Zoning Administrator Meeting were
approved and the minutes of August
19, and September 2, 1992, Zoning
Administrator Meetings were continued.
ITEM 1: USE PERMIT NO. 92-50
Applicant: St. Bonaventure Church

Attn: John Andrews
Request: To permit a Temporary Outdoor Event (Annual
Church Festival) on October 9 - 11, 1992
pursuant to Section 9730.64 of the Huntington
Beach Ordinance Code.
Location:

Wayne Carvalho, Staff Planner, reported that the item was continued
from the September 2, 1992 Zoning Administrator Meeting. Staff
advised that the request was for the annual church festival with the
standard conditions of approval as in the past years. Staff said
that there is one change in the conditions from the past festivals
regarding the number of Police Officers and security guards on site
and at the barricades on adjacent streets. Staff suggested that the
Police Chief would determine the number of Officers required both on
site and at the barracades. Staff concluded by recommending
approval with findings and suggested conditions of approval.
THE PUBLIC HEARING WAS REOPENED.
Sheela Andrews, representing the applicant, was present and
concurred with the conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 92-50 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO
CALENDAR (2) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance, and operation of the three (3)
day church festival will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity. With the conditions imposed, parking,
circulation and noise impacts will be minimal. Further,
there were no area residents present at the hearing in
opposition to the request.
b. Property and improvements in the vicinity of such use or
building. All improvements are temporary in nature.
2. The granting of Use Permit 92-50 will not adversely affect the
General Plan of the City of Huntington Beach. The proposed
use is temporary.
SPECIAL CONDITIONS OF APPROVAL:
1. Prior to the event, the following shall be completed:
a. All necessary electrical permits shall be obtained.
b. The applicant shall obtain clearance from the Public
Liability Claims Coordinator, Administrative Services
Department, and/or shall provide a Certificate of
Insurance and Hold Harmless Agreement to be executed at
least five (5) days prior to the event.

c. An on -site inspection by the Fire Department shall be
required prior to the event. The applicant shall apply to
the Fire Department for a Fire Department permit at least
seven (7) days prior to the event to allow for this
inspection and to allow sufficient time for final
documents to be issued. The applicant shall also submit,
along with the application, a detailed site plan
indicating fire lanes and booth, ride, and large equipment
locations. The applicant shall meet with a Fire
Department representative at the time of issuance of the
permit to receive approval of the submitted site plan.
The site shall be inspected for compliance prior to 10:00
a.m. on the opening day.
d. Prior to operation of any equipment used in conjunction
with the amusement rides, the City shall be in receipt of
State Certification and permits, showing inspection within
one (1) year period, stating that the rides meet all
requirements of the State Industrial Safety Division.
e. The Church shall provide to the City a name and telephone
number of a contact person with whom the local residents
may make contact about any complaints they may have on the
festival activities between the dates of October 9 through
October 11, 1992. The Church shall distribute a letter to
the affected residents indicating the contact person's
name and a map showing what streets will be barricaded.
f. The proposed Bingo tent shall be a minimum of twenty (20)
feet from the convent.
g. The Code Enforcement Section shall inspect the site for
compliance with all conditions of approval prior to 10:00
a.m. opening day.
2. The hours of operation of the festival shall be limited to the
following: Noon to 10:30 p.m. on Friday, 10:00 a.m. to 10:30
p.m. on Saturday, and 2:00 p.m. to 10:30 p.m. on Sunday.
3. All operations of the festival, including machinery other than
necessary refrigeration units and the sale of alcohol, shall
desist between the hours of 9:30 p.m. and 8:00 a.m.
4. Use of amplifiers, speakers, musical instruments, and playing
of recorded music are to be discontinued as of 9:00 p.m. each
evening.
5. All activity on the site or clean-up activity off -site shall
be shut down by 11:00 p.m. All activities shall conform to
the provisions of the Huntington Beach Ordinance Code
regarding noise.

6. Uniformed officers shall be provided on -site during the
operation hours of the event, in number as determined by the
Police Chief. The contract for the officers shall include a
one half-hour period before and after the scheduled duty time
for briefing and travel time. Where there may not be a
sufficient number of Huntington Beach Police Officers, the
applicant shall hire private security guards. The applicant
shall be required to meet with the Patrol Sergeant to ensure
standard enforcement between shifts.
7. Two (2) people from the Church shall patrol the adjacent
surrounding neighborhoods during the hours of the festival
operation to prevent trespassing and littering, and additional
Church personnel shall monitor Springdale Avenue to deter
patrons from jaywalking to reach the carnival or parking lot.
8. An announcement shall be made in the Church at all masses one
week prior to the event to ask the parishioners not to park on
the neighborhood streets, and that workers at the event itself
be encouraged to park in the Lutheran Church parking lot.
9. The following traffic, circulation, and on -site parking
provisions shall be made during the event:
a. Barricades shall be placed at the intersections of
Springdale Street and Brassie Circle, Springdale Street
and Orlando Drive, Heil Avenue and Bradbury Lane, Orlando
Drive and Bradbury Lane, and Orlando Drive and Angler
Lane. The applicant shall provide, at their expense,
uniformed police officers or private security guards to
man the barricades at all times during the hours of
operation at all locations one (1) hour prior to the
opening of the festival to the close of each day (to be
approved by the Traffic Engineer and Traffic Division of
the Police Department). The barricades at Angler and
Orlando Drive as well as at Bradbury Lane and Orlando
Drive and Brassie Circle and Springdale Street shall not
be required to be manned. Barricades shall be delivered
and available for placement one (1) day prior to the
event. Barricades shall be twelve (12) feet in length,
reflectorized, and have lighting equipment which is
automatically activated at dusk.
b. Appropriate signs (temporary) for the direction of traffic
and on -site parking shall be provided by the applicant.
Said signs, location, and content to be as recommended by
the Traffic Division of the Police Department.
c. The vehicular access off of Orlando Drive and Bradbury
Lane shall be secured and not used for access or egress to
the site except for emergency purposes.

