ITEM 1• USE PERMIT NO, 92-5
Applicant: Huntington Harbour Anglers
16455 Ladona Circle
Huntington Beach, CA 92649
Request: To approve a temporary outdoor event for the Huntington
Harbour Anglers 21st Annual Charity Bazaar to be held
on May 2, 1992 pursuant to Section 9730.64 of the
Huntington Beach Ordinance Code.
Location: 16899 Algonquin Street (Huntington Harbour Mall)
Wayne Carvalho, Staff Planner, reported that the annual charity
bazaar would be held from 9:00 AM to 2:00 PM on May 2, 1992. He
advised that the event has been held for the past twenty-one years
and the layout, drive aisles and partitions are the same as the
previous years event. Staff concluded by recommending approval with
findings and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Claude Jones, representing the applicant, said that the charity
event will sell new and used fishing equipment.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 92-5 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO
CALENDAR (2) DAYS.
FINDINGS FOR APPROVAL:
1. The temporary outdoor event will not be detrimental to the
general welfare of persons residing or working in the vicinity
as the event must comply with fire safety requirements.
2. The granting of Use Permit No. 92-5 will not adversely affect
the General Plan of the City of Huntington Beach as the
temporary event is scheduled for one day.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated January 27, 1992 shall be the
conceptually approved layout.
2. The applicant shall obtain clearance from the Administrative
Services Department, Risk Management Division, and/or shall
provide a Certificate of Insurance to be executed at least five
(5) days prior to the event.
3. The applicant shall obtain all necessary Fire Department
permits and comply with all provisions of Article 32 of the
Uniform Fire Code.
4. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
5. Fire access lanes shall be a minimum width of (20) twenty feet.
6. All tents shall be of fire retardant material. Proof of
Certification shall be submitted to the Fire Department for
approval prior to installation.
7. All parking shall be a minimum of forty (40) feet from the
proposed tent.
8. Tents shall be secured against collapsing to the satisfaction
of the Fire Department.
9. "No Smoking" signs shall be posted in conspicuous locations.
10. Two fire extinguishers shall be provided at locations specified
by the Fire Department.

11. Temporary use of extension cords shall be permitted for one day
only.
12. Stand by personnel shall be on site to safeguard premises.
13. Balloons and temporary signs in conjunction with the temporary
event shall be permitted as part of this approval.
INFORMATION OF SPECIFIC CODE REQUIREMENTS:
1. The event shall comply with all applicable provisions of the
Ordinance Codes, Building Division and Fire Department.
2. The applicant shall meet all applicable local, State and
Federal Fire Codes, Ordinances and standards.
3. The Zoning Administrator reserves the right to revoke Use
Permit No. 92-5 if any violations of these conditions or the
Huntington Beach Ordinance Code occurs.
ITEM 2• TENTATIVE PARCEL MAP NO, 92-111
Applicant: Parkview Partnership/Pacific Beach Co., Inc.

Request: To subdivide 2.85 acres into eight (8) industrial lots
pursuant to Section 9920 of the Huntington Beach
Ordinance Code.
Location: 18241 Gothard Street
Wayne Carvalho, Staff Planner, reported that Tentative Tract Map No.
14494 was approved for the subject property in June 1991 by the
Planning Commission. Staff advised that the standard conditions
imposed on the approved Tract Map would be imposed on the Tentative
Parcel Map. The Fire Department requested that the hammer -head meet
Fire Department Specification No. 401 for turn -around purposes.
Staff concluded by recommending approval with findings and suggested
conditions of approval.
Bruce Crosby, Public Works, advised that the water system should be
dedicated to the City of Huntington Beach.
THE PUBLIC HEARING WAS OPENED.
Ron Pattinson, representing the applicant, questioned why additional
conditions were being added when the Tract had previously been
approved by the Planning Commission.

Scott Hess, Zoning Administrator, advised that no additional
conditions were being imposed and that staff was just reiterating
existing conditions of approval. He advised that the Tract was
approved in conjunction with an Administrative Review and those
conditions remain in effect.
There were no other persons present to speak for or against the
request and the public hearing was closed.
TENTATIVE TRACT MAP NO. 92-111 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The proposed eight (8) lot subdivision for purposes of
industrial use is in compliance with the size and shape of
property necessary for that type of development.
2. The General Plan has set forth provisions for industrial
development as well as setting forth objectives for
implementation of this type of use.
3. The property was previously studied for this intensity of land
use at the time the land use designation of General Industrial
M1-CD zoning, was implemented.
4. The size, depth, frontage, street width and other design and
improvement features of the proposed subdivision are proposed
to be constructed in compliance with standards plans and
specifications on file with the City as well as in compliance
with the State Map Act and supplemental City Subdivision
Ordinance.
5. Tentative Parcel Map No. 92-111 for an eight (8) lot
industrial subdivision is consistent with the goals and
policies of the Huntington Beach General Plan.
CONDITIONS OF APPROVAL:
1. The Tentative Parcel Map received by the Department of
Community Development on January 21, 1992 shall be the
approved layout.
2. The water system shall be installed per the Public Works
Department standards, ordinances and policies.
3. All utilities shall be installed underground at the time said
parcel(s) is/are developed.

