PUBLIC HEARING ITEMS B-1 CONDITIONS OF APPROVAL SUBMITTAL ON CONDITION NOS 17 AND 18 OF CONDITIONAL USE PERMIT NO 91-39 (CONTINUED FROM THE NOVEMBER 4. 1992 PLANNING COMMISSION MEETING): APPLICANT: City of Huntington Beach Redevelopment Agency LOCATION: 101 Main Street (northwest corner of Main Street at Pacific Coast Highway) This is a request to review, approve and forward to the City Council a parking plan for the four (4) story commercial/office building at the northwest corner of Main Street and Pacific Coast Highway. A condition of approval for the project requires that a parking plan be approved by the Planning Commission and forwarded to the City Council identifying the code required spaces for the project prior to issuance of building permits. The Planning Commission continued the review of the parking plan in order to allow staff and the applicant additional time to clarify and address concerns raised by the Commission. These concerns centered on temporary versus permanent parking, the downtown shared parking concept and the Coultrup phase of Main Pier Phase II. No new information has been received from the applicant/Agency regarding the issues raised by the Commission. STAFF RECOMMENDATION: Planning staff recommends that the Planning Commission approve the Parking Plan, as outlined in the November 4, 1992 Planning Commission staff report, with the added condition to indicate the permanent location of any displaced parking and forward to the City Council. THE PUBLIC HEARING WAS OPENED. Gary Mulligan, 117 Main Street, stated his concern that if this parking plan were deemed adequate their project in the adjacent area would not be able to proceed, as it would increase their parking requirements. He asked if the plan could be put on hold until their project was ready for approval. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARINGS WAS CLOSED. The Commission discussed various alternatives to the parking plan, the phasing of the plan and impacts to adjacent properties. They were also concerned with the consequences if the Coastal Commission did not approve the request. The permanent location of all required parking shall be provided as follows: a. Provide 21 additional parking spaces along Fifth Street (public right-of-way) by changing the parallel parking to diagonal parking. b. Develop 50 parking spaces on the former Terry Buick site, now owned by the Agency. c. Develop 65 parking spaces on Block 105 owned by the Agency for either temporary or permanent use. 2. The temporary location of all required parking shall be provided as follows: a. Provide 87 spaces on the former Terry Buick site. b. Provide 36 new spaces on Fifth Street between Pacific Coast Highway and Olive Street. c. Develop 10 spaces on the Agency -owned parcel in the 200 block of Fifth Street. PC Minutes - 11/17/92 -3- (5559d) B-2 DOWNTOWN SPECIFIC PLAN CODE AMENDMENT NO. 92-5/"VILLAGE CONCEPT" AND DOWNTOWN PARKING MASTER PLAN (CONTINUED FROM THE OCTOBER 6, 1992 PLANNING COMMISSION MEETING): APPLICANT: City of Huntington Beach LOCATION: An area bounded by Goldenwest Street, Pacific Coast Highway, Beach Boulevard and Sixth Street (see attached map) The Downtown Specific Plan rewrite and Parking Master Plan report is divided into four (4) sections which comprise the Downtown Master Plan. Section I describes the intent and purpose of the "Village Concept" and what the City should expect to achieve. Section II, of the report provides the Commission with an annotated list of the legislative strike out version of the Downtown Specific Plan. Section IV is the supporting analysis to implement the Downtown Parking Master Plan. Your attention should also be given to the new provisions included in the Downtown Specific Plan general provisions section that provide incentives for affordable housing projects. A workshop is being conducted on November 12, 1992 at the Art Center downtown to discuss the proposed changes and parking master plan. A summary of the workshop will be presented at the Planning Commission meeting. STAFF RECOMMENDATION: Staff recommends that the Planning Commission open the public hearing, receive testimony and continue Downtown Specific Plan Code Amendment/"Village Concept" and Downtown Master Parking Master Plan to the December 15, 1992 meeting. The Commission brought up concerns regarding mandatory parking versus required parking, if the impacts of seasonal parking had been addressed and property owners concerns regarding the Specific Plan. THE PUBLIC HEARING WAS OPENED. Bob Bolen, 1818 Pine Street, stated his concern that if the request was not approved by the Coastal Commission, the property owners would be stuck with down zoned property. He stated that a better parking management plan was needed and the Third Block West area should be held for meeting future parking requirements. The Commission asked staff what would happen if the Coastal Commission