B-1 CONDITIONAL USE PERMIT NO. 92-1/NEGATIVE DECLARATION NO. 92-7
(CONTINUED FROM THE JULY 21, 1992 PLANNING COMMISSION MEETING):
APPLICANT: Gary Gorman, Huntington Beach Wetlands Conservancy
LOCATION: 21900 Pacific Coast Highway (Northwest corner at
Newland Avenue in front of the Edison Power Plant)
The Huntington Beach Wetlands Conservancy proposes to develop a
Wetlands Information and Wildlife Care Center on a vacant 1.73 acre
site at Newland Street and Pacific Coast Highway. The project will
be open to the public but will consist primarily of surgical and
rehabilitation care for local sick and injured wildlife.
The property owner, Southern California Edison, is leasing the site
to the Wetlands Conservancy for a temporary, three (3) year period
in order to retain the land for future use. The applicant,
therefore, is proposing temporary modular buildings and a crushed
aggregate ground cover in -lieu of permanent buildings and standard
paving.
This project was continued at staff's request from the July 21, 1992
Planning Commission meeting due to incomplete public notification.
Staff has completed the public notification requirements for the
August 4, 1992 meeting.
STAFF RECOMMENDATION:
Planning staff recommends approval of Conditional Use Permit No.
92-1 and Negative Declaration No. 92-7 for a maximum three (3) year
period subject to a review of the use in one (1) year as the project
complies with other development standards such as setbacks, building
height, site coverage, parking and landscaping.
The Commission discussed their concerns about the project being
short term, the operation of Car Care that currently inhabits the
site and violations by the current property owner.
THE PUBLIC HEARING WAS OPENED.
Robert London Moore, Jr., representing Mills Land and Water Company,
spoke in opposition to the request. Mr. Moore stated that he was
not aware of temporary conditional use permits and felt the
applicant was using this method in order to avoid permanent parking
lot requirements, dedications and public improvements. He also
feels the negative declaration is inadequate.
Gary Gorman, applicant, stated that the main goal of the facility
was to provide care for the wildlife. Mr. Gorman stated that he had
not acquired permits because he was not aware of development
procedures. He is trying to correct this now.
Jerry Dominguez, Southern California Edison, spoke in support of the
project.

The Commissioners were concerned that this may become an information
center instead of a hospital. The applicant assured them that the
hospital will be the primary use. The Commission stated that
although this was not the ideal spot for the hospital, it was the
most feasible. They were concerned with the fact that the applicant
proceeded without permits, they felt ignorance was not an excuse.
The also discussed the permanence of the hospital.

FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 92-1:
1. The location, site layout, and design of the proposed Wetlands
Information and Wildlife Care Center properly adapts the
proposed structures to streets, driveways, and other adjacent
structures and uses in a harmonious manner. Adequate access
from Newland Street is provided to the site.
2. The combination and relationship of the proposed use to another
on a site are properly integrated. The visitors center, animal
hospital and rehabilitation enclosures are designed to be
compatible with each other and with surrounding land uses.
There is a 100 foot buffer between the use and the wetlands
property to the southeast.
3. The access to and parking for the proposed Wetlands Information
and Wildlife Care Center does not create an undue traffic
problem. The development project meets the parking requirements
for automobiles and provides two (2) bus parking spaces.

4. The proposed Wetlands Information and Wildlife Care Center is
consistent with the General Plan designation of Industrial
Resource Production and the zone designation of M2-O-FP2
(Industrial-Oil-Floodplain) as this type of development is a
permitted use in any zone subject to conditional use permit
approval by the Planning Commission.
5. The project will comply with mitigation measures outlined in
Mitigated Negative Declaration No. 92-7 by incorporating a
minimum 100 foot buffer from the wetlands property to the
southeast and by obtaining approval for the proposed drainage
culvert and siltation pond system by the Department of Fish and
Game and the Department of Public Works.
6. The proposed Wetlands Information and Wildlife Care Center
conforms with the Coastal Development Permit requirements as
follows:
a. The proposed Wetlands Information and Wildlife Care Center
development conforms with the plans, policies, requirements
and standards of the Huntington Beach Coastal Element of the
General Plan.
b. The proposed Wetlands Information and Wildlife Care Center is
consistent with the CZ (Coastal Zone) suffix, the M2-0-FP2
(Industrial-Oil-Floodplain) zone as well as other provisions
of the Huntington Beach Ordinance Code applicable to the
property. This use is permitted in any zone as an
unclassified use subject to conditional use permit approval
by the Planning Commission.
c. At the time of occupancy, the proposed Wetlands Information
and Wildlife Care Center development can be provided with
infrastructure in a manner that is consistent with the
Huntington Beach Coastal Element and Coastal Land Use Plan of
the General Plan.
d. The proposed Wetlands Information and Wildlife Care Center
development conforms with the public access and public
recreation policies of Chapter 3 of the California Coastal
Act.
CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT N0, 92-1:
1. The site plan, floor plans, and elevations received and dated
July 15, 1992 shall be the conceptually approved layout with the
following modifications:
a. Handicapped access shall be provided to all buildings.

