No action can be taken by the Planning Commission on this date, unless agendized. The following persons spoke in support of non-public hearing item D-1, John Newcomb, John Tillotson and Tom Winfield. The following persons spoke in opposition of non-public hearing item D-1, Ronald Dreyer, L.M. Gaurano, M.D., Bob Bolen, Loretta Wolfe, Bob Mandic, Connie Mandic. Kirk Kirkland, 2217 Florida Street, stated his concerns regarding street vendors in the neighborhoods and the deterioration of the Utica, Florida residential area. THE COMMISSION VOTED AT THIS POINT TO BRING ITEM D-1 TO THE FRONT OF THE AGENDA. PLEASE NOTE THE MINUTES WILL SHOW THE ACTIONS IN ITS ORIGINAL ORDER B. PUBLIC HEARING ITEMS B-1 APPEAL OF THE ZONING ADMINISTRATOR'S ACTION REVOKING USE PERMIT NO, 92-29: APPLICANT/ APPELLANT: Juan Navarro LOCATION: 19731 Beach Boulevard Use Permit No. 92-29 was revoked by the Zoning Administrator on December 23, 1992 following a public hearing for a six (6) month review. The revocation required the applicant to cease operation of the recycling business due to the incompatibility of the use with the surrounding properties. On January 4, 1993, the applicant appealed the action of the Zoning Administrator with the opinion that the business is compatible with the surrounding neighborhood, and that the present location is adequate and convenient for the residents in the area. The applicant further states that the recycling center helps as a means of financial support for many residents in the area, and that the business supports the applicants family of six. STAFF RECOMMENDATION: Due to the concerns received by surrounding residents about the operation of the recycling center, and the appellant's non-compliance with conditions of approval, staff recommends that the Planning Commission deny the appeal and sustain the Zoning Administrator's action by revoking Use Permit No. 92-29 with findings. THE PUBLIC HEARING WAS OPENED. Frank Puccilli, 2402 Florida #G, spoke in opposition to the request stating that the recycling center was incompatible with the adjacent apartment complex. Kirk Kirkland, 2217 Florida, spoke in opposition to the request stating that the recycling center was incompatible with the adjacent apartment complex. Haydee V. Tillotson, 16426 Ladona Circle, spoke in support of the small business but in opposition to its location. She stated the use was incompatible to the area. Brenda Roberts, 615 Utica #3, spoke in opposition to the request stating her concern with excessive loitering and trash in the area. PC Minutes - 2/17/93 -2- (6161d) Mel Heckman, 303 Alabama Street, spoke-in,opposition to the request stating the business did not follow their conditioned hours of operation. Jo Brennan 2402 Florida, spoke in opposition to the request. Dave Karina, 1903 Florida, spoke in opposition to the request stating that the use did not enhance the neighborhood. Don Dooley, 1921 Alsuna Lane, spoke in opposition to the request. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Commission discussed the laws governing the requirements for recycling center proximities. They spoke in support of the center but felt the location was incompatible to the surrounding area. They requested a 60-day extension of the use permit and directed staff to work with the applicant in relocating to a more compatible area. A MOTION WAS MADE BY INGLEE, SECOND BY BIDDLE TO SUSTAIN THE ZONING ADMINISTRATOR'S ACTION BY REVOKING USE PERMIT NO. 92-29 WITH FINDINGS, BY THE FOLLOWING VOTE: AYES: Cook, Bourguignon, Inglee NOES: None ABSENT: None ABSTAIN: None MOTION PASSED 'Biddle, Richardson, Dettloff, Gorman, FINDINGS FOR DENIAL - USE PERMIT NO. 92-29: 1. After the monitoring of the maintenance and operation of the Recycling Center for six (6) months, it has been determined that the use has been detrimental to: a. The general welfare of persons residing or working in the vicinity. The Recycling Center creates noise and odors for the tenants residing and working in the vicinity. Furthermore, there is no buffer from the residential property. b. Property and improvements in the vicinity of such use. The recycling bin is situated in close proximity to apartment buildings and is incompatible with the adjacent residential development. The Planning Commission requested that the applicant have a 60-day extension of time to relocate to an appropriate site, and directed staff to assist the applicant in this relocation. PC Minutes - 2/17/93 -3- (6161d) B-2 