ZONING ADMINISTRATOR: Mike Strange STAFF MEMBERS: Wayne Carvalho MINUTES: The Minutes of February 24, 1993 Zoning Administrator Meeting were continued. ITEM 1: USE PERMIT NO. 92-8 (EXTENSION OF TIME) Applicant: Rick Russell 18971 Beach Blvd. Huntington Beach, CA 92648 Request: To permit a one (1) year extension of time for the construction of an oil change operation in conjunction with a car wash by converting two (2) bays within an existing four (4) bay detail building to oil change bays pursuant to Sections 9730.58 and 9220.1 of the Huntington Beach Ordinance Code. Location: 18971 Beach Blvd. Wayne Carvalho, Staff Planner, reported that the applicant is requesting a one year extension of time of Use Permit No. 92-8 because of financial concerns. Staff concluded by recommending approval of the extension of time. USE PERMIT NO. 92-8 (EXTENSION OF TIME FOR ONE YEAR) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE ORIGINAL CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. ITEM 2: COASTAL DEVELOPMENT PERMIT NO 93-2: Applicant: Gerald A. Jones P. O. Box 337 16771 Bay View Drive Sunset Beach, CA 90742 Request: To permit a 785 square foot single story addition to an existing one story residence pursuant to Section 989.5.2 of the Huntington Beach Ordinance Code. Location: 3442 Gilbert Drive Wayne Carvalho, Staff Planner, reported that the request was for a 785 square foot single story addition. The original plans were revised to reflect a 55% maximum site coverage allowance. Staff indicated that one call was received ragarding the proposed rear yard setback. Staff was informed that the CC&R's require a ten foot rear yard setback; however Code allows a five foot rear yard setback. The proposed addition would encroach two feet into the ten foot setback specified in the CC&R's. Staff concluded by recommending approval with findings and suggested conditions of approval and noted that the City does not enforce CC&R's. THE PUBLIC HEARING WAS OPENED. Gerald Jones, Applicant, said that the home is one of the original homes in the Harbor which has small rooms and closets. He advised that there is no change in the number of rooms but a rearrangement of how the rooms are layed out. He said about thirty percent of the homes in the tract don't conform to the existing CC&R's for rear yard setback. Bob Helfer, 3472 Gilbert Drive, advised that the Homeowners Association Architectural Review Committee would be meeting on the subject request that evening. He stated that when Moffett and Nichols designed the bulkhead it was determined that structural foundations should be ten feet from the bulkhead for safe pressure on the bulkhead. Later the City changed the Ordinance Code to allow construction to five feet from the bulkhead. He concluded by saying he was not opposed to the project but was opposed to construction to encroach into the ten foot setback. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 93-2 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN WORKING (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. L ZA Minutes - 3/3/93 -2- (6208d) FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO, 93-2: 1. The request to permit the remodel and 785 square foot addition to an existing single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed addition will not impact public views or access. 2. Coastal Development Permit No. 93-2 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed development will conform with all applicable City codes. 3. At the time of occupancy, the proposed remodel and addition to an existing single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All infrastructure currently exist to the site. 4. The proposed remodel and 785 square foot single story addition to an existing two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated February 18, 1993 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. All proposed dock and ramp improvements shall require separate permits for the improvements located within the public waterways. 4. All proposed cantilevered deck improvements require separate permits for the improvements. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. Proposed structures shall be architecturally compatible with existing structures. ZA Minutes - 3/3/93 -3- (6208d) 7. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 8. Low -volume heads shall be used on all spigots and water faucets. 9. Water service shall be upgraded to include a back flow device pursuant to Public Works standards. 10. Smoke detectors shall be installed pursuant to Uniform Building Code standards. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 93-2 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 3: USE PERMIT NO. 93-7 Applicant: Home Depot #681 C/O Gary Lewis 6912 Edinger Avenue Huntington Beach, CA 92647 Request: To permit Home Depot to occupy an adjacent 13,260 square foot suite for a period of up to four (4) months pursuant to Section 9220.1 of the Huntington Beach Ordinance Code. Location: 6912 Edinger Wayne Carvalho, Staff Planner, reported that Home Depot is under construction to modify their existing building. During the period of construction the applicant is requesting use of a vacant suite adjacent to their existing business for a period of four months. The suite will be strictly used to sell damaged merchandise and discontinued items. Staff reported that comments were received from various Departments and were reflected in the suggested conditions of approval. Staff concluded by recommending approval with findings and suggested conditions of approval. I ZA Minutes - 3/3/93 -4- (6208d) THE PUBLIC HEARING WAS OPENED. Gary Lewis, Store Manager, advised that they have had to reduce the interior space of the existing building by 15,000 square feet while remodeling. Mr. Lewis indicated that they have been cited by City Code Enforcement for outside storage of fruit trees and recently received a final notice of violation. The Zoning Administrator advised the applicant to request a ten day extension on the notice of violation with the agreement that the merchandise be placed inside after that time; this would allow time for the appeal period to expire. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 93-7 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO 93-7: 1. The establishment, maintenance and operation of the temporary use of the adjacent 13,260 square foot suite will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The occupancy of the adjacent suite will provide additional retail space during temporary remodeling of offices, etc. within the existing suite. b. Property and improvements in the vicinity of such use or building. All improvements currently exist to the suite. The use is temporary for a period of up to four (4) months. 2. The granting of Use Permit No. 93-7 will not adversely affect the General Plan of the City of Huntington Beach. The temporary use of the adjacent 13,260 square foot suite is consistent with the goals and objectives of the General Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated February 3, 1993 shall be the conceptually approved layout. ZA Minutes - 3/3/93 -5- (6208d) 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 4. All applicable Public Works fees shall be paid prior to issuance of building permits. 5. Fire Department Requirements: a. Floor plan layout and exiting plans shall be reviewed and approved by the Fire Department and Building Department. b. An automatic fire sprinkler system shall be approved and installed pursuant to Fire Department regulations. c. Fire extinguishers shall be installed in number and at locations specified by the Fire Department. d. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them.
