ZONING ADMINISTRATOR: Mike Strange STAFF MEMBERS: Wayne Carvalho MINUTES: The Minutes of the August 5, 1992 Zoning Administrator Meeting were approved. ITEM 1: SITE PLAN AMENDMENT NO. 92-5 Applicant: Kaiser Foundation Health Plan, Inc. Jeffrey J. Lambert 393 E. Walnut Street - Prop. Acquisition Pasadena, CA 91188 Request: To permit the modification of existing driveways by closing one driveway, widening another driveway, and creating another driveway off Joyful Lane (rear of property) pursuant to Section 9811.4 of the Huntington Beach Ordinance Code. Location: 18081 Beach Blvd. Wayne Carvalho, Staff Planner, indicated that the project would result in the reduction of one driveway onto Beach Boulevard which is consistent with the City's Circulation Element. Staff also reported that three letters were submitted in opposition to the rear driveway off Joyful Lane. Staff concluded by recommending approval based on the limited hours of operation and consistency with the Circulation Element of the General Plan. THE PUBLIC HEARING WAS OPENED. Jeff Lambert, the applicant, stated that Kaiser Foundation wanted improve circulation on their property. He stated that visitors/patients do not observe the entrance in time and proceed to slam on their brakes or turn in on the second (south) driveway which is for exiting only. Dick Harlow, representing Bijan Sassounian, spoke in opposition to the request. He said that the request if approved would set a precedent by establishing a commercial entrance from a residential street and would be inconsistent with City policy. Bijan Sassounian, 2124 Main Street, spoke in opposition to the request. He advised that the Kaiser Foundation results in 1,800 visits per day which is unacceptable for a residential area. Dr. Bock, representing the homeowners association (south of the approved condomonium project), spoke in opposition to the request. He said his main concern was the increased number of vehicles driving on Joyful Drive to visit the Kaiser facility. There were no other persons present to speak for or against the request and the public hearing was closed. SITE PLAN AMENDMENT NO. 92-5 WAS DENIED BY THE ZONING ADMINISTRATOR. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. ITEM 2: USE PERMIT NO, 92-42 Applicant: Vicki Beato 18752 Beach Blvd. Huntington Beach, CA 92648 Request: To permit an exterior facade remodel to existing commercial building and modifications to the existing parking lot. Location: 18760 Beach Blvd. Wayne Carvalho, Staff Planner, reported that the request for the exterior facade remodel had been heard by the Design Review Board and was approved with modifications. Staff recommended the property owner provide an offer for reciprocal access to the adjacent property owners and the pole sign be removed as conditions of approval. 1 ZA Minutes - 8/12/92 -2- (4322d) THE PUBLIC HEARING WAS OPENED. Tom Wickstrom, architect for the project, advised that the intent of the request is to bring in more business to the restaurant. He appealed to the Zoning Administrator to allow the freestanding pole sign to remain. He also indicated that the reciprocal access to the south would not be possible because International House of Pancake's property is three feet higher and the owner wants to put in a block wall. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 92-42 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The establishment and maintenance of the proposed facade remodel and parking lot modification will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The proposed project will enhance the appearance of the existing commercial center and will provide additional on -site parking. b. Property and improvements in the vicinity of such use or building. The proposed project will reduce the number of driveways onto Beach Boulevard and eventually provide reciprocal access with adjacent properties. 2. The granting of Use Permit 92-42 will not adversely affect the General Plan of the City of Huntington Beach. The proposed facade remodel and parking lot modification is consistent with the General Commercial land use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 30, 1992 shall be the conceptually approved layout with the following modifications: a. Architectural treatment shall be incorporated around the north building elevation to match the west and south elevations as suggested by the by Design Review Board. b. The new driveway shall not encroach onto the southern property. ZA Minutes - 8/12/92 -3- (4322d) 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. Landscape and irrigation plan to the Departments of Community Development and Public Works for review and approval. Said landscape plan shall include five (5) twenty-four (24) inch Queen palms evenly spaced along the front property line as approved by the Design Review Board. b. Rooftop Mechanical Equipment Plan. Said plan shall indicate screening of all rooftop mechanical equipment and shall delineate the type of material proposed to screen said equipment. c. All applicable Public Works fees shall be paid. 4. Installation of required landscaping and irrigation systems shall be completed prior to final inspection. 5. Applicant shall pursue CalTrans approval of radius type driveways on Beach Boulevard. 6. Driveway on Beach Boulevard shall have a minimum width of thirty feet (30'). 7. Remove existing northerly driveway and replace with curb, gutter and sidewalk per Public Works standards. 8. Remove and replace damaged pavement along entire frontage of project, approximately three (3) feet past the edge of existing gutter. 9. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 10. All signs shall be brought into compliance with the Huntington Beach Ordinance Code prior to final building inspection. 