B. PUBLIC HEARING ITEMS
B-1 CODE AMENDMENT N0, 92-5/DOWNTOWN SPECIFIC PLAN CODE
AMENDMENT/"VILLAGE CONCEPT" AND DOWNTOWN PARKING STUDY AND
MASTER PLAN (CONTINUED FROM THE MARCH 16, 1993 PLANNING
COMMISSION MEETING):
APPLICANT: City of Huntington Beach
LOCATION: An area bounded by Goldenwest Street, Pacific
Coast Highway, Beach Boulevard and Sixth Street
On March 16, 1993 the Planning Commission took a series of straw
votes on Districts No. 3 and No. 4 of the Downtown Specific Plan.
Discussion for the this meeting will focus on Districts No. 5 and
No. 6 as well as the General Provisions of the Specific Plan. To
date, staff has not received the parking implementation study for
the Parking Master Plan. Therefore, a final decision will not be
made on the Downtown Master Parking Plan until April 20, 1993.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission Approve Code Amendment
No. 92-5 (Downtown Specific Plan) with the 'Village Concept Master
Plan' and Downtown Parking Plan as amended.
Discussion ensued regarding net site area versus gross site area
calculations, alley widths and upper story setbacks.
THE PUBLIC HEARING WAS OPENED.
Gary Mulligan, 117 Main Street, stated his concern regarding the
suggested alley width. Mr. Mulligan felt 30 feet would be to wide.
Michelle Pap, 16000 Villa Yorba #622, stated she felt the suggested
30 foot alley width was to wide.
Bob Bolen, 1818 Pine, spoke in opposition to the suggested changes
in District 5. His concerns included height limits, gross versus
net area calculations and 30 foot alley to wide.
Jo Christian Craig, 529 Lake Street, spoke in opposition to the
suggested minimum parcel size in District 6.
THERE WERE NO OTHER PERSONS PRESENT TO SPEAK FOR OR AGAINST THE
REQUEST AND THE PUBLIC HEARING WAS CLOSED.
The Commission requested a continuance until April 20, 1993 in order
to obtain the Downtown Master Parking Plan and allow staff to
prepare a report on the effect of gross site area versus net site
area calculations in all Districts.

LOCATION: 6561 Edinger Avenue (McDonald's Restaurant)
At the applicant's request, Use Permit No. 92-60 was continued from
the March 2, 1993 Planning Commission meeting to allow McDonald's
adequate time to meet with the other property owners to discuss
leasing area for parking, and abandoning the access easement. As
indicated in the attached letter dated March 24, 1993, the applicant
has requested an additional two (2) week continuance to resolve all
matters with the adjacent property owners.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission continue the appeal of
Zoning Administrator's approval of Use Permit No. 92-60 and
Conditional Exception (Variance) No. 93-4 to the April 20, 1993
Planning Commission meeting as requested by the applicant.

B-3 SITE PLAN AMENDMENT NO, 93-1:
APPLICANT: Bill Winn
LOCATION: 300 Pacific Coast Highway (northeast corner of
Pacific Coast Highway and Main Street)
Site Plan Amendment is a request to amend the site plan as approved
for Conditional Use Permit No. 88-7 by modifying the Pierside
Pavilion open space plaza, which is located at the corner of Pacific
Coast Highway and Main Street. The applicant wishes to remove the
existing fountain from the open space plaza, and replace it with a
seating area and a surfers' "Walk of Fame".
STAFF RECOMMENDATION:
Staff is recommending approval of Site Plan Amendment No. 93-1 with
findings and suggested conditions of approval.
THE PUBLIC HEARING WAS OPENED.
Bill Winn, 300 Pacific Coast Highway, property manager of the
Pavilion, stated they wished to remove the fountain because of
vandalism and safety for children.

Dianne Easterling, 203 - 8th Street, spoke in opposition to the
request.
Loretta Wolfe, 411 - 6th Street, spoke in opposition to the request.
Richard Andino, 16549 Lassen Street, Fountain Valley, spoke in
support of the fountain removal. He stated that his daughter fell
into the fountain and could have been seriously injured.
Peter Townend, 14172 Ebony Way, Westminster, spoke in support of the
request.
Michelle Pap, 1600 Villa Yorba #622, spoke in support of the request.

