PUBLIC HEARING ITEMS B-1 CONDITIONAL USE PERMIT NO. 92-5 (CONTINUED FROM THE MAY 19, 1992 PLANNING COMMISSION MEETING): APPLICANT: Richard Russell/System Autowash LOCATION; 17042 Beach Boulevard Conditional Use Permit No. 92-5 is a request for a 910 square foot addition to an existing carwash and to construct a 360 square foot car rental office building pursuant to Section 9652, 9220.1 and 9220.4 of the Huntington Beach Ordinance Code. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No. 92-5 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Ric Russell, 17042 Beach Boulevard, applicant, stated his concern regarding a condition requiring the dedication of land. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Commission discussed whether the dedication of the land creates an unbuildable lot. The majority of the Commission felt that the dedication of land condition should be waived. A MOTION WAS MADE BY NEWMAN, SECOND BY BOURGUIGNON, TO APPROVE CONDITIONAL USE PERMIT NO. 92-5 WITH FINDINGS AND MODIFIED CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Inglee, Bourguignon, Richardson, Shomaker, Dettloff, Newman NOES: None ABSENT: Leipzig ABSTAIN: None MOTION PASSED FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 92-5: 1. The proposed carwash addition and car rental building will be compatible with adjacent properties because the expansion is only 10% of the existing structures and will not significally intensify onsite uses. The establishment, maintenance and operation of the expanded carwash and car rental building will not be detrimental to the general welfare of persons working or residing in the vicinity, or detrimental to the value of the property and improvements in the neighborhood. 3. On -site parking and circulation are adequate for the proposed car rental building and carwash expansion. 4. Ingress and egress to the site will not create additional traffic impacts to the intersection along Beach Boulevard and Warner Avenue. 5. The granting of Conditional Use Permit No. 92-5 for a carwash expansion and car rental building will not adversely affect the General Plan of the City of Huntington Beach. 6. The location, site layout, and design of the proposed carwash addition and car rental building is properly adapted to the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 92-5: 1. The site plan, floor plans and elevations received and dated May 11, 1992 shall be the conceptually approved layout. 2. Prior to submittal for building permits, the applicant/owner shall complete the following: a. Elevations shall depict colors and building materials proposed. b. All new rooftop mechanical equipment shall be screened from any view. Said screening shall be architecturally compatible with the building in terms of materials and colors. If screening is not designed specifically into the building, a rooftop mechanical equipment plan must be submitted showing screening and must be approved. c. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. 3. Prior to issuance of building permits, the applicant/owner shall complete the following: a. A Landscape Construction Set must be submitted to the Departments of Community Development and Public Works and must be approved. The Landscape Construction Set shall include a landscape plan prepared and signed by a State licensed Landscape Architect and which includes all proposed/existing plant materials (location, type, size, PC Minutes - 6/3/92 -3- (4162d) quantity), an irrigation plan, a grading plan, an approved site plan, and a copy of the entitlement conditions of approval. The landscape plans shall be in conformance with Section 9608 of the Huntington Beach Ordinance Code. The set -must be approved by both departments prior to issuance of building permits. Any existing mature trees that must be removed shall be replaced at a 2 to 1 ratio with minimum 36-inch box trees, which shall be incorporated into the project's landscape plan. b. All applicable Public Works fees shall be paid. c. A planned sign program shall be submitted and approved by the Planning Commission for all signing. The planned sign program must receive Design Review Board approval. Said program shall be approved prior to the first sign request. d. All major identification signs shall be removed or altered to comply with the approved sign program. 4. The Public Works Department requirements are as follows: a. Prior to issuance of building permits, the property owner shall enter into an agreement with the City whereby the future value of portions of the subject property, which may be acquired by the City for street purposes, shall not be increased as a result of improvements constructed under this conditional use permit. The agreement shall be notarized. 5. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 7. Installation of required landscaping and irrigation systems shall be completed prior to final inspection/within twelve (12) months. 8. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 9. During construction, the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site; b. Wet down areas in the late morning and after work is completed for the day; PC Minutes - 6/3/92 -4- (4162d) c. Use low sulfur fuel (.05% by'weight) for construction equipment; d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. 10. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 11. Prior to issuance of a Certificate of Occupancy, the following shall be completed: a. All signs shall be brought into compliance with the Huntington Beach Ordinance Code. (Article 961) b. All improvements (including landscaping) to the property shall be completed in accordance with the approved plans and conditions of approval specified herein. c. Compliance with all conditions of approval specified herein shall be accomplished. 