d. All vehicular access and egress to the site shall be via
the Church driveway located mid -block on Springdale Street.
e. Vehicular parking shall be prohibited on the driveway
leading to Orlando Drive so that emergency access will not
be impeded.
f. Additional temporary fencing shall be erected along
Bradbury Lane to close off any access from that street into
the festival grounds.
g. Any refrigeration truck to be placed on site shall be
located as near as possible to the intersection of
Springdale Street and Heil Avenue to minimize noise from
the unit.
h. The police shall place barricades at the left turn lane on
Orlando Drive to prevent any turning into the Church
property at this location.
10. All equipment and manpower required by Condition Nos. 6 and 9
a. shall be provided at the applicant's expense.
11. No structures, booths, etc., shall be erected on the site
sooner than two (2) weeks prior to the event, and all evidence
of the activity (booths, rides, and other material) shall be
completely removed from the site within two (2) weeks of
closing of the festival. All rental equipment shall be removed
from the site within one (1) week of closing of the festival.
12. A temporary fence acceptable to the Police Department, shall be
constructed to control the crowds around the haunted house.
13. The applicant shall provide professional clean-up crews to
clear the adjacent streets of trash and debris each evening
after closing of the activity.
14. All trash, debris, and garbage, as well as special dumpsters,
shall be removed from the site within two (2) days of the
closing of the festival.
15. Alcoholic beverage sales are subject to review and approval of
the Alcoholic Beverage Control Board and issuance of a license.
16. In the event there are any violations of the foregoing
conditions or any violations of life safety codes or the
festival conditions, the festival activity will be terminated
and not permitted to reopen.
17. Parking lots shall be monitored by Church personnel. When a
parking lot becomes full, a "Lot Full" sign shall be placed at
the entrance to the parking lots.

ITEM 2: TENTATIVE PARCEL MAP 92-19
Applicant: The Dahl Company
123 Agate, Suite B
Balboa Island, CA 92662
Request: To consolidate three (3) lots into two (2) for
single family residential purposes pursuant to
Section 9921 of the Huntington Beach Ordinance
Code.
Location: South of Ellis Ave., west of Goldenwest Street
(Tract 13439, Lots 19, 20, 21)
Wayne Carvalho, Staff Planner, reported that the request will
enlarge the lot sizes of two parcels within Tract 13439. Staff
advised that no comments were received from other City Departments
and that the request complies with the minimum lot size and lot
frontage requirements. Staff concluded by recommending approval.
Jeff Smith, representing the applicant was present, said that the
request meets the intent of the Ellis/Goldenwest Specific Plan.
This was not a public hearing.
TENTATIVE PARCEL MAP NO. 92-199 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The proposed consolidation of three (3) parcels into two (2)
for purposes of Estate Residential use is in compliance with
the size and shape of property necessary for that type of
development. The proposed consolidation is consistent with
the Ellis-Goldenwest Specific Plan and Huntington Beach
Ordinance Code.
2. The General Plan has set forth provisions for this type of
land use as well as setting forth objectives for
implementation of this type of use. The proposed
consolidation is consistent with the Estate Residential Land
Use Designation of the General Plan.
3. The property was previously studied for this intensity of
land use at the time the land use designation for Estate
Residential allowing single family residences was placed on
the subject property.

4. The size, depth, frontage, street width and other design and
improvement features of the proposed consolidation are
proposed to be constructed in compliance with standards plans
and specifications on file with the City as well as in
compliance with the State Map Act and supplemental City
Subdivision Ordinance.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR
ANY PURPOSE:
1. The Tentative Parcel Map received by the Department of
Community Development on August 7, 1992 shall be the approved
layout with the amendments as noted thereon which include:
a. The existing and proposed zoning designation as
Ellis-Goldenwest Specific Plan.
2. Grading elevations and proposed pad heights are subject to
approval by the Public Works and Community Development
Departments.
3. A parcel map shall be filed with and approved by the
Department of Public Works and recorded with the Orange
County Recorder. A copy of the recorded parcel map shall be
filed with the Department of Community Development.
4. All previous conditions on Tentative Tract Map 13439,
Conditional Use Permit No. 89-6(A) and Conditional Exception
No. 90-5 are still in effect.
ITEM 3: USE PERMIT NO. 92-48
Applicant: Michael Mehalick
320 22nd Street
Huntington Beach, CA 92648
Request: To permit a 770 square foot addition to an existing
single family residence with non -conforming sideyard
setbacks (3110" in lieu of 5'), including an additional
unit over a new garage pursuant to Section 9652(c) of
the Huntington Beach Ordinance Code.

