ZONING ADMINISTRATOR: Mike Strange STAFF MEMBERS: MINUTES: Wayne Carvalho The Minutes of September 9, September 16, 1992 Zoning Administrator Meetings were ITEM 1 • SITE PLAN AMENDMENT NO. 92-6 Applicant: Architectural Team Three 3611 S. Harbour Blvd., Ste. 100 Santa Ana, CA 92704 Request: To permit the installation of a carwash unit for preparation of cars for display (no public use) Section 9811.4 of the Huntington Code. Location: 18801 Beach Blvd. and approved. freestanding new and used pursuant to Beach Ordinance Wayne Carvalho, Staff Planner, reported that the applicant was proposing to install a freestanding cash wash. Staff indicated that the applicant submitted a Noise Study which included mitigation measures. One of the mitigation measures was to construct a seven foot wall on the north and west sides of the carwash. Staff recommended that a roof structure be required over a portion of the unit. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. r� Steve Coleman, representing the applicant, was present. He stated that he was opposed to the roof structure because of the cost. He advised that the hours of operation would be limited; therefore, noise should not be a problem. There were no other persons present to speak for or against the request and the public hearing was closed. SITE PLAN AMENDMENT NO. 92-6 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, received and dated July 29, 1992 shall be the conceptually approved layout. 2. A seven (7) foot high masonry block wall shall be constructed to mitigate any noise impacts to the residential properties. The wall shall be located adjacent to the carwash on the west and north sides; the wall shall not be located on the property line. 3. Should the wall not mitigate the carwash noise to comply with the City's Noise Code, additional measures shall be taken to conform with the Ordinance Code. 4. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 5. Conditions of approval shall be printed verbatim on the cover sheet of all working drawings submitted for plancheck. 6. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. Four (4) sets of revised landscape and irrigation plans shall be submitted to the Department of Community Development and Public Works for review and approval. 7. Hours of operation Monday - Saturday; and Holidays. for the carwash shall be 8 a.m. - 8 p.m. carwash use shall be prohibited on Sunday's J 1 ZA Minutes - 9/23/92 -2- (4640d) 1 8. The carwash shall be prohibited for public use. 9. All applicable Public Works fees shall be paid prior to issuance of building permits. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke Site Plan Amendment No. 92-6 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2: ADMINISTRATIVE REVIEW NO. 92-14 Applicant: Michael Nott/Lynn Hartzell 14691 Purdy Midway City, CA 92655 Request: To permit the establishment of an automotive repair business within a 1,060 square foot industrial suite pursuant to Section 9530.01 of the Huntington Beach Ordinance Code. Location: 7522 Slater Ave., Ste. 124 Wayne Carvalho, Staff Planner, reported that an administrative review is required because of the automotive type use and the requirement for a parking analysis. Staff advised that the center currently has eighty-one parking spaces and seventy-nine would be required with the proposed use. Staff concluded by recommending approval with suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Michael Nott, representing the applicant, was present and concurred with the suggested conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. ZA Minutes - 9/23/92 -3- (4640d) ADMINISTRATIVE REVIEW NO. 92-14 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. "The applicant/owner shall be responsible for payment of Traffic Impact fees prior to issuance of a Certificate of Occupancy and/or final building permit approval." 5. Fire Department Requirements: a. On -site fire hydrants shall be provided in number and at locations specified by the Fire Department. b. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. c. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. d. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 6. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 7. ITEM 3: LOT LINE ADJUSTMENT NO. 92-2 Applicant: Andrew Homes, Inc. James C. Wright 4400 MacArthur Blvd. #900 Newport Beach, CA 92660 Request: To permit a Lot Line Adjustment for a 126 square foot area between Lots 2 and 3, of Tract No. 13694 pursuant to Section 9811.3.1 of the Huntington Beach Ordinance Code. Location: Lots 2 and 3, Tract 13694 (Southwest corner of Newland Street and Heil Ave.) Wayne Carvalho, Staff Planner, reported that the request was to adjust the lot line that ran north and south between the two (2) lots two feet to the east. Staff advised that both property owners have signed the agreement for the lot line adjustment. Staff concluded by recommending approval with findings and suggested conditions of approval. Tom Banks, representing the applicant, said that the structures on both properties will meet code requirements for sideyard setbacks. LOT LINE ADJUSTMENT NO. 92-2 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. ZA Minutes - 9/23/92 -5- (4640d) FINDINGS FOR APPROVAL - LOT LINE ADJUSTMENT NO 92-2: 1. The lot line adjustment will not create a nonconforming parcel. 2. The lot line adjustment will not create a nonforming yard requirement. 3. The lot line adjustment will not sever existing structures on the two lots. 4. The lot line adjustment will not allow a greater number of dwelling units than allowed by the code prior to the adjustment. CONDITIONS OF APPROVAL - LOT LINE ADJUSTMENT NO 92-2: A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S) FOR ANY PURPOSE: ' 1. The Lot Line Adjustment received by the Department of Community Development on August 10, 1992 shall be the approved layout. 2. Monuments for the newly -established property lines shall be readjusted in compliance with the Subdivision Map Act. A record of survey shall be completed to verify the location of the newly placed monuments. 3. Authentic data on the bearings on the adjusted line shall be shown on a plat map -which shall be certified by the City Engineer prior to recordation. 4. Said plat map shall be recorded with the County Recorder prior to the issuance of a certificate of compliance for the structure and/or structures upon subject properties. A copy of the recorded document shall be submitted to the Department of Community Development for the file. ITEM 4: USE PERMIT NO 92-56 Applicant: William F. Fischer 20182 McKinley Lane Huntington Beach, CA 92646 Request: To permit a six (6) foot high wrought iron fence with brick pilasters within the required front yard setback (6' in lieu of minimum 151) pursuant to Section 9771(1) of the Huntington Beach Ordinance Code. Location: 20182 McKinley Lane ZA Minutes - 9/23/92 -6- (4640d) C Wayne Carvalho, Staff Planner, reported that the request for the use permit was the result of a Code Enforcement violation. Staff advised that the actual wall is setback six feet and includes a two (2) foot retainer; therefore the wall is basically four feet high. Staff recommended approval based on the fact that it is compatible with the adjacent neighborhood. THE PUBLIC HEARING WAS OPENED. Mr. Fischer, the applicant, submitted letters from adjacent residences recommending approval. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 92-56 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL - USE PERMIT NO 92-56: 1. The establishment, maintenance and operation of the six (6) foot high wrought iron fence with brick pilasters will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. With the conditions imposed, the fence will comply with the Uniform Building Code requirements. Furthermore, there were no persons present in opposition to the request. b. Property and improvements in the vicinity of such use or building. The fence will provide added security and additional privacy for the property owner, as well as increase the property value. 2. The granting of Use Permit No. 92-56 will not adversely affect the General Plan of the City of Huntington Beach. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan and fence elevations received and dated August 24, 1992 shall be the conceptually approved layout. ZA Minutes - 9/23/92 -7- (4640d) 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. The applicant shall obtain building permits for the fence/wall within sixty (60) days from the date of approval; and the permits shall be finalled within ninety (90) days. 4. Conditions of approval shall be printed verbatim on the cover sheet of all working drawings submitted for plancheck. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke Use Permit No. 92-56 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 5: CONDITIONAL EXCEPTION NO 2-30 Applicant: Texaco, U.S.A. 10 Universal City Plaza Universal City, CA 91608 Attn: Jack Fong Request: To permit a variance for reduced landscaping (7% in lieu of minimum 10% of site), including landscape planter requirements pursuant to Sections 9220.14(f)(5) and 9607.3 of the Huntington Beach Ordinance Code. The request includes a modification to a previously approved landscape plan (DRB 91-36). Location: 18502 Beach Blvd. Wayne Carvalho, Staff Planner, reported that the applicant requested a two week continuance. Staff recommended that the continuance be granted.