b. Secondary access from Pacific Coast Highway shall be gated
and posted "Emergency Access Only" subject to review and
approval by the Fire Department.
c. Replace the existing chain link fence.
d. Designate an area to accommodate a minimum of ten (10)
bicycle parking spaces.
e. Designate ultimate right-of-way line for Newland Avenue and
Pacific Coast Highway including the corner radius. All
property improvements including signage and landscaping shall
be located within the project boundaries.
f. Relocate bus parking spaces to run parallel with Pacific
Coast Highway.
2. Prior to submittal for building permits, the applicant/owner
shall complete the following:
a. Applicant shall obtain approval from Caltrans for
construction of a secondary emergency access only from
Pacific Coast Highway to the site.
b. The site plan (or reference page) shall include all
conditions of approval imposed on the project printed
verbatim.
3. Prior to issuance of building permits, the applicant/owner shall
complete the following:
a. Submit written evidence of project approval by the California
Coastal Commission.
b. The project shall comply with mitigation measures identified
in Mitigated Negative Declaration No. 92-7 by obtaining
design approval of the drainage culvert and siltation pond
system by the Department of Fish and Game and the Department
of Public works. The project shall also maintain a minimum
one hundred (100) foot buffer between the project development
and any wetlands area.
c. A $500.00 cash bond shall be posted with the city for each
modular building or temporary structure to guarantee removal
of all trailers at the time Conditional Use Permit No. 92-31
expires.

d. A Landscape Construction Set must be submitted to the
Departments of Community Development and Public Works and
must be approved. The Landscape Construction Set shall
include a landscape plan prepared and signed by a State
Licensed Landscape Architect and which includes all
proposed/existing plant materials (location, type, size,
quantity), an irrigation plan, a grading plan, an approved
site plan, and a copy of the entitlement conditions of
approval. The landscape plans shall be in conformance with
Section 9607 of the Huntington Beach Ordinance Code. The set
must be approved by both departments prior to issuance of
building permits.
e. A grading plan shall be submitted to the Department of Public
Works for review and it must be approved (by issuance of a
grading permit). A plan for silt control for all water
runoff from the property during construction and initial
operation of the project may be required if deemed necessary
by the Director of Public Works.
f. Hydrology and hydraulic studies shall be submitted for Public
Works approval.
g. All applicable Public Works fees shall be paid.
h. Perimeter fencing plans for review and approval which depict
decorative materials.
i. Submit copy of completed FEMA Elevation Certificate prepared
by a registered engineer.
j. Elevations depicting colors and materials of all structures
shall be reviewed and approved by Department of Community
Development staff.
Fire Department Requirements are as follows:
a. Two (2) fire hydrants will be installed prior to combustible
construction. Shop drawings will be submitted to the Public
Works Department and approved by the Fire Department prior to
installation.
b. Fire lanes will be designated and posted to comply with City
Specification No. 415.
c. Address numbers will be installed to comply with City
Specification No. 428. The size of the numbers will be the
following:
o The number for the building will be sized a minimum of
ten (10) inches with a brush stroke of one and one-half
(1-1/2) inches.

d. Fire access roads will be provided in compliance with the
Huntington Beach Fire Code and City Specification No. 401.
Include the circulation plan and dimensions of all access
roads (24' or 27' fire lanes, turnarounds and 17' by 45'
radius turns.)
e. Length of lot requires second access to property on Pacific
Coast Highway.
f. Parking lot and fire access lanes shall be paved with all
weather driving surface.
5. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
6. Installation of required landscaping and irrigation systems shall
be completed within twelve (12) months from approval of this
entitlement.
7. There shall be no outside storage of vehicles, vehicle parts,
equipment or trailers.
8. During construction, the applicant shall:
a. Use water trucks or sprinkler systems in all areas where
vehicles travel to keep damp enough to prevent dust raised
when leaving the site;
b. Wet down areas in the late morning and after work is
completed for the day;
c. Use low sulfur fuel (.05% by weight) for construction
equipment;
d. Attempt to phase and schedule construction activities to
avoid high ozone days (first stage smog alerts);
e. Discontinue construction during second stage smog alerts.
9. Prior to final building permit approval or issuance of a
Certificate of Occupancy, the following shall be completed:
a. The applicant shall obtain the necessary permits from the
South Coast Air Quality Management District and submit a copy
to Community Development Department.
b. All improvements (including landscaping) to the property
shall be completed in accordance with the approved plans and
conditions of approval specified herein.

