ZONING ADMINISTRATOR: Mike Strange STAFF MEMBERS: Wayne Carvalho MINUTES: The Minutes of February 24, and March 10, 1993 Zoning Administrator Meetings were ITEM 1: TENTATIVE PARCEL MAP NO. 92-228 (Continued from the February 17, 1993 Zoning Administrator Meeting) Applicant: Jim Ko Morse Consulting Group 4 Venture #100 Irvine, CA 92718 March 3, approved. Request: To subdivide a 48.362 acre parcel into four (4) lots for conveyance purposes pursuant to Section 9921 of the Huntington Beach Ordinance Code. Location: Old Meadowlark Airport (North of Warner Avenue, west of Graham Street) Wayne Carvalho, Staff Planner, reported that the item was continued to allow for notification of the public hearing and for minor amendments on the map. Staff advised that the request is consistent with the Master Plan and Specific Plan and that the Final Map for the original three (3) lot subdivision was approved by the City Council at their last meeting. Staff recommended dedication of Plaza and Roosevelt Lanes and improvement of Roosevelt Lane. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Jim Ko, Engineer who prepared the map, said that the map was for conveyance purposes only and that no specific development is -being proposed. He concurred with staff's recommendation with exception to the improvements to Roosevelt Lane. He said that the City's Conceptual Plan and Development Agreement requires that street improvements be completed at the time of development. Mr. Carvalho advised that staff had not reviewed the entire Development Agreement. Dave Powell, Pacific Development Group, was present. He advised that he is a consultant to the Nerio family, the property owner. He said that the Nerio's are processing the map as a vehicle to separate the family interests and no development plan was being submitted. Mr. Powell responded to a question by the Zoning Administrator stating that a one week continuance would be acceptable to allow staff adequate time to review the Development Agreement. There were no other persons present to speak for or -against the request and the public hearing was continued open. TENTATIVE PARCEL MAP NO. 92-228 WAS CONTINUED TO THE ZONING ADMINISTRATOR MEETING OF MARCH 24, 1993 BY THE ZONING ADMINISTRATOR. ITEM 2: DRAFT NEGATIVE DECLARATION NO. 93-6 Applicant: City of Huntington Beach Department of Public Works 2000 Main Street Huntington Beach, CA 92648 Request: Installation of street improvements along the below segment of Ward Street to bring the street segment up to secondary arterial capacity. Improvements include street -widening and the installation of curb, gutter and sidewalk and will require the acquisition of approximately 26,800 square feet of property on the east side of Ward Street. Location: Ward Street from Garfield Avenue to approximately 1,540 feet south. Wayne Carvalho, Staff Planner, reported that the application was reviewed by the Environmental Assessment Committee and they recommended the Negative Declaration. Staff said the Negative Declaration was advertised for twenty-one days and concluded by recommending approval with the standard mitigation measures. There were no other persons present to speak for or against the request. ZA Minutes - 3/17/93 -2- (6288d) I DRAFT NEGATIVE DECLARATION NO. 93-6 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING MITIGATION MEAUSRES. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. MITIGATION MEASURES: 1. To minimize impacts to emergency access as a result of temporary lane closures, the applicant shall notify the City of Huntington Beach Fire and Police Departments of any street lane closures a minimum of 24-hours prior to the initiation of street improvement activities. 2. To minimize impacts to circulation conflicts as a result of construction traffic, the applicant shall submit and implement a construction traffic circulation plan identifying the routes which construction equipment and trucks will use to access and depart from the area. The plan shall use routes to generate the minimum number of circulation conflicts with residential, pedestrian, bicycle and vehicle traffic. 3. Prior to initiation of street improving construction, the Department of Public Works shall replace at a one to one ratio all trees which will be removed as a result of the street improvement project. Replacement trees may be located on private property adjacent to the former tree locations or within the public right-of-way. ITEM 3: USE PERMIT NO. 93-5 Applicant: Bill Winn C/O HDMC 2603 Main Street No. 110 Irvine, CA 92714 Request: To permit a temporary outdoor event for twenty (20) days during 1993 for a sidewalk sale with autograph signing by surfing celebrities pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Days include: April 3/4, 10, 17/18, 24/25, June 29/30, July 2-4, August 20/21, December 4/5, 11/12, 18/19, 1993. Location: 300 Pacific Coast Hwy. Wayne Carvalho, Staff Planner, reported that Huntington Surf and Sport was requesting approval for a twenty-one day sidewalk sale. Staff said that the the applicant had a previous approval for a sidewalk sale which did not result in any negative impacts. Staff advised that the Police Department supports the request; however requested that the sidewalk sale not be allowed July 2-4. Staff concluded by recommending approval with findings and suggested conditions of approval. ZA Minutes - 3/17/93 -3- (6288d) THE PUBLIC HEARING WAS OPENED. Aaron Pai, owner of Huntington Surf and Sport, said that they held the sidewalk sale for three years and they never experienced any problems. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 93-5 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO 93-5: 1. The temporary outdoor event will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The event will not obstruct views of the adjacent businesses. b. Property and improvements in the vicinity of such use or building. The event is a temporary use. 2. The granting of Use Permit No. 93-5 will not adversely affect the General Plan of the City of Huntington Beach. The temporary outdoor event is consistent with the goals and objectives of the Visitor Serving Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated January 28, 1993 shall be the conceptually approved layout. 