ACTING ZONING ADMINISTRATOR: STAFF MEMBERS: MINUTES• ITEM 1: USE PERMIT NO. 92-37 Room B-6 - Civic Center 2000 Main Street Huntington Beach, California Scott Hess Wayne Carvalho The Minutes of the June 3, 1992 and June 10, 1992 Zoning Administrator Meetings were approved. Applicant: The PetCare Company 2043 Westcliff #202 Newport Beach, CA 92660 Request: To permit a temporary outdoor event for a Grand Opening Celebration which will include Hollywood animal actors and a roof balloon pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 8909 Adams Ave. Wayne Carvalho, Staff Planner, reported that the grand opening would be held June 24 through June 26, 1992 between the hours of 10:00AM to 5:00 PM. Staff advised that there will be animal actors and a balloon on top of the building. Staff concluded by recommending approval with findings and suggested conditions of approval. Lee Hine, representing the applicant, was present. He said the three day request is for the balloon only; the animal actors will be present on Saturday only. USE PERMIT NO. 92-37 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The event will not obstruct on -site circulation or access to existing business. b. Property and improvements in the vicinity of such use or building. The event is a temporary use for three (3) days. 2. The granting of Use Permit No. 92-37 will not adversely affect the General Plan of the City of Huntington Beach. The grand opening event is consistent with the General Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated June 1, 1992 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. Fire access lanes shall be a minimum with of (20) twenty feet. 4. A detailed site plan shall be submitted to the Huntington.Beach Fire Department for approval (show table locations, tents, barriers, etc.). 5. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 6. The applicant's request shall include necessary permits for balloons and temporary signs. 7. All parking shall be setback a minimum of forty (40) feet from the proposed tent. 8. The proposed tent shall be of fire retardant material. Proof of Certification shall be submitted to the Fire Department for approval prior to the tent's installation on the site. 9. The proposed tent shall be secured against collapsing to the satisfaction of the Fire Department. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 92-37 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of thirty (30) days prior to the event. Failure to provide adequate notice shall result in denial of the request. ITEM 2: USE PERMIT NO, 92-3 Applicant: Jacks Surfboards 113 Main Street Huntington Beach, CA 92648 Request: To permit a temporary outdoor event for a merchandise sale on June 22-28, July 4, 16-18, 1992 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: 101 Main Street Wayne Carvalho, Staff Planner, reported that the event is to sell T-shirts on the above dates. He said the applicant advised that if the shirts were sold prior to July 18, 1992, the future events would be cancelled. No one was present to speak for or against the request. USE PERMIT NO. 92-39 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The event will not obstruct on -site circulation or access to existing businesses. b. Property and improvements in the vicinity of such use or building. The event is a temporary use for up to eleven (11) days over June and July 1992. 2. The granting of Use Permit No. 92-39 will not adversely affect the General Plan of the City of Huntington Beach. The temporary outdoor sale is consistent with the Visitor Serving Commercial land use designation of th General Plan. ZA Mintues - 6/17/92 -3- (3682d) SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated June 9, 1992 shall be the conceptually approved layout. 2. No merchandise, equipment or customer lines shall encroach into the public right-of-way. 3. All merchandise shall be cleared from the site at the end of each business day. 4. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 5. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 6. The applicant's request shall include necessary permits for balloons and temporary signs. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 92-39 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of thirty (30) days prior to the event. Failure to provide adequate notice shall result in denial of the request. ITEM 3: USE PERMIT NO, 92-38 Applicant: Orange County Farm Bureau Nancy Jiminez 2512 Chambers Road #203 Tustin, CA 92680 Request: To permit a temporary outdoor event for a Certified Farmers Market from 2:00 p.m. to 6:00 p.m. for ten (10) Fridays commencing July 3, 1992 pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: Southwest Corner of Main Street and Orange Ave. ZA Mintues - 6/17/92 -4- (3682d) 1 Wayne Carvalho, Staff Planner, reported that the event will be held on Friday's for ten weeks from 2:00 PM to 6:00 PM in the City parking lot. Set up is scheduled for 12:00 noon with clean up completed by 8:00 PM. Staff indicated that the applicant will work with Economic Development to establish a validation system for parking in the Main Promenade parking structure. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Nancy Jimenez, representing the applicant, said they had other farmers markets in other cities that ran smoothly. She said there would be a manager on -site during all the events. Bob Mandic, representing the.Downtown Merchants, spoke in support of the request. Mary Lou Lorenzini, representing the applicant, advised that she is the manager for the site. She said portable toilets and dumpsters will be delivered at noon on Fridays and picked up on Saturday mornings. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 92-38 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO CALENDAR (2) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event for a Certified Farmers Market limited to ten consecutive Friday afternoons will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The proposed market will not obstruct circulation or impact access to existing businesses. Furthermore, motorists will be directed to park in the Main Promenade parking structure with validation by vendors. b. Property and improvements in the vicinity of such use or building. The proposed market is a temporary use on an existing parking lot. The applicant is responsible for clean up after each event. 2. The granting of Use Permit No. 92-38 for a limited time Farmers Market will not adversely affect the General Plan of the City of Huntington Beach. The proposed Farmers Market is consistent with the Mixed Use Land Use designation of the General Plan. ZA Mintues - 6/17/92 -5- (3682d) SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated June 2, 1992 shall be the conceptually approved layout. a. The trash containers shall be setback to the greatest extent possible from Orange Street. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. Fire access lanes shall be a minimum width of (20) twenty feet. 4. The applicant shall obtain all necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 5. The applicant's request shall include necessary permits for balloons and temporary signs. 6. The applicant shall obtain clearance from the Administrative Services Department, Risk Management Division and provide a Certificate of Insurance to be executed at least five (5) days prior to the event. 7. Barriers, equipment, or customer lines shall not encroach into the public right-of-way (street, alley, sidewalks). 8. The applicant shall coordinate with the Community Services and Economic Development Departments to establish a validation system for customer parking in the Main Promenade parking structure. 9. The applicant shall file a cash bond in the amount of Five Hundred Dollars ($500.00) to insure clean-up of the site after each event. 10. Signs shall be posted directing motorists to the Main Promenade parking structure on the 200 block of Main Street. 11. The entire market operation (includes set-up and break down) shall be limited to 11:00 AM to 9:00 PM on Fridays only. 12. Fire extinguishers shall be provided in number and locations specified by the Fire Department. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The Zoning Administrator reserves the right to revoke Use Permit No. 92-38 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 4: USE PERMIT NO. 92- Applicant: Jeff & Tami Driessen 15852 Plymouth Huntington Beach, CA 92647 Request: To permit a two (2) foot wood extension over an existing five (5) foot block wall pursuant to Section 9771(1) of the Huntington Beach Ordinance Code. Location: 15852 Plymouth Wayne Carvalho, Staff Planner, reported that the request is to allow an existing two foot wood extension over an existing five foot block wall. Staff recommended denial due to the fact that it was not compatible with other fences in the neighborhood. THE PUBLIC HEARING WAS OPENED. Toni Approllado, representing the applicant, requested approval. He advised that the extension was added as a result of problems with children from Marina High School teasing the owners dogs. Tami Driessen, applicant, advised that at least 25% of the homes in their tract have extensions with three extensions on their block. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 92-33 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The proposed ood extension is consistent with the Low Density Residential Land Use designation of the City's General Plan and Land Use Map. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 18, 1992 shall be the conceptually approved layout. 2. The applicant shall obtain building permits for the wood extension within thirty (30) days of the date of approval; and the permits shall be finaled within ninety (90) days. 3. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department except for variances granted under Use Permit No. 92-33. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 92-33 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 1 ZA Mintues - 6/17/92 -8- (3682d) 1 ITEM 5• USE PERMIT NO, 92-29 Applicant: Juan Navarro 1917 Florida Street Huntington Beach, CA 92648 Request: To permit the establishment of state licensed recycling center (mobile container 8' X 21' X 8'), by using one (1) parking space adjacent to the existing retail center pursuant to Section 9220.10(a)(6) of the Huntington Beach Ordinance Code. Location: 19731 Beach Blvd. Wayne Carvalho, Staff Planner, said the request is to continue the operation of a recyling center with operating hours from 8:30 AM to 6:00 PM. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Mr. Navarro, applicant, was present and stated that they are a State Licensed operator. He said they clean the site every night and take all recycled material to Los Angeles. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 92-20 WAS CONTINUED BY THE ZONING ADMINISTRATOR TO THE MEETING OF JUNE 24, 1992. ITEM 6: USE PERMIT NO, 92-31 Applicant: Arturo Hidalgo 17881 Bell Circle Apt. A Huntington Beach, CA 92647 Request: To permit the installation of two (2) security gates equipped with Knox boxes at the north and south points of access pursuant to Section 9604.2 of the Huntington Beach Ordinance Code. Location: Private alley west of Bell Circle Wayne Carvalho, Staff Planner, reported that the request is to install two security gates while restricting thru traffic through the private alley. Staff indicated that the City recently processed the alley vacation and had a General Plan Conformance approved by the Planning Commission. Staff concluded by recommending approval with findings and suggested conditions of approval. ZA Mintues - 6/17/92 -9- (3682d) Arthur Hidalgo, applicant, stated that they had been working with the City for two years to obtain approval for the alley vacation because of the crime and unsafe conditions. The Public Works Department recently received approval from the City Council for the alley vacation and the applicant is now requesting security gates to restrict outside traffic. USE PERMIT NO. 92-31 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the proposed security gates will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The gates will provide added security for tenants and reduce outside pedestrian and vehicular traffic through the alley. b. Property and improvements in the vicinity of such use or building. The gates will potentially reduce transient traffic and alledged criminal activity. 2. The granting of Use Permit No. 92-31 will not adversely affect the General Plan of the City of Huntington Beach. The alley vacation was previously approved by the City Council. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May, 15, 1992 shall be the conceptually approved layout. 2. A revised site plan shall be submitted depicting the modifications described herein: a. Maximum seven (7) foot high gates. b. Relocation of the north gate approximately 15 feet south to allow for stacking. c. Details of buildings and walls adjacent to gate location 3. The gates shall be remote controlled and each tenant shall be issued a transitter. In addition, the gates shall have a knox box for emergency access. 4. The applicant shall coordinate trash pick up with the Rainbow Disposal Company. ZA Mintues - 6/17/92 -10- (3682d) 1 5. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 8. If lighting is included in the parking area/alley, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 9. Conditions of approval shall be printed verbatim on the cover sheet of all working drawings submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke this Use Permit No. 92-31 if any violation of these conditions or the Huntington Beach Ordinance Code occurs.