c. Compliance with all conditions of approval specified herein
shall be accomplished.
10. Building permits shall be obtained for the modular trailer
installed without permits.
11. At the time of additional entitlement, proper dedication shall be
required.
12. A review of the use shall be conducted in one (1) year of the
issuance of Certificate of Occupancy to verify compliance with
all conditions of approval and applicable Articles of the
Huntington Beach Ordinance Code. If, at that time, there is a
violation of these conditions or code sections or adverse
impacts, Conditional Use Permit No. 92-1 may become null and void.
13. The Planning Commission reserves the right to revoke this
Conditional Use Permit No. 92-1 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
14. This conditional use permit shall not become effective for any
purpose until the ten (10) day appeal period has elapsed, until
coastal development permits have been obtained from the Coastal
Commission and written evidence submitted to this department, and
until an "Acceptance of Conditions" form has been properly
executed by the applicant and an authorized representative of the
owner of the property, recorded with County Recorder's Office,
and returned to the Planning Division.
15. Conditional Use Permit No. 92-1 shall become null and void unless
exercised within one (1) year of the date of final approval by
the California Coastal Commission, or such extension of time as
may be granted by the Planning Commission pursuant to a written
request submitted to the Planning Department a minimum 30 days
prior to the expiration date.
16. This conditional use permit shall expire three (3) years from the
date of Coastal Commission approval, or expiration of the
existing County E.M.A. lease from Southern California Edison,
whichever comes first.
B-2 CONDITIONAL USE PERMIT NO 92-17 WITH SPECIAL PERMITS/
CONDITIONAL EXCEPTION (VARIANCE) NO. 92-28/ TENTATIVE TRACT MAP
NO 14666/COASTAL DEVELOPMENT PERMIT NO. 92-14 (CONTINUED FROM
JULY 21, 1992 PLANNING COMMISSION MEETING):
APPLICANT: City of Huntington Beach Redevelopment Agency/
Coultrup Development Company
LOCATION: Two block area as follows:
Block 104 bounded by Pacific Coast Highway, 5th
Street, Walnut Avenue, and Main Street.
Block 105 bounded by Pacific Coast Highway, 6th
Street, Walnut Avenue and 5th Street.

The proposed project is a master plan mixed use development in
District 3 of the Downtown Specific Plan. The project is situated on
a two (2) block area (Blocks 104 and 105) bounded by Sixth Street,
Walnut Avenue, Main Street and Pacific Coast Highway. The proposal is
for two (2) commercial buildings totaling 47,774 square feet on Block
104 and an 80 unit condominium complex on Block 105. The proposal
does not include commercial use along Pacific Coast Highway between
Sixth and Fifth Streets as normally required by the Specific Plan.
Twenty (20) special permits were advertised for the public hearing.
Since the notice of public hearing, the project has been revised to
require only 15 special permits. A special permit for tandem parking
is requested but was not one of the 20 original special permits
advertised. A 325 space commercial parking variance is also requested.
STAFF RECOMMENDATION:
Staff is recommending denial of the project based on it being
inconsistent with the land use policies of the Coastal Element and
Downtown Specific Plan. Two (2) alternative actions for approval are
provided for Planning Commission consideration. Alternative Action
No. 1 requires the project to be revised to provide commercial use
along Pacific Coast Highway between Sixth and Fifth Streets.
Alternative Action No. 2 would require the Coastal Element and
Downtown Specific Plan to be amended to allow residential use
exclusively along Pacific Coast Highway between Sixth and Fifth
Streets.
Commissioner Inglee stated that he would be abstaining due to a
conflict of interest.
Barbara Kaiser, Director of Economic Development, gave a brief
overview of Redevelopment's role in the process.
THE PUBLIC HEARING WAS OPENED.
Jon Coultrup, applicant, expressed his support for the request, and
stated that the project had strong public support.
Dave Viggiano, architect for the project, submitted and explained a
matrix of the special permits to the Commission.
Richard Harlow, stated that the plan does conform to the Downtown
Specific Plan.
Connie Mandic, explained that the property owners are asking for help
to accommodate existing uses and the special need they face.
Jerry Buchanan, School District Representative, stated that the
district feels the environmental impact report inadequately addressed
the impacts on schools. He requested that the Planning Commission
deny the request unless the school issues in the environmental impact
report are mitigated.

