were approved and the Minutes of
April 8, 1992 were continued.
REGULAR AGENDA ITEMS:
ITEM 1• ADMINISTRATIVE REVIEW NO, 92-4
Applicant: Jun Macaraig, Merit Construction
13437 Leffingwell Road
Whittier, CA 90605
Request: To demolish an existing 2,400 square foot Cheveron
office building and construct a new 3,200 sq. ft.
industrial office building pursuant to Section
9530.01(A) of the Huntington Beach Ordinance Code.
Location: 17881 Gothard Street
Wayne Carvalho, Staff Planner, reported that the request was heard by
the Design Review Board who recommended approval with an added
condition that the proposed stucco treatment be required on all
sides. Staff concluded by recommending approval with conditions of
approval.
Greg Smith, representing the applicant, was present and explained
that the existing structure was over fifty years old and was not
adequate for their operation.
ADMINISTRATIVE REVIEW NO. 92-4 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
March 16, 1992 shall be the conceptually approved layout.
a. The exterior building elevations shall be revised to reflect
stucco treatment on all building exterior walls as
recommended by the Design Review Board.
2. Prior to issuance of building permits, the applicant shall:
a. Submit a grading plan for review and approval by the
Department of Public Works.
b. All applicable Public Works fees shall be paid.
c. Submit a copy of revised elevations to the Community
Development Department for the file.
3. Conditions of approval shall be printed verbatim on the cover
sheet of all sets of working drawings submitted for plancheck.
4. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to require
that an amendment to the original entitlement be processed if
the proposed changes are of a substantial nature.
5. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
6. All proposed fencing requires separate building permits.
7. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.

4. Prior to occupancy the applicant shall restripe the parking lot
so that it conforms to provisions of Article 960 of the
Huntington Beach Ordinance Code.
5. The Zoning Administrator reserves the right to revoke
Adminstrative Review No. 92-4 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
ITEM 2• COASTAL DEVELOPMENT PERMIT NO, 92-12
Applicant: City of Huntington Beach
2000 Main Street
Huntington Beach, CA 92648
Request: Widen Goldenwest Street at location described below to
provide three northbound and southbound traffic lanes,
bike lanes, left turn pockets and railed medians
pursuant to Section 989.5.2 of the Huntington Beach
Ordinance Code.
Location: Segment of Goldenwest Street within the Coastal Zone
between Pacific Coast Highway and approximately 200 feet
north of Palm Avenue.
Wayne Carvalho, Staff Planner, reported that a coastal development
permit and negative declaration was approved for the Goldenwest
widening project from Pacific Coast Highway to Warner Avenue.
Because the project never proceeded within the required one year
period, the applicant is required to obtain a new coastal
development permit; a new environment assessment is not required.
Staff recommended approval with the same mitigation measures as
approved in 1988 by the Planning Commission.
THE PUBLIC HEARING WAS OPENED.
Eric Charlonne, Public Works Department, was present to respond to
questions.
There were no other persons present to speak for or against the
request and the public hearing was closed.
COASTAL DEVELOPMENT PERMIT NO. 92-12 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL
COMMISSION.
FINDINGS FOR APPROVAL/COASTAL DEVELOPMENT PERMIT NO, 92-12:
1. The proposal is consistent with the goals and objectives of the
City's General Plan and Circulation Element.

2. The proposal is consistent with the Huntington Beach Coastal
Element and with Chapter 3 of the California Coastal Act by
providing a major and primary arterial highway for beach and
public recreation acessibility.
3. The Goldenwest Street Improvement and Widening project as
proposed by Coastal Development Permit No. 92-12 conforms with
the plans, policies, requirements and standards of the
Huntington Beach Coastal Element.
4. Coastal Development Permit No. 92-12 is consistent with the CZ
suffix and with the various zoning designations along the
one-half mile segment of Goldenwest Street.
5. Coastal Development Permit No. 92-12, at the time of
completion, will provide infrastructure in a manner that is
consistent with C-LUP by providing a fully improved major and
primary arterial highway.
CONDITIONS OF APPROVAL:
1. The street improvement plans received and dated April 1, 1992
shall be the conceptually approved layout.
2. All previous conditions of approval for Coastal Development
Permit No. 88-29 applicable to this segment of Goldenwest
Street shall apply.
3. The Zoning Administrator reserves the right to revoke Coastal
Development Permit No. 92-12 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
ITEM 3: COASTAL DEVELOPMENT PERMIT NO. 92-15/USE PERMIT NO. 92-18
CONDITIONAL EXCEPTION NO. 92-11
Applicant: Mark R. Kelly
On the Go Expresso

Request: To permit the expansion of an existing 125 sq. ft.
kiosk to 375 sq. ft. by utilizing one additional
parking space. The request includes a one (1) space
variance to the required number of parking spaces as
the center was previously granted a parking variance
for 21 spaces pursuant to Sections 9220.1(c)R, 9602.2
and 989.5.3.14(e) of the Huntington Beach Ordinance
Code.

