ITEM 1: COASTAL DEVELOPMENT PERMIT NO. 91-27 Applicant: Pacific Coast Homes 2124 Main Street, Suite 200 Huntington Beach, CA 92648 Request: To construct eight (8) new single family residences on a previously approved eight (8) lot subdivision pursuant to Section 989.5.2 of the Huntington Beach Ordinance Code. A Local Coastal Program Amendment was recently approved by the California Coastal Commission for a zone change on the subject property. Location: North side of Palm Avenue approximately 150 feet east of Cherryhill Drive. Wayne Carvalho, Staff Planner, reported that the subject property is one of twelve oil islands which were being developed for single family homes. Staff indicated that a Tentative Tract Map and Negative Declaration were previously approved by the Planning Commission and that a Zone Change was recently approved by the Coastal Commission. Staff said that there had not been any telephone calls as a result of the public notification. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED Richard Loyd, representing the applicant, was present and concurred with the suggested conditions of approval. There were no other persons present to speak for or against -.the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 91-27 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 91-27: 1. The request to permit the construction of an eight (8) lot single family subdivision conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed eight (8) lot subdivision will not impact public views or access. 2. Coastal Development Permit No. 91-27 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. In addition, the proposed tract conforms with the public access and public recreation policies of Chapter 3 of the California Coastal.Act. 3. At the time of occupancy, the proposed single family residences will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan received and dated December 10, 1992, shall be the conceptually approved layout with the following modification(s): a. Lot 5 shall conform with the minimum open space and open space dimension requirements. 2. A revised plan shall be submitted for inclusion in the entitlement file. 3. All previous conditions on Tentative Tract Map No. 14243 shall still apply. 4. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 5. Prior to issuance of building permits, a Lot Line Adjustment shall be approved by the City of Huntington Beach and recorded with the County Recorder for the modification of Lot 1. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 91-27 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2• USE PERMIT NO. 92-27 (Six Month Review) Applicant: Wendy Campbell 2716 Ocean Park Blvd. #3040 Santa Monica, CA 90405 Request: Six (6) month review for the establishment of a 1,800 square foot sandwich shop/smoothie bar in conjunction with a video arcade (initially up to 10 games) pursuant to Section 9220.11 of the Huntington Beach Ordinance Code. The applicant requests up to 30 additional video games to be permitted as part of the review. Location: 8865 Atlanta Avenue Wayne Carvalho, Staff Planner, reported that the building suite has ample room for the additional video games. Staff reported that the City Code Enforcement Section had not received any complaints during the first six months of operation. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Chuong Sweeney, co-owner of the business, concurred with staff's recommendation. He said that their initial request was for twenty video games but only ten were approved. He said the additional games were needed to run a profitable business. Sue Ann Pohl, representing Travel Center at 8861 Atlanta, was present. She said her business was adjacent to the video arcade and that she had been at the location for seventeen years. She said their work environment had been disturbed because of noise generated by the video store's stereo. She was also concerned that bike racks cut into sidewalk creating a hazard. She said that most of her business is with senior citizens who have indicated that they will discontinue doing business with her agency because they do not want to interface with the children. She concluded by stating that the use is not compatible with other uses in the center. ZA Minutes 1/6/93 -3- (5535d) Ms. Whitney, 8855 Atlanta, was present. She said she was a tenant in the center for ten years and that the owners of the arcade had been responsive to her complaints; therefore there were no complaints on record to the City. She said her main concern was that games were being played before 3:00 PM on school days and there were too many bikes on the sidewalk disrupting access to other businesses. Chuong Sweeney offered to eliminate the noise by not playing the stereo during normal business hours. He said there are fifteen bike racks and he personally parks bikes when they become busy to ensure that access to the sidewalk is clear. He advised that Edison High School students come in during lunch break from 12:00 noon to 12:30 PM and after school at 2:30 PM. Mr. Sweeney requested to be allowed to operate during lunch period and after 2:30 PM. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 92-27 (SIX MONTH REVIEW) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING MODIFIED CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. MODIFIED CONDITIONS OF APPROVAL - USE PERMIT NO, 92-27: 1. The site plan, floor plans, and elevations received and dated May 7, 1992 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in floor area is proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. There shall be a maximum of 25 games (including billiard tables). 4. Video games shall not be operational during school hours. Games may be operational during the high school's lunch hour (12:00 - 12:30 p.m.) and after 2:30 p.m. 5. Hours of operation shall be as follows: a. Monday -Thursday 10:00 a.m. - 10:00 p.m. b. Friday -Saturday 10:00 a.m. - 11:00 p.m. c. Sundays 10:00 a.m. - 3:00 p.m. 1 ZA Minutes 1/6/93 -4- (5535d) C� 6. One supervisory employee eighteen (18) years or older shall be in attendance during operating hours. 7. Two (2) bicycle racks shall be provided adjacent to the entryway and shall not obstruct the entire sidewalk. 8. Stereos shall be prohibited from operation before 6:00 p.m. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1.