12. The Planning Commission reserves the right to revoke this Conditional Use Permit No. 92-5 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 13. This conditional use permit shall not become effective for any purpose until an "Acceptance of Conditions" form has been properly executed by the applicant and an authorized representative of the owner of the property, recorded with County Recorder's Office, and returned to the Planning Division; and until the ten day appeal period has elapsed. 14. Conditional Use Permit No. 92-5 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. 15. Approval of the car rental office building and car rental operations shall be for a period of five (5) years from issuance of a certificate of occupancy. Extension of the car rental operations shall be contingent upon review and approval by the Planning Commission with a finding that consolidation of the lot with other properties to the east is not imminent. Thomson, Actec Engineering Corporation LOCATION: 18622 Quarterhorse Lane Conditional Exception (Variance) No. 92-8 is a request for a variance from the required side yard setback of 25 to 7.5 feet along the southerly property lines for a 1,435 square foot room addition pursuant to Section 930 (Ellis-Goldenwest Specific Plan) of the Huntington Beach Ordinance Code. STAFF RECOMMENDATION: Staff recommends that the Planning Commission deny Conditional Exception (Variance) No. 92-8 with findings for denial. THE PUBLIC HEARING WAS OPENED. Gerald Chapman, 6742 Shire Circle, representing the Homeowner's Association, spoke in opposition to the request. C.M. Thomson, 1312 W. Collins, Orange, applicant, spoke in support of the request giving a short overview of the project. Mike Davis, 6711 Shire Circle, spoke in opposition to the request. Mr. Davis felt the building would not be aesthetically pleasing from his home view. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The unique topographic features of the subject property do not have any bearing on the inability to meet the side yard setback requirements. Since the subject property can be fully developed within regularly established setbacks, such a conditional exception for a reduced side yard setback is not necessary for the preservation and enjoyment of substantial property rights. 3. Granting of Conditional Exception (Variance) No. 92-8 for a reduced side yard setback would constitute a special privilege inconsistent with limitations upon properties in the vicinity. The subject property was legally subdivided and developed in a manner consistent with the applicable zoning laws. 4. Exceptional circumstances do not apply that deprive the subject property of privileges enjoyed by other properties in the same zoning classifications. 5. Encroachment into the required setback of the southerly property line is not compatible with properties to the south and would be inconsistent with the intent of the EGWSP. 6. The addition will create an aesthetic impact onto adjoining properties because of its mass, building height and floor to ceiling glass elevations. 7. The privacy of adjoining properties will be impacted by the proposal due to the numerous windows on the southerly elevation and the proposed addition height. B-3 CODE AMENDMENT N0, 90-10(a): APPLICANT: City of Huntington Beach LOCATION: Mixed Development District located at the northeast corner of Goldenwest Street and Yorktown Avenue. Staff recommends that the Planning Commission continue the Mixed Development Provisions for the Holly-Seacliff Specific Plan to the June 16, 1992 Planning Commission meeting in order to further analyze the development standards. Parcel B - Approximately 500 feet west of the terminius of Clay Avenue. Parcel C - Approximately 500 feet north of the intersection of Ofelin Lane and Morning Tide Drive. Zone Change No. 92-1 is a request for to rezone three (3) parcels from R2-PD-0-CZ to ROS-O-CZ, R4-0 to ROS-0, and R4-01-CZ to ROS-OI-CZ. The request to rezone the three (3) parcels has been initiated to satisfy a condition of approval of Zone Change No. 88-9 which established the Seacliff Specific plan. When the Seacliff Specific Plan was adopted the applicant was required to provide 4.6 acres of open space zoning. An acre was provided in Zone Change No. 90-14 which was approved by the City Council on May 4, 1992. Zone Change No. 92-1 will provide the balance of Recreation Open Space zoning. Further, for each site General Plan Designations will be changed to Open Space Recreation as part of the forthcoming General Plan Update. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Negative Declaration No. 92-6 with mitigation measures and Zone Change No. 92-1 with findings and forward to City Council for adoption. THE PUBLIC HEARING WAS OPENED. Jay Kreitz, 19781 Island Bay Lane, representing the Homeowner's Association spoke in support of the zone change. He did, however, express concern about the structure, access and roads and requested the homeowner's association be allowed to review these before permits are issued. Cathy Bush, 6581 Morningtide, spoke in support of the request. Ms. Bush also requested to be allowed to review plans before permits are issued. Nancy Howar, 6551 Morning Tide Drive, spoke in support of the request. Bill Holman, 2124 Main Street, stated his support for the request and staff's recommendation. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No. 92-16 and Tentative Parcel Map No. 92-105 with findings and suggested conditions of approval. FINDINGS FOR APPROVAL - TENTATIVE PARCEL MAP NO. 92-105: 1. The subdivision of four (4) buildable lots into four (4) buildable lots and a 4,937 square foot greenbelt conforms to the subdivision standards in the Seacliff Specific Plan. 2. The proposed subdivision will not create non -conforming lots. 3. The proposed subdivision will not exceed the General Plan Designation of seven (7) units per acre. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO, 92-12/TENTATIVE PARCEL MAP NO, 92-105: 1. The tentative parcel map dated received March 27, 1992 shall be the approved layout. 2. The Conditions, Covenants and Restrictions for Tract 13821 shall be amended to require the Association to maintain the greenbelt "A" lot and to permantly set -aside Lot A for greenbelt purposes. B-6 CONDITIONAL USE PERMIT N0, 92-14: APPLICANT: Huntington Christian School LOCATION: 1207 Main Street Conditional Use Permit No. 92-14 is a request to permit the installation of a modular building to house four (4) classrooms and to modify the existing conditional use permit to add additional students and grades pursuant to Section 9630.C. of the Huntington Beach Ordinance Code. The Huntington Christian School is located on the grounds of the First Christian Church bounded by Main Street, Seventeenth Street, Loma Avenue, and Adams Avenue. The surrounding uses are primarily residential with two (2) public schools southwest of the property. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve Conditional Use Permit No. 92-14 with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Jim Woest, 19572 Roderick Lane, spoke in support of the request. Mr. Woest stated the school was trying to accomodate parents request for the children to continue at that school. The location, site layout, and design of the proposed modular classroom building properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. A driveway entrance has been relocated to provide through circulation and continuous flow of vehicles as they enter the site from Loma Avenue and drop-off children at the school. 2. The combination and relationship of one proposed use to another on a site are properly integrated. The modular classroom building will be conveniently located adjacent to existing sidewalks and outdoor play area and will be incorporated into the present church and school facility. 3. The access to and parking for the proposed modular classroom building does not create an undue traffic problem. A redesign of the adjacent driveway entrance allows through circulation for loading and unloading of vehicles to be maintained. One (1) additional parking space than required for the use will be provided as a result of this project. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO, 92-14: 1. The site plan, floor plans, and building elevations received and dated May 22, 1992 shall be the conceptually approved layout. 2. The total student enrollment shall be limited to 360 students and kindergarten through eighth grade only. 3. Handicapped access to the modular classroom building shall be provided. 4. There shall be no storing of vehicles in the parking lot and the three detached trailers currently present on -site shall be removed. 5. The trash bins shall be stored inside the trash enclosure at all times except when moved to curbside for pick-up. 6. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 8. During construction, the applicant shall: a. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO 92-18 AND COASTAL DEVELOPMENT PERMIT NO. 92-18: 1. The site plan, floor plans, and elevations received and dated April 13, 1992 shall be the conceptually approved layout. 2. Prior to submittal for building permits, the applicant/owner shall complete the following: a. Floor plans shall depict natural gas and 220V electrical shall be stubbed in at the location of clothes dryers; natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units; and low -volume heads shall be used on all spigots and water faucets. b. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department and indicated on the floor plans. c. Elevations shall depict colors and building materials proposed. d. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. A grading plan shall be submitted to the Department of Public Works for review and it must be approved (by issuance of a grading permit). A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works. b. All applicable Public Works fees shall be paid. c. The property owner shall sign, notarize, and record with the County Recorder a "Letter of Agreement" assuring that the single family residence will be maintained as one (1) dwelling unit. 4. Fire Department Requirements are as follows: a. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. b. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances, and standards. 5. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 7. During construction, the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site; b. Wet down areas in the late morning and after work is completed for the day; c. Use low sulfur fuel (.05% by weight) for construction equipment; d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. 8. The project list was distributed to the Planning Commission for review at their May 19, 1992 meeting. The Capital Improvement Program provides the long-range planning, resources and coordination necessary to meet current and future community facility needs. It is designed to implement community policies and attain goals contained in the City's General Plan. The projects are grouped by department classification, followed by applicable City policies from the General Plan to establish conformance with the General Plan.
