Minutes of the June 17, and 24, 1992,
Zoning Administrator Meeting were
approved and the July 1, 1992 minutes
were continued to the July 15, 1992
Zoning Administrator Meeting.
ITEM 1• ADMINISTRATIVE REVIEW NO. 92-11:
Applicant: Kar Kare Parking Systems, Inc.
5622 Research Drive
Huntington Beach, CA 92649
Request: To permit the continued use of a seasonal parking lot
,until September 20, 1992 pursuant to Section 9730.56 of
the Huntington Beach Ordinance Code.
Location: 21690 Pacific Coast Highway (Southeast corner at
Newland)
Wayne Carvalho, Staff Planner, reported that the applicant has
operated a seasonal parking lot on the subject property for over ten
(10) years. Staff indicated that the Administrative Review request
was valid for this summer only due to a proposed Wetlands and
Wildlife Care Center on the same site planned to start construction
later this year. In the event that the Care Center project did not
proceed, and the applicant proposed to conduct a seasonal parking
lot next year (1993), the applicant would be required to provide
several improvements on site. Staff further stated that the
approval was conceptual with final approval to be rendered by the
California Coastal Commission. Staff concluded by recommending
approval with conditions of approval.
THE PUBLIC HEARING WAS OPENED.
John Bonnani, applicant, was present and concurred with staff's
recommendation and conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
ADMINISTRATIVE REVIEW NO. 92-11 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated June 9, 1992 shall be the
conceptually approved layout.
2. The Applicant shall obtain a Coastal Development Permit from
the California Coastal Commission, or a waiver of such permit
and shall provide proof of this prior to operation of the
parking lot.
3. There shall be no direct access to the parking lot from Pacific
Coast Highway. Access shall be reviewed and approved by the
Department of Public Works prior to use of the site.
4. The site shall be maintained in a clean condition free from
trash and debris. Trash containers shall be placed on the site
sufficient to accommodate and store all trash that accumulates
on the lot. Any trash accumulated on the lot shall be cleaned
up on a daily basis.
5. The lot shall be secured at the close of business to prevent
overnight parking.
6. An attendant shall be on duty at all times during business
hours. The attendant shall be at least 18 years of age.
7. Directional and informational signs shall be displayed on -site
to provide identification of entry into the parking lot and
charges for parking and hours of operation. Such signs shall
be located at the entrance in a copy size visible to motorists
entering the parking lot. On -site signs shall not exceed
twelve (12) square feet and shall not be more than eight feet
(8') high nor less than six feet_(6') high. Said signs shall
be removed from the site each season to later than the third
weekend each September. The signs shall not interfere with
traffic visibility.
8. An approved fire extinguisher shall be provided on the premises
during business hours.
9. This approval is valid through September 20, 1992.

10. Lot surface shall be to the satisfaction of the Fire and Public
Works Department, with specific concern for dust control.
11. A copy of the conditions of approval shall remain on -site
during parking lot business hours.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke
Administrative Review No. 92-11 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
ITEM 2: CONDITIONAL EXCEPTION NO, 92-1
Applicant: William J. Sullivan
7612 Woodwind Drive
Huntington Beach, CA 92647
Request: To permit a seven (7) square foot dumbwaiter
(elevator) to be allowed within the required
open space area, reducing the open space to 218
square feet on the ground in lieu of the
required 225 square feet pursuant to Section
9130.9(a) of the Huntington Beach Ordinance Code.
Location:
202 Nineteenth Street
Wayne Carvalho, Staff Planner, reported that the dumbwaiter was
installed over two (2) years ago due to a disabled family member.
Staff indicated that the dumbwaiter encroached into the required
open space and that there were no substantial land related hardship
scenarios to support the request. Staff concluded by recommending
denial of the request with findings.
THE PUBLIC HEARING WAS OPENED.
Thomas F. Kamph, representing the applicant, indicated that the
dumbwaiter assists a disabled family member in transporting
materials up and down the three story residence. He stated that
there were no objections by neighbors and requested approval of the
minor variance.
There were no other persons present to speak for or against the
request and the public hearing was closed.

