the Minutes -of September 9, 1992
Zoning Administrator Meeting were
continued.
ITEM 1: COASTAL DEVELOPMENT PERMIT NO. 92-23
Applicant: Ray Pereda, Jr.
4884 Via Alameda
Yorba Linda, CA 92686
Request: To permit a 524 square foot second story addition to an
existing two story residence pursuant to Section
989.5.2 of the Huntington Beach Ordinance Code.
Location: 16462 Barnstable Circle
Wayne Carvalho, Staff Planner, reported that the proposed addition
was above the garage area. Staff said the proposal meets all
aspects of the zoning code and concluded by recommending approval
with findings and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Ray Pereda, Jr. the applicant, was present. He said the addition
includes a complete new roof structure.
There were no other persons present to speak for or against the
request and the public hearing was closed.
COASTAL DEVELOPMENT PERMIT NO. 92-23 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL
COMMISSION.
FINDINGS FOR APPROVAL -COASTAL DEVELOPMENT PERMIT NO 92-23:
1. The request to permit the remodel and 524 square foot second
story addition to an existing two-story single family residence
conforms with the plans, policies, requirements and standards
of The Coastal Element of the General Plan. The proposed
addition will not adversely impact public views or public
access.
2. Coastal Development Permit No. 92-23 is consistent with the CZ
suffix zoning requirements, the R1 Zoning District, as well as
other provisions of the Huntington Beach Ordinance Code
applicable to the property. The proposed development will
conform with all.applicable city codes.
3. At the time of occupancy, the proposed remodel and addition to
an existing two-story single family residence will be provided
with infrastructure in a manner that is consistent with the
Coastal Element of the General Plan. All infrastructure
currently exist to the site.
4. The proposed remodel and 524 square feet addition to an
existing two story single family residence conforms with the
public access and public recreation policies of Chapter 3 of
the California Coastal Act.
CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
August 17, 1992 shall be the conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.

3. All proposed dock and ramp improvements shall require separate
permits for the improvements located within the public
waterways.
4. All proposed cantilevered deck improvements require separate
permits for the improvements.
5. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
6. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
7. Low -volume heads shall be used on all spigots and water faucets.
8. The applicant shall pay all applicable Public Works fees.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The Zoning Administrator reserves the right to revoke Coastal
Development Permit No. 92-23 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
ITEM 2: CONDITIONAL EXCEPTION NO. 92-32
Applicant: Steve Noble

Huntington Beach, CA 92646
Request: To permit a 320 sq. ft. addition to an existing
Single Family Residence resulting in reduced
open space minimum dimensions (12'6" in lieu of
the minimum 201) pursuant to Section 9110.9(b)
of the Huntington Beach Ordinance Code.
Location:

Wayne Carvalho, Staff Planner, reported that the proposed addition
would result in a reduction in the open space minimum dimension,
however, the lot would comply with the total open space
requirement. Staff concluded by recommending approval based on the
reduced lot size, the front setback of the structure at 20 feet in
lieu of 10 feet, and other variances granted in the tract for
reduced open space dimension.

Martin Steigmer, representing the owner, stated that the request
will improve the property.
There were no other persons present to speak for or against the
request and the public hearing was closed.
CONDITIONAL EXCEPTION NO. 92-32 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO. 92-32:
1. The granting of Conditional Exception No. 92-32 will not
constitute a grant of special privilege inconsistent upon other
properties in the vicinity and under an identical zone
classification. There were other variances granted for reduced
open space minimum dimension within the same tract.
2. Because of special circumstances applicable to the subject
property, including size, shape, topography, location or
surroundings, the strict application of the Zoning Ordinance is
found to deprive the subject property of privileges enjoyed by
other properties in the vicinity and under identical zone
classifications. The existing residence is located
approximately twenty (20) feet from the front of property line
in lieu of the permitted ten (10) feet. Further, the lot size
(53.5' by 95') is smaller than the standard 60' by 100' lot.
3. The granting of Conditional Exception No. 92-32 is necessary
in order to preserve the enjoyment of one or more substantial
property rights. The proposed project will provide for a one
story family room addition.
4. The granting of Conditional Exception No. 92-32 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications. Granting of
reduction in open space minimum dimension will not reduce the
required total open space area (900 square feet). Further,
there were no persons in opposition to the request.
5. The granting of Conditional Exception No. 92-32 will not
adversely affect the General Plan of the City of Huntington
Beach. The addition is consistent with the Low Density
Residential Land Use designation of the General Plan.

SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated

facilities, water heaters, and central heating units.
8. Low -volume heads shall be used on all spigots and water faucets.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department
except for variances granted under Conditional Exception No.
92-32.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke
Conditional Exception No. 92-32 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.

ITEM 3: USE PERMIT NO. 92-46
Applicant: Harbor Crest Construction, Inc.

Tustin, CA 92680
Request: To permit the construction of a new 10,300
square foot commercial building pursuant to
Section 9220.1(R) of the Huntington Beach
Ordinance Code.,