indeed did not approve the plan. Staff stated that the standards could be modified to require less parking spaces, but that too would be subject to Coastal Commission approval. Bob Mandic, 1112 Main Street, stated his concern regarding District 6 parking requirements and also felt that Third Block West should be kept for required parking. PC Minutes - 11/17/92 -4- (5559d) The Commission discussed the Third -Block -West parcel as an alternative for additional parking when downtown development is finished. Staff explained that option could not be considered at this time since there was currently an active conditional use permit on the parcel. Terry L. Olson, 611 - 6th Street, was concerned with live entertainment being allowed in District 6. Gus Zisakis, 611 - 6th Street, stated his concern regarding parking requirements for District 6. Michael Tater, 317 - 5th Street, stated his concern regarding changes within District 5. He feels the property values will go down, by down zoning his property. Michael Niccole, 16861 Coral Cay, stated his restaurant in District 6 was not a problem or a party place and that he shares his parking with adjacent businesses. A MOTION WAS MADE BY RICHARDSON, SECOND BY INGLEE, TO CONTINUE THE PUBLIC HEARING ON THE DOWNTOWN SPECIFIC PLAN CODE AMENDMENT, "VILLAGE CONCEPT" AND DOWNTOWN MASTER PARKING PLAN TO THE JANUARY 1, 1993 PLANNING COMMISSION MEETING, BY THE FOLLOWING VOTE: AYES: Inglee, Richardson, Shomaker, Dettloff, Newman, Leipzig NOES: None ABSENT: Bourguignon ABSTAIN: None MOTION PASSED B-3 CONDITIONAL USE PERMIT NO. 92-37/CONDITIONAL EXCEPTION (VARIANCE) NO. 92-34 (CONTINUED FROM THE NOVEMBER 4, 1992 PLANNING COMMISSION MEETING): APPLICANT: Robert J. Zinngrabe LOCATION: 18800 Florida Street The application is a request to add nine (9) senior residential units to Huntington Terrace South senior residential facility and to have a reduced building setback from 20 feet to 15 feet along the specific plan perimeter (southerly property line). Previous construction at the facility reduced the number of units from 171 to 157. The proposed nine (9) units will make a total of 166 units at the facility. STAFF RECOMMENDATION: Staff is recommending approval of the project provided architectural elevation enhancements are provided and the Fire Department access requirements are met subject to that department's review and approval. The Commission asked the Tom Poe, Fire Department if the fire concerns had been addressed, he stated they had. THE PUBLIC HEARING WAS OPENED. Rick Blomgreen, 18800 Delaware #100, agent for applicant/owner, requested modifications to Condition No. la to a 15 foot setback, and Condition No. lb to two (2), four (4) foot offsets. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. A MOTION WAS MADE BY LEIPZIG, SECOND BY RICHARDSON, TO APPROVE THE ABOVE ENTITLEMENTS WITH FINDINGS AND CONDITIONS OF APPROVAL, AND PASSED BY A 6-1 VOTE, BOURGUIGNON BEING ABSENT. The granting of Conditional Exception (Variance) No. 92-34 for a five (5) foot reduced southerly property line/Specific Plan boundary setback will not be materially detrimental to conforming land, property, or improvements in the neighborhood. The granting of this conditional exception from Section 9645.6 of the Huntington Beach Ordinance code will not defeat the general purposes or intent of the code which is to provide adequate setbacks between buildings and/or uses. 3. The establishment, maintenance and operation of Conditional Exception (Variance) No. 92-34 for a five (5) foot reduced southerly property line/Community Plan setback will not be detrimental to the general welfare of persons residing or working in the vicinity; and property and improvements in the vicinity of such use or building. 4. The granting of the Conditional Exception (Variance) No. 92-34 for a reduced setback will not adversely affect the General Plan of the City of Huntington Beach. FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO, 92-37: 1. The location, site layout, and design of the proposed nine (9) unit senior residential units are properly adapted to the streets, driveways, and other adjacent structures and uses in a harmonious manner. 2. The access to and parking for the proposed nine (9) unit senior residential complex does not create an undue traffic problem. 