Applicant: Mobil Tronix

Attn: Gene Scarcello
Request: To establish a business for sales and installation of
automobile sound equipment and car phones pursuant to
Section 9220.1(c) of the Huntington Beach Ordinance
Code.
Location: 7586 Edinger Ave.
Wayne Carvalho, Staff Planner reported that the applicant was
proposing to occupy a suite within and existing shopping center.
Staff advised that the use permit is required because the use falls
under minor automobile repair. Staff concluded by recommending
approval with findings and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Gene Scarcello, representing the applicant, said that he concurred
with the suggested conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 92-61 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL:
1. The establishment, maintenance and operation of the proposed
business for sales and installation of automobile sound
equipment and car phones will not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity with the conditions imposed noise impacts
will be reduced to levels of insignificance.
b. Property and improvements in the vicinity of such use
or building. All installation work will be conducted
inside the building.
2. The granting of Use Permit No. 92-61 will not adversely affect
the General Plan of the City of Huntington Beach. The proposed
business is consistent with the goals and objectives of the
General Commercial Land Use designation of the General Plan.
CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
October 16, 1992 shall be the conceptually approved layout.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to'the original entitlement be
processed if the proposed changes are of a substantial nature.
3. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawings submitted for plancheck.
4. Fire Department Requirements:
a. Fire extinguishers shall be installed in both sales and
installation areas in accordance with Huntington Beach Fire
Code standards.

b. Building address for unit shall comply with Fire Department
standards. Unit address shall be a minimum of four (4)
inches in height.
c. Service roads and fire lanes, as determined by the Fire
Department, shall be posted and marked.
d. Fire access lanes shall be maintained. If fire lane
violations occur and the services of the Fire Department
are required, the applicant will be liable for expenses
incurred.
5. Hours of operation for the installation of auto sound
equipment/car alarms shall be limited from 9 a.m. - 8 p.m.
6. All applicable Public Works fees shall be paid prior to
issuance of building permits.
7. There shall be no outside storage of vehicles or equipment.
8. All installation work shall be conducted wholly within the
building.
9. All rear doors shall be closed during testing of auto sound
equipment/car alarms, etc.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
a. A one (1) hour occupancy separation shall be installed
between the sales area and installation area per Building
Division requirements.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. The Zoning Administrator reserves the right to revoke
Use Permit No. 92-61 if any violation of these conditions or
the Huntington Beach Ordinance Code occurs.
ITEM 2: CONDITIONAL EXCEPTION NO. 92-38
Applicant: D'Ambra
7744 Westminster Blvd.
Westminster, CA 92683

Request: To permit the remodel of an existing two (2) car garage
by reducing the inside dimension to 17' in width in
lieu of the required 18' pursuant to Section 9601.5 of
the Huntington Beach Ordinance Code. The remodel will
provide an additional parking space along the side
property line for a Recreational Vehicle (RV).
Location: 17431 Forbes Lane
Wayne Carvalho, Staff Planner, reported that the applicant was
proposing to reduce the size of an existing garage to provide room
to store a RV on the side of the garage. Staff recommended denial
based on the fact that there was no land related hardship.
THE PUBLIC HEARING WAS OPENED.
Jim Fox, owner of the property, advised that their motorhome had
been broken into two times on a storage lot. He provided staff with
a Letter of Intent which described the request and signed by the
adjacent property owners supporting the request. Mr. Fox stated
that the residence closest to where the RV would be stored does not
have any windows facing his property.
Dennis D'Ambra, representing the applicant, advised that two
vehicles would fit in the reduced garage. He also said that the
construction would be accomplished in a manner where the extra width
could be added at a later date if desired.
There were no other persons present to speak for or against the
request and the public hearing was closed.
Wayne Carvalho, Staff Planner, advised that under the proposed plan
the RV would encroach to seven feet of the front property line. He
said Code does not allow a fence over forty-two inches high to
encroach within fifteen feet into the front setback and that the
request if approved would set a precedent.
Mike Strange, Zoning Administrator, requested staff to research
other similar requests and report back on November 18, 1992.
CONDITIONAL EXCEPTION NO. 92-38 WAS CONTINUED TO THE ZONING
ADMINISTRATOR MEETING OF NOVEMBER 18, 1992 BY THE ZONING
ADMINISTRATOR.
ITEM 3: USE PERMIT NO, 92-21(R)
Applicant: Swede -Cal Properties, Inc.

Request: To allow a reduction in the required number of
parking spaces for a newly established
automotive related business (Sube Sports)
pursuant to Section 9600 of the Huntington Beach
Ordinance Code. The business includes mail
order/sales of performance parts and
accessories, fabrication and maintenance of two
(2) race cars, and automotive repair.

Wayne Carvalho, Staff Planner, reported that an Administrative
Review was approved in 1990 which authorized three new industrial
buildings. A Use Permit was subsequently approved in April, 1992
for the subject business. Staff explained that the proposed
business would result in less activity than a typical automotive
repair business due to the mail order and racing team portion of the
business.
Staff indicated that the applicant had an independent parking study
conducted in September which resulted in the requirement of eight
parking spaces for the subject spaces. The Department of Public
Works, Traffic Division, concurred with the results of the study.
Staff recommended that the revised Use Permit, if approved, expire
with a change in ownership. Staff concluded by recommending
approval with findings and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Jan Erik Palm, Vice President, Swede -Cal Properties, was present and
concurred with staff's recommendation.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 92-21(R) WAS APPROVED BY THE ZONING ADMINISTRATOR
WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO 92-21(R):
1. The establishment, maintenance and operation of the proposed
business (Sube Sports) will not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity. The CC & R's will be revised to restrict
uses requiring more than twelve (12) parking spaces per
building. Based on the unique nature of the subject
business, the proposed use requires no more than 12
parking spaces, in lieu of 15 required pursuant to the
standard automotive repair standards.

b. Property and improvements in the vicinity of such use
or building. The independent parking study indicates
ten (10) spaces are required for the subject business
during peak hours. With the conditions imposed, the
present use and all future uses, will be restricted to
no more than twelve (12) spaces.
2. The granting of Use Permit No. 92-21(R) will not adversely
affect the General Plan of the City of Huntington Beach. The
proposal is consistent with the goals and objectives of the
General Industrial Land Use designation of the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. All previous conditions of approval shall remain in effect
except for the following:
a. Use Permit No. 92-21(R) shall apply to the present
business owner/property owner and shall become null and
void at the time the business or property is
transferred or sold.
b. The existing CC & R's shall be revised to restrict
future uses to twelve (12) designated parking spaces
per building. This will allow an equal distribution of
spaces throughout the complex. A copy of the revised
CC & R's shall be submitted to and approved by the City
Attorney and Department of Community Development.
c. Conditions of approval shall be printed verbatim on the
cover sheet of all working drawings submitted for
plancheck.
d. The Zoning Administrator shall be notified in writing
if any changes in building height, floor area,
setbacks, building elevations or open space are
proposed as a result of the plan check process.