Joe Hartge, engineer, stated that he was there to answer any technical
questions the Commission may have.
Phil Zisakis, property owner, stated his support for the project.
Bill Gallagos, property owner, stated his support for the project.
Guy Guzzardo, spoke in regards to block 105 and the historical value
of the Worthy property.
Gary Mulligan, property owner, spoke in support of the project.
James Lane, property owner, spoke in support of the project.
Bob Bolen, spoke in support of the project.

The Commission discussed their concerns regarding the Worthy property,
Phase I in comparison to Phase II, open space and vertical versus
horizontal residential development. Some of the Commissioners were
concerned that there were to many additional facts presented at the
meeting, and more time was needed for evaluation and staff comment.
It was decided to continue the item with direction from the Commission.

Conditional Use Permit No. 92-31 is a request to install an 85 foot
tall electronic message center sign between Center Avenue and the
I-405 (San Diego) Freeway. This request is pursuant to Code
Amendment No. 92-1, recently approved by the Planning Commission and
scheduled to be presented before the City Council on August 3, 1992
for adoption. The proposed sign will provide off -premise
advertisement for automobile dealers on Beach Boulevard that are
members of the Huntington Beach Auto Dealer's Association.
STAFF RECOMMENDATION:
Planning staff recommends denial of Conditional Use Permit No. 92-31
because at the time this report is written, Code Amendment No. 92-1
has not been approved by the City Council to allow this type of
signage. Staff also feels the proposed 85 foot tall sign is not
compatible with other signage in the area, that it will detract and
impact the visual beauty and scenic values of landscaping areas, and
diminish the aesthetic value of the gateway to Huntington Beach.

exit off the freeway after viewing the sign, the possibility of

a. Circulation: Develop a system of streets and highways that
ensures the safe and efficient movement of people and goods.
The subject remnant parcel is not required for the Center
Avenue/Beach Boulevard freeway off -ramp and may properly be
disposed of without affecting the efficiency of effectiveness
of the arterial highway system.
b. Land Use: Continuing to diversify the economic base of the
City and increasing the tax base. The approval of
Conditional Use Permit No. 92-31 will increase consumer
awareness of automobile dealerships on Beach Boulevard and
other participating businesses and thus increase tax revenue
to the City.
c. Land Use: To continue to promote development of commercial
centers. The approval of Conditional Use Permit No. 92-31
will increase the livelihood of existing and future
businesses that participate in advertising on the sign.

4. The granting of Conditional Use Permit No. 92-31 for an 85 foot
tall electronic message center will not adversely affect the
General Plan of the City of Huntington Beach.
5. The access to and parking for the proposed 85 foot tall
electronic message center does not create an undue traffic
problem because no parking is necessary for the implementation
of the readerboard sign.
CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 92-31:
1. The site plans and elevations received and dated July 27, 1992
shall be the conceptually approved layout with the following
modifications:
a. Revise the site plan to depict the correct project address,
7991 Center Avenue, in the lower right hand corner.
b. The elevations shall depict anti -graffiti finish, if
available, which shall be compatible with the proposed sign
materials and applied to a minimum distance of ten (10) feet
above the base of the sign.
2. The sign shall be operated in conformance with the provisions
specified in Section 9610.9(e) of the Huntington Beach Ordinance
Code.
3. All businesses, merchants and organizations participating in
advertising on the electronic message center shall be prohibited
from flying, displaying, or utilizing all temporary banners,
flags, pennants, car top signs, balloons, or other non -permanent
signage otherwise permitted under Section 9610.9(a) of the
Huntington Beach Ordinance Code.
4. Prior to submittal for building permits, the applicant/owner
shall complete the following:
a. Elevations shall depict colors and building materials
proposed.
b. The site plan shall include (or reference page) all
conditions of approval imposed on the project printed
verbatim.
5. Prior to issuance of building permits, the applicant/owner shall
complete the following:
a. Submit copy of the revised site plan, floor plans and
elevations pursuant to Condition No. 1 for review and
approval and inclusion in the entitlement file.
6. The Planning Commission reserves the right to revoke this
Conditional Use Permit No. 92-31 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.

7. Conditional Use Permit No. 92-31 shall not become effective
until Code Amendment No. 92-1 has been approved by the City
Council and is in effect.
8. Conditional Use Permit No. 92-31 shall become null and void
unless exercised within one (1) year of the date of final
approval, or such extension of time as may be granted by the
Planning Commission pursuant to a written request submitted to
the Planning Department a minimum 30 days prior to the
expiration date.