CONDITIONAL USE PERMIT NO, 92-50/CONDITIONAL EXCEPTION (VARIANCE) NO. 92-49: APPLICANT: D. Scott Hulber LOCATION: 7368 Center Avenue Conditional Use Permit No. 92-50 is a request to establish a coffee house, Strange Brew Espresso Bar, with live entertainment at 7368 Center Avenue. Conditional Exception (Variance) No. 92-49 is a request for a reduction of five (5) parking spaces in association with the espresso bar. The use is proposed at the southeast corner of Center Avenue and Gothard Street within the College Country Center. STAFF RECOMMENDATION: Staff recommends approval of both requests because the site is substantially buffered from any residential properties and several land related hardships exists on the property. THE PUBLIC HEARING WAS OPENED. Willian Nelson Gentry, Attorney for the applicant, stated he supported the staff report and was there to answer any questions the Commission may have. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. A MOTION WAS MADE BY DETTLOFF, SECOND BY BOURGUIGNON, TO APPROVE CONDITIONAL USE PERMIT NO. 92-50 AND CONDITIONAL EXCEPTION (VARIANCE) NO. 92-49 WITH FINDINGS AND CONDITIONS OF APPROVAL, BY THE FOLLOWING VOTE: AYES: Cook, Bourguignon, Biddle, Richardson, Dettloff, Gorman, Inglee NOES: None ABSENT: None ABSTAIN: None MOTION PASSED FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION (VARIANCE) NO. 92-49: 1. There are exceptional or extraordinary circumstances or conditions applicable to the land, buildings or premises involved that do not apply generally to other property or uses in the district. The property was developed in phases and over a time period when parking requirements changed. There is a Southern Pacific Railroad easement on the east side of the property which prohibits additional parking. The property is L-shaped and is a corner parcel. The granting of a conditional exception for reduction of five (5) parking spaces in conjunction with the restaurant with live entertainment is necessary in order to preserve the enjoyment of one or more substantial property rights. The property is zoned and general planned for general commercial uses such as Strange Brew Espresso Bar. 3. The granting of Conditional Exception (Variance) No. 92-49 for a reduction of five (5) parking spaces in conjunction with a restaurant with live entertainment will not be materially detrimental to the public health, safety and welfare, or injurious to the conforming land, property, or improvements in the neighborhood. Sufficient and adequate circulation currently exists on the site and can be maintained with the implementations of this project. 4. Conditional Exception (Variance) 92-49 for a reduction of five (5) parking spaces is consistent with the goals and objectives of the City's General Plan and Land Use Map designation of general commercial which allows a restaurant with live entertainment. Deviations from the parking requirements may also be granted subject to approval of a conditional exception (variance). 5. The granting of this conditional exception from Section 9602.2(R) of the Huntington Beach Ordinance Code will not defeat the general purposes or intent of the code which is to provide sufficient on -site parking for all uses. During the peak hours of operation of the live entertainment in the evening, the adjacent office uses will most likely be closed and the parking demand will decrease. 6. The establishment, maintenance and operation of the proposed reduction of five (5) parking spaces will not be detrimental to the general welfare of persons residing or working in the vicinity; and property and improvements in the vicinity of such use or building. The surrounding uses are also general retail commercial. 7. The applicant is willing and able to carry out the purposes for which the conditional exception (variance)/conditional use permit is sought and he will proceed to do so without unnecessary delay. FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO. 92-50: 1. The proposed restaurant with live entertainment is in conformance with the City of Huntington Beach General Land Use designation of general commercial which permits live entertainment in conjunction with a standard commercial use. The location site layout, and design of the proposed restaurant with live entertainment properly adapts the proposed structures to streets, driveways, and other adjacent structures and uses in a harmonious manner. The project is located in a primarily commercial area and the proposed live entertainment will not adversely impact other surrounding properties. 