In response to Councilmember Bauer's inquiry, the City Administrator stated an
affordable housing workshop would be beneficial. He stated that the Council's
adopted policies need to be in the proposed ordinance.
Discussion was held between Council and staff pertaining to the 20% set aside
objective.
The Community Development Director reported on SCAG (Southern California
Association of Governments) reasonable allocation numbers and stated that a
failure to comply would mean that building permits would have to be reviewed
in Sacramento.

In response to Councilmember Silva's inquiry, Mayor Winchell stated the alter-
nate action to that recommended by staff for the item pertaining to the speed
limits on Brookhurst and Bushard Streets would be to maintain the speed limit
at 45 miles per hour.

The Mayor called a Closed Session of the City Council pursuant to Government
Code Section 54956.9 (a) to confer with its attorney regarding pending litiga-
tion which has been initiated formally and to which the city is a part. The
title of the litigation is in the matter of the complaint of American Trading
Transportation Court Case No. CV 90-2619 Central District. (120.80)
The Chairman called a Closed Session of the Redevelopment Agency pursuant to
Government Code Section 54956.9 (a) to confer with its attorney regarding
pending litigation which has been initiated formally and to which the agency
is a party. The title of the litigation is Bloom v Redevelopment Agency,
Orange County Superior Court Case No. 67 13 06. (400.50)
The Chairman called a Closed Session of the Redevelopment Agency pursuant to
Government Code Section 54956.8 to give instructions to the Agency's
negotiator regarding negotiations with Resolution Trust Corporation for the
joint sale of 10,000 square feet of condominium property in "Town Square"
Redevelopment Project at 501 Main Street, Huntington Beach, California (Main

The Chairman called a Closed Session of the Redevelopment Agency pursuant to
Government Code Section 54956.8 to give instructions to its negotiator regard-
ing negotiations with Coultrup Development Corporation concerning the
purchase/sale/exchange/lease of the property located between Main Street,
Pacific Coast Highway and 5th and Walnut - Main -Pier Phase II. (400.50)

Mayor Winchell called the regular meetings of the City Council and the
Redevelopment Agency of the City of Huntington Beach to order at 7 p.m.
ROLL CALL
PRESENT: Robitaille, Bauer, Winchell, Silva, Sullivan, Leipzig
ABSENT: Moulton —Patterson
Mayor Winchell stated that Councilmember Moulton —Patterson was in
Washington, D.C. attending the Presidential Inauguration.
FLAG CEREMONY AND INVOCATION
The Flag Ceremony was led by students from Huntington Christian School,
Huntington Beach. The invocation was given by Father Larry Hunter from St.
Wilfrid's Episcopal Church, Huntington Beach.
PRESENTATION_ — RETIRED FIRE CHIEF PIrARD — EMERGENCY SERVICES
Mayor Grace Winchell and Fire Chief Mike Dolder presented a plaque to Retired
Fire Chief Ray Picard for donating his personal funds to send Glorria
Morrison, Emergency Services Coordinator, to Dade County, Florida to study the
long term effects of Hurricane Andrew.
E-VOLIC COMMENTS
,Jack Bpwland addressed the Council regarding the speed limit on Bushard and
Brookhurst. He stated various observations he had made during a survey he
conducted including observing 41 of 138 bike riders of middle school age on
Bushard from Brookhurst to Garfield riding on the wrong side of the street and
28 riding on the wrong side of the street in the non —marked bike lane side of
Brookhurst. He cited the average speed of automobiles. He recommended that
Council adopt the alternate action as proposed by staff and that a larger
study be done.

