ZONING ADMINISTRATOR: Mike Strange STAFF MEMBERS: Wayne Carvalho MINUTES: Minutes of the June 17, 1992 Zoning Administrator Meeting were continued to the July 1, 1992 Zoning Administrator Meeting. ITEM 1• USE PERMIT NO. 92-29 (Continued from the June 17, 1992 Zoning Administrator Meeting) Applicant: Juan Navarro 1917 Florida Street Huntington Beach, CA 92648 Property Owner: Byeong C. Choi 3 Stillwater Irvine, CA 92715 Request: To permit the establishment center (mobile container 8' (1) parking space adjacent center pursuant to Section Huntington Beach Ordinance Location: 19731 Beach Blvd. of state licensed recycling X 21' X 81), by using one to the existing retail 9220.10(a)(6) of the Code. Wayne Carvalho, Staff Planner, reported that the request was continued from the June 17, 1992 meeting to allow staff to conduct further analysis on the proposed use. Staff stated that further correspondence with the Police Department and Code Enforcement Section resulted in no additional concerns. Staff recommended approval with added conditions, including limited hours of operation during winter months and painting of the trailer to match the commercial building. Juan Navarro, applicant, was present and concurred with staff's recommendation. Edith Hanlon and Shirley Gimber of Carden School, 721 Utica Avenue, expressed their concern over the relationship between the business and mobile recycling trucks in the neighborhood. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 92-29 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the recycling center will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The recycling center will provide a drop-off/buy back facility within the Beach Blvd./Utica Ave. area. Furthermore, the conditions of approval imposed will further regulate the operation of the recycling center including a six (6) month review. b. Property and improvements in the vicinity of such use or building. Although the recycling center occupies one parking space, the entire center remains in compliance with providing the required number of spaces. 2. The granting of Use Permit No. 92-29 will not adversely affect the General Plan of the City of Huntington Beach. The proposed recycling center is consistent with the General Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 11, 1992 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. The applicant shall paint the structure/container to match the abutting commercial building. ZA Minutes - 6/24/92 -2- (3803d) 4. Hours of operation shall be as follows: a. 8:30 a.m. - 6:30 p.m. (March -October) b. 8:30 a.m. - 4:30 p.m. (November -February). 5. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 6. There shall be no outside storage of recycling items. 7. All proposed signs shall be submitted and approved by the Zoning Administrator. 8. A review of the use shall be conducted within six (6) months of the date of this approval to verify compliance with all conditions of approval and applicable Articles of the Huntington Beach Ordinance Code. If, at that time, there are violations of these conditions or code sections, Use Permit No. 92-29 may become null and void. A public hearing will be scheduled within six (6) months. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke Use Permit No. 92-29 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2• ADMINISTRATIVE REVIEW NO. 92-1 (Continued from the April 8, 1992 Zoning Administrator Meeting) Applicant: Marty Olson, MDSSC 5301 Bolsa Avenue Huntington Beach, CA 92647 Property Owner: McDonnell Douglas Corporation 5301 Bolsa Avenue Huntington Beach, CA 92648 Request: To permit a 7,000 sq. ft. addition to an existing aerospace industrial building pursuant to Section 9510.01 of the Huntington Beach Ordinance Code. Location: 5301 Bolsa Avenue ZA Minutes - 6/24/92 -3- (3803d) Wayne Carvalho, Staff Planner, reported that the item was continued from the April 8, 1992 Zoning Administrator meeting due to revisions in the site plan. Staff explained that the addition included an autoclave facility equipped to compound materials such as graphites, etc. Staff indicated that the entire complex had a surplus in parking of over 800 spaces and that the proposed addition would not generate any additional noise. Staff recommended approval with suggested conditions. THE PUBLIC HEARING WAS OPENED. Marty Olsen, applicant was present and concurred with staff's recommendation. There were no other persons present to speak for or against the request and the public hearing was closed. ADMINISTRATIVE REVIEW NO. 92-1 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. ONDITIONS OF APPROVAL: 1. Site plans, floor plans and building elevations dated and received June 4, 1992 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height and floor area, are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. All fire protection equipment and systems shall be extended to the proposed addition. 4. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 5. ITEM 3• TENTATIVE PARCEL MAP NO. 92-174: Applicant: Joe Gergen 326 N. Newport Blvd. Newport Beach, CA 92663 Property Yunker/Morton/Dolley Partnership Owner: C/O Gergen Company 326 N. Newport Blvd. Newport Beach, CA 92663 Request: To consolidate four (4) 27 foot wide lots into two (2) 54 foot wide, 3,375 square foot lots, for single family residential purposes pursuant to Section 9921 of the Huntington Beach Ordinance Code. Location: Southwest corner of Springfield Ave. and Huntington Street Wayne Carvalho, Staff Planner, reported that the subject property was located within the Oldtown Specific Plan and the proposed consolidation complies with the minimum lot size and width requirements of the Ordinance Code. Staff concluded by recommending approval with suggested findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Joe Gergen, applicant, was present and concurred with staff's recommendation. There were no other persons present to speak for or against the project and the public hearing was closed. TENTATIVE PARCEL MAP NO. 92-174 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The proposed consolidation of four (4) lots into two (2) 54 foot wide, 3,375 square foot lots for purposes of constructing two (2) single family residences complies with the Oldtown Specific Plan District Standards and Medium Density Residential Land Use designation of the General Plan. ZA Minutes - 6/24/92 -5- (3803d) 2. The General Plan has set forth -provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for Medium Density Residential development was placed on the subject property. 4. The size, depth, and frontage of the proposed lot consolidation are in compliance with standards, plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: 1. The Tentative Parcel Map received by the Department of Community Development on May 11, 1992 shall be the approved layout. 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. A copy of the recorded parcel map shall be filed with the Department of Community Development. 3. Street improvements shall be constructed to Public Works standards. 4. All utilities shall be installed underground at the time said parcel(s) is/are developed. 5. Development shall comply with all applicable City Ordinances. 6. All vehicular access rights along Huntington Street and Springfield Avenue shall be dedicated to the City of Huntington Beach except at locations approved by the Zoning Administrator. 7. Park and Recreation fees shall be paid prior to the release of map for recordation. ITEM NO. 4: CONDITIONAL EXCEPTION NO. 92-25: Applicant: Daniel Sevensky 17888 Pollard Huntington Beach, CA 92647 Property Owner: Pam Nixon 21751 Windsong Circle Huntington Beach, CA 92646 ZA Minutes - 6/24/92 =6- (3803d) 1 I Request: To permit a 128 square foot room addition within eight (8) feet of the rear property line in lieu of ten (10) feet pursuant to Section 9110.8 of the Huntington Beach Ordinance Code. Location: 21751 Windsong Circle Wayne Carvalho, Staff Planner, reported that the request is to allow a two (2) foot encroachment into the rear yard setback for a portion of a 128 square foot room addition. Staff indicated that the property is odd -shaped and located at the end of a cul-de-sac. Staff explained that the property complied with the minimum open space requirements (1200 sq. ft.) and concluded by recommending approval with suggested findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Daniel Sevensky, applicant, was present and concurred with the suggested conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. CONDITIONAL EXCEPTION NO. 92-25 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The granting of Conditional Exception No. 92-25 for an 88 square foot room addition will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. The subject property is unique in shape as it is located at the end of a cul-de-sac. In addition, the property will maintain the minimum open space area of 1,200 square feet. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. The subject property is a pie -shaped lot and is located at the end of a cul-de-sac. 3. The granting of Conditional Exception No. 92-25 is necessary in order to preserve the enjoyment of one or more substantial property rights. Conditional Exception No. 92-25 will allow for a single family room addition on a unique shaped lot. ZA Minutes - 6/24/92 -7- (3803d) 4. The granting of Conditional Exception No. 92-25 will not be materially detrimental'to the public welfare, or injurious to property in the same zone classifications. The proposed addition will meet all provisions of the Huntington Beach Ordinance Code except for variances granted under Conditional Exception 92-25. Furthermore, there were no persons in opposition to the project. 