No action can be taken by the Planning Commission on this date, unless agendized. Gary Reed, 16251 Kim Lane, spoke on behalf of the residents residing on Kim Lane. He submitted a petition from the residents requesting staff to investigate the possibility of building a brick wall to seperate their street. Public Works stated they would investigate. Barbara Leonard, 17242 Argo Circle, spoke in opposition to Item B-1. She is concerned with with property values being lowered. John Whelan, 17332 Lee Circle, spoke to Item B-1. He asked staff to brief the public on the meeting that was held between staff and the applicant. Staff stated they would when the item came up for discussion. B. PUBLIC HEARING ITEMS Commissioners Shomaker and Dettloff stated they would be abstaining from public hearing item B-1 because of conflicts of interest. B-1 GENERAL PLAN AMENDMENT NO. 90-8/ZONE CHANGE NO. 90-17/ ENVIRONMENTAL IMPACT REPORT NO 90-3 (CONTINUED FROM THE JANUARY 7, 1991 PLANNING COMMISSION MEETING): APPLICANT: Andover/Chandler Companies LOCATION: Wintersburg School Site (southeast corner of Warner Avenue and Goldenwest Street) The Planning Commission continued General Plan Amendment No. 90-8, Zone Change No. 90-17, and Environmental Impact Report No. 90-3 to give the applicant the opportunity to meet with staff to discuss alternatives for the project site. After meeting with staff and members of the Planning Commission on January 14, 1991, the applicant has attempted to arrive at feasible alternatives involving densities, acreages and affordabilities. However, the applicant has been unable to agree on any of staff's alternatives and has requested a continuance to further discuss land use options. STAFF RECOMMENDATION: Staff recommends that the Planning Commission continue General Plan Amendment No. 90-8, Zone Change No. 90-17, and Environmental Impact Report No. 90-3 to the February 19, 1992 Planning Commission meeting. Code Amendment No. 91-9 is a request to amend Article 911 (Low Density Residential) to establish more restrictive standards for the approval of third story components of single family homes. The new standards would be applicable in the R1 (Low Density Residential) zoning district City-wide. The code amendment will also establish a new definition for building height in the R1 zone. The recommendations contained in Code Amendment No. 91-9 were generally formulated by the Harbour Code Committee which was created by the City Council in response to concerns regarding new third story construction in Huntington Harbour. The Code committee was comprised of City staff members, Planning Commissioners and residents of Huntington Harbour. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Code Amendment No. 91-9 as amended by staff with findings and forward to City Council for adoption. Hal Simmons, Senior Planner, read into the record his interpretation of the Code Committee's recommendation. The proposed Code Amendment No. 91-9 to regulate third stories and redefine Building Height in the R1 district is necessary to promote and protect compatibility of land uses. The proposed Code Amendment No. 91-9 to regulate third stories and redefine Building Height in the R1 district is consistent with the goals and objectives of the Huntington Beach General Plan which are to encourage and maintain a well balanced variety of residential densities and uncrowded living environments. 4. B-3 SPECIAL SIGN PERMIT NO. 92-1: APPLICANT: PHH Fleet America LOCATION: 16401 Beach Boulevard Special Sign Permit No. 91-7 is a request to permit a 64 square foot in area, 15 foot tall illuminated business identification freestanding sign pursuant to Section 9610.7 of the Huntington Beach Ordinance Code. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Special Sign Permit No. 92-1 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Gary Thompson, representing applicant, stated he was there to answer any questions the Commission may have. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. Strict compliance with Article 976 will result in substantial economic hardship to the applicant because other signs in the area exceed seven (7) feet in height. 2. The proposed illuminated freestanding sign will not adversely affect other signs in the area because other signs in the area exceed seven 97) feet in height. 3. When the height of the sign is reduced by 10 feet, it will be in keeping with other signs the surrounding area. CONDITIONS OF APPROVAL - SPECIAL SIGN PERMIT NO, 92-1: 1. NON-PUBLIC HEARING ITEMS D-1 CONDITIONAL USE PERMIT NO. 91-9 - REVIEW OF OPERATION: APPLICANT: Rod Wilson LOCATION: 16242 Beach Boulevard (east side approximately 135 feet south of Stark Avenue) Conditional Use Permit No. 91-9 in conjunction with Planned Sign Program No. 91-1 was approved on April 16, 1991. The conditional use permit request was for a 25 foot high, 98 square foot electronic readerboard sign, pursuant to Section 9610.9 of the Huntington Beach Ordinance Code. The Planning Commission required that the sign be reviewed for compliance with the conditions of approval and the Huntington Beach Ordinance code. STAFF RECOMMENDATION: Staff recommends that the Planning Commission direct the applicant to comply with all conditions of approval for Conditional Use Permit No. 91-9, within 60 days. The above -stated actions shall be completed within 60 days. Failure to comply with the conditions of approval may result in revocation of Conditional Use Permit No. 91-9. PC Minutes - 2/4/92 -6- (3208d) L � ' LI D-2 CONDITIONAL USE PERMIT NO, 89-6(C)/CONDITIONAL EXCEPTION VARIANCE) NO. 90-7/TENTATIVE TRACT MAP NO. 14109 - ONE (1� YEAR EXTENSION OF TIME: APPLICANT: David Dahl LOCATION: Southwest corner of Ellis Avenue and