Ian Collins, Sowers Middle School Principal representing Dr. Duane Dishno,
Huntington Beach City School Board, requested that Council stand by their
previous actions and leave the speed limits on Brookhurst and Bushard Streets
at 45 mph, because their previous decision was based on reasonable and safe
action; that motorists drive five to ten miles above the speed limit
Increasing the possibility of student accidents. He requested that on behalf
of the City School District and the 1100 students attending Sowers, that
Council honor their previous reasonable and safe actions and to honor the
Council -agreed upon flashing yellow lights and the use of mobile police
display boards. He stated the Traffic and Engineering Department had
responded to safety and placement of pedestrian crosswalks and that he
appreciated the cooperation of the city.
Togger Horagk stated he did not believe that the Brookhurst speed limit should
be the same as the freeway and that additional police code enforcement was
needed; He stated that in the 20 years he had lived at the south end of
Bushard he could not remeber a policeman at the side of the road ticketing or
radar used more 'than once or twice. He urged Council to approve a 40 mph
speed limit on Bushard and Brookhurst. He stated it was said that a "25 mph
School Children Present" sign could not be placed on Bushard for Sowers School
because it was not on Bushard but was 1/10 mile from Bushard, but that sign is
used for Moiola School in Fountain Valley which is 4/10 mile from Bushard. He
stated that the Attorney survey showed the highest accident rate is from
Indianapolis to Atlanta where the crosswalk is at Sowers School.
Edward Wooley stated he had two issues of concern pertaining to the speed
limits on Bushard and Brookhurst and that was risk of reduced safety and ease
of enforcement. He stated he cared more about safety than procedures and that
the speed sample was flawed in logic. He stated there was, a restricted
horizontal view because of the walls on Bushard.
T K Brimer stated he was opposed to higher speed limits on Bushard and
Brookhurst and he asked that the safety of children be taken into considera-
tion. There had been three bicycle/auto accidents in the area, one almost
fatal which perhaps would have been if the speed had been posted higher.
CA rolyn Fizer stated she lives between Bushard and Brookhurst, south of Adams,
and that she was in support of a low speed limit. She stated that the survey
conducted 11/12/92 during non -peak hours already stated that the traffic is
too fast. She urged Council to approve the alternate action citing
unsupervised crossing at Bushard, that as these two streets are surrounded by
residences a lower speed is a necessity not an engineering judgment. Perhaps
the low accident rate is because of low speed postings.
Georg_ Arnold stated that people were traveling 65--70 mph on Newland and that
he believed the speed limits in Huntington Beach was too high. He stated he
believed the State Vehicle Code stating "drive at a safe speed" provides the
means for a lower speed posting in such areas of concern.
JamRs Schultz, Huntington -By -the -Sea Mobile Estate Association Vice President,
stated that mobile home rates were increasing and affordable housing had been
ignored.
Sandra Cale stated she was in support of rent stabilization and affordable
housing. She stated that mobile home space rent had increased 48% since 1986
for her but that her retirement income had only increased 2%.

Sandra Sweeney, Driftwood Mobile Home Park, stated that since the death of her
husband had caused her a hardship, she believed that it was not fair to
conduct a general lottery drawing and that a hardship case should be
prioritized.
Heinz J. Hamelberg presented material to Council. He cited the fowl ordinance
and stated he would propose that it be amended to allow him to raise homing
pigeons since it was a world—wide recognized sport. He stated that his birds
are kept in sanitary conditions in a loft away from any dwelling.
In response to Mayor Winchell's inquiry, -Heinz Hamelberg stated he had 75-100
birds. Mayor Winchell stated the staff would review the matter and contact
him.
Mary Gray stated she was a resident on Heil Avenue and that she believed that
Fort Apache (Unocal) created an unsafe environment with toxic fumes not less
than 30' away blowing into her home. She stated that her health and the
health of her child had deteriated in seven months. She urged. Council to
check into the issue.
Mayor Winchell stated the issue of Fort Apache was being pursued and that
staff members were reviewing the matter and preparing reports on a regular
basi s .
CITY ADMINISTRATOR'S RESPONSE TO PUBLIC COMMENTS
Driftwood
The City Administrator stated the mobile home buyout would be discussed later
in the meeting during the administrative item pertaining to Budget Amendment
for FY 1992/93 and Authorization to expend $1,000,000 for the Driftwood Annual
Buyouts.
Bushard/Brookhurst Speed Limits
The City Administrator stated the speed limits on Bushard and Brookhurst will
be discussed later in the meeting during the administrative item pertaining to
it.
Fort Apaghe — Unocal Faciliisy — Heil Avenue
The City Administrator stated that the Fire Chief was working on the issue of
Fort Apache.
Fire Chief Dol der reported that it was an air quality issue and not an issue
covered under the Fire Code. He stated that AQMD (Air Quality Management
District) was conducting a risk assessment as provided by Unocal and that the
data was not yet available.
NO MAJOR FLOOD DAMAGE DURING RECENT RAINS
The City Administrator reported that there was no major flood damage during
the previous rainy weather and that the tornado damage was not major.

The City Administrator stated the Citizens` Committee reviewing the General
Plan would be at 7:30 p.m., January 27. 1993 in Room B-8. He assured the
public that there would be public notification before any actions would be
taken.
STATE BUDGET
The City Administrator reported on the summary of the state budget. He stated
that at the January 25, 1993 Council meeting he would present the status of
the impact of the city budget by state actions and a process for preparing the
199311994 fiscal year budget.
REPORT RE: FORT APACHE - UNOCAL FACILITY - HEIL AVENUE
In response to Councilmember Bauer's inquiry pertaining to Fort Apache, Fire
Chief Dolder stated that the Council would receive a weekly update through the
City Administrator. He stated he did not forecast a closing of the site as
long as there were off -shore systems.