3. The combination and relationship of one proposed to another on a site are properly integrated. The other businesses in the center and in the vicinity are general retail commercial restaurant uses and office uses which are compatible with the proposed restaurant with live entertainment. 4. The access to and parking for the proposed restaurant with live entertainment does not create an undue traffic problem. Although there is a variance for five (5) parking spaces, there is a mix of uses in the site that will not conflict with each other. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 92-50/ CONDITIONAL EXCEPTION (VARIANCE) NO. 92-49:: 1. The site plan, floor plans, and elevations received and dated February 8, 1993 shall be the conceptually approved layout. 2. Prior to commencing live entertainment activities, the following shall be completed: a. The applicant shall obtain approval of an entertainment permit from the Police Department. b. The signage marking the 23 spaces "Reserved Del Taco Parking Only" shall be removed unless a Parking Management Plan is submitted and approved. The property owner may install signage identifying "College Country Center Parking Only". 3. The use shall conform to the following: a. All exterior doors and windows, particularly the bar/patio doors, shall remain closed during all hours of live entertainment. b. The hours of operation for live entertainment shall be limited to between the following hours: Monday - Thursday 8:00 PM - 12:00 AM Friday - Saturday 8:00 PM - 1:00 AM Sunday 4:00 PM - 12:00 AM c. There shall be no dumping of trash and/or glass bottles outside the building after 10:00 PM d. The restrooms shall be available for patrons use during business hours. PC Minutes - 2/17/93 -6- (6161d) 1 rI J 1 e. The number of live entertainment performers shall be limited to a maximum of five (5) players at any given time. f. No dancing shall be permitted. g. The stage shall be handicapped accessible. 4. The Fire Department Conditions are as follows: a. New tenant will have to change use from B-2 occupancy group to A-3. Applicable building codes for Group A are as follows: 1) Two (2) hour fire resistive wall separation where less than ten (10) feet. 2) Exits, aisleways, and signage must comply with Uniform Building Code Chapter 33. 3) Occupancy load must be established by Building Division and posted on sign inside front entry. 4) Fire extinguishers must be installed per Fire Code. 5. The Planning Commission reserves the right to revoke Conditional Use Permit No. 92-50 and Conditional Exception (Variance) No. 92-49 if any violation of the conditions or the Huntington Beach Ordinance Code occurs. 6. Conditional Use Permit No. 92-50 and Conditional Exception (Variance) No. 92-49 shall not become effective for any purpose until an "Acceptance of Conditions" form has been signed and notarized by the applicant, and returned to the Planning Division; and until the ten (10) day appeal period has elapsed. 7. Conditional Use Permit No. 92-50 and Conditional Exception (Variance) No. 92-49 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. CODE REQUIREMENTS: 1. Conditional Use Permit No. 92-50 for live entertainment is non -transferable. PC Minutes - 2/17/93 -7- (6161d) B-3 CONDITIONAL USE PERMIT NO, 92-45: APPLICANT: Al Volini LOCATION: 17041 Beach Boulevard Conditional Use Permit No. 92-45 is a request to establish a restaurant, Rockin' Pasta, with live entertainment and alcoholic beverage sales at 17041 Beach Boulevard. The site is located at the southwest corner of Warner Avenue and Beach Boulevard within the Guardian center commercial/office complex. STAFF RECOMMENDATION: Staff recommends approval of the request because there are substantial buffers from residential uses, the site has previously been utilized as a restaurant with live entertainment and alcohol and no complaints were received, the Police Department does not object to the request, and no adverse impacts to adjacent properties are anticipated. The Commission asked staff what method or review could we use to determine if the Alcohol Beverage Control (ABC) Board's conditions were consistent with the City's conditions. Staff explained that generally they are and ABC has requested a copy of the City's conditions, in order to review them when they review the license . request. THE PUBLIC HEARING WAS OPENED. Al Volini, 27661 