ZONING ADMINISTRATOR: Mike Strange STAFF MEMBERS: Wayne Carvalho MINUTES: The Minutes of January 20, 1993 Zoning Administrator Meetings were continued. ITEM 1: COASTAL DEVELOPMENT PERMIT NO. 92-32 Applicant: Richard L. Andersen 128 S. Glassell Orange, CA 92666 Request: To permit a 1,500 sq. ft. two (2) story addition to an existing two story single family residence pursuant to Section 989.5.2 of the Huntington Beach Ordinance Code. Location: 16602 Somerset Lane Wayne Carvalho, Staff Planner, reported that an identical application for a coastal development permit at the location was approved in 1990. The project was never started and the permit expired. Staff advised that the request meets Code in every aspect and concluded by recommending approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Richard Andersen, the applicant, was present and concurred with staff's report. Marguerite Morrison, 16582 Somerset, posed questions to staff and requested that the Zoning Administrator ensure that the request meet the Association's CC&R's. The Zoning Administrator advised that the City enforces Code requirements not CC&R's. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 92-32 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. 1. The request to permit the remodel and addition to an existing two-story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed 1,500 sq. ft. two (2) story addition will not impact public views or access. 2. Coastal Development Permit No. 92-32 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The addition complies with all applicable City codes. 3. At the time of occupancy, the proposed remodel and 1,500 sq. ft. addition to an existing two-story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All infrastructure currently exist to the site. 4. The proposed remodel and 1,500 sq. ft. addition to an existing two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated December 30, 1992 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. All proposed dock and ramp improvements shall require separate permits for the improvements located within the public waterways. ZA Minutes 1/27/93 -2- (5763d) 1 4. All proposed cantilevered deck improvements require separate permits for the improvements. 5. All -building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. Proposed structures shall be architecturally compatible with existing structures. 7. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 8. Low -volume heads shall be used on all spigots and water faucets. 9. The Public Works Department requirements are: a. Water service shall be upgraded to a two (2) inch water meter pursuant to Public Works standards. b. The applicant shall pay all applicable Public Works fees. 10. The Fire Department requirements are: a. Automatic sprinkler systems shall be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code standards. b. Smoke detectors shall be installed in sleeping areas per the 1991 Uniform Building Code. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 92-32 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 2: USE PERMIT NO, 92-70 Applicant: The Vons Companies, Inc. 618 Michillinda Ave. Arcadia, CA 91007 ZA Minutes 1/27/93 -3- (5763d) Request: To permit a 1,200 sq. ft. addition by enclosing an existing loading dock area in the rear of the Vons Supermarket and installing a trash compacter pursuant to Section 9220.10 of the Huntington Beach Ordinance Code. Location: 5922 Edinger Ave. Wayne Carvalho, Staff Planner, reported that the Vons Store is located at the southwest corner of Springdale and Edinger. He indicated that staff analyzed the parking and noise impact to the adjacent residential and the circulation within the center and determined that the request would not have a detrimental impact. Staff concluded by recommending approval with findings and conditions of approval. THE PUBLIC HEARING WAS OPENED. Margaret Blancher, representing the applicant, was present and concurred with Staff's report. Steve Parsons, Vons Store manager at the subject location, was present and available to respond to questions. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 92-70 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO 92-70: 1. The establishment, maintenance and operation of the 1,200 square foot commercial addition will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. With the conditions imposed, the addition will not impact adjacent properties nor employees working at the center. b. Property and improvements in the vicinity of such use or building. The proposed addition will allow loading and unloading within an enclosed area which will reduce noise impacts to the surrounding properties. 2. The granting of Use Permit No. 92-70 will not adversely affect the General Plan of the City of Huntington Beach. The 1,200 square foot commercial addition is consistent with the goals and objectives of the General Commercial Land Use designation of the General Plan. 1 ZA Minutes 1/27/93 -4- (5763d) 1 SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated December 16, 1992 shall be the conceptually approved layout with the following modifications: a. Depict the present location of the trash compactor and removal of a parking space. 2. A revised site plan shall be submitted depicting the modifications described above. 3. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 5. Fire Department Requirements: a. An automatic fire sprinkler system shall be extended into the proposed addition area pursuant to Fire Department regulations. b. Service roads and fire lanes, as determined by the Fire Department, shall be posted and marked. c. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 6. There shall be no outside storage of goods or equipment. 7. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 8. Proposed structures shall be architecturally compatible with existing structures. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke Use Permit No. 92-70 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 3: CONDITIONAL EXCEPTION NO. 92-48 Applicant: John E. Shanks 1219 "B" Alabama Street Huntington Beach, CA 92648 Request: To permit the construction of a new 3,100 sq. ft. two story residence with reduced exterior sideyard setbacks for the garage and upperstory pursuant to Section 9130.7 of the Huntington Beach Ordinance Code. Location: 1235 Alabama Street Wayne Carvalho, Staff Planner, reported that the property is located on a corner lot and has a railroad easement at the rear of the lot with no alley access. Staff advised that the proposed construction includes a three car garage. Staff concluded by recommending . approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. John Shanks, the applicant, was present and concurred with Staff's report. There were no other persons present to speak for or against the request and the public hearing was closed. CONDITIONAL EXCEPTION NO. 92-48 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO, 92-48: 1. The granting of Conditional Exception No. 92-48 will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. There is one feasible point of access to the site which requires a variance. Other properties on the same block take access from the front (Alabama Street), however, with the dedication of the corner radius, the property owner is required to take access off Memphis Avenue. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. The property is located on a corner where access can only be taken off the exterior side yard (Memphis Ave.) since there is no alley access to the property. 3. The granting of Conditional Exception No. 92-48 is necessary in order to preserve the enjoyment of one or more substantial property rights. The variance will allow the property owner to construct a single family residence on a conforming lot. 4. The granting of Conditional Exception No. 92-48 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. The applicant has provided a three (3) car garage to reduce impacts on street parking. 5. The granting of Conditional Exception No. 92-48 will not adversely affect the General Plan of the City of Huntington Beach. The proposed single family residence is consistent with the Medium Density Residential Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated January 19, 1993 shall be the conceptually approved layout with the following modifications: a. Special window treatment shall be provided along the south elevation similar to that of the north (Memphis Avenue) elevation. 2. A revised site plan shall be submitted depicting the modifications described above. 3. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 4. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. ZA Minutes 1/27/93 -7- (5763d) 5. Prior to issuance of building permits, the following plans and items shall be submitted and/or completed by the applicant: a. Four (4) sets of landscape and irrigation plans toithe Department of Community Development and Public Works for review and approval. 6. All applicable Public Works fees shall be paid prior to issuance of building permits. 7. Prior to issuance of building permits, the applicant shall dedicate a twenty (20) foot corner radius per Public Works Department requirements. 8. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. Full street improvements shall be provided prior to final building permit approval. 5. The Zoning Administrator reserves the right to revoke Conditional Exception No. 92-48 if any violation of these conditions or the Huntington Beach Ordinance Code occurs.
