continued.
ITEM 1• CONDITIONAL EXCEPTION NO 92-16 (continued from the Mav
27 1992 Zoning Administrator Meeting
Applicant: John Topolewski
815 Geneva
Huntington Beach, CA 92648
Request: To permit a 344 square foot room addition to an
existing two-story single family residence with a
variance for reduced open space (494 square feet in
lieu of 600 square feet) pursuant to Section 9130.9 of
the Huntington Beach Ordinance Code.
Location: 815 Geneva Avenue
Wayne Carvalho, Staff Planner, reported that the item was continued
to allow the applicant to work out Building Code deficiencies
regarding emergency access from the third story deck. Staff
indicated that the applicant had modified plans that met Building
Code requirements with only a minimal loss in open space. Staff
recommended approval based on findings and suggested conditions of
approval.
THE PUBLIC HEARING WAS OPENED.
John Topolewski, the applicant, was present and concurred with the
suggested conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
CONDITIONAL EXCEPTION NO. 92-16 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The granting of Conditional Exception 92-16 for a 344 square
foot addition will not constitute a grant in special privilege
inconsistant upon properties in the vicinity and under
identical zone classifications. The subject property provides
open space on second and third story decks. In addition, the
existing residence has a twenty (20) foot front setback
providing additional open space.
2. Because of special circumstances applicable to the subject
property, including size, shape, location or surroundings, the
strict application of the Zoning Ordinance is found to deprive
the subject property of privileges enjoyed by other properties
in the vicinity and under identical zone classifications. The
subject lot has a unique shape that restricts any open space to
be calculated within the rearyard due to the additional garage
space.
3. The granting of Conditional Exception No. 92-16 is necessary in
order to preserve the enjoyment of one or more substantial
property rights. The proposed addition will allow for a second
enclosed parking space and a second story room addition.
4. The granting of Conditional Exception No. 92-16 for reduced
open space will not be materially detrimental to the public
welfare, or injurious to property in the same zone
classifications. The proposed addition will meet all
provisions of the Huntington Beach Ordinance Code except for
variances granted under Conditional Exception No. 92-16.
5. The granting of Conditional Exception No. 92-16 will not
adversely affect the General Plan of the City of Huntington
Beach. The proposed room addition is consistent with the Low
Density Residential Land Use designation in the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
April 22, 1992 shall be the conceptually approved layout with
the following modification:
a. Access to the third story deck by use of a spiral
staircase shall be provided through the proposed teen
room on the second floor.

2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
4. Proposed structures shall be architecturally compatible with
existing structures.
5. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department
except for variances granted under Conditional Exception No.
92-16.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke
Conditional Exception No. 92-16 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
ITEM 2: SITE PLAN AMENDMENT NO, 92-1
Applicant: Paul Cook
306 3rd Street
Huntington Beach, CA 92648
Request: To permit the relocation and expansion of the
Coral Cay guard house with an approximate total
of 146 square feet of building area pursuant to
Section 9841.5. of the Huntington Beach
Ordinance Code.

Location: Outside of Coral Cay main entrance,
approximately fifty (50) feet northeast of
Bluewater Lane.
Wayne Carvalho, Staff Planner, reported that the request is to
relocate an existing guard house and enlarge the structure to
include a bathroom to meet Building Division Requirements. Staff
advised that the Fire Department will require 14 foot drive aisle
for both ingress and egress. Staff concluded by recommending
approval with suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Louie Hernandez, representing the applicant, was present. He stated
they had room to shift the guard house to meet the Fire Department
requirement and concurred with the requested modification.
There were no other persons present to speak for or against the
request and the public hearing was closed.
SITE PLAN AMENDMENT NO. 92-1 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.

1. The site plan and floor plans received and dated June 5, 1992
shall be the conceptually approved layout with the following
modifications:
a. Drive aisle width shall be a minimum of fourteen (14)
feet wide for the easterly driveway to meet Fire
Department requirements.
b. Building height shall not exceed sixteen (16) feet.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.

ITEM 3: USE PERMIT NO, 92-21
Applicant: Chad DiMarco

Request: To permit the establishment of an automotive
related business (auto repair, fabrication and
maintenance of two (2) race cars, and
performance parts and accessory mail order
business) pursuant to Section 9530.01 of the
Huntington Beach Ordinance Code.
Location: 17161 Palmdale Street
Wayne Carvalho, Staff Planner, reported that the applicant's
proposal is to occupy a building in an existing industrial center
for an automotive related business. Staff presented letters from
adjacent businesses of the applicant's present location who indicate
that the business does not create a parking problem. Staff
concluded by recommending approval with findings and suggested
conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Chad DiMarco, the applicant, concurred with the suggested conditions
of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 92-21 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the automotive
service/mail order business will not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity. All automotive repair will be conducted
within the building and there will be no outside
storage of vehicles or parts. Further, there were no
persons in opposition to the request.

b. Property and improvements in the vicinity of such use
or building. The industrial complex provides the
necessary amount of parking spaces required by the
Huntington Beach Ordinance Code.
2. The granting of Use Permit No. 92-21 will not adversely affect
the General Plan of the City of Huntington Beach. The
automotive related business is consistent with the General
Industrial Land Use designation of the City's General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
April 8, 1992 shall be the conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
2. Automotive service area shall not exceed 1,000 sq. ft. in
area. A physical barrier/partition shall be provided to
separate the automotive service area from the manufacturing
area.
3. There shall be no outside storage of vehicles, vehicle parts,
equipment or trailers.
4. All repair work shall be conducted wholly within the building.
5. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
6. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department
which include:
a. Compliance with Article 29 of the Uniform Fire Code
(UFC) for garages.
b. Compliance with Article 79 of the UFC for
flammable/combustible liquids.

2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke Use
Permit No. 92-21 if any violation of these conditions or the
Huntington Beach Ordinance Code occurs.
ITEM 4: USE PERMIT NO, 92-32
Applicant: Five Points Seniors
David Michelson

Request: To permit a seven foot, six inch (7'6") high block wall
within seven feet (7') of the property line for
purposes of enclosing a water pump and placing a
project identification sign pursuant to Section 9771(1)
of the Huntington Beach Ordinance Code.
Location: 18561 Florida Street
Wayne Carvalho, Staff Planner, reported that the request is for a
blockwall/enclosure for a water pump and project identification
sign. Staff indicated that the proposal for the blockwall is 1.5
feet above code and encroaches 3 feet into the 10 foot setback.
Staff concluded by recommending approval with findings and suggested
conditions of approval.
Mr. Brinegar, representing the applicant, was present and concurred
with staff's recommendation and conditions of approval.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the proposed
7 1/2 foot block wall/enclosure will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity. The proposed wall will mitigate potential noise
impacts and provide for an aesthetically pleasing project
identification sign.
b. Property and improvements in the vicinity of such use The
proposed wall will meet site angle visibility requirements
and will not impact pedestrian or vehicular traffic.
2. The granting of Use Permit No. 92-32 will not adversely affect
the General Plan of the City of Huntington Beach. The proposal
is consistent with the goals and objectives of the City's
General Plan and Land Use Map.

March 16, 1992 shall be the conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any
changes in building height or setbacks are proposed as a result
of the plan check process. Building permits shall not be
issued until the Zoning Administrator has reviewed and approved
the proposed changes. The Zoning Administrator reserves the
right to require that an amendment to the original entitlement
be processed if the proposed changes are of a substantial
nature.
3. The proposed block wall/enclosure shall be architecturally
compatible with the proposed residential project an shall be
stuccoed to match building texture and color.
4. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plancheck.

1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