CONDITIONAL EXCEPTION NO. 92-18 WAS APPROVED BY THE ZONING
ADMINISTRATOR THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL.
THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The granting of Conditional Exception 92-18 for a 91 square
foot room addition will not constitute a grant of special
privilege inconsistent upon other properties in the vicinity
and under an identical zone classification. The subject lot
has a reduced lot size due to the corner radius (Walnut Ave.
and 19th Street). Additional open space is provided on upper
story decks with over 600 square feet including the ground
floor.
2. Because of special circumstances applicable to the subject
property, including size, shape, location or surroundings, the
strict application of the Zoning Ordinance is found to deprive
the subject property of privileges enjoyed by other properties
in the vicinity and under identical zone classifications. The
subject property is located at the end of a block and has a
reduced lot size. The property is provided with additional
open space on second and third story decks.
3. The granting of Conditional Exception No. 92-18 is necessary in
order to preserve the enjoyment of one or more substantial
property rights. The granting of Conditional Exception No.
92-18 allows the property owner to provide services necessary
for a disabled family member.
4. The granting of Conditional Exception No. 92-18 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications. The encroachment
into the required open space does not extend any further than a
standard chimney. Further, there were no persons in opposition
to the request.
5. The granting of Conditional Exception No. 92-18 will not
adversely affect the General Plan of the City of Huntington
Beach. The addition is consistent with the Medium Density
Residential land use designation of the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
May 8, 1992 shall be the conceptually approved layout.
2. Building permits shall be obtained within thirty (30) days from
the date of approval and shall be finalled within ninety (90)
days.
3. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plan check.

INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department
except for variances granted under Conditional Exception No.
92-18.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke
Conditional Exception No. 92-18 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
ITEM 3• CONDITIONAL EXCEPTION NO 92-24:
Applicant: George D. Wittman/Architect

West Hollywood, CA 90046
Request: To permit a three (3) foot exterior sideyard
setback for a 91 square foot room addition in
lieu of the code required ten (10) feet pursuant
to Section 9110.7(b) of the Huntington Beach
Ordinance Code.
Location: 16707 Graham Street
Wayne Carvalho, Staff Planner, reported that the subject property
includes an easement (Old Pirate Lane) on the north side of the
property. Staff indicated that the proposed addition will maintain
a distance of three (3) feet from the existing block wall which is a
similar setback as maintained by the property located north of Old
Pirate Lane. Staff concluded by recommending approval of the
request with findings and conditions of approval.
THE PUBLIC HEARING WAS OPENED.
William J. Sullivan, representing the applicant, concurred with
staff's recommendation and conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
CONDITIONAL EXCEPTION NO. 92-24 WAS APPROVED BY THE ZONING
ADMINISTRATOR THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL.
THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.

FINDINGS FOR APPROVAL:
1. The granting of Conditional Exception 92-24 for a 91 square
foot room addition will not constitute a grant of special
privilege inconsistent upon other properties in the vicinity
and under an identical zone classification. The subject
property provides a forty (40) foot wide easement (Old Pirate
Lane) running along the north property line allowing vehicular
access to properties located west of the subject property. The
addition will maintain a thirteen (13) foot setback from the
existing pavement.
2. Because of special circumstances applicable to the subject
property, including location or surroundings, the strict
application of the Zoning Ordinance is found to deprive the
subject property of privileges enjoyed by other properties in
the vicinity and under identical zone classifications. Due to
the granting of the vehicular easement by the property owner,
the property will maintain an identical sideyard setback as
provided by the property located north of the easement (16705
Graham Street).
3. The granting of Conditional Exception No. 92-24 is necessary
in order to preserve the enjoyment of one or more substantial
property rights. The granting of Conditional Exception 92-24
will allow for a 91 square foot room addition to an existing
single family residence.
4. The granting of Conditional Exception No. 92-24 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications.
5. The granting of Conditional Exception No. 92-24 will not
adversely affect the General Plan of the City of Huntington
Beach. The addition to a single family dwelling is consistent
with the Low Density Residential land use designation in the
General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
May 20, 1992 shall be the conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.

4. Proposed structures shall be architecturally compatible with
existing structures.
5. All applicable Public Works fees shall be paid prior to
issuance of building permits.
6. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plan check.