3. The proposed nine (9) unit senior residential unit addition to an existing 157 unit complex is consistent with the Pacific Community Plan and the mixed development land use designation by the General Plan. CONDITIONS OF APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO 92-34/ CONDITIONAL USE PERMIT NO. 92-37: 1. The site plan, floor plans and elevations received and dated November 5, 1992 shall be the conceptually approved layout with the following modifications subject to the approval of the Community Development Director: a. A minimum 15 foot setback must be provided along the Florida Street frontage. b. There must be a minimum of two (2), four (4) foot offsets within the building plane facing Florida Street. c. Provide roof line variation compatible and consistent with elevation plane breaks. d. Provide window enhancements such as window flower boxes, shape variation or other acceptable treatment. PC Minutes - 11/17/92 -7- (5559d) 2. KV Prior to submittal for building permits, the applicant/owner shall complete the following: a. Submit three copies of the site plan to the Planning Division for addressing purposes. If street names are necessary, submit proposal to Fire Department for review and approval. b. Floor plans shall depict natural gas and 220V electrical shall be stubbed in at the location of clothes dryers; natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units; and low -volume heads shall be used on all spigots and water faucets. C. If foil -type insulation is to be used, a fire retardant type shall be installed as approved by the Building Department and indicated on the floor plans. d. Elevations shall depict colors and building materials proposed. e. All rooftop mechanical equipment shall be screened from any view. Said screening shall be architecturally compatible with the building in terms of materials and colors. If screening is not designed specifically into the building, a rooftop mechanical equipment plan must be submitted showing screening and must be approved. f-. If outdoor lighting is included, high-pressure sodium vapor lamps or similar energy savings lamps shall be used. All outside lighting shall be directed to prevent "spillage" onto adjacent properties and shall be noted on the site plan and elevations. g. Obtain building permits for previous construction which reduced the number of residential units from 171 to 157 units prior to this application approval. h. Comply with handicapped standards. i. The site plan shall include (or reference page) all conditions of approval imposed on the project printed verbatim. Prior to issuance of building permits, the applicant/owner shall complete the following: a. Submit copy of the revised site plan, floor plans and elevations pursuant to Condition No. 1 for review and approval and inclusion in the entitlement file. PC Minutes - 11/17/92 -8- (5559d) b. A Landscape Construction Set must be submitted to the Departments of Community Development and Public Works and must be approved. The Landscape Construction Set shall include a landscape plan prepared and signed by a State Licensed Landscape Architect and which includes all proposed/existing plant materials (location, type, size, quantity), an irrigation plan, a grading plan, an approved site plan, and a copy of the entitlement conditions of approval. The landscape plans shall be in conformance with Section 9608 of the Huntington Beach Ordinance Code. The set must be approved by both departments prior to issuance of building permits. Any existing mature trees that must be removed shall be replaced at a 2 to 1 ratio with minimum 36-inch box trees, which shall be incorporated into the project's landscape plan. c. All applicable Public Works fees shall be paid. d. The subject property shall enter into irrevocable reciprocal driveway and parking easement(s) between the subject site and adjacent properties. A copy of the legal instrument shall be approved by the Community Development Department and the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development. e. Joint use parking shall require that a Joint Use Parking Agreement be recorded between property owners prior to issuance of permits or occupancy. A copy of the legal instrument shall be approved by the City Attorney as to form and content and, when approved, shall be recorded in the Office of the County Recorder. A copy shall be filed with the Department of Community Development. 4. The Public Works Department requirements are as follows: a. All applicable Public Works fees shall be paid. b. A grading plan shall be submitted to the Department of Public works for review and it must approved by issuance of a grading permit. A plan for silt control for all water runoff from the property during construction and initial operation of the project may be required if deemed necessary by the Director of Public Works. c. Prior to Certificate of Occupancy or final building permit inspection traffic impact fees shall be paid. 5. Fire Department Requirements are as follows: a. Install automatic sprinkler systems throughout to comply with Huntington Beach Fire Department and Uniform Building Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. PC Minutes - 11/17/92 -9- (5559d) b. Install a fire alarm system to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. The system will provide the following: 1) Manual Pulls 2) Water flow, valve tamper and trouble detection 3) 24 hour supervision 4) Annunciation 5) Audible Alarms 6) Graphic Display c. Install fire