Paseo Barona, San Juan Capistrano, applicant, stated she was available to answer any questions the Commission may have. She also requested the waiver of Conditions of Approval No. 3.a. and 3.c. The Commission discussed the waiver of the above conditions and felt these would be acceptable if a six (6) month review were held to determine the impacts. The site can already provide adequate parking and no additional parking is required in association with the restaurant with live entertainment and alcoholic beverage sales. CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 92-45: 1. The site plan, floor plans, and elevations received and dated January 14, 1993 shall be the conceptually approved layout. 2. Prior to commencing live entertainment activities, the following shall be completed: a. The applicant shall obtain approval of an entertainment permit from the Police Department. b. The applicant shall submit a copy of the Alcoholic Beverage Control Board (ABC) license, along with any special conditions imposed by ABC, to the Department of Community Development. 3. The use shall conform to the following: a. The hours of operation for live entertainment shall be limited to between the following hours: Monday - Thursday 9:00 PM - 12:00 AM Friday - Saturday 9:00 PM - 1:00 AM Sunday 4:00 PM - 9:00 PM PC Minutes - 2/17/93 -9- (6161d) b. A minimum of one security officer shall be on patrol in the vicinity of the restaurant during all hours of live entertainment and for a minimum of one (1) hour past closing time. c. There shall be no dumping of trash and/or glass bottles outside the building (in the trash bin) from between one (1) hour after closing time to one (1) hour before opening. d. No dancing shall be permitted. 4. The Fire Department Conditions are as follows: a. Automatic sprinkler systems will be installed throughout to comply with Huntington Beach Fire Department and Uniform Building Code Standards. Shop drawings showing sprinkler head locations will be submitted to and approved by the Fire Department prior to installation. b. A fire alarm system will be installed to comply with Huntington Beach Fire Department and Uniform Fire Code Standards. Shop drawings will be submitted to and approved by the Fire Department prior to installation. The system will provide the following: 1) Twenty-four (24) hour supervision (if over 100 sprinkler heads). c. Fire extinguishers will be installed and located in areas to comply with Huntington Beach Fire Code Standards. d. Fire lanes will be designated and posted to comply with City Specification #415. e. Address numbers will be installed to comply with City Specification #428. The size of the numbers will be the following: 1) The number for the building will be sized a minimum of six (6) inches with a brush stroke of one and one-half (1-1/2) inches. f. Fire access roads will be provided in compliance with the Huntington Beach Fire Code and City Specification #401. Include the circulation plan and dimensions of all access roads (24' or 27' fire lanes, turnarounds and 17' by 45' radius turns). g. Exit signs and exit path markings will be provided in compliance with the Huntington Beach Fire Code and Title 24 of the California Administrative Code. PC Minutes - 2/17/93 -10- (6161d) 5. A review of the use shall be conducted by staff within six (6) months of the issuance of Certificate of Occupancy to verify compliance with all conditions of approval and applicable Articles of the Huntington Beach Ordinance Code. The review shall include an outdoor test for compliance with the Huntington Beach Noise Ordinance during live entertainment periods. If, at that time, there is a violation of these conditions or code sections, Conditional Use Permit No. 92-45 may become null and void. 6. The Planning Commission reserves the right to revoke Conditional Use Permit No. 92-45 if any violation of the conditions or the Huntington Beach Ordinance Code occurs. 7. Conditional Use Permit No. 92-45 shall not become effective for any purpose until an "Acceptance of Conditions" form has been signed and notarized by the applicant, and returned to the Planning Division; and until the ten (10) day appeal period has elapsed. 