ZONING ADMINISTRATOR: Mike Strange STAFF MEMBERS: Wayne Carvalho MINUTES: The Minutes of October 21, 1992 Zoning Administrator Meetings were approved. ITEM 1: TENTATIVE PARCEL MAP NO. 92-218 Applicant: Joseph C. Trusaw and Associates, Inc. 721 N. Euclid Street, Ste. 311 Anaheim, CA 92801 Request: To consolidate two (2) lots to create one (1) legal lot pursuant to the requirements of the Subdivision Map Act and Section 9921 of the Huntington Beach Ordinance Code. Location: 7812 Edinger Avenue Wayne Carvalho, Staff Planner, reported that the request was to consolidate and legalize the subject parcel. Staff advised that the request meets code and concluded by recommending approval with findings and suggested conditions of approval. Joseph Truzaw, the applicant, was present and concurred with the suggested conditions of approval. There were no other persons present to speak for or against the request. TENTATIVE PARCEL MAP NO. 92-218 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The proposed consolidation of two (2) parcels for purposes of commercial use is in compliance with the size and shape of property necessary for that type of development. 2. The General Plan has set forth provisions for this type of land use as well as setting forth objectives for implementation of this type of use. 3. The property was previously studied for this intensity of land use at the time the land use designation for community business district allowing commercial buildings was placed on the subject property. 4. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. CONDITIONS OF APPROVAL: 1. The Tentative Parcel Map received by the Department of Community Development on September 30, 1992 shall be the approved layout (with the amendments as noted thereon). 2. A parcel map shall be filed with and approved by the Department of Public Works and recorded with the Orange County Recorder. A copy of the recorded parcel map shall be filed with the Department of Community Development. 3. Prior to recordation of this parcel map, the surveyor/ engineer preparing the map shall tie the boundary of the map into the Horizontal Control System established by the County Surveyor in a manner described in Sections 7-9-330 and 7-9-337 of the Orange County Subdivision Code and Orange County Subdivision Manual, Subarticle 18. 1 ZA Minutes - 10/28/92 -2- (4995d) I� I 4. Prior to recordation of this parcel map, the surveyor/engineer preparing the map shall submit to the County Surveyor a digital -graphics file of said map in a manner described in Sections 7-9-330 and 7-9-337 of the Orange County Subdivision Code and Orange County Subdivision Manual, Subarticle 18. 5. The subject property shall enter into irrevocable reciprocal driveway easement(s) between the subject site and adjacent properties. A copy of the legal instrument shall be approved by the Community Development Department and the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development. 6. Development shall comply with all applicable City Ordinances. ITEM 2: TENTATIVE PARCEL MAP NO. 92-229 Applicant: Frank A. Merenda 20332 Brentstone Lane Huntington Beach, CA 92646 Request: To legalize an existing 1.17 acre parcel for Industrial purposes pursuant to Section 9921 of the Huntington Beach Ordinance Code. Location: 17222 and 17242 Gothard Street Wayne Carvalho, Staff Planner, reported that the identical request was approved in August, 1987; however, the map was never recorded. Staff concluded by recommending approval with findings and suggested conditions of approval. Frank Merenda, the applicant, was present and concurred with the suggested conditions of approval. There were no other persons present to speak for or against the request. The size, depth, frontage, street width and other design and improvement features of the proposed subdivision are proposed to be constructed in compliance with standards plans and specifications on file with the City as well as in compliance with the State Map Act and supplemental City Subdivision Ordinance. All applicable Public Works fees shall be paid. ITEM 3: ADMINISTRATIVE REVIEW NO, 92-15 Applicant_: Dave Atwood 15391 Pacific Street Midway City, CA 92655 1 [l. ZA Minutes - 10/28/92 -4- (4995d) Request: To establish an automotive repair business within an existing 2,640 square foot industrial suite pursuant to Section 9530.01 of the Huntington Beach Ordinance Code. Location: 16442 Gothard Street, Suite A Wayne Carvalho, Staff Planner, reported that the administrative review is required due to the minor automotive repair business. Staff advised that three other automotive uses are currently in the center. Staff analyzed the parking ratio and had determined there would be adequate parking. Staff concluded by recommending approval with findings and suggested conditions of approval. Dave Atwood, the applicant, was present. He agreed to the suggested conditions of approval except for the requirement for the one hour fire wall. Mike Strange, the Zoning Administrator, advised that the one hour wall was a provision of the Uniform Building Code and the Zoning Administrator did not have the authority to waive the requirement. There were no other persons present to speak for or against the request. ADMINISTRATIVE REVIEW NO. 92-15 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. CONDITIONS OF APPROVAL: 1. The site plan and floor plans received and dated September 23, 1992 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Conditions of approval shall be printed verbatim on the cover sheet of all working drawings submitted for plancheck. 4. All applicable Public Works fees shall be paid prior to issuance of building permits. ZA Minutes - 10/28/92 -5- (4995d) 5. "The applicant/owner shall be responsible for payment of Traffic Impact fees prior to issuance of a Certificate of Occupancy and/or final building permit approval." 6. Fire Department Requirements: a. Fire extinguishers shall be installed in number and at locations specified by the Fire Department. b. Address numbers shall be installed to comply with City Specification #428. c. On site flammable liquid storage and use shall comply with Chapter 9 of the Uniform Building Code and Article 79 of the Huntington Beach Fire Code. 7. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 8. All repair work shall be conducted wholly within the building. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall provide a one (1) hour occupancy separation wall between the new auto repair business (B-1) and adjacent suite (B-2 occupancy) per Building Division. 4. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 5. All signs shall be brought into compliance with the Huntington Beach Ordinance Code prior to issuance of Certificate of Occupancy. 6. The Zoning Administrator reserves the right to revoke Administrative Review No. 92-15 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 4: USE PERMIT NO, 92-58 Applicant: Andre S. Ouellette 6856 Edinger Avenue Huntington Beach, CA 92647 ZA Minutes - 10/28/92 -6- (4995d) 1 1 Request: To permit the establishment of a martial arts studio within a 1,000 square foot commercial suite pursuant to Section 9220.1(c) of the Huntingon Beach Ordinance Code. Location: 6856 Edinger Avenue Wayne Carvalho, Staff Planner, reported that applicant's request is to occupy a 1,000 square foot suite within the Home Depot shopping center. Staff advised that the tenants and owners in the center were notified and no comments in opposition were received. The hours of operation are proposed to be 9:00 AM through 9:00 PM Monday through Saturday. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Andre Ouellette, the applicant, was present and concurred with the suggested conditions of approval. He advised that he currently owns a martial arts studio in the City of Huntington Beach and that the request is merely to change the location. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 92-58 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO 92-58: 1. The establishment, maintenance and operation of the proposed martial arts studio will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The studio will have scheduled classes with reduced hours of operation which will minimize any parking impact. b. Property and improvements in the vicinity of such use or building. The business will occupy a 1,000 square foot commercial suite within an existing commercial center. 2. The granting of Use Permit No. 92-58 will not adversely affect the General Plan of the City of Huntington Beach. The proposal is consistent with the goals and objectives of the General Commercial Land Use designation of the General Plan. ZA Minutes - 10/28/92 -7- (4995d) SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated October 6, 1992 shall be the conceptually approved layout. 2. Address numbers shall be installed to comply with City Specification #428. The subject suite shall be sized a minimum of four (4) inches with a brush stroke of one-half (1/2) inch. 3. Fire extinguishers shall be installed and located in areas to comply with Huntington Beach Fire Code Standards. 4. Any modification to existing signs or installation of new signs shall require separate building permits. 5. Hours of operation shall be as follows: Monday - Saturday 9 a.m. - 9 p.m. Sundays, Holidays closed 6. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 7. ZA Minutes - 10/28/92 -8- (4995d) ITEM 5• COASTAL DEVELOPMENT PERMIT NO, 92-26 Applicant: Brion S. Jeannette 470 N. Newport Blvd. Newport Beach, CA 92663 Request: To permit the construction of a 1,566 square foot two (2) story addition to an existing two story residence pursuant to Section 989.5.2 of the Huntington Beach Code. Location: 3541 Courtside Lane Wayne Carvalho, Staff Planner, reported that the coastal development was required because the addition exceeds ten percent (10%) of the existing floor area. Staff advised that fire sprinklers and a two inch water meter was required because the total square footage exceeds5,000 square feet. Staff advised that the Home Owner's Association indicated that the homeowners architectural committee had not reviewed the project and requested that a condition for approval be included requiring their approval. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Brion Jeannette, the applicant, was present and concurred with the conditions of approval except for the fire sprinkler requirement. He requested that the condition be waived if he could obtain approval to remove the condition from the Fire Department. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 92-26 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT ALL ACTIONS TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL -COASTAL DEVELOPMENT PERMIT NO, 92-26: 1. The request to permit the 1,566 square foot, two story addition to an existing two-story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed addition will not adversely impact existing views or public access. ZA Minutes - 10/28/92 -9- (4995d) 2. Coastal Development Permit No. 92-26 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed development will conform with all applicable City Codes. 3. At the time of occupancy, the proposed 1,566 square foot addition to an existing two-story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All infrastructure currently exists to the site. 4. The proposed 1,566 square foot addition to an existing two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. _The site plan, floor plans, and elevations received and dated September 24, 1992 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. All proposed dock and ramp improvements shall require separate permits for the improvements located within the public waterways. 4. All proposed cantilevered deck improvements require separate permits for the improvements. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to'handle them. 6. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 7. The applicant shall pay all applicable Public Works fees. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 1 ZA Minutes - 10/28/92 -10- (4995d) LI 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. Automatic sprinkler systems shall be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code standards. Shop drawings shall be approved by the Fire Department prior to installation. 4. The sprinkler system shall require the installation of a two (2) inch water meter approved by the Public Works Department. 5. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 92-26 if any violation of these conditions or the Huntington Beach Ordinance Code occurs.