11. All new wall signs shall be of channel letter type. ZA Minutes - 8/12/92 -4- (4322d) 12. If lighting is included in the parking lot, high-pressure sodium vapor lamps shall be used for energy savings. All outside lighting shall be directed to prevent "spillage" onto adjacent properties. 13. Prior to issuance of building permits, the subject property shall enter into irrevocable reciprocal driveway and parking easement(s) between the subject site and adjacent properties. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development prior to occupancy or final inspection, whichever occurs first. 14. Conditions of approval shall be printed verbatim on the cover sheet of all working drawings submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke Use Permit No. 92-42 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 3• USE PERMIT NO. 92-43 Applicant: Windrose Development Company 7491 Talbert Ave., Ste. 200 Huntington Beach, CA 92648 Request: To permit the demolition of two (2) commercial buildings and construction of a 4,880 square foot commercial building with a special permit for compact parking spaces (5) pursuant to Sections 9220.1(c) and 9606.3 of the Huntington Beach Ordinance Code. Location: 17827 and 17837 Beach Blvd. ZA Minutes - 8/12/92 -5- (4322d) Wayne Carvalho, Staff Planner, reported that the request meets Code for landscaping, parking and setback requirements. Staff advised that the request had been heard by the Design Review Board who recommended approval with conditions. Staff concluded by recommending approval with findings and conditions of approval which included a parcel map to legally subdivide the parcels. THE PUBLIC HEARING WAS OPENED. Fred McMurto, representing the applicant, advised that Windrose Development was in the process of purchasing the property. He said the proposal is to replace the buildings with new buildings designed for automotive services. The applicant advised that they would be adding landscaping and removing one of the driveways off Beach Boulevard. He concluded by opposing the condition that required street improvements on Ronald Road. Margaret Dattels, owner of the adjacent property, spoke in opposition to the request. Ms. Dattels advised that the use would not be compatible with the types of businesses in the adjacent center. She also was concerned about noise that would be generated from the use, and access to her property. Pat Lester, representing the current property owner, spoke in support of the request. There were no other persons present to speak for or against the request and the public hearing was closed. Mike Strange, Zoning Administrator, advised that City policy requires that all new construction on Beach Boulevard be heard by the Planning Commission. USE PERMIT NO. 92-43 WAS REFERRED TO THE PLANNING COMMISSION BY THE ZONING ADMINISTRATOR. ITEM 4: CONDITIONAL EXCEPTION NO 92-27 Applicant: Martin Gobel 205 Thirteenth Street, Unit A Huntington Beach, CA 92648 Request: To permit a second story balcony within five (5) feet of the front property line in lieu of the required eight (8) feet pursuant to Section 9130.6 of the Huntington Beach Ordinance Code. Location: 205 Thirteenth Street 1 ZA Minutes - 8/12/92 -6- (4322d) 1 Wayne Carvalho, Staff Planner, reported that other properties in the adjacent neighborhood had similar balcony encroachments into the required front yard setback; however, they were constructed prior to the code change. Staff recommended denial based on the finding that there was no land related hardship. THE PUBLIC HEARING WAS OPENED. Martin Gobel, the applicant, provided a list of properties in the area that have balcony encroachments into the frontyard setback. There were no other persons present to speak for or against the request and the public hearing was closed. Mike Strange, Zoning Administrator, advised that staff would research the list provided by the applicant to determine if variances had been granted. CONDITIONAL EXCEPTION NO. 92-27 WAS CONTINUED BY THE ZONING ADMINISTRATOR TO THE MEETING OF AUGUST 19, 1992. ITEM 5: REVOCATION OF HOME''OCCUPATION PERMIT Applicant: Vince and Susan Redmond 17392 Forbes Lane Huntington Beach, CA 92649 Request: Revocation Hearing for a Home Occupation Permit involving Redmond Bumper Service located at the address below pursuant to Section 9730.42 of the Huntington Beach Ordinance Code. Location: 17392 Forbes Lane Wayne Carvalho, Staff Planner, advised that the Code Enforcement Section requested the hearing based on on -going violations of the home occupation permit. Staff indicated that the applicant is storing bumpers in the side and rear yards of his property. Staff concluded by recommending revocation of the home occupation permit. Michael Gregory, Code Enforcement Officer, advised that he had been working with the owners for almost one year to clean up and remove the bumpers and there had been no significant improvement. THE PUBLIC HEARING WAS OPENED. ZA Minutes - 8/12/92 -7- (4322d) Mr. Redmond, owner, advised that he had been looking for a new location to move his business in the City. He said that there were delays in finding a new location due to serious personal and health problems. He said the original complaint filed against the business was for storage in the front yard and he had resolved that issue. Lisa Zar, adjacent property owner, advised that she was the person who filed the complaint. She said that the bumpers are stored up against her fence and that the storage is harboring rodents. She presented pictures of mature rats that had been trapped in her garage. She also said she had four children who were afraid to play in their yard or enter the garage. HOME OCCUPATION PERMIT FOR REDMOND BUMPER SERVICE LOCATED AT 17392 FORBES LANE WAS REVOKED BY THE ZONING ADMINISTRATOR WITH COMPLETE REMOVAL OF OUTSIDE STORAGE ITEMS WITHIN TWENTY-ONE (21) DAYS THE MEETING WAS ADJOURNED AT 3:05 PM BY THE ZONING ADMINISTRATOR TO THE NEXT REGULARLY SCHEDULED MEETING OF THE ZONING ADMINISTRATOR ON WEDNESDAY, AUGUST 19, 1992, AT 1:30 PM.