8. Conditional Use Permit No. 92-45 shall become null and void unless exercised within one (1) year of the date of final approval, or such extension of time as may be granted by the Planning Commission pursuant to a written request submitted to the Planning Department a minimum 30 days prior to the expiration date. CODE REOUIREMENTS: 1. Conditional Use Permit No. 92-45 for live entertainment is non -transferable. B-4 REVIEW OF THE 1992 HOLLY-SEACLIFF DEVELOPMENT AGREEMENT (DEVELOPMENT AGREEMENT NO. 90-1) COMPLIANCE REPORT: APPLICANT: City of Huntington Beach LOCATION: The Holly-Seacliff Masterplan Area On November 5, 1990, the City Council approved Development Agreement No. 90-1; the Holly-Seacliff Development Agreement. Section 3.1.1 of the Development Agreement requires the developer to prepare and submit an Annual Monitoring Report and staff to prepare a Compliance Report for City Council review. At the January 4, 1993 City Council meeting, staff was directed to schedule a public hearing for review of the Compliance Report before the Planning Commission prior to City Council review. Staff has notified interested parties of the Planning Commission meeting. PC Minutes - 2/17/93 -11- (6161d) STAFF RECOMMENDATION: Staff recommends that the Planning Commission accept the 1992 Compliance Report and forward to the City Council for review. THE PUBLIC HEARING WAS OPENED. Tom Zanic, 520 Broadway, Santa Monica, representing applicant, stated that the developer has acted in good faith and is in compliance with the Development Agreement. Chuck Scheid, 8062 Ebbtide, stated he does not believe that the developer has complied with the Development Agreement in regards to the Soils Report. He also stated he felt there was non-compliance in Section 2.2.1.a, Parcel 4. THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE REQUEST AND THE PUBLIC HEARING WAS CLOSED. The Commission discussed the issue of contaminated soil remains, where the responsible for clean-up lies and which reimbursable costs the developer would be eligible for. Staff stated that they were comfortable after their review that the soil was clean, but there was always the possibility that some remained in which case the property owner would be held responsible. Staff also stated that developer will be reimbursed, per the Development Agreement, for items outside their scope. The Commission requested a modification to change the status of Parcel (4) 7.7 acres by 6/30/92 of item 2.2.1.(a) of the report to state in -progress ("P") rather than compliance ("C"). NON-PUBLIC HEARING ITEMS D-1 CONDITIONAL USE PERMIT NO 90-39/TENTATIVE TRACT MAP N0, 14352/COASTAL DEVELOPMENT PERMIT NO. 90-30 - ONE (1) YEAR EXTENSION OF TIME: APPLICANT: City of Huntington Beach Redevelopment Agency LOCATION: West 300 block Main Street (full block bounded by Main Street, Olive Street, Fifth Street and Orange Avenue) The City of Huntington Beach Redevelopment Agency is requesting a one (1) year extension of time for Conditional Use Permit No. 90-39, Tentative Tract Map No. 14352 and Coastal Development Permit No. 90-30 which were approved by the City Council on March 4, 1991 for a mixed use development project. The project consists of a 9,500 square foot market, 9,500 square foot of general retail, 8,000 square feet of office, a 200 space City parking structure, and 68 residential condominiums. STAFF RECOMMENDATION: Staff recommends that the Planning Commission approve a one (1) year extension of time, until March 4, 1994, for Conditional Use Permit No. 90-39, Tentative Tract Map No. 14352 and Coastal Development Permit No. 90-30 with previously approved findings and conditions to remain in effect. PC Minutes - 2/17/93 -13- (6161d) The Commission discussed with Counsel- their legal basis for a decision. Counsel informed the Commission that they could not base their decision on the entitlement since it had already been approved by the City Council. Counsel stated that the Commission must decide if the applicant showed good intention to fulfill his obligation. Counsel also stated that if they wished to deny the extension of time they must make findings of fact that the applicant indeed did not show good intention. Commissioner's Cook, Biddle and Gorman stated their objection to the project and their desire to renegotiate the entitlement. Commissioner Inglee stated that if the Commission could not provide clear evidence of bad faith by the applicant, a denial of this extension of time would set a poor precedence to investors and developers interested in working in the City. A two (2) week continuance was discussed, in order to allow the new Commissioners additional time to study their possible options and legal basis for granting or denying an extension of time.