2. No merchandise, equipment or customer lines shall encroach into the public right-of-way. 3. All merchandise and tables shall be cleared from the site at the end of each business day. 4. The applicant shall provide a barrier separating the public sidewalk from the merchandise area to allow for adequate pedestrian flow. 5. Stand by personnel shall be on site to safeguard premises and provide crowd control. 7. A detailed site plan shall be submitted to the Huntington Beach Fire Department for approval (show location of tables, clothes racks, barriers, etc.) 8. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 93-5 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. 4. The applicant shall submit all future temporary outdoor event applications a minimum of thirty (30) days prior to the event. Failure to provide adequate notice shall result in denial of the request. ITEM 4: USE PERMIT NO, 93-16 Applicant: Orange County Farm Bureau 2512 Chambers Road, Suite 203 Tustin, CA 92680 Request: To permit the Certified Farmers Market to operate at the location described below for twenty-one (21) days (Friday's) commencing on March 26, 1993 between the hours of 2:00 p.m. to 7:00 p.m. pursuant to Section 9730.64 of the Huntington Beach Ordinance Code. Location: Southwest corner of Main Street and Orange Avenue Wayne Carvalho, Staff Planner, reported that the request was to permit the Certified Farmers Market for twenty-one Fridays commencing March 26. Staff said that the applicant had a previous approval for the Certified Market and that the same conditions of approval would be imposed. Staff advised that subsequent requests would require a conditional use permit application. THE PUBLIC HEARING WAS OPENED. ZA Minutes - 3/17/93 -5- (6288d) Mary Lou Lorezini and Emilia -Ramirez, representing Orange County Farm Bureau, was present and concurred with staff's presentation. Keith Bohr, Redevelopment, was present and supported the request. Mike Strange, the Zoning Administrator, urged the applicant to file for a conditional use permit to obtain permanent approval stating that the market was a positive addition to the downtown area. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 93-16 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL: 1. The temporary outdoor event for a Certified Farmers Market for twenty-one (21) consecutive Friday afternoons commencing on March 26, 1993 will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. The proposed market will not obstruct circulation or impact access to existing businesses. Furthermore, motorists will be directed to park in the Main Promenade parking structure with validation by vendors. b. Property and improvements in the vicinity of such use or building. The proposed market is a temporary use on an existing parking lot. The applicant is responsible for clean up after each event. 2. The granting of Use Permit No. 93-16 for a limited time Farmers Market will not adversely affect the General Plan of the City of Huntington Beach. The proposed Farmers Market is consistent with the Mixed Use Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The revised site plan received and dated June 2, 1992 shall be the conceptually approved layout. 2. Fire access lanes shall be maintained. If fire lane violations occur and the services of the Fire Department are required, the applicant will be liable for expenses incurred. 3. The applicant shall obtain.a11 necessary Fire Department permits and comply with all provisions of Article 32 of the Uniform Fire Code. 5. The applicant's request shall include necessary permits for balloons and temporary signs. Location, number and size of all temporary signs shall be approved by Zoning Administrator.. 6. Vehicles, barriers, equipment, or customer lines shall not encroach into the public right-of-way (street, alley, sidewalks). 7. The applicant shall coordinate with the Community Services and Economic Development Departments to establish a validation system for customer parking in the Main Promenade parking structure. 8. The applicant shall file a cash bond in the amount of Five Hundred Dollars ($500.00) to insure clean-up of the site after each event. 9. Signs shall be posted directing motorists to the Main Promenade parking structure on the 200 block of Main Street. 10. The entire market operation (includes set-up and break down) shall be limited to 11:00 AM to 9:00 PM on Fridays only. 11. Fire extinguishers shall be provided in number and locations specified by the Fire Department. INFORMATION OF SPECIFIC CODE REQUIREMENTS: 1. The event shall comply with all applicable provisions of the Ordinance Codes, Building Division and Fire Department. 2. The applicant shall meet all applicable local, State and Federal Fire Codes, Ordinances and standards. 3. The Zoning Administrator reserves the right to revoke Use Permit No. 93-16 if any violations of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 5: COASTAL DEVELOPMENT PERMIT NO. 93-4 Applicant: Scott N. Paden 8535 Cavel Street Downey, CA 90242 Request: To permit an 810 square foot two (2) story addition to an existing two story residence pursuant to Section 989.5.2 of the Huntington Beach Ordinance Code. Location: 4012 Figaro Circle ZA Minutes - 3/17/93 -7- (6288d) Wayne Carvalho, Staff Planner-, reported that end of a cul-de-sac and that the request met Staff concluded by recommending approval with conditions of approval. THE PUBLIC HEARING WAS OPENED. the property is at the Code requirements. - findings and suggested Scott Paden, applicant, was present and concurred with staff. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 93-4 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN WORKING (10) DAYS AND ANOTHER TEN WORKING (10) DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO, 93-4: 1. The request to permit the remodel and 810 square foot two story addition to an existing two-story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed 810 square foot addition will not impact public views or access. 2. Coastal Development Permit No. 93-4 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed development will conform with all applicable City codes. 