Request: To permit a temporary outdoor event for an annual
carnival and pancake breakfast on July 4, 1992 pursuant
to Section 9730.64 of the Huntington Beach Ordinance
Code.
Location: 2111 Main Street (Seacliff Village Parking Lot)
Wayne Carvalho, Staff Planner, reported that other City Departments
had reviewed the request and no comments were received. Staff
recommended approval with the same conditions as the previous years
event.
There was no one present to speak on the item.
USE PERMIT NO. 92-20 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO
CALENDAR (2) DAYS.
FINDINGS FOR APPROVAL:
1. The temporary outdoor event will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity. The event will occur on the Fourth of July
(Holiday) and will allow for normal business on July 5,
1992.
b. Property and improvements in the vicinity of such use or
building. The event is a temporary use.
2. The granting of Use Permit No. 92-20 will not adversely affect
the General Plan of the City of Huntington Beach. The pancake
sale/carnival is consistent with the Commercial Land Use
Designation of the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated April 1, 1992 shall be the
conceptually approved layout.
2. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
3. Fire access lanes shall be a minimum with of (20) twenty feet.
4. A detailed site plan shall be submitted to the Huntington Beach
Fire Department for approval (show table locations, tents,
barriers, etc.).
5. The applicant shall obtain all necessary Fire Department
permits and comply with all provisions of Article 32 of the
Uniform Fire Code.
6. The applicant's request shall include necessary permits for
balloons and temporary signs.
7. All parking shall be a minimum of forty (40) feet from the
proposed tent.
8. The proposed tent shall be of fire retardant material. Proof
of Certification shall be submitted to the Fire Department for
approval prior to the tent's installation on the site.
9. The proposed tent shall be secured against collapsing to the
satisfaction of the Fire Department.
10. "No Smoking" signs shall be posted in conspicuous locations.
11. Fire extinguishers shall be provided in number and locations
specified by the Fire Department.

12. Stand by personnel shall be on site to safeguard premises.
INFORMATION OF SPECIFIC CODE REQUIREMENTS:
1. The event shall comply with all applicable provisions of the
Ordinance Codes, Building Division and Fire Department.
2. The applicant shall meet all applicable local, State and
Federal Fire Codes, Ordinances and standards.
3. The Zoning Administrator reserves the right to revoke Use
Permit No. 92-20 if any violations of these conditions or the
Huntington Beach Ordinance Code occurs.
4. The applicant shall submit all future temporary outdoor event
applications a minimum of thirty (30) days prior to the event.
Failure to provide adequate notice may result in denial of the
request.
ITEM 2• USE PERMIT NO, 92-19
Applicant: Gary Bassett
415 Canal Street
Newport Beach, CA 92663
Request: To permit the modification of an existing detached
non -conforming (10' front setback in lieu of 15'),
entry structure to a Single Family Residence by
changing the roof style (flat to gable) and adding
twelve (12) square feet of building area pursuant to
Section 9652(c) of the Huntington Beach Ordinance Code.
Location: 16531 Channel Lane
Wayne Carvalho, Staff Planner, reported that the request is to
modify an existing entry structure to provide a gable roof
architecture compatible with the main dwelling, and to add twelve
square feet to the entry structure. Staff indicated that the twelve
foot addition will provide added storage space and will not be
visible from the public right-of-way. Staff concluded by
recommending approval with findings and conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Gary Bassett, the applicant, was present and concurred with the
conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.

USE PERMIT NO. 92-19 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL - USE PERMIT NO, 92-19:
1. The establishment, maintenance and operation of the proposed
front entry structure will not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity. The proposed roof modification on the
entry structure will not encroach any further into
required setbacks.
b. Property and improvements in the vicinity of such use
or building. The proposed twelve (12) square foot
addition to the existing entry structure will not
encroach into required open space and will not be seen
from the public right-of-way.
2. The granting of Use Permit No. 92-19 will not adversely affect
the General Plan of the City of Huntington Beach. The proposed
entry modification to an existing single family residence is
consistent with the Low Density Residential Land Use
Designation of the General Plan.
CONDITIONS OF APPROVAL - USE PERMIT NO, 92-19:
1. The site plan, floor plans, and elevations received and dated
March 24, 1992 shall be the conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
4. Proposed structures shall be architecturally compatible with
existing structures.
5. Conditions of approval shall be printed verbatim on the cover
sheet of all sets of working drawings submitted for plancheck.

ITEM 3• USE PERMIT NO 92-16/CONDITIONAL EXCEPTION NO, 92-10
Applicant: Uluc Ali Davasligil

Westminster, CA 92683
Request: Use Permit: To allow a 674 square foot addition to an
existing single family residence with non -conforming
setbacks pursuant to Section 9652(c) of the Huntington
Beach Ordinance Code.
Conditional Exception: To allow a variance for reduced
open space at 561 square feet in lieu of the required
600 square feet pursuant to Section 9130.9 of the
Huntington Beach Ordinance Code.
Location: 1810 Lake Street
Wayne Carvalho, Staff Planner, reported the request is for a second
story room addition over an existing garage off the alley. Staff
indicated that the approved Tract included a three foot (3')
maintenance easement on each lot. The easement is landscaped and
can be used by the adjacent property owner. Staff concluded by
recommended approval with findings and conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Mr. Davasligil, the architect, said that all lots in the subdivision
were developed with a zero lot line concept. There are no windows
on one side of the homes and each home utilizes three feet of the
adjacent owner's property.
Gisela Belim, 1812 Lake Street, stated concern that the addition
would take away the sunlight from their back yard.

There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 92-16/CONDITIONAL EXCEPTION NO. 92-10 WERE APPROVED
BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND
CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE
ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE
PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL - USE PERMIT NO, 92-16:

the vicinity. The addition will not encroach any
further into the sideyard setback than the existing
structure.
b. Property and improvements in the vicinity of such use
or building.
2. The granting of Use Permit No. 92-16 will not adversely affect
the General Plan of the City of Huntington Beach. The single
family room addition is consistent with the Medium -Density land
use designation and Oldtown Specific Plan zoning.
FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO, 92-10:
1. The granting of Conditional Exception No. 92-10 for a 674
square foot room addition will not constitute a grant in
special privilege inconsistent upon properties in the vicinity
and under identical zone classification. With the conditions
imposed, the property meets the 600 square foot open space
requirement as the tract conforms with the intent of zero lot
line development.
2. Because of special circumstances applicable to the subject
property, the strict application of the Zoning Ordinance is
found to deprive the subject property of privileges enjoyed by
other properties in the vicinity and under identical zone
classifications. With the conditions imposed, the usable open
space area will include a three foot (3') easement on the
adjacent property.
3. The granting of Conditional Exception No. 91-10 for the 674
square foot room addition is necessary in order to preserve the
enjoyment of one or more substantial property rights as it will
allow for a two bedroom, one bath room addition on the second
floor.

4. The granting of Conditional Exception No. 92-10 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications. The addition will
not encroach into any required setbacks. Furthermore, there
were no persons in opposition to the project.
5. The granting of Conditional Exception No. 92-10 will not
adversely affect the General Plan of the City of Huntington
Beach. Granting Conditional Exception No. 92-10 for
calculating open space within an adjacent easement will not
reduce the required total open space (600 square feet).
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
April 1, 1992 shall be the conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. All building spoils, such as unusable lumber, wire, pipe, and

4. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
5. Low -volume heads shall be used on all spigots and water faucets.
6. All windows on the north elevation shall be obscure and shall
conform with the Uniform Building Code.
7. Conditions of approval shall be printed verbatim on the cover
sheet of all sets of working drawings submitted for plancheck.