On motion by Leipzig,.second Sullivan, Council approved suspending the regular
order of business as shown on the agenda to move immediately to item pertain-
ing to the speed limits on Brookhurst and Bushard Streets by the following

1 - INTRODUCTION APPRQVED
The City Clerk presented a communication from the Public Works Director and
the Chief of Police regarding lowering the speed limits on Brookhurst and
Bushard Streets.
Councilmember Sullivan stated he believed the item pertaining to the speed
limits on Brookhurst and Bushard Streets should be a public hearing with
resident notification.
The City Clerk presented Ordinance No. 3187 for Council approval - "AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ADOPTING A NEW
PRIMA FACIE SPEED LIMIT FOR BUSHARD STREET BETWEENBROOKHURST STREET AND
ARFIELD AVENUE."
The City Clerk presented Ordinance No. 3188 for Council approval - "AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH ADOPTING A NEW
PRIMA FACIE SPEED LIMIT FOR BROOKHURST STREET BETWEEN PAC,I„EIC COAST HIGHWAY

A motion was made by Bauer, seconded by Silva, to approve introduction of
Ordinance Nos. 3187 and 3188 that confirms the 45 mph speed limit on
Brookhurst and Bushard Streets.
Police Chief Lowenberg reported on the use of radar to control vehicular
speed. He stated that the purpose was not to garner revenue but to control
speed.
The City Administrator reported on the issue of providing safe streets. He
stated the city is bound by rules, regulations and laws that stipulate in
order to use radar the city has to comply with the 85 percentile.
Councilmember Bauer requested staff to write a letter to Senator Bergeson and
Assemblymember Doris Allen pertaining to the city's problem of lowering speed
limits while staying in compliance with state regulations for radar use. He
stated that local jurisdictions need more flexibility to lower the speed limit
And use radar.
Councilmember Robitaille suggested a resurvey after posting the speed to
review the effect.
Mayor Winchell stated the survey was done after posting the speed and it did
not lower the speed.
The motion was made by Bauer, seconded by Silva, to approve introduction of
Ordinance Nos. 3187 and 3188 that confirms the 45 mph speed limit on
Brookhurst and Bushard Streets carried by the following roll call vote:

The Mayor announced that this was the day and hour set for a public hearing
continued open from January 4, 1993 for the purpose of considering a draft
fiscal year 1993 Comprehensive Housing Affordability Strategy (CHAS) Annual
Plan and an Annual Performance Report.
Barbara Kaiser, Deputy City Administrator/Economic Services, presented a staff
report.
Legal notice as provided to the City Clerk's Office by staff had been mailed,
published, and posted. No communications or written protests were received on
the matter.
The Mayor declared the public hearing open.
Norb Johnson stated he had been at the GSMOL (Golden State Mobilehome Owners'
League) and submitted the City Administrator's name and the City Attorney's
name to receive a monthly GSMOL newspaper pertaining to mobilehomes throughout
the state. He stated that the rents had been raised too high at the
Huntington -by -the -Sea Mobilehome Park.

eorge Arnold stated he did not believe that the City of Huntington Beach
provides affordable housing.
There being no one present to speak further on the matter and there being no
further protests filed, either oral or written, the hearing was closed by the
Mayor.
The City Administrator stated that a rent stabilization workshop was scheduled
for February 5, 1993 at 3-7 p.m.
A motion was made by Leipzig, seconded by -Bauer, to approve the Comprehensive
Housing Affordability' Strategy (CHAS) Annual Report and Annual Performance
Report and to direct, staff to submit all. comments received from the City
Council and the public during the 30 day comment period which ends
December 25, 1992, to HUD with the CHAS Annual Report and Annual Performance
Report. The motion carried by the following roll call vote:

The Mayor announced that this was the day and hour set for a public hearing
pursuant to Section 5.48.040 of the Huntington Beach Municipal Code to
consider an application for a Certificate of Public Convenience and Necessity
to operate a taxi cab business in the City of Huntington Beach. The appli-
cants are Panagotis and Athanasios Roditis, dba South Coast Cab Company, Inc.
and their proposed principal place of business is 12918 Haster #A, Garden
Grove, CA 92640.
Legal notice as provided to the City Clerk's Office by staff had been mailed,
published, and posted. No communications or written protests were received on
the matter.
Police Chief Lowenberg presented a staff report.
The Mayor declared the public hearing open.
Peter Roditis, South Coast Cab owner, spoke in support of his taxi cab opera-
tion. He stated his operation has clean cabs and experienced drivers, that
his business creates jobs, and he gives a 10-20% discount to senior citizens.
There being no one present to speak further on the matter and there being no
further protests filed, either oral or written, the hearing was closed by the
Mayor.
A motion was made by Silva, seconded by Robitaille, to find in the public
interest that convenience and necessity require the issuance of a certificate
subject to the filing and approval of an undertaking as provided for in the
Huntington Beach Municipal Code Section 5.48.070 (Liability Insurance), and
subject to such conditions as may be imposed by the City Council, including
the minimum and maximum of vehicles that may be used. The motion carried by
the following roll call vote:

The City Administrator explained the exploration that had taken place pertain-
ing to the process of selecting people for the Driftwood buyout.
Barbara Kaiser, Deputy City Administrator/Economic Development, reported on
the lottery process according to the terms of the 1988 Agreement.
Discussion was held between Councilmembers on the possibility of continuing
the item pertaining to the Driftwood annual buyouts for further information.
The City Administrator stated an overview of the Driftwood buyouts could be
presented at the study session January 25, 1993.
Mayor Winchell reported that a component of the Waterfront -Driftwood history
could be added to the study session January 25, 1993.
A motion was made by Sullivan, seconded by Leipzig, to continue the item
pertaining to the Driftwood annual buyouts to February 1, 1993 pending a study
session to be held January 25, 1993.- The motion carried by the following roll

A motion was made by Silva, seconded by Leipzig, to:
1. Approve Amendment No. 1 to the agreement for legal services between the
city and Lewis, D'Amato, Brisbois and Bisgaard and authorize execution by
the Mayor and City Clerk.
2. Approve an amendment to the current year's budget by appropriating an
additional $50,000 for defense of Bloom v. City of Huntington Beach &
Redevelgpm-ent Agency of the City fHuntington Bach.

Following his comments on downtown Redevelopment, Councilmember Sullivan
requested from the City Attorney a listing of all legal fees to defend suits

Administrator/Economic Services a list of how many downtown Redevelopment
projects are in bankruptcy.

The City Clerk presented Ordinance No. 3179 for Council adoption - AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AMENDING
CHAPTER 9502.3 OF THE HUNTINGTON BEACH ORDINANCE CODE RELATING TO RESIDENTIAL
USES." Amends Article 96Q and the Downtown Specific Plan related to parking
provi�ipn� - Local Cgastal Program Amendment No. 2091.
Councilmember Silva stated he had received a letter from the Association of
Realtors and that they requested a one -month continuance of the item
pertaining to Ordinance No. 3179.

The Community Development Director reported.
Following discussion, a motion was made by Silva, seconded by Robitaille, to
continue the item pertaining to Ordinance No. 3179 to January 25, 1993 with
staff returning with information on a possibility of a continuance. The
motion carried by the following roll call vote:

A motion was made by Silva, seconded by Robitaille, to continue the item per-
taining to Ordinance No. 3180 to January 25, 1993 with staff returning with
information on a possibility of a continuance. The motion carried by the
following roll call vote:

Councilmember Robitaille requested staff to check with the Orange County
Vector Control regarding homing pigeons.
Mayor Winchell requested a staff report pertaining to the pros and cons of
raising homing pigeons in residential neighborhoods.

HS SMALL BUSINESS ASSISTANCE CENTER
Councilmember Bauer announced the Huntington Beach Small Business Assistance
Center Grand Opening would be held, 5-7 p.m., January 26, 1993. He stated the'
facility would open February 2, 1993.
SURFCREST NORTH STATUS - MEETING TO BE SCHEDULED WITH STAFF/WINCHELL/SILVA/

Discussion regarding the status of Surfcrest north. Request for diction
from Council regarding the process for working with staff and applicant.

Mayor Winchell stated that Seacliff Partners requested a continuance from the
Coastal Commission and stated their intent was to return to the city for
modifications.
Mayor Winchell requested staff to schedule a meeting with herself and
Councilmembers Sullivan and Silva prior to the discussion with the applicant.
REPORT PRESENTED - ROAD MATERIAL RECYCLING
The Public Forks Director reported regarding road material recycling.
JOINT STUDY SESSION WITH TRANSPORTATION CDMMISSION TO BE 2/l/93
Request Council consider rescheduling the Joint study session with the
the new members to meet with the existing commissioners prior to meeting with
the City Council Tuesday. February 161h
Counciimember Leipzig stated a joint study session with the Transportation
Commission regarding signal light prioritization would be rescheduled for
February 1, 1993. He stated the next Transportation Commission meeting would
be February 9, 1993.
Mayor Winchell requested citizens concerned with Yorktown/Florida and
Atlanta/Garfield to be notified of rescheduling and any other persons as
applicable.

The City Administrator stated there would be a work study session held
February 5, 1993 at 5:30 p.m.; an adjourned regular meeting February 22, 1993;
