MINUTES: The Minutes of October 7, 1992 Zoning
Administrator Meetings were approved.
ITEM 1: WAIVER OF PARCEL _MAP 90-272
Applicant: Phil Zisakis/City of Huntington Beach
17131 Beach Blvd.
Huntington Beach, CA 92647
Request: Waiver of Parcel Map No. 90-272, which includes
the consolidation of two (2) parcels into one,
pursuant to Section 9920.1 of the Huntington
Beach Ordinance Code.
Location:
17131 Beach Blvd.
Wayne Carvalho, Staff Planner, reported that the request was
continued from the September 19, 1990 Zoning Administrator Meeting.
Staff indicated that the tentative parcel map was approved two years
ago and included a request for a waiver of the final map. Since
public improvements were not completed, the waiver was continued.
Staff concluded by recommending approval with findings and suggested
conditions.
THE PUBLIC HEARING WAS OPENED.
Larry Nelson, representing the applicant, was present and agreed to
the conditions.
There were no other persons present to speak for or against the
request and the public hearing was closed.
WAIVER OF PARCEL MAP 90-272 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY
THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION
WITHIN TEN CALENDAR (10) DAYS.
FINDINGS OF APPROVAL FOR WAIVER:
1. The proposed consolidation of two (2) lots into one for
commercial use complies with the requirements as to area,
improvement and design, flood and water drainage control,
appropriate and approved public roads, sewer and water
facilities, environmental protection, and other requirements
of Article 992 of the Ordinance Code.
CONDITIONS OF APPROVAL:
A. TO BE COMPLETED PRIOR TO USE OR OCCUPANCY OF SAID PARCEL(S)
FOR ANY PURPOSE:
1. A plat map shall be filed with and approved by the Department
of Public Works and recorded with the Orange County Recorder.
A copy of the recorded plat map shall be filed with the
Department of Community Development.
2. The applicant shall record a Certificate of Compliance, a
"Covenant to hold properties as one parcel" and the approved
plat map with the Orange County Recorder's Office. A copy of
the recorded covenant shall be filed with the Department of
Community Development prior to final inspection/issuance of
Certificate of Occupancy.
ITEM 2: ADMINISTRATIVE REVIEW NO 89-6(R)
Applicant: Urban West Communities

Request: To amend the current model homes site permit to allow a
fourth model to be constructed within "The Estates"
project (Tract No. 13821).
Location: 6272 Doral Drive
Wayne Carvalho, Staff Planner, reported that the request was to
permit a fourth model home for the Estates project which was
originally approved for three model homes. Staff concluded by
recommending approval with suggested conditions of approval.

THE PUBLIC HEARING WAS OPENED.
Michael Kaizoji, representing the applicant, was present and
concurred with the suggested conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
ADMINISTRATIVE REVIEW NO. 89-6 (R) WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
September 17, 1992 shall be the conceptually approved layout.
2. Prior to issuance of building permits, connection between
Seapoint Avenue and Garfield Avenue shall be completed and open
for traffic.
3. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
4. Prior to issuance of building permits, all roads shall be
completed, fire lane signs be provided, and fire hydrants in
service within three hundred (300) feet of all models, or the
applicant shall obtain written approval by the Fire Department.
5. The office use shall be discontinued within thirty (30) days
following sale of the last on -site unit. A cash bond of one
thousand dollars ($1,000) shall be posted with the City for the
fourth model home.
6. No sales office or model shall be converted or expanded into a
general business office for the contractor or developer.
7. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plan check.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.

4. The Zoning Administrator reserves the right to revoke
Administrative Review No. 89-6(R) if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
ITEM 3: ADMINISTRATIVE REVIEW NO, 92-13/NEGATIVE DECLARATION
NO. 92-33
Applicant: McDonnell Douglas Space System Co.
5301 Bolsa Ave.
Huntington Beach, CA 92648
Attn: Dwight Young
Request: Expansion of the existing McDonnell Douglas Space system
facilities. The project proposes construction of a new
30,400 sq. ft. building for the assembly and testing of
aerospace systems. The proposed building will be
located between existing buildings and will be
approximately 62 feet tall. Operations in the building
will involve approximately 30 employees and will occur
during the hours of 7:00 a.m. to 5:00 p.m.
Location: 5301 Bolsa Ave.
Wayne Carvalho, Staff Planner, reported that the applicant was
proposing to connect two existing buildings to provide an additional
30,400 square foot of industrial space. Due to the size of the
addition, a negative declaration was required and advertised for the
twenty-one day period. Staff said one comment was received from the
Environmental Board in support of the negative declaration. Staff
advised that with the addition, there would continue to be a surplus
of parking spaces. Staff concluded by recommending approval with
findings and suggested conditions of approval.
This was not a Public Hearing.
ADMINISTRATIVE REVIEW NO. 92-13/NEGATIVE DECLARATION NO. 92-33 WAS
APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING CONDITIONS
OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN
BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING
COMMISSION WITHIN TEN CALENDAR (10) DAYS.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
August 19, 1992 shall be the conceptually approved layout.
2. Fire Department Requirements:
a. On -site fire hydrants shall be provided in number and at
locations specified by the Fire Department.

b. An automatic fire sprinkler system shall be approved and
installed pursuant to Fire Department regulations.
c. A fire alarm system shall be installed to comply with
Huntington Beach Fire Department standards.
d. Fire access lanes shall be maintained. Prior to issuance
of Building Permits, the applicant shall submit a
circulation plan with dimensions of all access roads (24'
or 27' lanes, turnarounds and 17' by 45' radius turns).-
e. All elevators shall be sized to accommodate an ambulance
gurney. Minimum 618" wide by 4'3" deep with minimum of 42"
opening.
f. A Class III wet standpipe system (combination) shall be
installed per Fire Department standards.
g. Prior to issuance of building permits, the applicant shall
submit a Fire Protection Plan to the Fire Department for
approval.
h. Exit signs and exit path markings shall be provided per
Huntington Beach Fire Code.
3. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
4. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plancheck.
5. All applicable Public Works fees shall be paid prior to
issuance of building permits.
6. "The applicant/owner shall be responsible for payment of
Traffic Impact fees prior to issuance of a Certificate of
Occupancy and/or final building permit approval."
7. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.

