ZONING ADMINISTRATOR: Mike Strange STAFF MEMBERS: Wayne Carvalho MINUTES: The Minutes of the July 15, 1992 Zoning Administrator Meeting were approved. ITEM 1. SITE PLAN AMENDMENT NO. 92-4 Applicant: Steve Donley Donley -Bennett Architects 12821 Newport Avenue Tustin, CA 92680 Request: To approve a site plan amendment for the redistribution of compact parking stalls within an existing commercial center pursuant to Section 9811.4 of the Huntington Beach Ordinance Code. Location: 8861 Adams (Northwest corner at Magnolia) Wayne Carvalho, Staff Planner, reported that a use permit was approved in 1989 for a facade remodel on the subject property. Staff recommended the closure of one driveway cut off of Adams Avenue since there were four (4) other driveways providing access to the center from Adams Avenue, two (2) of which were within a short distance of the subject driveway. Staff also recommended a modification to the proposed stripping layout, reducing the total number of compact spaces. Staff concluded by recommedning approval of a modified site plan with findings and suggested conditions of approval. Steve Donley, the applicant, requested that the driveway be allowed to remain, stating it was vital to the bank operation. SITE PLAN AMENDMENT NO. 92-4 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. CONDITIONS OF APPROVAL: 1. The site plan received and dated July 22, 1992 shall be the conceptually approved layout with the following modifications: a. The driveway along Adams Avenue between the existing bank and proposed coffee shop shall be closed and replaced with landscaping. b. Striping for two (2) additional parallel spaces shall be provided east of the abandoned bank teller island. 3. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. The applicant/property owner shall restripe the parking lot to conform with the approved plan within sixty (60) days from the date of approval. 5. Parking stalls located east of the bank shall be designated as employee parking. 6. A Do Not Enter sign shall be placed in the planter and/or painted on the pavement at the drive-thru exit to assist on -site circulation. 7. The applicant shall replace the driveway with a new curb, gutter and sidewalk pursuant to Public Works Department standards within one hundred twenty (120) days from date of approval. 8 Maximum area allowed for retail use (1 space/200 sq. ft.) in the vacant PX suite shall be 14,500 sq. ft. The remaining 7,700 sq. ft. shall be utilized for furniture/appliance use only. Additional retail usage shall require approval of a parking variance or joint use parking agreement by the City of Huntington Beach. 10. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Site Plan Amendment No. 92-4 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2: USE PERMIT NO, 92-40 Applicant: Christina L. Glasgow 16255 Pacific Circle Huntington Beach, CA 92649 Request: To permit the use of a drive-thru window within an existing 1,200 sq. ft. freestanding commercial building (Bagelmania and Coffee House) pursuant to Section 9220.1(c) of the Huntington Beach Ordinance Code. Location: 8861 Adams (Northwest corner at Magnolia) Wayne Carvalho, Staff Planner, reported that thr maximum number of seating would be limited to twelve (12) seats and that the striping modification shall be completed prior to occupancy of the patio area. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Christina glasgow, the applicant, was present and concurred with the conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 92-40 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment, maintenance and operation of the proposed drive-thru Bagel and Coffee business will not be detrimental to: ZA Minutes 7/22/92 -3- (4014d) a. The general welfare of persons residing or working in the vicinity. With the conditions imposed, the proposed drive-thru will not obstruct on -site circulation. b. Property and improvements in the vicinity of such use or building. The proposed drive-thru is part of center -wide striping modification plan which will improve on -site circulation. 2. The granting of Use Permit No. 92-40 for a drive-thru bagel and coffee business will not adversely affect the General Plan of the City of Huntington Beach. The proposed business is consistent with the General Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated July 22, 1992 shall be the conceptually approved lAyout with the following modifications: a. The driveway along Adams Avenue between the existing bank and proposed coffee shop shall be closed and replaced with landscaping. b. Striping for two (2) additional parallel spaces shall be provided east of the abandoned bank teller island. 2. Prior to issuance of Certificate of Occupancy the parking lot striping modifications shall be completed. 3. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. All proposed signage requires separate building permits. 5. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 6. ITEM 3: NEGATIVE DECLARATION NO, 92-23 Applicant: City of Huntington Beach Request: The purpose of the project is to rehabilitate the man made lake at Chris Carr Park to restore the aesthetics of the lake and provide a healthy environment for fish and fowl. The project proposes construction of pump facilities and removal of lake sediment, stabilization of the lake edge and installation of a concrete path along the lake edge. The lake is currently drained and closed. Dredging and pump facility construction will improve lake water quality but will not alter water circulation patterns or effect the vegetation island presently contained in the lake. Location: Chris Carr Park (East side of Springdale Street between Heil and Warner Avenues) Wayne Carvalho, Staff Planner, reported that the Draft Negative Declaration was sent to the State Clearinghouse for the required thirty (30) day comment period. Staff indicated that the improvements will enhance the appearance of the park site and improve the lake water quality. Staff concluded by recommending approval of the negative declaration as submitted. Daryl Smith, Public Works, advised that the lake in the present state is an eyesore to the community and a health hazard to wildlife. NEGATIVE DECLARATION NO. 92-23 WAS APPROVED BY THE ZONING ADMINISTRATOR. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. NEGATIVE DECLARATION NO. 92-24 WAS APPROVED BY THE ZONING ADMINISTRATOR. