ACTING ZONING ADMINISTRATOR: STAFF MEMBERS: MINUTES: Room B-6 - Civic Center 2000 Main Street Huntington Beach, California Michael Strange Wayne Carvalho The Minutes of the April 1, 1992 Zoning Administrator Meeting was approved. REGULAR AGENDA ITEMS: ITEM 1• ADMINISTRATIVE REVIEW NO, 92-1 Applicant: Marty Olson, MDSSC 5301 Bolsa Avenue Huntington Beach, CA 92647 Request: To permit a 7,000 sq. ft. addition to an existing aerospace industrial building pursuant to Section 9510.01 of the Huntington Beach Ordinance Code. Location: 5301 Bolsa Avenue Wayne Carvalho, Staff Planner, reported that the applicant had requested that a continuance be granted due to a significant modification to the site plan. Staff concluded by recommending a continuance to a date uncertain. ADMINISTRATIVE REVIEW NO. 92-1 WAS CONTINUED BY THE ZONING ADMINISTRATOR TO A DATE UNCERTAIN. ITEM 2• ADMINISTRATIVE REVIEW NO. 92-2 Applicant: Richard Walker 7501 Slater Avenue, Suite Q Huntington Beach, CA 92648 Request: To establish an automobile restoration and refinishing business (major auto repair) within an existing industrial complex pursuant to Section 9530.01 of the Huntington Beach Ordinance Code. Location: 7501 Slater Avenue, Suite Q Wayne Carvalho, Staff Planner, reported that the request is classified as major auto repair according to the M-1 district standards; however, the actual use is to restore very old automobiles. Staff indicated that the request was not an auto repair business, and that the expected length of time to restore one automobile is approximately three months. There would be no outdoor storage of automobiles or parts. Staff concluded by recommending approval with findings and conditions of approval. Richard Walker, the applicant, was present and concurred with.the conditions of approval. ADMINISTRATIVE REVIEW NO. 92-2 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated March 6, 1992 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an 'amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 4. All repair work shall be conducted wholly within the building. 5. Conditions of approval shall be printed verbatim on the cover sheet of all sets of working drawings submitted for plancheck. 6. Fire Department requirements: a. Fire access lanes shall be maintained. Flammable combustible liquids shall not exceed quantities of UBC Table 9A. c. Storage of flammable combustible liquids shall comply with Huntington Beach Fire Code Article 79. d. A spray booth shall be required for all painting and refinishing. A Building Permit shall be obtained for the spray booth. e. Fire extinguishers shall be provided in number and at locations specified by the Fire Department. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke Administrative Review No. 92-2 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 3: USE PERMIT NO, 92-13 Applicant: Phyllis Lembke 18631 Chapel Lane Huntington Beach, CA 92646 Request: To permit the interim use of four (4) modular units for preschool and Sunday school classrooms during the construction phase of new school facilities pursuant to Section 9730.28 of the Huntington Beach Ordinance Code. Location: 18631 Chapel Lane Wayne Carvalho, Staff Planner, reported that the request was for the interim use of modular classrooms during construction of permanent school facilities. If approved, the Use Permit would allow the use for up to one year. Staff recommended that if the use was going to exceed the one year time limit, that the applicant file for an extension a minimum of forty-five (45) days prior to the expiration of Use Permit No. 92-13. Staff concluded by recommending approval with findings and conditions of approval. ZA Minutes - 4/8/92 -3- (3023d) THE PUBLIC HEARING WAS OPENED. The applicant, Mrs. Lembke, advised that because of conflicts with utility lines, there were changes to the site plan. The new request was for three modular 12' x 60' units instead of four 12' x 42' units. The revised site plan was submitted. There were no other persons present to speak for or against the request and the public hearing was closed. Mike Strange, Zoning Administrator, asked staff for a recommendation. Wayne Carvalho, Staff Planner, recommended approval with findings and conditions noting that the revised request was less intense than the original request and that required setbacks would be maintained. USE PERMIT NO. 92-13 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH REVISED PLANS AND THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of four (4) modular units will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The modular units will provide temporary classrooms during the construction phase of permanent facilities. b. Property and improvements in the vicinity of such use or building. The modular units are temporary and will be situated toward the rear of the property. Furthermore, required setbacks will be maintained to reduce impacts on adjacent properties. 2. The granting of Use Permit No. 92-13 will not adversely affect the General Plan of the City of Huntington Beach. The church/preschool use is consistent with the goals and objectives of the City's General Plan and Land Use Map. 3. The location and site layout of the proposed modular units properly adapt the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. 1. The Use Permit shall be limited to one year and shall expire on April 8, 1993. An extension may be granted for an additional year upon written request. The written request shall be received by the Department of Community Development at least forty-five (45) days prior to expiration of Use Permit No. 92-13. 3. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 6. Low -volume heads shall be used on all spigots and water faucets. 7. All applicable Public Works fees shall be paid prior to issuance of building permits. 8. Conditions of approval shall be printed verbatim on the coversheet of all sets of working drawings submitted for plancheck. 9. Prior to issuance of a building permit, the applicant shall post a five hundred dollar ($500) cash bond with the Department of Community Development to guarantee removal of the temporary structures.