ITEM 4: COASTAL DEVELOPMENT PERMIT NO, 92-27/USE PERMIT NO. 92-55
CONDITIONAL EXCEPTION 92-37
Applicant: Ron Burns

Downey, CA 90241
Request: To permit a 500 square foot, third story addition to a
two (2) story single family residence currently under
construction pursuant to Sections 9110.4(c) and 989.5.2
of the Huntington Beach Ordinance Code. The addition
includes variances to upper story setbacks (2' in lieu
of 5') for dormers on the third floor.
Location: 4671 Los Patos Avenue
Wayne Carvalho, Staff Planner, reported that the applicant was
originally permitted to construct a two story residence. Subsequent
to a new code amendment, the plans were changed to include a third
story which requires the approval of additional entitlements. Since
the existing dormers do not meet code due to a two (2) foot
upperstory setback in lieu of five (5) feet, a conditional exception
and coastal development permit is required to be approved. Staff
recommended that the dormers be setback five feet to meet code and
recommended approval of the requests with findings and suggested
conditions of approval. .
THE PUBLIC HEARING WAS OPENED.
Ron Burns, applicant, said that pulling the windows back would
result in changing the roof and extensive expense. He requested
that the request be approved as depicted on the plan.
There were no other persons present to speak for or against the
request and the public hearing was closed.
COASTAL DEVELOPMENT PERMIT NO. 92-27/USE PERMIT NO.
92-55/CONDITIONAL EXCEPTION NO. 92-37 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF
APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL
COMMISSION.

FINDINGS FOR APPROVAL -COASTAL DEVELOPMENT PERMIT NO, 92-27:
1. The request to permit a 500 square foot third story addition to
a two-story single family residence currently under
construction conforms with the plans, policies, requirements
and standards of The Coastal Element of the General Plan. The
additional floor area will not adversely impact public views or
public access.
2. Coastal Development Permit No. 92-27 is consistent with the CZ
suffix zoning requirements, the R1 Zoning District, as well as
other provisions of the Huntington Beach Ordinance Code
applicable to the property. The proposed development will
conform with all applicable City codes.
3. At the time of occupancy, the proposed third story addition
will be provided with infrastructure in a manner that is
consistent with the Coastal Element of the General Plan. All
infrastructure currently exists to the site.
4. The proposed third story addition to a two story single family
residence currently under construction conforms with the public
access and public recreation policies of Chapter 3 of the
California Coastal Act.
FINDINGS FOR APPROVAL -USE PERMIT NO 92-55:
1. The establishment, maintenance and operation of the proposed
500 square foot, third story addition will not be detrimental
to:
a. The general welfare of persons residing or working in
the vicinity. The proposed project will not adversely
impact the privacy of adjacent properties by
prohibiting transparent windows along abutting
properties.
b. Property and improvements in the vicinity of such use
or building. The proposed third story will conform
with the provisions of the Ordinance Code except for
variances granted under Conditional Exception No.
92-37. All floor area will be within the confines of
the roof structure.
2. The granting of Use Permit No. 92-55 will not adversely affect
the General Plan of the City of Huntington Beach. The third
story addition is consistent with the Low Density Residential
Land Use Designation of the General Plan.

FINDINGS FOR APPROVAL CONDITIONAL EXCEPTION NO, 92-37:
1. The granting of Conditional Exception No. 92-37 will not
constitute a grant of special privilege inconsistent upon other
properties in the vicinity and under an identical zone
classification. The proposed project will maintain all yard
setback requirements and will comply with the maximum building
height and minimum open space requirements. Furthermore, there
are other two (2) and three (3) story residences on the same
street with comparable heights.
2. Because of special circumstances applicable to the subject
property, including size, shape, topography, location or
surroundings, the strict application of the Zoning Ordinance is
found to deprive the subject property of privileges enjoyed by
other properties in the vicinity and under identical zone
classifications. The subject property has a smaller lot size
and frontage than standard 60 foot wide, 6,000 square foot
lots.
3. The granting of Conditional Exception No. 92-37 is necessary
in order to preserve the enjoyment of one or more substantial
property rights. The proposed project will allow for a 500
square foot third story room addition -to a two story residence
currently under construction.
4. The granting of Conditional Exception No. 92-37 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications. With the conditions
imposed, the proposed project will protect the privacy of
adjacent properties. The additional floor area will also be
compatible with the existing structure and surrounding
neighborhood.
5. The granting of Conditional Exception No. 92-37 will not
adversely affect the General Plan of the City of Huntington
Beach. The third story addition is consistent with the Low
Density Residential Land Use Designation of the General Plan.
CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
August 12, 1992 shall be the conceptually approved layout.
2. The applicant/property owner shall record with the County
Recorder a covenant assuring that the property will remain as a
single family dwelling.
3. Obscure glass windows shall be used on the west dormer to
protect the privacy of the adjacent owner.

4. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
5. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
6. The applicant shall install smoke detectors in compliance with
the Uniform Building Code and California Code of Regulations.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The Zoning Administrator reserves the right to revoke Coastal
Development Permit No. 92-27, Use Permit No. 92-55 and
Conditional Exception No. 92-37 if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.
