MINUTES: The Minutes of the August 12 and 19,
1992 Zoning Administrator Meetings
were continued.
ITEM 1: USE PERMIT NO. 92-50
Applicant: St. Bonaventure Church
Request: To permit a Temporary Outdoor Event (Annual
Church Festival) on October 9 - 11, 1992
pursuant to Section 9730.64 of the Huntington
Beach Ordinance Code.
Location:
16400 Springdale
Wayne Carvalho, Staff Planner, reported that public hearing notices
were inadvertently not mailed to the surrounding property owners.
Staff recommended a one week continuance to send notices.
The Zoning Administrator, Mike Strange, advised that it is City
policy that the surrounding residents are advised of the hearing.
A representative from St. Bonaventure said in the past they had been
required to have ten police officers and one sergeant on duty. He
requested that this be reduced to seven officers and one sergeant.
Staff indicated that they were in receipt of a communication from
the Police Department addressing the security and barricade issues.
USE PERMIT NO. 92-50 WAS CONTINUED BY THE ZONING ADMINISTRATOR TO
THE MEETING OF SEPTEMBER 9, 1992
ITEM 2: USE PERMIT NO. 92-38
Applicant: Orange County Farm Bureau

Request: To permit a temporary outdoor event for a
Certified Farmers Market from 2:00 p.m. to 6:00
p.m. for an additional eleven (11) Fridays
commencing September 4, 1992 pursuant to Section
9730.64 of the Huntington Beach Ordinance Code.
Location: Southwest Corner of Main Street and Orange Ave.
Wayne Carvalho, Staff Planner, reported that the request was for an
eleven (11) week extension for the farmers market. Staff reported
that the market had been very successful over the last ten (10)
weeks. Staff indicated that a $500 bond would be required to be
posted by the applicant, banners and signs be relocated off the
landscaping and the site plan be revised to indicate the trucks on
the west side of the alley. Staff concluded by recommending
approval with findings and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Nancy Urias, representing the applicant, was present and agreed to
the suggested conditions of approval.
Kimberly Glick, Business Owner of Tutti Flora 200 Main Street, was
present. She supported the market, however, was concerned with the
flower booth in the market as it resulted in a severe economic loss
to her business. She explained that Friday's had been her busiest
day, however, with the market operation, it had become her slowest.
She advised that she had contacted The Orange County Farm Bureau to
obtain a booth and her request was denied. She requested that the
City condition the approval on allowing an additional flower booth
or prohibit the flower booth.
Nancy Urias, responded, by advising that only individual growers
certified by the County were allowed to sell at the farmers market.
She said one of the requirements is that all sellers must grow the
items themself. She also said that the organization limits the
number of types of sellers.
Mike Strange, Zoning Administrator, tabled the item to allow the two
parties to meet with Keith Bohr of the Redevelopment Office to
resolve the issue.

USE PERMIT NO. 92-38 (EXTENSION OF TIME) WAS APPROVED FOR ELEVEN
(11) FRIDAYS, COMMENCING SEPTEMBER 4, 1992 BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO
CALENDAR (2) DAYS.
Conditions of Approval:
1. All previous conditions of approval still apply.
2. No trucks or displays shall be located within the public
alley; emergency access shall be provided.
ITEM 3: USE PERMIT NO, 92-52
Applicant: Steve Bartosch

Westminster, CA 92683
Request: To permit the installation of a satellite dish antenna
on the roof of a single family dwelling pursuant to
Section 9730.85.4 of the Huntington Beach Ordinance
Code.
Location: 4232 Branford Street
Wayne Carvalho, Staff Planner, reported that the request is to
relocate an existing satellite dish. Staff advised that the use
permit is required due to deviations in screening requirements. The
dish will be moved from the roof on the rear of the property on to
the patio cover located in the side of the property. Staff
concluded by recommending approval with findings and suggested
conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Steve Bartosch, the applicant, was present. He advised that the
permit for the original dish was never issued. He indicated that
the dish should never have been placed on the roof and that the
proposed location would be an improvement.
There were no other persons present to speak for or against the
request and the public hearing was closed.

USE PERMIT NO. 92-52 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the proposed
satellite dish antenna will not be detrimental to:
a. Property and improvements in the vicinity of such use
or building. The satellite dish is proposed to be
situated in the most inconspicuous location, while
still being able to receive transmissions.
b. The general welfare of persons residing or working in
the vicinity. The satellite dish does not exceed the
maximum height limit nor does it encroach into any
required setbacks.
2. The granting of Use Permit No. 92-52 will not adversely affect
the General Plan of the City of Huntington Beach. The proposed
satellite dish antenna is consistent with the Low Density
Residential Land Use designation of the City's General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
August 10, 1992 shall be the conceptually approved layout with
the following modification:
a. the proposed four foot lattice fence on the patio cover
shall be deleted.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plan check.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.

2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The Zoning Administrator reserves the right to revoke Use
Permit No. 92-52 if any violation of these conditions or the
Huntington Beach Ordinance Code occurs.

Request: To permit a model home complex for Tentative Tract
13439 pursuant to 9730.32 of the Huntington Beach
Ordinance Code.
Location: Saddleback Lane at Derby Circle
Wayne Carvalho, Staff Planner, reported that the request is to
permit the construction of three model homes a sales office trailer
for Tract No: 13439. Staff advised that other departments reviewed
the request and their comments were incorporated into the suggested
conditions of approval.
Jeff Smith, representing the applicant, was present. He requested
to open the sales office prior to the completion of the street
improvements.
Mike Strange, Zoning Administrator, explained that it was a Fire
Department requirement and that the condition would allow for
written Fire Department approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
ADMINISTRATIVE REVIEW NO. 92-12 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans and elevations received and
dated August 31, 1992 shall be the conceptually approved
layout.
2. Plans must be submitted to the Building Division showing
handicapped access into and around the sales area.

3. Fire access lanes shall be maintained. If fire lane
violations occur and the services of the Fire Department
are required, the applicant will be liable for expenses
incurred.
4. Prior to issuance of building permits, all roads shall be
completed, fire lane signs be provided and fire hydrants in
service, or the applicant shall obtain written approval by
the Fire Department.
5. The office use shall be discontinued within thirty (30)
days following sale of the last on -site unit. A cash bond
of one thousand dollars ($1,000) shall be posted with the
City for the sales office and for each model home ($4,000
total).
6. No sales office or model shall be converted or expanded
into a general business office for the contractor or
developer.
7. All previous conditions of approval from Conditional Use
Permit No. 89-6, Tentative Tract 13439 shall remain in
effect.

Request: One (1) year extension of time.
Location: 5301 Sagamore
Wayne Carvalho, Staff Planner, reported that the applicant is
requesting a one year extension of time due to the current economic
situation. Staff recommended approval of the request.
The applicant was not present.
COASTAL DEVELOPMENT PERMIT NO. 91-17 (ONE YEAR EXTENSION OF TIME
WAS APPROVED BY THE ZONING ADMINISTRATOR . THE ZONING ADMINISTRATOR
STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE
APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
