Area 2 - North of Clay Avenue east of Holly
Street.
On October 8, 1991, the Planning Commission instructed staff to
initiate General Plan Amendment No. 91-5 and Code Amendment
No. 91-12 to address concerns raised by property owners within the
Holly-Seacliff Master Plan area. The Amendment does not consist of
any development at this time but represents a Land Use Designation
change to two (2) areas of the Holly-Seacliff, Master Plan and
General Plan. The amended sites will still be subject to the
conditions, regulations and development standards of the
Holly-Seacliff Specific Plan.
The first area affected by this amendment is located north of Clay
Avenue between Stewart and Crystal Streets (Area 1). The amendment
will change the General Plan Designation on nine (9) gross acres of
real property from Medium Density Residential to Industrial. The
Industrial General Plan Designation will allow existing industrial
uses, which are nonconforming uses under the present land use
designation, to continue as legal uses. The industrial designation
will remain compatible with existing and proposed industrial uses to
the north. The industrial designation will prevent the development
of 85 dwelling units proposed on the site, but the loss will be
partially offset by the changes in Area 2.
The amendment to the second area, located north of Clay Avenue and
east of Main Street (Area 2), is a request to increase the
residential density on approximately eight (8) gross acres of real
property from 8.8 dwelling units per acre to 15 dwelling units per
acre. This density increase will allow for development of an
additional 50 units within Area 2.
The amendment creates no significant environmental impacts as
identified in Negative Declaration No. 91-42. The main issues
raised by the proposal are the effects of a net loss of 35 dwelling
units within the Holly-Seacliff Specific Plan, increased traffic
levels at the intersection of Main and Garfield, compatibility of
land uses and the retention of industrial uses.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission:
A. Approve Negative Declaration No. 91-42 with mitigation measures;
and

The amended condition would read as follows:
6. "The rear entrance/exit shall be for emergency use only and
shall be kept closed during business hours. A sign shall be
posted on the front door informing customers to enter and
exit through the front door on Talbert Avenue."
All other required conditions of approval including a joint use of
parking agreement recorded at the County and the removal of an
illegal pole sign have been complied with. An existing roof -top
sign has been replaced and approved by the Director of Planning as
required.
Planning staff is recommending approval of the six (6) month review
as no complaints have been received through either Code Enforcement
or the Police Department. Staff suggests that the use be monitored
for a further six (6) months for compliance with the sign code
regarding window signage.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve the six (6)
month review and schedule a second review in six (6) months to
determine compliance with code requirements regarding window signage.
The Commission discussed the door condition and hours of operation.
Gary S. Melzer, applicant, explained to the Commission that he could
not lock the doors due to fire codes.
A MOTION WAS MADE BY RICHARDSON, SECOND BY NEWMAN, TO APPROVE
CONDITIONAL USE PERMIT NO. 91-14 SIX (6) MONTH REVIEW WITH A
SUGGESTED CONDITION OF APPROVAL TO REQUIRE A SECOND REVIEW IN SIX
(6) MONTHS, BY THE FOLLOWING VOTE:
