MINUTES: The Minutes of the July 29, 1992 and
Zoning Administrator Meeting were
approved.
ITEM 1• NEGATIVE DECLARATION NO. 92-29
Applicant: City of Huntington Beach
Request: Installation/Reconstruction of street improvements in
the Oakview North Redevelopment Area. Improvements
include installation of curb, gutter and sidewalk.
Location: Oakview north vicinity including the following street
segments; Oak Lane (Warner Avenue to 1,300 feet to the
south); Ash Street (Warner Avenue to 1300 feet to the
south); Elm Street (Sycamore Avenue to Keelson Lane);
Sycamore Avenue (Oak Lane to Elm Street); Cypress Avenue
(Oak Lane to Beach Boulevard); and Keelson Lane (from
500 feet south to Cypress to 630 feet south of Cypress
Avenue).
Wayne Carvalho, Staff Planner, reported that the City of Huntington
Beach, Public Works Department, was requesting an environmental
approval of the street improvements in the Oakview Redevelopment
Project Area. He advised that the Environmental Assessment
Committee had reviewed the request and recommended a mitigated
negative declaration be filed. The negative declaration was posted
for twenty-one days and no comments were received. Staff concluded
by recommending approval with mitigation measures.
Tony Folaran, Public Works, was present to respond to questions.

NEGATIVE DECLARATION WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING MITIGATION MEASURES. THE ZONING ADMINISTRATOR STATED
THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO
THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
Mitigation Measures:
1. In order to minimize impacts to the existing street scene
regarding 72 mature trees, the Department of Public Works shall
replace at a one to one ratio all trees which will be removed as
a result of the street improvement project. Replacement trees
may be located on private property adjacent to the former tree
locations or within the public right-of-way; concentrations of
trees shall be located toward points of arterial access (i.e.
Oak and Ash Streets approaches to Warner Ave. and the Cypress
Avenue approach to Beach Boulevard).
2. In order to minimize temporary circulation hazards, the
applicant shall submit a construction plan for approval by the
City's Traffic Division prior to construction.
a. The plan shall include, at minimum, alternate routes for
traffic during construction, construction vehicle routes and
proposed warning signage and markings to provide adequate
warning to motor vehicles, bicyclists and pedestrians. The
plan shall be implemented during construction.
b. The applicant shall notify the Police and Fire Departments,
about the extent and duration of any construction activities
which will impede emergency circulation a minimum 24 hours
prior to the initiation of such activities.
ITEM 2: USE PERMIT NO. 92-4
Applicant: Sang S. Kim

Huntington Beach, CA 92646
Request: To permit the establishment of a martial arts studio
within an existing 2,000 sq. ft. retail suite pursuant
to Section 9220.1(c) of the Huntington Beach Ordinance
Code.
Location: 10088 Adams Avenue
Wayne Carvalho, Staff Planner, reported that various City
Departments reviewed the request and no negative comments were
received. The hours of operation will be Monday through Friday
10:00 AM to 9:00 PM, Saturday 9:00 AM to 3:00 PM and closed on
Sunday. Staff concluded by recommending approval with findings and
conditions of approval.

THE PUBLIC HEARING WAS OPENED.
Mr. Kim, the applicant, advised that most of the students are
children who will be driven to the studio by adults; therefore the
use will not impact parking in the center.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 92-29 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL - USE PERMIT NO. 92-45:
1. The establishment, maintenance and operation of the proposed
martial arts studio will not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity. The studio will have scheduled classes
with reduced hours of operation which will minimize any
parking impacts.
b. Property and improvements in the vicinity of such use
or building. The business will occupy a 2,000 sq. ft.
commercial suite within an existing commercial center.
2. The granting of Use Permit No. 92-45 will not adversely affect
the General Plan of the City of Huntington Beach. The proposed
martial arts studio is consistent with the General Commercial
Land Use designation of the City's General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, received and dated July 16, 1992 shall be the
conceptually approved layout.
2. Hours of operation shall be limited to 10:00 a.m. to 9:00 p.m.
(Monday - Friday), 9:00 a.m. to 3:00 p.m. (Saturday), closed.
Sunday and Holidays.
3. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.

4. Any modification to existing signs or installation of new signs
shall require separate building permits.
5. Address numbers shall be installed to comply with City
Specification #428. The subject suite shall be sized a minimum
of four (4) inches with a brush stroke of one-half (1/2) inch.
6. Fire extinguishers shall be installed and located in areas to
comply with Huntington Beach Fire Code Standards.
7. Exit signs and exit path markings shall be provided in
compliance with the Huntington Beach Fire Code and Title 24 of
the California Administrative Code.
8. Conditions of approval shall be printed verbatim on all working
drawings submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke Use
Permit No. 92-25 if any violation of these conditions or the
Huntington Beach Ordinance Code occurs.
ITEM 3: CONDITIONAL EXCEPTION NO, 92-29
Applicant: Bernie Siwek
21122 Indigo Circle
Huntington Beach, CA 92646
Request: To permit the construction of a 216 sq. ft, room
addition resulting in reduced open space dimensions
(14'9" in lieu of minimum 25') pursuant to Section
9110.9(a) of the Huntington Beach Ordinance Code.
Location:. 21122 Indigo Circle
Wayne Carvalho, Staff Planner, reported that the proposed 216 square
foot room and second story deck addition will result in a reduction
to the minimum dimension for open space. He stated, however, that
the addition meets the minimum setback and total open space
requirements. Staff reported that one call was received in
opposition to the request. Staff concluded by recommending approval
based on findings and conditions of approval.

THE PUBLIC HEARING WAS OPENED.
Mr Siwek, the applicant, advised that he recently purchased the home
which had previously been rented and they were in the process of
fixing it up. He indicated that the upper story deck would
primarily be used for weekend leisure with his wife. He said that
along with the proposed addition, the entire house would be painted.
Rob Ellery, 21121 Cocobana Lane, advised that he owns the property
directly in back of the subject request. He said that the requested
addition would be on the side of the property that faces his main
living areas and that the second story deck would allow a
"birds -eye" view of his property. He stated that the deck would
reduce his property value.
Mr. Ellery responded to Mike Strange, Zoning Administrator, that he
is less opposed to the room addition; however, strongly opposed to
the deck.
Helen Ellery, 21121 Cocobana Lane, was strongly opposed to the
request stating that any construction activity would have a negative
impact on their ability to sell their home which was currently on
the market.
Nancy Krueger, 21111 Cocobana Lane, advised that her main concern
with the request was the sun deck and the loss of privacy.
There were no other persons present to speak for or against the
request and the public hearing was closed.
Mike Strange, Zoning Administrator, said he would approve the one
story room addition without the sun deck due to land related
hardship.
CONDITIONAL EXCEPTION NO. 92-29 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The granting of Conditional Exception No. 92-29 for a reduction
in the required open space minimum dimension will not
constitute a grant of special privilege inconsistent upon other
properties in the vicinity and under an identical zone
classification. The subject lot is located at the end of a
cul-de-sac with less than 6,000 sq. ft. of lot area. The shape
of the lot restricts structures on the front portion of the lot.

2. Because of special circumstances applicable to the subject
property, including size, shape, topography, location or
surroundings, the strict application of the Zoning Ordinance is
found to deprive the subject property of privileges enjoyed by
other properties in the vicinity and under identical zone
classifications. The subject property is an odd -shaped lot
restricting any building on the front one-third (1/3) of the
lot.
3. The granting of Conditional Exception No. 92-29 is necessary
in order to preserve the enjoyment of one or more substantial
property -rights. The proposed addition will provide for a one
story recreation,room..
4. The granting of Conditional Exception No. 92-29 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications. Granting of
reduction in open space minimum dimension will not reduce the
required total open space area (1,200 square feet). Further,
:)I, with the conditions imposed, the surrounding properties will
maintain privacy.
5. The granting of Conditional Exception No. 02-29 will not
adversely affect the General Plan of the City of Huntington
Beach. The addition is consistent with the Low Density
Residential Land Use designation of the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
July IQ, 1992 shall be the conceptually approved layout with
the following modifications:
a. The second story deck shall be deleted and revised to
depict a pitched roof.
2. Proposed structures shall be architecturally compatible with
existing structures.
3., 411 building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
4. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plancheck.
5. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