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. ITEM 5: COASTAL DEVELOPMENT PERMIT NO, 92-21/CONDITIONAL EXCEPTION NO, 92-26/USE PERMIT NO, 92-36 Applicant: Richard Anderson 128 S. Glassell Ave. Orange, CA 92666 Request: To permit a major renovation and 4,400 square foot second and third story addition to an existing single story residence with a variance for reduced front setback (10 feet in lieu of 22 feet) for the garage pursuant to Section 9110.6 of the Huntington Beach Ordinance Code. The request includes a 478 square foot third story addition pursuant to Section 9110.4(c) of the Huntington Beach Ordinance Code. Location: 16732 Coral Cay Lane ZA Minutes 7/22/92 -6- (4014d) J 1 1 Wayne Carvalho, Staff Planner, advised that a variance was approved on the adjacent property for a 10 foot front yard setback and explained that the Tract was developed with a sixty (60) foot right-of-way with a forty (40) foot street width. Staff further explained that there was a ten (10) foot strip between the sidewalk and front property line running along the entire street. Staff stated that there would be a twenty (20) foot driveway allowing two cars to be parked. Staff indicated that the proposed addition (including the third story) was not formally approved by the Coral Cay Community Association Architectural Committee. Staff stated however, that the proposed third story met the provisions of the Huntington Beach Ordinance Code. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Richard Anderson, the applicant, was present and concurred with the suggested conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 92-21/CONDITIONAL EXCEPTION NO. 92-26/USE PERMIT NO. 92-36 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL -COASTAL DEVELOPMENT PERMIT N0, 92-21: 1. The request to permit the remodel and 4,400 sq. ft. addition to an existing single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed addition will not adversely impact public views or public access. 2. Coastal Development Permit No. 92-21 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed addition complies with the provisions of Article 911 of the Huntington Beach Ordinance Code. 3. At the time of occupancy, the proposed remodel and 4,400 sq. ft. addition to an existing single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All infrastructure currently exists to the site. ZA Minutes 7/22/92 -7- (4014d) 4. The proposed remodel and 4,400 sq. ft. addition to an existing single story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. FINDINGS FOR APPROVAL -USE PERMIT NO, 92-36• 1. The establishment, maintenance and operation of the proposed third story addition will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The proposed addition complies with standards specified in the Huntington Beach Ordinance Code. All windows and decks are oriented toward public rights -of -way. b. Property and improvements in the vicinity of such use or building. The addition will be harmonious and compatible with the streets, driveways, property lines, and surrounding neighborhood. 2. The granting of Use Permit No. 92-36 will not adversely affect the General Plan of the City of Huntington Beach. The proposed addition is consistent with the Low Density Residential Land Use designation of the General Plan. FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO. 92-2 1. The granting of Conditional Exception (Variance) No. 92-36 to allow a front entry garage at ten feet (10') in lieu of twenty-two feet (22'), will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. The existing sidewalk is located approximately twenty feet (20') from the proposed garage, leaving a driveway area large enough to accommodate two (2) cars. In addition, the reduced garage setback does not impact adjacent site angle visibility requirements. 2. Because of special circumstances applicable to the subject property, including size, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. The subdivision was developed with a sixty foot (60') right-of-way and a forty foot (40') wide street (curb to curb), leaving an approximate ten foot (10') easement between the sidewalk and actual from property line. 3. The granting of Conditional Exception No. 92-26 is necessary in order to preserve the enjoyment of one or more substantial property rights. There are several homes in the subdivision that have a reduced garage setbacks including the adjacent property to the east. 1 ZA Minutes 7/22/92 -8- (4014d) 4. The granting of Conditional Exception No. 92-26 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. The proposed front entry garage will be built with a similar setback as the garage located east of the subject property. 5. The granting of Conditional Exception No. 92-26 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 1, 1992 shall be the conceptually approved layout. 2. Automatic sprinkler systems shall be installed throughout the residence to comply with Huntington Beach Fire Department and Uniform Building Code standards. 3. The applicant shall submit a grading plan for review and approval by the Department of Public Works prior to issuance of building permits. 4. The property shall be equipped within a minimum two (2) inch water service pursuant to Public Works standards. 5. The applicant shall pay all applicable Public Works fees. 6. The Applicant/Property owner shall provide roll -up type garage doors. 7. Conditions of approval shall be printed verbatim on the cover sheet of all working drawings submitted for plan check. 8. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 9. All proposed cantilevered deck improvements require separate permits for the improvements. 10. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 11. Low -volume heads shall be used on all spigots and water faucets. 12. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. ITEM 6: ADMINISTRATIVE REVIEW NO 92-10/NEGATIVE DECLARATION NO 2-21 Applicant: Archeion 6 Morgan, Ste. 100 Irvine, CA 92718 Request: To construct a new 100,000 square foot industrial building pursuant to Section 9530.01(a) of the Huntington Beach Ordinance Code. Location 17311 Nichols Street Wayne Carvalho, Staff Planner, reported that the proposed use includes manufacturing of traffic delineator devices which involves processing of rubber and plastic materials. Staff stated that the Fire Department requested detailed plans depicting the location of hydrants and chemical storage. Staff recommended approval of a modified site plan with findings and suggested conditions of approval. Al Shenkle, representing the applicant, was present and concurred with the suggested conditions of approval.