Location: Southeast corner of Garfield Avenue and Bushard
Street
Wayne Carvalho, Staff Planner, reported that a general plan
amendment was approved for the mixed use in the area of the
request. Staff explained_ that the Fire and Public Works Departments
have concerns which have been incorporated into conditions of
approval. Staff concluded by recommending approval with findings
and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Richard Harvey, representing the applicant, was present. He
concurred with the suggested conditions; however, requested that the
condition regarding stamped concrete be eliminated.
Jeff Gradow, owner of property located at 19000 Bushard, advised
that an error was made on the addressing of the request and
requested that the address be corrected. He concluded by stating he
was not for or against the construction.
Ron Chamberlain, representing the applicant, was present. He
requested that the suggested condition relative to the island to
separate the driveway be eliminated.
There were no other persons present to speak for or against the
request and the public hearing was closed.
Mike Strange, Zoning Administrator, requested clarification on the
driveway/island condition. Staff indicated that the Fire Department
recommended against the condition and that staff supported the
applicants request to approve the site as submitted.
USE PERMIT NO. 92-46 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO 92-46:
1. The establishment, maintenance and operation of the proposed
commercial center will not be detrimental to:

a. The general welfare of persons residing or working in
the vicinity. All environmental impacts have been
reviewed and addressed with Certification of EIR 90-6.
With the conditions imposed, the access to and parking
for the proposed commercial center does not create an
undue traffic problem.
b. Property and improvements in the vicinity of such use
or building. The proposed commercial development
conforms with all applicable City Codes. Furthermore,
street improvements will be provided along the subject
property.
2. The granting of Use Permit No. 92-46 will not adversely affect
the General Plan of the City of Huntington Beach. The proposal
is consistent with the goals and objectives of the General
Commercial Land Use designation of the General Plan.
CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
July 22, 1992 shall be the conceptually approved layout with
the following modifications:
a. The roof awning shall be incorporated along the entire
north elevation.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plancheck.
4. Prior to issuance of building permits, applicant shall file a
parcel map, legally creating the lot; or obtain written
approval by the Public Works Department. Said map shall be
recorded with the County of Orange Recorder prior to final
inspection and a copy of the recorded map submitted to the
Department of Community Development for inclusion in the
entitlement file.
5. Prior to issuance of building permits, the following plans and
items shall be submitted and/or completed by the applicant:

a. Four (4) sets of landscape and irrigation plans to the
Department of Community Development and Public Works for
review and approval.
b. Rooftop Mechanical Equipment Plan. Said plan shall
indicate screening of all rooftop mechanical equipment and
shall delineate the type of material proposed to screen
said equipment.
Installation of required landscaping and irrigation systems
shall be completed prior to final inspection.
A planned sign program shall be approved for all signing. Said
program shall be approved prior to the first sign request.
Public Works Requirements:
a. A grading plan shall be submitted to the Department of
Public Works for review and it must be approved (by
issuance of a grading permit). A plan for silt control for
all water runoff from the property during construction and
initial operation of the project may be required if deemed
necessary by the Director of Public Works.
b. All applicable Public Works fees shall be paid prior to
issuance of building permits.
c. The developer will be responsible for the payment of the
Traffic Impact Fees at the time of final inspection.
d. The property owner shall dedicated seven (7) feet on a
portion of Garfield Avenue.
e. Low volume fixture heads and ultra -low flush toilets shall
be incorporated into the potable water system.
f. The Developer shall use "drought -tolerant" plants and turf
for all landscaping.
g. There shall be a right turn restriction onto Garfield
Avenue. Proper signing shall be posted per Public Works
specifications.
h. Driveways shall be of radius type construction.
i. The proposed driveway on Bushard Street shall be located
directly across the driveway on the west side, or north of
it.
j. Hydrology and hydraulic studies shall be submitted for
Public Works approval.

k. A detailed soils analysis shall be prepared by a registered
Soils Engineer. This analysis shall include on -site soil
sampling and laboratory testing of materials to provide
detailed recommendations regarding grading, chemical and
fill properties, foundations, retaining walls, streets, and
utilities.
9. During construction, the applicant shall:
a. Use water trucks or sprinkler systems in all areas where
vehicles travel to keep damp enough to prevent dust raised
when leaving the site;
b. Wet down areas in the late morning and after work is
completed for the day;
c. Use low sulfur fuel (.05% by weight) for construction
equipment;
d. Attempt to phase and schedule construction activities to
avoid high ozone days (first stage smog alerts);
e. Discontinue construction during second stage smog alerts.
10. Fire Department Requirements:
a. on -site fire hydrants shall be provided in number and at
locations specified by the Fire Department.
b. An automatic fire sprinkler system shall be approved and
installed pursuant to Fire Department regulations.
c. Service roads and fire lanes, as determined by the Fire
Department, shall be posted and marked.
d. Fire access lanes shall be maintained. If fire lane
violations occur and the services of the Fire Department
are required, the applicant will be liable for expenses
incurred.
e. Prior to issuance of building permits, the
applicant/property owner shall provide proof that the site
is free of soil contaminants, underground tanks or oil
wells.
f. Standard fire safety Fire Protection Plan shall be approved
by the Fire Department.

g. The following shall be complied with prior to final
building inspection/certification of occupancy:
1. Installation of fire extinguishers.
2. Twenty-four hour monitoring of fire sprinkler system.
11. There shall be no outside storage on site, including the area
to the rear of the building (east side).
12. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
13. The applicant/property owner shall comply with FEMA Floodplain
regulations.
14. A copy of completed FEMA Elevation Certificate shall be
submitted prior to issuance of building permit.
15. Natural gas shall be stubbed in at the locations of cooking
facilities, water heaters, and central heating units.
16. Low -volume heads shall be used on all spigots and water faucets.
17. If lighting is included in the parking lot, high-pressure
sodium vapor lamps shall be used for energy savings. All
outside lighting shall be directed to prevent "spillage" onto
adjacent properties.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. Landscaping shall comply with Section 9607 of the Huntington
Beach Ordinance Code.
5. Construction activities shall be restricted to the hours of
7:00 AM to 8:00 PM, Monday through Saturday. Construction
shall be prohibited on Sundays and Federal Holidays.
6. The Zoning Administrator reserves the right to revoke
Use Permit No. 92-46 if any violation of these conditions or
the Huntington Beach Ordinance Code occurs.
