B-1 TENTATIVE PARCEL MAP NO 92-223/CONDITIONAL EXCEPTION
(VARIANCE) NO. 92-35:
APPLICANT: S.Y. Kimball Development
LOCATION: 16231 and 16235 Whitecap Lane
This project is located south of Edinger Avenue and west of Saybrook
Lane at the easterly terminus of Whitecap Lane. The request
involves a reconfiguration of two (2) single family residential lots
at the entrance to the Faire Marin development tract. The location
of the guard gate and landscape median at the private community
blocks proper access to the two (2) residential lots. Convenient
access to the two (2) lots can be maintained by relocating the
driveways to the west side of the parcels and orienting the lots
parallel to Whitecap Lane. The conditional exception (variance) is
requested in order to reduce the lot frontage on one (1) lot from
the required 60 feet to 20 feet.
This request was previously approved by the Planning Commission in
1986 but the applicant failed to record the final map with the
County Recorder. The map subsequently expired and the applicant has
resubmitted the request for approval.
STAFF RECOMMENDATION:
Planning staff recommends approval with two (2) new conditions of
approval and all previous conditions to remain in effect.
THE PUBLIC HEARING WAS OPENED.
Scott Kimball, 15852 Tullow, applicant, stated he was available for
any questions the Commission may have.

REQUEST AND THE PUBLIC HEARING WAS CLOSED.

CONDITIONAL EXCEPTION (VARIANCE) NO. 92-35 AND TENTATIVE PARCEL MAP
NO. 92-223 WITH FINDINGS AND CONDITIONS OF APPROVAL, BY THE
FOLLOWING VOTE:

FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 92-35:
1. The granting of Conditional Exception (Variance) No. 92-35 to
permit a 20 foot lot frontage in -lieu of the required 60 foot
frontage in conjunction with a two (2) lot reconfiguration will
not constitute a grant of special privilege inconsistent upon
other properties in the vicinity and under an identical zone
classification.
2. Because the subject property is located adjacent to the security
gate operation and the perimeter wall for the tract, the strict
application of the zoning ordinance is found to deprive the
subject property of its full utilization which is so enjoyed by
other properties in the vicinity and under the identical zone
classification.

3. The granting of a conditional exception (variance) is necessary
in order to fully utilize both lots to their highest and best
potential.
4. The granting of Conditional Exception (Variance) No. 92-35 will
not be materially detrimental to the public welfare, or
injurious to property in the same zone classifications. The two
(2) single family homes have been constructed and occupied in
conformance with the proposed layout and are compatible with the
size, shape, style, and architectural design of the surrounding
properties.
5. The granting of the conditional exception (variance) will not
adversely affect the General Plan of the City of Huntington
Beach. The General Plan designation of Low Density Residential
is consistent with the two (2) existing single family residences.
FINDINGS FOR APPROVAL - TENTATIVE PARCEL MAP NO, 92-223:
1. The reconfiguration of two (2) parcels for purposes of
residential use is in compliance with the size and shape of
property necessary for that type of development. A conditional
exception (variance) has been submitted to reduce the required
lot frontage from 60 feet to 20 feet.
2. The General Plan has set forth provisions for this type of land
use as well as setting forth objectives for implementation of
this type of housing.
CONDITIONS OF APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 92-35/
TENTATIVE PARCEL MAP N0, 92-223:
1. The Tentative Parcel Map No. 92-223 received and dated september
23, 1992 and the site plan received and dated November 24, 1992
shall be the conceptually approved layout.
2. All previous conditions of approval of Conditional Exception
(Variance) No. 86-87 and Tentative Parcel Map No. 86-407 shall
remain in effect.
3. The following represent new conditions of approval required by
the Department of Public Works:
a. Prior to recordation of this parcel map, the
surveyor/engineer preparing the map shall tie the boundary of
the map into the Horizontal Control System established by the
County Surveyor in a manner described in Sections 7-9-330
and 7-9-337 of the Orange County Subdivision Code and Orange
County Subdivision Manual, Subarticle 18.
b. Prior to recordation of this parcel map, the
surveyor/engineer preparing the map shall submit to the
County Surveyor a digital -graphics file of said map in a
manner described in Sections 7-9-330 and 7-9-337 of the
Subdivision Manual, Subarticle 18.

E. PLANNING COMMISSION ITEMS/INQUIRIES
Commissioner Richardson - congratulated Commissioner Shomaker
for a job well done as the Planning Commission Chairperson.
Commissioner Bourguignon - stated that the meetings with
Public Works had been successful, and they had come up with a
solution to the construction parking problem on street
sweeping days. Steve May, Public Works, explained a policy
will be introduced in which permits would be issued for
construction vehicles to park on public streets during street
sweeping days, with the understanding that the construction
site be responsible for street cleaning.

Commissioner Gorman - expressed his appreciation to City
Councilmember Victor Leipzig for appointing him Planning
Commissioner, and said he looked forward to his role on the
Commission.
F. COMMUNITY DEVELOPMENT ITEMS

City Council meeting.