3. At the time of occupancy, the proposed remodel and addition to an existing two-story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All infrastructure currently exist to the site. 4. The proposed remodel and 810 square foot two (2) story addition to an existing two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated February 23, 1993 shall be the conceptually approved layout. The Zoning Administrator shall be notified in writing if any changes in building height-, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. All proposed dock and ramp improvements shall require separate permits for the improvements located within the public waterways. 4. All proposed cantilevered deck improvements require separate permits for the improvements. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. Proposed structures shall be architecturally compatible with existing structures. 7. Natural gas shall be stubbed in at the locations of cooking facilities, water heaters, and central heating units. 8. Low -volume heads shall be used on all spigots and water faucets. 9. Water service shall be upgraded to include a back flow device pursuant to Public Works standards. 10. Smoke detectors shall be installed to comply with Uniform Building Code requirements. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 93-4 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ZA Minutes - 3/17/93 -9- (6288d)- ITEM 6: USE PERMIT NO. 93-3/CONDITIONAL EXCEPTION NO. 93-5 Applicant: Giovanni Saffioti 18344 Beach Blvd. Huntington Beach, CA 92646 Request: To permit a restaurant expansion (Macaroni) into an adjacent, 1,200 square foot commercial suite pursuant to Section 9220.1 of the Huntington Beach Ordinance Code. The request includes a five (5) space parking variance for the commercial center (95 spaces provided in lieu of 100 spaces required). Location: 18344 Beach Blvd. Wayne Carvalho, Staff Planner, reported that the proposed request is to expand an existing restaurant to add an office, restroom and additional seating area. Staff suggested that a finding for hardship existed due to the lot configuration and the requirement for a ten foot landscape planter along the entire street frontage which restricted the design of the parking lot. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Rosemary Saffioti, applicant, was present and concurred with the suggested conditions of approval except of the exiting door requirement. Mike Strange, Zoning Administrator, advised that the exit door was a Uniform Building Code requirement. He suggested that the applicant meeting with the Assistant Building Official to determine if other solutions would be allowed. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 93-3/CONDITIONAL EXCEPTION NO. 93-5 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL -USE PERMIT NO 93-3: 1. The establishment, maintenance and operation of the ,1,200 square foot restaurant expansion will not be detrimental to: a. The general welfare of persons residing or working in the vicinity. With the conditions imposed, the expansion will not impact adjacent businesses. 1 ZA Minutes - 3/17/93 -10- (6288d) 1 b. Property and improvements in the vicinity of such use or building. All improvements currently exist to the site. The expansion will allow for handicap bathrooms, an office and waiting area. 2. The granting of Use Permit No. 93-3 will not adversely affect the General Plan of the City of Huntington Beach. The proposed restaurant expansion is consistent with the goals and objectives of the General Commercial Land Use designation of the General Plan. FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO. 93-5: 1. The granting of Conditional Exception No. 93-5 for a five (5) space parking variance will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. The granting of Conditional Exception No. 93-5 is necessary to provide handicap facilities and an office area for the existing restaurant. 2. Because of special circumstances applicable to the subject property, including shape, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. Due to the long rectangular configuration of the parcel, the property is required to have a ten (10) foot wide landscape planter along the entire length of Beach Boulevard; it restricts the parking lot design. Furthermore, the business does not have rear access or parking, as there is a private alley located directly behind the building. 3. The granting of Conditional Exception No. 93-5 is necessary in order to preserve the enjoyment of one or more substantial property rights. The granting of Conditional Exception 93-5 will allow for an expansion of Macaroni Restaurant to provide handicap bathroom facilities, office, additional seating and waiting area. 4. The granting of Conditional Exception No. 93-5 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. With the conditions imposed, the expansion will not impact businesses or patrons of the commercial center. ZA Minutes - 3/17/93 -11- (6288d) 5. The granting of Conditional Exception No. 93-5 will not adversely affect the General Plan of the City of Huntington Beach. The restaurant expansion is consistent with the General Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated January 20, 1993 shall be the conceptually approved layout. 2.' The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 4. All applicable Public Works fees shall be paid prior to issuance of building permits. 5. "The applicant/owner shall be responsible for payment of Traffic Impact fees prior to issuance of a Certificate of Occupancy and/or final building permit approval." 6. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 7. The applicant shall submit shop drawings depicting tenant improvements to automatic sprinkler systems with details showing sprinkler head locations and relocations. 8. The applicant shall submit seating plans to the Fire Department depicting table locations, aisles and exits. 9. The business owner shall require all employees to park along Beach Boulevard to provide more parking closer to the commercial building. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. ZA Minutes - 3/17/93 -12- (6288d) 1 3. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. The Zoning Administrator reserves the right to revoke Use Permit No. 93-3 if any violation of these conditions or the Huntington Beach Ordinance Code occurs.
