B-1 CODE AMENDMENT NO. 92-5/DOWNTOWN SPECIFIC PLAN CODE
AMENDMENT/"VILLAGE CONCEPT" AND DOWNTOWN PARKING MASTER PLAN
CONTINUED FROM THE FEBRUARY 2, 1993 PLANNING COMMISSION
MEETING):
APPLICANT: City of Huntington Beach
LOCATION: An area bounded by Goldenwest Street, Pacific
Coast Highway, Beach Boulevard and Sixth Street
On February 2, 1993 the Planning Commission continued action on the
amendment to the Downtown Specific Plan in order to allow additional
time for the City's Traffic Engineering Consultant to prepare a
Parking Management and Implementation Plan for the Downtown Core.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission open the public
hearing, receive testimony and continue Downtown Specific Plan Code
Amendment/"Village Concept" and Downtown Master Parking Master Plan
to the March 16, 1993 meeting.
Staff presented reports on the changes recommended for Districts 1
and 2.
THE PUBLIC HEARING WAS OPENED.
Bob Bolen, (no address given), requested a meeting with the downtown
property owners before any final decisions were made on recommended
changes. He also stated that he wished to have more notice given to
the property owners affected within the Districts. Mr. Bolen stated
concern with height limitations.
Nazmi Ali, 706 Pacific Coast Highway, requested that the lot size
for service stations be down sized.
Richard Harlow, 211 Main Street, stated his concern that the
residents/property owners were not being involved in the discussions
enough. He stated he would like to see a town meeting with the
Planning Commission to discuss the problems currently in the
downtown area and the residents/property owners concerns.
Doug Langevin, 8106 Pawtucket Drive, stated that he wanted a
downtown meeting with property owners before any decisions were made
regarding the suggested changes. He stated he wants to be informed
and involved in the process.

Use Permit No. 92-60 was continued from the February 2, 1993
Planning Commission meeting to allow staff the opportunity to meet
with the applicant and other commercial property owners to discuss
options regarding the abandonment of the access easement. In
addition, the applicant has added a variance request with their
application. The variance is to permit 43 parking spaces in lieu of
79 spaces (36 space deficiency) should reciprocal access to adjoin
parcels be precluded.
On February 19, 1993, staff met with the applicant and Ivan Ulloa,
property owner of George's Mexican Restaurant, where Mr. Ulloa's
primary concern was parking. After further discussion, the
applicant requested the item be continued to the April 6, 1993
Planning Commission meeting to allow McDonald's adequate time to
meet with the other property owners to discuss possibly leasing area
for additional parking, and abandoning the access easement.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission continue Use Permit
No. 92-60 and Conditional Exception (Variance) No. 93-4 to the
April 6, 1993 meeting.

Administrative Review No. 92-16 and Conditional Exception (Variance)
No. 92-44 is a request to retain a 4,628 square foot metal building
to an existing 23,724 square foot industrial facility (Tiodize
Company). Pursuant to Section 9510.17 of the Huntington Beach
Ordinance Code, metal structures are required to be reviewed and
acted upon by the Planning Commission. The conditional exception
(variance) involves a request for a 20 space parking variance (33 in
lieu of 53) pursuant to the off-street parking requirements
specified in Section 9602.2 of the Huntington Beach Ordinance Code.
The items were continued from the February 2, 1993 Planning
Commission meeting to give the applicant the opportunity to provide
evidence of building permits for the addition. Following a meeting
with the applicant on February 11, 1993, it was concluded that valid
building permits do not exist. In addition, it was brought to
staff's attention that the Tiodize Company headquarters is located a
half mile away at 5858 Engineer Drive. The 26,000 square foot
industrial building has over 5,000 square feet of office space,
which is used as the company's headquarters. The subject property
(15701 Industry/15702 Container) is entirely used for processing/
manufacturing of materials with all visitors and customers directed
to the headquarters. In light of this new information, and the fact
that the subject property is exclusively used for manufacturing with
adequate parking for employees, staff supports the applicant's
request.

STAFF RECOMMENDATION: • 1
Staff is recommending approval of Administrative Review No. 92-16
and Conditional Exception No. 92-44 with the condition that when the
property or business is sold, the metal structure be removed or
adequate parking be provided based upon any new uses.
Commissioner Inglee stated he would be abstaining from taking action
on the item in conformance with the Political Reform Act.

1. There are exceptional or extraordinary circumstances or
conditions applicable to the land, buildings or premises
involved that do not apply generally to other property or uses
in the district. The parcel is a corner lot and abuts streets
on three (3) sides. In addition, the existing metal building is
temporary and when Tiodize vacates the premises, parking will be
brought into conformance with the code.
2. The granting of a conditional exception for a 20 space parking
variance (33 in lieu of 53) in conjunction with an existing
metal building is necessary in order to preserve the enjoyment
of one or more substantial property rights. The existing metal
building is temporary and when Tiodize vacates the premises,
parking will be brought into conformance with the code.
3. The establishment of the metal building resulting in a 20 space
parking variance (33 spaces in lieu of 53) will not be
detrimental to the general welfare of persons residing or
working in the vicinity; and property and improvements in the
vicinity of such use or building. The Tiodize Company occupies
a 26,000 square foot building a half mile away which includes
the company headquarters which is the primary use of the
operation; all visitors and customers are directed to the
headquarters which provides for adequate parking on -site. In
addition, the nature of the use is manufacturing and warehouse.

