The addition includes variances to upper story setbacks (2' in lieu of 5') for dormers on the third floor. Location: 4671 Los Patos Avenue Wayne Carvalho, Staff Planner, reported that the applicant was originally permitted to construct a two story residence. Subsequent to a new code amendment, the plans were changed to include a third story which requires the approval of additional entitlements. Since the existing dormers do not meet code due to a two (2) foot upperstory setback in lieu of five (5) feet, a conditional exception and coastal development permit is required to be approved. Staff recommended that the dormers be setback five feet to meet code and recommended approval of the requests with findings and suggested conditions of approval. . THE PUBLIC HEARING WAS OPENED. Ron Burns, applicant, said that pulling the windows back would result in changing the roof and extensive expense. He requested that the request be approved as depicted on the plan.
