Zoning Administrator Meeting were
approved.
ITEM 1• TENTATIVE PARCEL MAP NO. 92-191
Applicant: Dewayne Brown
15481 Electronic Lane, Unit E
Huntington Beach, CA 92649
Request: To subdivide a 23,225 square foot parcel into two (2)
lots pursuant to Section 9921 of the Huntington Beach
Ordinance Code.
Location: 17752-17762 Metzler Lane
Wayne Carvalho, Staff Planner, reported that the request meets the
zoning code in terms of lot size and frontage. There are two
buildings on site. Staff recommended approval with findings and
suggested conditions of approval. Staff advised that a letter was
received from the applicant contesting the suggested condition for
the separate fire service connections.
Ward Kinsman, Fire Department, reported that the separate fire
service connections was required because each parcel must stand
alone for all utilities which includes fire service connections. He
advised that this is a Fire and Water Department standard as well as
Municipal Code requirement.
Dewayne Brown, the applicant, stated that the property presents a
hardship due to the 400 foot City easement for storm drain and sewer
that runs along the back and one side of the property. He stated
that the ordinance is questionable because large apartment complexes
do not have the same requirement as industrial.
TENTATIVE PARCEL MAP NO. 92-191 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The proposed subdivision of two (2) parcels for purposes of
industrial use is in compliance with the size and shape of
property necessary for that type of development. The proposed
parcels comply with Article 951 (M1-A District Standards) of
the Huntington Beach Ordinance Code.
2. The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation of
this type of use.
3. The property was previously studied for this intensity of land
use at the time the land use designation -for General Industrial
allowing industrial buildings was placed on the subject
property.
4. The size, depth and frontage, of the proposed subdivision are
in compliance with standards, plans and specifications on file
with the City as well as in compliance with the State Map Act
and supplemental City Subdivision Ordinance.
CONDITIONS OF APPROVAL:
1. The Tentative Parcel Map received by the Department of
Community Development on June 17, 1992 shall be the approved
layout (with the amendments as noted thereon).
2. A parcel map shall be filed with and approved by the Department
of Public Works and recorded with the Orange County Recorder.
A copy of the recorded parcel map shall be filed with the
Department of Community Development.
3. The applicant/property owner shall provide an independent fire
service connection to each parcel pursuant to Fire Department
and Water Department standards.
4. Reciprocal access easements shall be provided between
properties. A copy of the legal instrument shall be approved
by the Department of Community Development and City Attorney as
to form and content, and when approved shall be recorded in the
Office of the County Recorder. A copy shall be filed with the
Department of Community Development.
5. The Final Map shall be based on a field survey. Survey
monuments shall be set prior to recordation.

ITEM 2: USE PERMIT NO. 92-35
Applicant: Harold Lahaie
H.R.L. Construction, Inc.

Request: To construct a 4,150 square foot two (2) story triplex
pursuant to Section 9120.1(c) of the Huntington Beach
Ordinance Code.
Location: 7541 and 7555 Warner Ave.
Wayne Carvalho, Staff Planner, reported that the use permit is
required because the property is located on a arterial. The
proposal includes eight (8) off street parking spaces with six (6)
enclosed garages. Staff recommended approval with findings and
suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Harold Lahaie, the applicant, was present and Concurred with the
suggested conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
Mike Strange, Zoning Administrator, said he would approve the
request with an added condition that the front elevations be
reviewed by the Design Review Board.
USE PERMIT NO. 92-35 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the proposed
4,150 sq. ft. triplex will not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity. The proposed triplex will Conform with
all provisions of Article 913 (R2 development
standards).
b. Property and improvements in the vicinity of such use
or building. The proposed project will provide
additional landscaping throughout the project.
2. The granting of Use Permit No. 92-35 will not adversely affect
the General Plan of the City of Huntington Beach. The proposed
4,150 sq. ft. triplex is consistent with the Medium Density
Residential Land Use designation of the General Plan.

SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
July 9, 1992 shall be the conceptually approved layout with the
following modifications:
a. Elevations shall be approved by the Design Review Board.
b. Minimum vehicle clearance from the garage floor to
staircase (Units A & B) shall be four and one-half (4 1/2)
feet.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. Prior to issuance of building permits, applicant shall file a
parcel map consolidating the subject parcels. Said map shall
be recorded with the County of Orange Recorder prior to final
inspection and a copy of the recorded map submitted to the
Department of Community Development for inclusion in the
entitlement file.
4. Prior to issuance of building permits, the following plans and
items shall be submitted and/or completed by the applicant:
a. Four (4) sets of landscape and irrigation plans to the
Department of Community Development and public Works for
review and approval.
b. A grading plan shall be submitted to the Department of
Public Works for review and it must be approved (by
issuance of a grading permit). A plan for silt control for
all water runoff from the property during construction and
initial operation of the project may be required if deemed
necessary by the Director of Public Works.
c. All applicable Public Works fees shall be paid prior to
issuance of building permits.
5. The new driveway shall be constructed per Public Works
Department standards.
6. An automatic fire sprinkler system shall be approved and
installed pursuant to Fire Department regulations.

7. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
8. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
9. All utility apparatuses such as but not limited to backflow
devices and Edison transformers, shall be prohibited in the
front yard and exterior sideyards unless properly screened by
approved landscaping or any other method approved by the
Director of Planning. In no case shall they be within the
setback areas along Pacific Coast Highway. All such
apparatuses shall be depicted on the site plan prior to
issuance of building permits.
10. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plancheck.
NOTE: The new address for the proposed triplex is 7551 Warner
Avenue, Units A, B and C.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The structures on the subject property, whether attached or
detached, shall be constructed in compliance with the State
acoustical standards set forth for units that lie within the
60 CNEL contours of the property. Evidence of compliance shall
consist of submittal of an acoustical analysis report, prepared
under the supervision of a person experienced in the field of
acoustical engineering, with the application for building
permit(s).
5. The Zoning Administrator reserves the right to revoke Use
Permit No. 92-35 if any violation of these conditions or the
Huntington Beach Ordinance Code occurs.