The Commission discussed the removal of the fountain. It was felt
that the fountain was designed into the project as open space to
soften the structure. They did not oppose the "walk of fame" for
surfers but were opposed to the complete elimination of the
fountain. They decided a continuance was necessary and directed the
applicant to prepare an alternative design which incorporates a
fountain with the "walk of fame".

B-4 APPEAL - USE PERMIT NO. 92-66:
APPLICANT/
APPELLANT: Central Park No. 9 - Jeff Smith
LOCATION: Derby Circle at Saddleback Lane
Use Permit No. 92-66 is a request to install an entry gate for Tract
13439, a newly developed 27 lot subdivision in the Ellis-Goldenwest
quartersection.
On February 2, 1993, the Zoning Administrator denied Use Permit No.
92-66 and approved Lot Line Adjustment No. 93-1. The.use permit was
denied based on potential adverse effects on traffic flow in the
area and impacts to the future residence on Lot 1. The applicant
filed an appeal of the Zoning Administrator's denial of the use
permit on February 8, 1993.
STAFF RECOMMENDATION:
Staff recommends that the Planning Commission deny the appeal and
uphold the Zoning Administrator's denial of Use Permit No. 92-66
with findings.
The applicant submitted a request for continuance for 30 days.
Commissioner Cook stated she would be abstaining from voting on this
request in conformance with the Political Reform Act.

B-5 CONDITIONAL USE PERMIT NO 92-41/NEGATIVE DECLARATION NO, 93-2:
APPLICANT: Scats Gymnastics - Don Peters, Executive Director
LOCATION: 15682 Producer Lane
Conditional Use Permit No. 92-41/Negative Declaration No. 93-3 is a
request to establish SCATS Gymnastics training facility within an
existing 27,438 square foot industrial building at 15682 Producer
Lane. The proposed project consists of 16,395 square feet of
gymnasium and 11,043 square feet of administrative offices located
south of McFadden Avenue on the east side of Producer Lane. Because
the Huntington Beach Ordinance Code does not specify a parking
requirement for a gymnastics facility, staff requested that the
applicant submit a parking study of their existing facility on
Research Drive. Staff has determined that parking for the proposed
use can be provided after re -striping the parking lot.
STAFF RECOMMENDATION:
Staff recommends approval of the request as the peak hours of
operation for SCATS are typically weekday afternoons, evenings and
weekends when the surrounding industrial uses are winding down or
completely closed. The resulting staggered hours of operation
create more parking opportunities for all uses and help ensure
compatibility between the sports center and the light industrial
uses.

questions the Commission may have.

FINDINGS FOR APPROVAL - CONDITIONAL USE PERMIT NO, 92-41:
1. The granting of Conditional Use Permit No. 92-41 for
establishment of a gymnastics training facility is consistent
with the General Plan Land Use designation of General Industrial
which allows unclassified uses such as a sports training
facility to locate in any zone subject to approval of a
conditional use permit by the Planning Commission.
2. The location, site layout, and design of the proposed gymnastics
training facility properly adapts the proposed structures to
streets, driveways, and other adjacent structures and uses in a
harmonious manner. No exterior changes will be made to the
existing industrial building other than re -striping the parking
lot. The re -striping activity will conform to code standards
and improve traffic circulation on the property.
3. The combination and relationship of one proposed use to another
on a site are properly integrated. Establishment of the
gymnastics training facility will be properly integrated to
adjacent uses because the peak hours of operation for the
gymnastics center are weekday afternoons, evenings and weekends
when the industrial businesses are winding down or closed. -
4. The access to and parking for the proposed gymnastics training
facility does not create an undue traffic problem. Adequate
parking can be provided on -site and peak hours of operation will
typically be staggered so that proper traffic circulation will
be maintained.
CONDITIONS OF APPROVAL - CONDITIONAL USE PERMIT NO, 92-41:
1. The site plan, floor plans, and elevations received and dated
March 25, 1993 shall be the conceptually approved layout.
2. All gymnastics spectator events such as
exhibitions, etc., shall be held either
during weekend hours between 6:00 p.m.
Sunday. No spectator events shall take
competitions,
at an off -site venue or
Friday and 6:00 p.m.