Goldenwest Street This is a request to extend the approvals of Conditional Use Permit No. 89-6(C), Conditional Exception (Variance) No. 90-7 and Tentative Tract Map No. 14109 for one (1) year. The Planning Commission originally approved the 14 lot subdivision at the southwest corner of Ellis Avenue and Goldenwest Street on February 21, 1990. In the applicant's written request for an extension of time, it is indicated that the project has not yet begun due to on -going efforts to comply with conditions of approval as well as difficulty in obtaining construction loans (see Attachment No. 1). An extension of time for one (1) year should be sufficient to comply with conditions of approval, secure financial assistance and begin construction on the project. Planning staff supports the request for the one (1) year extension of time with deletion of one (1) condition of approval and modification of one (1) condition of approval and all other previously established conditions to remain in effect. Planning staff recommends the the Planning Commission delete Tentative Tract Map No. 14109 Condition of Approval No. 24: 24. Developer will be responsible, as part of conditions of approval, for payment of any additional fees adopted in the "upcoming" Water Division Financial Master Plan. Although it has been standard procedure to include this condition on all development projects for the past couple of years such fees have not been adopted, do not appear to be imminent, and are no longer being included by staff as suggested conditions of approval. Condition No. 29 currently reads as follows: "29. Should a Traffic Impact Fee be adopted by the City Council, the applicant/property owner shall be responsible for paying such fee prior to issuance of a Certificate of Occupancy and/or final building permit approval." Staff recommends the above condition of approval be amended to read: 29. The developer shall be responsible for the payment of Traffic Impact Fees at the time of final inspection PC Minutes - 2/4/92 -7- (3208d) ADDITIONAL INFORMATION Planning Staff would like to inform the Planning Commission of two (2) additional items of information on Tentative Tract No. 14109 located at the southwest corner of Ellis Avenue and Goldenwest Street. Staff recommends that the Planning Commission amend Tentative Tract No. 14109 condition of approval number la which currently reads as follows: "l. The Tentative Tract Map received and dated January 23, 1990 shall be revised to show the following: a. Additional ten (10) foot dedication along Goldenwest street, if necessary." Staff has determined only an additional five (5) feet of dedication is required to meet the street and sidewalk width as shown in the draft Holly-Seacliff Specific Plan Technical Appendix (See Attachment No. 1). The condition should be revised to read as follows: "l. The Tentative Tract Map received and dated January 23, 1990, shall be revised to show the following: a. Additional five (5) foot dedication along Goldenwest Street." Additionally, staff recommends that the Planning Commission add the following condition of approval to Tentative Tract No. 14109: l.b. The perimeter wall at Ellis Avenue and Goldenwest Street shall be angled at 45 degrees and setback a minimum of 40 feet from face of curb as specified in the Draft Ellis-Goldenwest Design Guidelines. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve a one (1) year extension of time to March 5, 1993 for Conditional Use Permit No. 89-6(C), Conditional Exception (Variance) No. 90-7 and Tentative Tract Map No. 14109 with the deletion of Tentative Tract Map No. 14109 Condition of Approval No. 24 and amendment of Tentative Tract Map No. 14109 Condition of Approval No. 29, and all other previous conditions of approval to remain in effect. D-3 CONDITIONAL USE PERMIT NO. 89-6(A)/CONDITIONAL EXCEPTION (VARIANCE) NO. 90-5/TENTATIVE TRACT MAP NO. 13439 - ONE (1� YEAR EXTENSION OF TIME: APPLICANT: David Dahl LOCATION: 1,000 feet south of Ellis approximately 700 feet west of Goldenwest Street This is a request to extend the approvals of Conditional Use Permit No. 89-6(A), Conditional Exception (Variance) No. 90-5 and Tentative Tract Map No. 13439 for one (1) year. The Planning Commission approved the 10 acre subdivision into 28 lots on February 21, 1990. The Planning Commission subsequently held a public hearing for clarification of conditions of approval regarding landscaping requirements and removal of trees on May 6, 1991. Conditions of Approval Nos. 3a and 3b for Conditional Use Permit No. 89-6(A) were modified at that time (see Attachment No. 3). Terry LOCATION: 19551 Beach Boulevard Use Permit No. 90-37 is a request to extend an existing temporary use permit for a period of six (6) months through June 30, 1992. The site is located near the southwest corner of Beach Boulevard and Yorktown Avenue and has been operating as automobile sales and leasing since 1986. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve an extension of time for Use Permit No. 90-37 for a period of six (6) months until June 30, 1992 with the deletion and replacement of Condition of Approval No. 9 and all other previous conditions of approval to remain in effect. DISCUSSION ITEMS Commissioner Kirkland - stated his concern regarding the illegal signage abundant in Huntington Beach. He requested staff to investigate ways in which to enforce the sign code. Commissioner Bourguignon - inquired as to the status of the glass room ordinance. F. PLANNING COMMISSION INQUIRIES None G. PLANNING COMMISSION ITEMS Commissioner Richardson - asked staff what they had done about his request of last August to raise the Commission's stipends. Staff stated they would discuss the matter with the Mayor. H.