extinguishers located in areas to comply with Huntington Beach Fire Code Standards. d. Fire lanes will be designated and posted to comply with City Specification No. 415. e. Security gates will be designed to comply with City Specification No. 403. f. Install address numbers to comply with City Specification No. 428. The size of the numbers will be the following: 1) The number for the building will be sized a minimum of six (6) inches with a brush stroke of one-half (1/2) inch. 2) Individual units will be sized a minimum of four (4) inches with a brush stroke of one-half (1/2) inch. g. Fire access roads will be provided in compliance with the Huntington Beach Fire Code and City Specification No. 401. Include the circulation plan and dimension of all access roads (24 feet), turnarounds and 17 foot by 45 foot radius turns. The easterly property line access shall be widened to the extent possible with relocation of the transformer if necessary to provide the minimum fire access width acceptable to the Fire Department. h. Another walkway access will be provided for Fire Department operations to the site. The access will be located from Florida Street, extend through a gate and continue to present walkway on the southwest corner of the main terrace building. The walkway and gate will be approximately six (6) feet in width and install per Fire Department approval. i. New Knox Boxes for entry keys for the Terrace complex will be installed in areas designated by Fire Department. 5. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. PC Minutes - 11/17/92 -10- (5559d) 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 7. During construction, the applicant shall: a. Use water trucks or sprinkler systems in all areas where vehicles travel to keep damp enough to prevent dust raised when leaving the site; b. Wet down areas in the late morning and after work is completed for the day; c. Use low sulfur fuel (.05% by weight) for construction equipment; d. Attempt to phase and schedule construction activities to avoid high ozone days (first stage smog alerts); e. Discontinue construction during second stage smog alerts. 8. Construction shall be limited to Monday - Saturday 7:00 AM to 8:00 PM. Construction shall be prohibited Sundays and Federal holidays. 9. Prior to final building permit approval or issuance of a Certificate of Occupancy, the following shall be completed: a. All improvements (including landscaping) to the property shall be completed in accordance with the approved plans and conditions of approval specified herein. b. Compliance with all conditions of approval specified herein shall be accomplished. 10. The Planning Commission reserves the right to revoke this conditional use permit and conditional exception (variance) if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 11. This conditional use permit shall not become effective for any purpose until an "Acceptance of Conditions" form has been properly executed by the applicant and an authorized representative of the owner of the property, recorded with County Recorder's Office, and returned to the Planning Division; and until the ten day appeal period has elapsed. 12. Conditional Use Permit No. 92-37 and Conditional Exception (Variance) No. 92-34 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. The applicant/property owner shall be responsible for paying the Park and Recreation Fees in effect at the time the final map is accepted by City Council or issuance by building permits, whichever occurs first. B-4 APPEAL TO ZONING ADMINISTRATOR'S DENIAL OF CONDITIONAL EXCEPTION (VARIANCE) NO. 92-27: APPLICANT/ APPELLANT: Martin Gobel LOCATION: 205-13th Street, Unit A On August 19, 1992, the Zoning Administrator denied the applicant's request to permit a second story balcony within five (5) feet of the front property line in lieu of the required eight (8) feet for the property located at 205 Thirteenth Street. STAFF RECOMMENDATION: Staff recommended denial of the request because of a lack of a land related hardship or exceptional circumstance to support the request. Staff recommends denial of the appeal and that the Planning Commission uphold the Zoning Administrator's denial of Conditional Exception (Variance) No. 92-27. THE PUBLIC HEARING WAS OPENED. Martin Gobel, stated he wished to build the balcony that would match the one across the street. He submitted photographs to the Commission. The granting of Conditional Exception (Variance) No. 92-27 for the encroachment of a second story balcony into the front yard setback will not constitute a grant of privilege inconsistent with other properties in the vicinity and under identical zone classifications. The existing apartment building was constructed in compliance with the prior development standards of this area and therefore, the granting of this request would not constitute a special privilege upon this property. The balcony would be consistent with the surrounding nonconforming apartment buildings and properties. 