ZONING ADMINISTRATOR: Scott Hess STAFF MEMBERS: Wayne Carvalho MINUTES: The Minutes of the April 29, 1992 Zoning Administrator Meeting were approved. ITEM 1• USE PERMIT NO, 92-24: Applicant: Lucky Store 9051 Atlanta Ave. Huntington Beach, CA 92646 Request: To permit a Temporary Outdoor Event for a Parking lot/Sidewalk Sale on May 15-17, 1992 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 9051 Atlanta Avenue Wayne Carvalho, Staff Planner, reported that the outdoor event will include pallets of merchandise and a cash register within the parking lot area. He said that the request had been reviewed by the Departments of Public Works and Fire. Staff concluded by recommending approval with the standard findings and conditions of approval. Peter Murtough, representing the applicant, presented a detailed site plan. USE PERMIT NO. 92-24 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The event will not obstruct on -site circulation or access to existing businesses. b. Property and improvements in the vicinity of such use or building. The event is a temporary use for three (3) days. 2. The granting of Use Permit No. 92-24 will not adversely affect the General Plan of the City of Huntington Beach. The temporary sidewalk/parking lot sale is consistent with the General Commercial Land Use Designation in the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated April 17, 1992 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. Fire access lanes shall be a minimum width of (20) twenty feet. 4. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show table and pallet locations, tents, barriers, etc.). 5. The applicant's request shall include necessary permits for balloons and temporary signs. 6. Stand by personnel shall be on site to safeguard premises. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 92-23 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of thirty (30) days prior to the event. Failure to provide adequate notice shall result in denial of the request. ZA Minutes - 5/6/92 -2- (3358d) ITEM 2: USE PERMIT NO, 92-23 Applicant: Lucky Store #524 19640 Beach Blvd. Huntington Beach, CA 92648 Request: To permit a Temporary Outdoor Event for a Parking lot/Sidewalk Sale on May 15-17, 1992 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 19640 Beach Blvd. Wayne Carvalho, Staff Planner, reported that the outdoor event will include pallets of merchandise and a cash register within the parking lot and sidewalk area. He said that the request had been reviewed by the Departments of Public Works and Fire. Staff concluded by recommending approval with the standard findings and conditions of approval. Keith Weiss, representing the applicant, was present. He advised that the outdoor sales would be held on Friday and Saturday only. USE PERMIT NO. 92-23 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. ITEM 3: USE PERMIT NO, 92-22 Applicant: Thirtieth Street Architects, Inc. 2821 Newport Blvd. Newport Beach, CA 92663 Request: To permit a ten (10) space temporary parking lot at the subject address pursuant to Section 9730.52 of the Huntington'Beach Ordinance Code. Location: 17131 Beach Blvd. Wayne Carvalho, Staff Planner, reported that a use permit was approved in 1990 for an expansion to an existing commercial building. In order to occupy the third floor, the applicant is required to obtain approval for the additional parking. The site layout had been reviewed by all applicable City departments. Staff concluded by recommending approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Phil Zisakis, representing the applicant, was present. He concurred with staff's report. There were no other persons present to speak for or against the I request and the public hearing was closed. ZA Minutes - 5/6/92 -4- (3358d) USE PERMIT NO. 92-22 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN'BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the temporary parking lot for 10 spaces in order to occupy a third level office portion of the building will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. Access to the temporary parking lot will be provided through the existing parking lot. b. Property and improvements in the vicinity of such use. Additional landscaping will be provided along Cypress Avenue during the interim use. The relationship of one proposed use to another on site are properly integrated. 2. The granting of Use Permit No. 92-22 will not adversely affect the General Plan of the City of Huntington Beach. The proposed temporary parking lot is consistent with the Commercial and Medium Density Residential Land Use Designations of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated April 13, 1992 shall be the conceptually approved layout. 2 The Zoning Administrator shall be notified in writing if any changes to the site plan are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Prior to issuance of building permits, the applicant shall: a. Submit a landscape and irrigation plan to the Department of Community Development for review and approval. The landscape plan shall be in conformance with Sections 9608 and 9730.52 of the Huntington Beach Ordinance Code. b. Submit a grading plan for review and approval by the Public Works and Community Development Departments. ZA Minutes - 5/6/92 -5- (3358d) c. Pay all applicable Public Works fees. d. Submit a covenant assuring the use of the 10-space parking lot for the duration of the office use on the third floor. The covenant shall be reviewed and approved as to form by the City Attorney's office and recorded with the County Recorder. A copy of the recorded document shall be submitted to the Department of Community Development. 4. Paving shall comply with Public Works Department requirements. 5. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 6. Conditions of approval shall be printed verbatim on the cover sheet of all working drawings submitted for plancheck. 7. All Conditions of Approval for Use Permit No. 90-24 still apply. 8. Use Permit No. 92-22 shall expire on May 6, 1997. If an extension is requested, it shall be filed with the Department of Community Development a minimum of 90 days prior to the expiration date. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke Use Permit No. 92-22 if any violation of these conditions or the Huntington Beach Ordinance Code occurs.