4. The granting of Conditional Exception (Variance) No. 92-44 for a
20 space parking variance will not adversely affect the General
Plan of the City of Huntington Beach. The metal building
addition used for shipping and receiving purposes is consistent
with the General Industrial land use designation of the General
Plan.
CONDITIONS OF APPROVAL - ADMINISTRATIVE REVIEW NO. 92-16/CONDITIONAL
EXCEPTION (VARIANCE) NO. 92-44
1. The site plans, floor plans and elevations received and dated
January 4, 1993 shall be the conceptually approved layout.
2. Prior to issuance of building permits, the following shall be
completed:
a. A parcel map consolidating lots 15 and 32, or other legal
instrument assuring that the two (2) parcels will be held in
common ownership during the life of the metal building, shall
be submitted. Said map shall be recorded prior to final
inspection and a copy submitted to the Department of
Community Development. This provision may be deleted if the
metal building is designed to conform with the Uniform
Building Code for buildings on property lines.
b. A covenant or agreement shall be submitted for review and
approval that assures compliance to parking requirements when
Tiodize vacates either or both of the parcels. This may
t'result in the removal of the metal building. When approved,
it shall be recorded in the Office of the County Recorder. A
recorded copy shall be filed with the Department of Community
Development.
3. Building permits for the metal building shall be obtained with
45 days from the date of approval; and all work shall be
completed and permits finaled within 120 days from date of
approval.
4. An automatic fire sprinkler system shall be approved and
installed pursuant to Fire Department regulations.
5. There shall be no outside storage of equipment, goods or
materials.
6. The Planning Commission reserves the right to revoke this
conditional exception (variance) if any violation of these
conditions or the Huntington Beach Ordinance Code occurs.

B-4 CONDITIONAL USE PERMIT NO. 91-49(R):
APPLICANT: Sal Gagliano
LOCATION: 300 Pacific Coast Highway, #111 (Pierside Pavilion)
Conditional Use Permit No. 91-49 (Revised) consists of the regularly
scheduled six (6) month review of On the Break Grill and Billiards
and a request to expand the hours of operation from 12:00 midnight
to 2:00 AM Sunday through Thursday.
Code Enforcement has reviewed the use and has determined that the
billiard hall/restaurant has consistently complied with the
conditions of approval. In addition, the Police Department has not
received any complaints against the use.
STAFF RECOMMENDATION:
Staff recommends approval of the review as well as the request for
expansion of hours.

Sal Gagliano, 300 Pacific Coast Highway, Suite 111, applicant,
stated they were not requesting live entertainment. He also stated
he was there to answer any questions the Commission may have.

Centerfield Sports Bar and Grill is requesting to amend the approved
hours of operation for live entertainment. The owners desire to
provide live entertainment (in lieu of taped music) on Sunday
through Wednesday from 7:00 PM to 12:00 AM. The amendment would
permit live entertainment on a daily basis.
STAFF RECOMMENDATION:
Staff supports the request for live entertainment on Sunday through
Wednesday from 9:00 PM to 12:00 AM since an existing joint use of
parking agreement for the retail center limits live entertainment
from 9:00 PM to 1:30 AM.

other adjacent structures and uses in a harmonious manner.
MODIFIED CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT

2. Live entertainment and dancing shall be only permitted during the
following hours:
Sunday through Wednesday 9:00 PM - 12:00 AM

4, 1993.

Prior to implementing the amended hours of live entertainment, the
applicant shall submit a copy of the following to the Department
of Community Development:
1. Approved Entertainment Permit as issued from the Business
License Department.
2. Alcohol Beverage Control License and Conditions.
13. (New) A six (6) month review shall be conducted by staff to
determine if any complaints have been filed that pertain to the
amended hours of live entertainment. If complaints have been
filed the use may be brought back to the Planning Commission for
review.
B-6 CONDITIONAL USE PERMIT N0, 92-46:
APPLICANT: Greg Peters
LOCATION: 19050 Brookhurst Street
Conditional Use Permit No. 92-46 is a request to establish, Pet's
Choice, a veterinary wellness clinic for domestic pets including
surgery, grooming, and overnight care for medical reasons in an
existing retail commercial center.
STAFF RECOMMENDATION:

adequate parking opportunities and the use will be compatible with
adjacent uses and the surrounding properties.

FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO, 92-46:
1. Conditional Use Permit No. 92-46 for the proposed veterinary
clinic is in conformance with the City of Huntington Beach
General plan Land Use designation of General Commercial which
permits animal hospitals and veterinary clinics subject to
conditional use permit approval.
2. The location, site layout, and design of the proposed veterinary
clinic properly adapts the proposed structures to streets,
driveways, and other adjacent structures and uses in a
harmonious manner. The project is located in a primarily
commercial area and the proposed animal clinic will not
adversely impact other surrounding properties.
3. The combination and relationship of one proposed use to another
on a site are properly integrated. The other businesses in the
center and in the vicinity are general retail/commercial uses
which are compatible with the proposed veterinary clinic. A pet
store is proposed in the adjacent suite to the south.
4. The access to and parking for the proposed veterinary clinic
does not create an undue traffic problem. The site can already
provide adequate parking and no additional parking is required
in association with the veterinary clinic.
CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO. 92-46:

2. All exterior doors along the easterly building wall to the
veterinary clinic shall remain closed at all times.
3. In the event complaints are received regarding noises associated
with the use, the applicant shall work with the Department of
Community Development to implement sound attenuation measures to
a level of satisfaction acceptable to the Department.
4. The hours of operation for the animal veterinary clinic shall be
as follows:
Monday - Saturday 8:00 AM - 8:00 PM
Sunday 12:00 PM - 6:00 PM
5. Overnight care shall be permitted in conjunction with medical
care only. No boarding or kenneling shall be permitted.

6. The Fire Department conditions of approval are as follows:
a. Automatic sprinkler systems will be installed throughout to
comply with Huntington Beach Fire Department and Uniform
Building Code Standards. Shop drawings will be submitted to
and approved by the Fire Department prior to installation.
Note: This must be done to allow openings in fire resistive
wall separating this building from already sprinklered
buildings.
b. Fire extinguishers will be installed and located in areas to
comply with Huntington Beach Fire Code Standards.
c. Fire lanes will be designated and posted to comply with City
Specification #415.
d. Address numbers will be installed to comply with City
Specification #428. The size of the numbers will be the
following:
1) Individual units will be sized a minimum of four (40
inches with a brush stroke of one-half (1/2) inch.
e. Fire access roads will be provided in compliance with the
Huntington Beach Fire Code and City Specification #401.
Include the circulation plan and dimensions of all access
roads (24' or 27' fire lanes, turnarounds and 17' by 45'
radius turns.)
f. Gas cylinders for analgesia or other uses will comply with
Uniform Fire Code Article 74 for storage and use.
7. The Planning Commission reserves the right to revoke this
Conditional Use Permit No. 92-46 if any violations of these
conditions or the Huntington Beach Ordinance Code occurs.
8. This conditional use permit shall not become effective for any
purpose until an "Acceptance of Conditions" form has been
properly executed by the applicant and an authorized
representative of the owner of the property, recorded with
County Recorder's Office, and returned to the Planning Division;
and until the the (10) day appeal period has elapsed.
9. This Conditional Use Permit No. 92-46 shall become null and void
unless exercised within one (1) year of the date of final
approval, or such extension of time as may be granted by the
Planning Commission pursuant to a written request submitted to
the Planning Department a minimum 30 days prior to the
expiration date.

The City of Huntington Beach Redevelopment Agency is requesting a

90-30 which were approved by the City Council on March 4, 1991 for a
mixed use development project. The project consists of a 10,000

This item was continued from the February 17, 1993 Planning
Commission meeting in order for the Commission to further evaluate
the request.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission approve a one (1) year
extension of time, until March 4, 1994, for Conditional Use Permit
No. 90-39, Tentative Tract Map No. 14352 and Coastal Development
Permit No. 90-30 with previously approved findings and conditions to
remain in effect.
Commissioner Cook expressed her appreciation to the Commission for
allowing this item to be continued for two (2) weeks to allow for a
thorough review. Commissioner Cook stated her understanding that
there was nothing the Commission could do at this time to stop the
project from going forward, but stated her objections to the project
and the number of deficiencies she felt the project contained.
Commissioner Biddle and Commissioner Gorman concurred with
Commissioner Cook.
A discussion ensued among the Commission regarding the legal issues
involved with allowing an extension of time to the applicant. They
also discussed the fact that the request had been taken to court and
a judge had found it to be consistent with the General Plan.

Commissioner Cook - asked staff to set up the Downtown Specific Plan
Townhall Meeting. Staff tentatively scheduled it for Thursday, March
11, 1993.
Commissioner Bourguignon - discussed with the Commission and staff the
possibility of having study sessions from 4:00 PM to 5:00 PM then break
and come back at 7:00 PM for the meeting in order to save money on
dinners and staff time. A few Commissioners stated their jobs would
create a conflict with the 4:00 PM to 5:00 PM study session. Staff
suggested that they only have a study session when it was absolutely
necessary, and the Commission could meet at 6:30 PM prior to meetings
for a brief agenda review. Commissioner Bourguignon also stated he
wished to wave his stipend as Commissioner Cook had already done.
Commissioner Gorman - asked staff for a brief explanation on the
notification process and cost.
Commissioner Inglee - stated his concern regarding the appointments to
the Planning Commission Subcommittees. He felt that new ideas and
concepts could be introduced'if the appointments could be rotational.