5. The granting of Conditional Exception No. 92-25 will not adversely affect the General Plan of the City of Huntington Beach. The addition to the existing single family residence is consistent with the Low Density Residential Land Use designation in the General Plan. CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 21, 1992 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Any proposal for future additions shall maintain all required setbacks. 4. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. Conditions of approval shall be printed verbatim on the cover sheet of all working drawings submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department except for variances granted under Conditional Exception 92-25. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke Conditional Exception No. 92-25 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ZA Minutes - 6/24/92 -8- (3803d) 1 11 ITEM NO 5• USE PERMIT NO, 92-27: Applicant: Wendy Campbell 2716 Ocean Park Blvd. #3040 Santa Monica, CA 90405 Property Owner: Huntington Beach No. 2, A Limited Partnership C/O Watt Management Company 2716 Ocean Park Blvd. #3040 Santa Monica, CA 90405 Request: To permit the establishment of a 1,800 square foot sandwich shop/smoothie bar in conjunction with a video arcade (up to 20 games) pursuant to Section 9220.11 of the Huntington Beach Ordinance Code. Location: 8865 Atlanta Avenue Wayne Carvalho, staff planner, reported that approval of a use permit was required due to the proposal for a 20-game video arcade. Staff indicated that the arcade met the locational critera set forth in the Ordinance Code and that standard conditions for bicycle racks, limited hours of operation and adult management would be imposed. Staff concluded by recommending approval with suggested findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Chuong Sweeney, applicant, was present and concurred with staff's recommendation and suggested conditions of approval. Eight (8) residents from the Huntington Landmark residential development located west of the commercial center, objected to the request for reasons revolving around the potential crowd the arcade was going to attract. In addition, the residents expressed concern that they would be harassed when walking to the shopping center and that the sidewalk would be cluttered with bicycles and skateboards. Lastly, the residents expressed a fear that children (teenagers) would loiter around the entrance to the arcade and possibly engage in criminal activity. Mike Strange, Zoning Administrator explained that the applicant was planning to operate a clean business with games to be operated during non -school hours. He explained that the primary business was a sandwich shop. He suggested that the number of games be reduced to ten (10) and that there be a six (6) month review to assess any problems or complaints received by the City. There were no other persons present to speak for or against the request and the public hearing was closed. ZA Minutes - 6/24/92 -9- (3803d) USE PERMIT NO. 92-27 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the 1,800 square foot sandwich shop/arcade will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. With the conditions imposed, video games will not be operational during school hours which will minimize the potential for truancy. In addition, residents and tenants will have the opportunity to testify at the six (6) month review hearing. b. Property and improvements in the vicinity of such use or building. The business will occupy a 1,800 square foot suite within an existing commercial center. 2. The granting of Use Permit No. 92-27 will not adversely affect the General Plan of the City of Huntington Beach. The proposed sandwich shop/arcade is consistent with the General Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 7, 1992 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in floor area is proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. There shall be no more than ten (10) video games. 4. Video games shall not be operational during school hours. 5. Hours of operation shall be as follows: a. Monday -Thursday 10:00 a.m. - 10:00 p.m. b. Friday -Saturday 10:00 a.m. - 11:00 p.m. c. Sundays 10:00 a.m. - 3:00 p.m. 6. Bicycle racks with a minimum of ten (10) stalls shall be provided adjacent to the entryway and shall not obstruct the entire sidewalk. 8. A review of the use shall be conducted within six (6) months from the date of first occupancy to verify compliance with all conditions of approval and applicable Articles of the Huntington Beach Ordinance Code. If, at that time, there are violations of these conditions or code sections, Use Permit No. 92-27 may become null and void. 9. Conditions of approval shall be printed verbatim on the cover sheet of all working drawings submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1.
