, requirements and standards of The Coastal
Element of the General Plan. The proposed addition will have
no impact on energy, public coastal views or access and all
necessary infrastructure is currently in place.
2. Coastal Development Permit No. 91-37 is consistent with the CZ
suffix zoning requirements, the R1 Zoning District, as well as
other provisions of the Huntington Beach Ordinance Code
applicable to the property. The proposed 221 square foot
addition meets all applicable provisions of code.
3. At the time of occupancy, the proposed remodel and 221 square
foot addition to an existing one-story single family residence
will be provided with infrastructure in a manner that is
consistent with the Coastal Element of the General Plan. All
necessary infrastructure is currently in place.
4. The proposed remodel and 221 square foot addition to an
existing one-story single family residence conforms with the
public access and public recreation policies of Chapter 3 of
the California Coastal Act. There are no public coastal views
or access relating to the property that could be impacted by
the proposed addition.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
December 23, 1991 shall be the conceptually approved layout
with the following modification:
a. The floor plan on sheet 1 shall be revised to match sheet 2
by showing door openings and room uses.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:

ITEM 4: TENTATIVE PARCEL MAP NO. 90-327 (Revised)
Applicant: H. B. Redevelopment Agency
2000 Main Street
Huntington Beach, CA 92648
Request: To subdivide a 4.1 acre parcel into three parcels
pursuant to Sections 9220 and 9530.02 of the Huntington
Beach Ordinance Code. The original map included a
smaller area and was approved for two parcels.
Location: 7491 Center Ave. (100 foot wide strip of land extending
from Center Avenue to the 405 Freeway along the west
side of the Southern Pacific Railroad)
Mike Connor, Staff Planner, reported that a request to subdivide one
parcel into two parcels was approved by the Zoning Administrator in
October 1990. Subsequent to that approval, it was determined that
the parcel was larger and crossed into the City of Westminster. The
revised request amends the map for three parcels. Staff concluded
by recommending approval with findings and suggested conditions of
approval.
TENTATIVE PARCEL MAP NO. 90-327 (REVISED) WAS APPROVED BY THE
ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The proposed subdivision of three (3) parcels for purposes of
industrial use are in compliance with the size and shape of
property necessary for that type of development because the
proposed parcels exceed the minimum lot frontage and minimum
parcel size required by the M1 Zoning District.
2. The General Plan has set forth provisions for General
Industrial land use as well as setting forth objectives for
implementation of this type of use. Any future development on
the three (3) lot industrial subdivision will be required to
meet the development standards of the M1 Zoning District as
well as the goals and policies of the Mixed Use and Public,
Quasi -Public Institutional Land Use Designations.

3. The subject property was previously studied for this intensity
of land use at the time the land use designations for Mixed
Use District and Public, Quasi -Public Institutional allowing
for industrial uses and public facilities were placed on the
subject property. The proposed project would help to
encourage industrial development and broaden the City's
economic base.
4. The size, depth, frontage, street width and other design and
improvement features of the proposed subdivision are proposed
to be constructed in compliance with standards plans and
specifications on file with the City as well as in compliance
with the State Map Act and supplemental City Subdivision
Ordinance. The proposed three (3) lot industrial subdivision
meets all minimum standards of the code.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S)
FOR ANY PURPOSE:
1. Tentative Parcel Map 90-327 received by the Department of
Community Development on December 30, 1991 shall be the
approved layout.
2. A parcel map shall be filed with and approved by the
Department of Public Works and recorded with the Orange County
Recorder.
3.
Water supply shall be through the
City of Huntington Beach's
water system at the time said parcels
are developed if such
systems exist within 200 feet of
said parcels.
4.
Sewage disposal shall be through
the City of Huntington
Beach's sewage system at the time
said parcels are developed
if such systems exist within 200
feet of said parcels.
5.
Fire hydrants shall be placed in
number and at locations
required by the Fire Department.
6.
All utilities shall be installed
underground at the time said
parcels are developed.
7.
Development shall comply with all
applicable City Ordinances.
8. A copy of the recorded parcel map shall be filed with the
Department of Community Development.
9. All vehicular access rights along McFadden and Center Avenues
shall be dedicated to the City of Huntington Beach except at
locations approved by the Zoning Administrator. Access
locations to Parcel No. 1 shall be determined at the time the
parcel is developed and shall be approved by the Department of
Public Works.