Wayne Carvalho, Staff Planner, reported that the business operating
hours is from 5:00 AM to 12:00 noon. Staff advised that a previous
parking variance approved for the center was for businesses
operating between the hours of 12:00 noon and 5:30 PM. Staff
recommended that the floor plan be amended by moving the entrance
door to the opposite side facing away from Pacific Coast Highway for
aesthetic purposes. Staff concluded by recommending approval with
findings and conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Mark Kelly, applicant, advised that the request was the result of
Health Department requirements for a storage area and a handicapped
restroom. He submitted pictures taken at various times of the
morning which showed that the center's parking lot was basically
vacant during the morning hours.
There were no other persons present to speak for or against the
request and the public hearing was closed.
COASTAL DEVELOPMENT PERMIT NO. 92-15/USE PERMIT NO.
92-18/CONDITIONAL EXCEPTION NO. 92-11 WERE APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO, 92-18:
1. The establishment, maintenance and operation of the expanded
coffee/expresso business will not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity. The expresso business will operate
during morning hours when the majority of businesses
will be closed.
b. Property and improvements in the vicinity of such use
or building. The removal of one parking space will not
adversely impact on -site circulation.
2. The granting of Use Permit No. 92-18 will not adversely affect
the General Plan of the City of Huntington Beach as the
expresso business is consistent with the General Commercial
Land Use Designation in the General Plan.
FINDINGS FOR APPROVAL -COASTAL DEVELOPMENT PERMIT NO, 92-15:
1. The request to permit the expansion of an existing 125 square
foot kiosk conforms with the plans, policies, requirements and
standards of The Coastal Element of the General Plan. The
proposed expansion will not adversly impact existing views or
public access.

2. Coastal Development Permit No. 92-15 is consistent with the CZ
suffix zoning requirements, the C4 Zoning District, as well as
other provisions of the Huntington Beach Ordinance Code
applicable to the property. The proposed expansion conforms
with all applicable City codes except for variances granted for
required parking spaces.
3. At the time of occupancy, the proposed expansion will be
provided with infrastructure in a manner that is consistent
with the Coastal Element of the General Plan. All required
infrastructure currently exists to the site.
4. The proposed expansion conforms with the public access and
public recreation policies of Chapter 3 of the California
Coastal Act.
FINDINGS FOR APPROVAL -CONDITIONAL EXCEPTION NO, 92-11:
1. The granting of Conditional Exception No. 92-11 for a one
space parking variance will not constitute a special privilege
inconsistent upon other properties in the vicinity and under an
identical zone classification.
2. Because of special circumstances applicable to the subject
property, including shape, location or surroundings, the strict
application of the Zoning Ordinance is found to deprive the
subject property of privileges enjoyed by other properties in
the vicinity and under identical zone classifications. The
expansion of the existing kiosk is necessary to comply with the
Orange County Health Department requirements in providing
employee restrooms and dry storage facilities.
3. The granting of Conditional Exception No. 92-11 for a one space
parking variance is necessary in order to preserve the
enjoyment of one or more substantial property rights.
Conditional Exception No. 92-11 will allow for a drive-thru
expresso use to expand to meet Health Department requirements.
4. The granting of Conditional Exception No. 92-11 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications as determined with
approval of Conditional Exception 89-3 for a 21 space parking
variance. Furthermore, there was no written or verbal
opposition to the request presented.
5. The granting of Conditional Exception No. 92-11 will not
adversely affect the General Plan of the City of Huntington
Beach as the drive-thru business is consistent with the General
Commercial Land Use Designation in the General Plan.

SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
March 11, 1992 shall be the conceptually approved layout with
the following modifications:
a. Roof material shall be compatible with shopping center
and gas station (i.e. mission tile).
b. The entry door facing Pacific Coast Highway shall be
located to the east side (facing shopping center).
2. Revised elevations pursuant to Condition No. 1 shall be subject
to staff approval; and a copy of the approved revisions shall
be submitted to Community Development Department for the file.
3. Hours of operation shall be limited to 5:00 a.m. - 12 noon,
Monday thru Sunday.
4. No outdoor seating shall be permitted.
5. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
6. If lighting is included in the parking lot, high-pressure
sodium vapor lamps shall be used for energy savings. All
outside lighting shall be directed to prevent "spillage" onto
adjacent properties.
7. Prior to issuance of building permits, landscape and irrigation
plans shall be submitted for review and approval by Department
of Community Development and Public Works.
8. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
9. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
10. Low -volume heads shall be used on all spigots and water faucets.
11. Conditions of approval shall be printed verbatim on the cover
sheet of all sets of working drawings submitted for plancheck.