Wayne Carvalho, Staff Planner, reported that the request was for an
addition to a single family home including the demolition of the
existing garage. The plans depict a new three car garage with a one
bedroom unit above. Staff advised that the use permit is required
because of the non -conforming side yard setback. Staff concluded by
recommending approval with findings and suggested conditions of
approval.
THE PUBLIC HEARING WAS OPENED.
Michael Mehalick, was present, who advised that the existing one
story house was constructed in 1951. He said the property is
located on two (2) twenty-five foot wide lots. He said that the
sideyard setback of 3' 10" should not create a problem because it is
a one story structure.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 92-48 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the proposed
770 sq. ft. addition including new garage and one bedroom unit
will not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity. The new garage and upper story unit will
maintain required setbacks. The property will also
comply with the open space requirements of the
Huntington Beach Ordinance Code.
b. Property and improvements in the vicinity of such use
or building. The proposal will include alley
dedication and removal of a non -conforming garage.
2. The granting of Use Permit No. 92-48 will not adversely affect
the General Plan of the City of Huntington Beach. The proposal
is consistent with the Low Density Residential Land Use
Designation of the City's General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
July 24, 1992 shall be the conceptually approved layout.

2. Prior to issuance of building permits, the applicant shall
submit -a covenant to hold both lots as one parcel. The
document shall be reviewed by the City Attorney's Office as to
form and recorded with the Orange County Recorder. A copy of
the recorded covenant shall be filed with the Department of
Community Development for inclusion in the entitlement file.
3. Public Works Requirements:
a. Submit a grading plan for Public Works approval prior
to issuance of building permits.
b. All Public Works fees shall be paid prior to issuance
of permits.
c. The applicant/property owner shall dedicate two and
one-half (2.5) feet of alley prior to issuance of
building permits.
d. The applicant/property owner shall remove and replace
existing curb, gutter and sidewalk adjacent to project
(front); remove and replace half of existing alley
adjacent to project (rear).
e. The applicant/property owner shall be responsible for
payment of Traffic Impact Fees at the time of final
inspection.
4. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
5. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
6. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.

3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke Use
Permit No. 92-48 if any violation of these conditions or the
Huntington Beach Ordinance Code occurs.
ITEM 4: USE PERMIT NO 92-54
Applicant: Syed M. Hasan
9852 Vicksburg
Huntington Beach, CA 92646
Request: To permit a six (6) foot high wrought iron fence with
pilasters on the front property line in lieu of a
maximum 42 inch height limit pursuant to Section
9771(1) of the Huntington Beach Ordinance Code.
Location: 9852 Vicksburg
Wayne Carvalho, Staff Planner, reported that the request is the
result of a code enforcement violation that was issued. Staff
advised that permits were not issued for the block wall that had
been constructed twelve years ago. Staff noted that a five (5) foot
wall had been constructed across Vicksburg Street within the front
setback. Staff concluded by recommending denial based on the
finding that the wall was not compatible with the adjacent
neighborhood.
The Zoning Administrator observed from the photographs supplied by
Staff and noted that at least one-half of the wall was wrought iron;
therefore the pilasters was the issue.
THE PUBLIC HEARING WAS OPENED.
Syed Hasan, the applicant, was present and stated that the fence was
constructed to improve the property and provide security. He said,
the construction company who built the fence did not advise that a
permit was required. He said he spoke to the adjacent neighbors and
they do not have a problem with the fence.
There were no other persons present to speak for or against the
request and the public hearing was closed.
Mike Strange, Zoning Administrator, said that it appears that the
wall had not been detrimental to the neighborhood over the past
twelve years. He said that staff had sent out public notices of the
hearing and no one responded. The Zoning Administrator said he
would approve the request, due to the fact that 50% of the wall is
open and landscaping could be seen through the wall.

USE PERMIT NO. 92-54 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the five (5)
foot high wrought iron fence with block pilasters will not be
detrimental to:
a. The general welfare of persons residing or working in
the vicinity. With the conditions imposed, the fence
will meet the requirements specified in the Uniform
Building Code. Furthermore, there were no persons in
opposition to the request.
b. Property and improvements in the vicinity of such use
or building. The fence will provide added security
and additional privacy for the property owner, as
well as increase the property value.
2. The granting of Use Permit No. 92-54 will not adversely affect
the General Plan of the City of Huntington Beach.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
August 13, 1992 shall be the conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. The applicant shall obtain building permits for the fence/wall
within sixty (60) days of the date of approval; and the permits
shall be finalled within ninety (90) days.
4. Conditions of approval shall be printed verbatim on the co,ver
sheet of all working drawings submitted for plancheck.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