3. The following shall be completed prior to issuance of a
Certificate of Occupancy:
a. The signage currently reserving parking spaces for Flooring
Concepts and Mohawk Finishing Products, Inc. shall be removed
unless a Parking Management Plan is submitted and approved by
the Community Development Department.
b. The parking on Lot 2 shall be re -striped to conform to the
site plan dated March 25, 1993 and pursuant to the
requirements of Article 960, Off -Street Parking and
Landscaping, of the Huntington Beach Ordinance Code.
c. All fencing blocking access in and around the parking area
shall be removed.
4. The Fire Department conditions of approval are as follows:
a. The Automatic Fire Sprinkler System modifications for an
"assembly" will be required to be installed throughout the
proposed complex.
b. All roads leading into the complex must be identified as fire
lanes and must be posted with "no parking" signs. The
northwest and southwest corners of the fire lanes must have a
minimum 17' x 45' turning radius designed so fire apparatus
can make the turns.
c-.'-The building address numbers must be ten inches or greater in
height with a minimum 1-1/2" brush stroke.
d. Fire extinguishers must be installed and located in areas
approved by the Fire Department.
e. An Automatic Detection and Alarm System must be installed
pursuant to State Building Standards.
f. All existing systems of the proposed project must comply with
Building Division and Chapter 33 of the Uniform Building Code.
5. The Planning Commission reserves the right to revoke Conditional
Use Permit No. 92-41/Negative Declaration No. 93-2 if any
violation of these conditions or the Huntington Beach Ordinance
Code occurs.
6. This conditional use permit shall not become effective for any
purpose until the ten day appeal period has elapsed.
7. Conditional Use Permit No. 92-41/Negative Declaration No. 93-2
shall become null and void unless exercised within one (1) year
of the date of final approval, or such extension of time as may
be granted by the Planning Commission pursuant to a written
request submitted to the Planning Department a minimum 30 days
prior to the expiration date.

B-6 GENERAL PLAN CONFORMANCE NO. 93-1:,
APPLICANT: City of Huntington Beach, Department of Public
Works
LOCATION: Southern terminus of Quarterhorse and Saddleback
Lane in the Ellis-Goldenwest Quartersection. The
area is bounded by Ellis Avenue, Garfield Avenue,
Edwards Street and Goldenwest Street.
The proposed project is located within the Ellis-Goldenwest
Quartersection at the southern terminus of Quarterhorse and
Saddleback Lanes. The purpose of the request is to find that the
proposed alignment and installation of a storm drain pipe from
Tentative Tract No. 14009 to Tentative Tract No. 13439 is in
conformance with the General Plan. The storm drain connection is an
off -site improvement conditioned by approval of Tentative Tract
No. 14009, an approved 96 lot estate residential subdivision.
STAFF RECOMMENDATION:
Planning staff recommends approval of the request. Approval is
based upon findings of consistency with the goals and policies of
the Community Facilities Element of the General Plan and will serve
to implement the Ellis-Goldenwest and Holly-Seacliff Specific Plans.
Steve May, Public Works, submitted a letter requesting continuance
to the April 20, 1993 Planning Commission meeting in order to allow
the applicant additional time to negotiate a land acquisition.

E. PLANNING COMMISSION ITEMS/INQUIRIES
Commissioner Cook - asked staff to investigate the street
light globes in the Main Street Park next to the Longboard
Restaurant. She thought that they may be to close to the
adjacent building. Steve May, Public Works, said he would
report back at the next meeting.
Commissioner Biddle - asked staff to investigate why the end
of Utica Street was blocked off by a partial block wall.
Steve May, Public Works, stated he would report back at the
next meeting.
Commissioner Gorman - asked staff to investigate the coastal
zoning boundary in his neighborhood. He stated that his
neighbors were getting conflicting responses from the Planning
Department. Scott Hess, Senior Planner, stated he would
report back at the next meeting.
Commissioner Inglee - asked staff to investigate why the
center dividers on Warner Avenue near the Meadowlark Airport
area were void of landscaping. Steve May, Public Works,
stated he would report back at the next meeting.
F. COMMUNITY DEVELOPMENT ITEMS
Howard Zelefsky, Planning Director, restated actions taken at
the April 5, 1993 City Council meeting.