4. All vehicular access rights along Gothard Street shall be
released and relinquished to the City of Huntington Beach
except at private street intersections as approved by the
Zoning Administrator.
5. A parcel map shall be filed with and approved by the
Departments of Public Works and Community Development and
recorded with the Orange County Recorder. A copy of the
recorded parcel map shall be filed with the Department of
Community Development.
ITEM 3 USE PERMIT NO 92 2/CONDITIONAL EXCEPTION NO 92-1
Applicant: Sandra King
Terronomics

Huntington Beach, CA 92648
Request: Use Permit No. 92-2: To permit a facade remodel on
existing commercial buildings pursuant to Section
9220.1 (b) of the Huntington Beach Ordinance Code.
Conditional Exception No. 92-1: A variance to allow
213 parking spaces in lieu of the required 220 spaces
for commercial building pursuant to Section 9602.2 of
the Huntington Beach Ordinance Code.
Location: 7672-7744 Edinger Avenue
Wayne Carvalho, Staff Planner, stated that the request was reviewed
by the Design Review Board who recommended approval with suggested
conditions. Staff said that further analysis indicated that 217
parking spaces would be required, not 220 as previously reported.
As required by the Edinger Corridor Project, a bus turnout at the
site would be required with dedication and improvements that it
would be the responsibility of the developer. Staff recommended
that an irrevocable offer for reciprocal access to the adjoining
commercial property and reduction in the number of drive aisles
along Edinger Avenue and Sher Lane be obtained. In addition, staff
recommended that all landscaping conform with the approved
Huntington Center Landscape Plant Palette, and that a six month
review be required for the loading dock to evaluate any noise
impacts. Staff concluded by recommending approval with findings and
suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Al Strand, representing the applicant, had several concerns with
staff's recommendation. He advised that the land along the corridor
is $30 per square foot resulting in the land requested for the bus
turn out to be $36,000. He was concerned that they had been working
with the City for over three years and had not been advised until
recently that OCTD funding was not available. He said the increased
costs may result in the abandonment of the project.

Mr. Strand, said that it is unfair to require reciprocal access to
other properties. He said the requirement to obtain two easements
may also result in the abandonment of the project.
Scott Hess, Zoning Administrator, advised that City policy requires
reciprocal access between parcels and that it improves access
between businesses for customers. He advised that the easement to
the south would not be required; however the easement to the north
would be required unless vehicular access to Edinger was precluded
from the commercial property located to the east.
In addition, Mr. Hess question the potential noise generated by the
trash compactor. Mr. Strand indicated that it would primarily be
used for the crushing of cardboard boxes. The Zoning Administrator
stated that a noise study would be required to measure the noise
levels as it conforms to the City's Municipal Code.
Mr. Hess also questioned the hours of operation of the proposed
Office Club and the hours of truck delivery. Mr. Strand indicated
that the majority of the deliveries would occur during store hours.
Mr. Hess stated that all truck deliveries would be required to take
place between 7 AM and 8 PM.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 92-2/CONDITIONAL EXCEPTION NO. 92-1 WAS APPROVED BY
THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS
OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN
BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN CALENDAR (10) DAYS.
1. The establishment, maintenance and operation to permit the
exterior facade remodel of a shopping center will not be
detrimental to:
a. The general welfare of persons residing or working in the
vicinity;
b. Property and improvements in the vicinity of such use or
building. The building and site improvements will enhance
the area and are consistent with the Redevelopment Plan.
2. The proposed exterior facade remodel of a shopping center is
consistent with the goals and objectives of the City's General
Plan and Land Use Map.

FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO, 92-1:
1. The granting of Conditional Exception No. 92-1 will not
constitute a grant of special privilege inconsistent upon other
properties in the vicinity and under an identical zone
classification.
2. The granting of Conditional Exception No. 92-1 for seven (7)
space parking variance is necessary to preserve the enjoyment
of one or more substantial property rights.
3. The granting of Conditional Exception No. 92-1 for seven (7)
space parking variance will not be materially detrimental to
the public welfare, or injurious to property in the same zone
classifications. The variance will allow for compact parking
spaces and for additional landscaping to be provided throughout
the parking lot.
4. The granting of Conditional Exception No. 92-1 for seven (7)
space parking variance will not adversely affect the General
Plan of the City of Huntington Beach.
5. The access to and parking for the proposed use does not create
an undue traffic problem. The reconfiguration of the existing
parking lot provides for better circulation on site and
reciprocal access with the adjacent commercial property.
CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
January 7, 1992 shall be the conceptually approved layout with
the following modifications:
a. The number of driveways along Sher Lane shall be reduced
from four to three. The driveway at the southwest corner
shall remain and the others shall be relocated to align
with the twenty-eight foot (281) wide drive aisles leading
to the front of the buildings.
b. Indicate the location of the reciprocal driveway easement
with the commercial property along the eastern property
line.
c. Indicate the location of the proposed bus turnout along
Edinger Avenue.
d. Indicate forty-five (45) degree angled parking along the
north side of the furniture building and sixty (60) degree
angled parking to the east of the furniture building.
e. Delete the designated parking along the eastern property
line to the rear of the dentist office.

f. Indicate six (6) parallel parking spaces along the south
property line as depicted on the approved plan.
g. Indicate the additional landscaping pockets throughout the
parking lot and rear driveway as depicted on the approved
plan.
2 The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. Prior to issuance of building permits, the following plans and
items shall be submitted and/or completed by the applicant:
a. The property owner shall dedicate property as required by
the Public Works Department for purposes of a bus turnout
lane along Edinger Avenue. Bus turnout improvements shall
be required per Public Works standards but may be postponed
until the Edinger Corridor Project is implemented. If
improvements are postponed, the property owner shall post a
bond/or cash deposit in an amount determined by the Public
Works Department.
b. The property owner shall submit a grading plan for review
and approval by the Public Works Department.
c. The property owner shall enter into an irrevocable
vehicular access agreement, or irrevocable offer to
dedicate such an agreement, between the subject site and
adjacent easterly commercial property. A copy of the legal
instrument shall be approved by the City Attorney as to
form and content and, when approved, shall be recorded in
the Office of the County Recorder. A copy shall be filed
with the Department of Community Development prior to
occupancy. It may include a caveat.allowing for recindment
by the property owner should this vehicular access point
become the only vehicular access way to the adjacent site
from Edinger Ave.
d. Submit a noise report for review and approval of the trash
compactor to assure the type and design will comply with
the City's noise ordinance.
e. Four (4) sets of landscape and irrigation plans to the
Department of Community Development and Public Works for
review and approval. The plans shall include an interim
landscape plan for the bus turnout area to be installed
until the time the turnout area is improved.

f. A -Landscape Construction Set submitted to the Departments
of Community Development and Public Works. The landscape
construction set shall include a landscape plan prepared
and signed by a State Licensed Landscape Architect which
includes all proposed/existing plant materials (location,
type, size, quantity), irrigation plan, grading plan and
approved site plan, and copy of conditions of approval.
The landscape plan shall be in conformance with the
approved Huntington Center Redevelopment Project Area
landscape plant palette and Section 9608 of the Huntington
Beach Ordinance Code . The set must be complete and
approved by both departments prior to issuance of building
permits.
g. Conditions of approval shall be printed verbatim on all
working drawings submitted for plancheck.
h. Rooftop Mechanical Equipment Plan. Said plan shall
indicate screening of all rooftop mechanical equipment and
shall delineate the type of material proposed to screen
said equipment.
i. All applicable Public Works fees shall be paid.
6. Installation of required landscaping and irrigation systems
shall be completed within six (6) months.
7. A planned sign program shall be submitted and approved for all
wall and freestanding signs within the center. Said program
shall be approved prior to installation of any new sign.
B. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
9. All new lighting in the parking lot shall be high-pressure
sodium vapor lamps for energy savings. All outside lighting
shall be directed to prevent "spillage" onto adjacent
properties.
10. A review of the loading area use shall be conducted within six
(6) months from operation to verify compliance with the City's
noise standards. If, at that time, there are any complaints
filed with the City, the Zoning Administrator may schedule
another hearing to review the use of the loading area, and if
necessary, impose additional conditions on the applicant.
11. The Zoning Administrator reserves the right to revoke Use
Permit No. 92-1 and Conditional Exception No. 92-1 if any
violation of these conditions of the Huntington Beach Ordinance
Code occurs.

INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department
except as approved herein.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