2. The subject property and structure along with other surrounding properties and structures were developed in compliance with the development standards at the time of construction. 3. The granting of Conditional Exception (Variance) No 92-27 is necessary to preserve the enjoyment of substantial property rights because the subject property and surrounding developed properties were developed under the same standards and therefore the denial of the request would deprive the subject property of a private balcony. 4. The granting of Conditional Exception (Variance) No 92-27 will not be materially detrimental to the public welfare or injurious to property in the same zone classification. The encroachment of a second story balcony into the front yard setback will not set a precedent for such a request and will not impact the conforming surrounding apartment buildings under the same zone classification. CONDITIONS OF APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO 92 27: 1. The site plan and elevation dated July 2, 1992 shall be the conceptually approved layout. B-5 APPEAL TO CONDITION NO la OF THE ZONING ADMINISTRATOR'S APPROVAL OF SITE PLAN AMENDMENT NO 92-4: APPLICANT/ APPELLANT: Donly-Bennett Architects LOCATION: 8861 Adams Avenue -Pacific Plaza Center On July 22, 1992, the Zoning Administrator approved Site Plan Amendment No. 92-4 which permitted the redistribution and the addition of 23 compact parking spaces at the Pacific Plaza Center located at 8861 Adams Avenue. Condition No. la was imposed which requires the closure of an existing driveway along Adams Avenue. The applicant has appealed Condition No. la based on the assertion PC Minutes - 11/17/92 -13- (5559d) that the driveway has not created traffic problems and the closure is an unnecessary financial burden. Staff disagrees with the reasons to keep the existing driveway open. Staff recommends that the Planning Commission uphold the Zoning Administrator's Condition of Approval No. la and require the closure of the existing driveway along Adams Avenue. THE PUBLIC WAS OPEN. Greg Bennett, 12821 Newport Avenue, Tustin, spoke in support of the project. Jody Roseman, 6479 Dwane Avenue, San Diego, owner of the center felt the loss of the driveway will affect the parcel value. Daniel Reza, 14500 Roscoe Blvd. #470, Panorama City, stated he was concerned that the loss of driveway will create a hardship on his business. The deletion of Condition No. la which requires the closure of an existing driveway on Adams Avenue will not affect traffic flows on Adams Avenue and will allow for additional site access opportunities. CONSENT CALENDAR C-1 GENERAL PLAN CONFORMANCE NO, 92-7: APPLICANT: City of Huntington Beach, Department of Public Works LOCATION: Charter/Guardian Center Project Area (southwest corner of Warner Avenue and Beach Boulevard) The project is located in the public street rights -of -way along Warner and Sycamore Avenues, Ash and Elm Streets, and Beach Boulevard in the Charter/Guardian Center Project Area. The purpose of the request is to determine if the transfer of title on four parcels from the Redevelopment Agency to the City is in conformance with the General Plan. The title transfer constitutes a "clean-up" action which will result in the City rather than the Redevelopment Agency holding the title to the parcels which are already part of the street right-of-way. STAFF RECOMMENDATION: Planning staff recommends approval of the request. The recommendation is based upon the fact that request is consistent with the policies of the Circulation Element of the General Plan and that the project will serve to give the City title to parcels within the street right-of-way. Circulation: Provide a transportation system that is consistent with efforts to minimize adverse environmental and aesthetic effects. The subject parcels are located within the existing street rights -of -way and provide efficient circulation with minimal environmental and aesthetic impacts to the area. NON-PUBLIC HEARING ITEMS D-1 CONDITIONAL USE PERMIT NO 91-34 - ONE (1) YEAR EXTENSION OF TIME• APPLICANT: RPP Architects & Associates LOCATION: 17221 Beach Boulevard RPP Architects and Associates has requested a one (1) year extension of time for Conditional Use Permit No. 91-34 for the construction of a new 2,640 square foot restaurant with alcoholic beverages. The conditional use permit was approved by the Planning Commission on October 8, 1991, concurrently with Tentative Parcel Map No. 91-248, Conditional Exception No. 91-33 and Negative Declaration No. 91-31. The conditional use permit is the only application valid for one year, while the others are valid for up to two (2) years. Based on the reasons contained in the applicant's letter dated October 8, 1992, (see Attachment No. 1) the applicant is requesting a one (1) year extension of time.
