MINUTES: The Minutes of March 31 and April 7,
1993 Zoning Administrator Meetings
were continued.
ITEM 1: DRAFT NEGATIVE DECLARATION NO. 93-7
Applicant: City of Huntington Beach
Public Works Department
2000 Main Street
Huntington Beach, CA 92648
Request: Installation of street improvements along the below
segment of Ellis Avenue to bring the street segment up
to its designated secondary arterial capacity.
Improvements will require the acquisition of portions of
approximately five (5) parcels; however, no structures
will be removed.
Location: North side of Ellis Avenue from approximately 132 feet
west of Patterson Lane to approximately 204 feet east of
Patterson Lane.
Wayne Carvalho, Staff Planner, reported that the Draft Negative
Declaration was recommended by the Environmental Assessment
Committee. The Draft Negative Declaration was advertised for
twenty-one days and one comment was received from the Environmental
Board. Staff advised that the environmental approval had been
requested by the Public Works Department for funding purposes only.
Staff concluded by recommending approval with mitigation measures.
Tony Folaron, Public Works, was available to respond to questions.
There were no other persons present to speak for or against the
request.
DRAFT NEGATIVE DECLARATION NO. 93-7 WAS APPROVED BY THE ZONING
ADMINISTRATOR WITH THE FOLLOWING MITIGATION MEASURES. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS. '
MITIGATION MEASURES:
1. Prior to initiation of street improving construction, the
Department of Public Works shall replace at a one to one ratio
all trees which will be removed as a result of the street
improvement project. Replacement trees may be located on
private property adjacent to the former tree locations or
within the public right-of-way.
2. To minimize noise impacts to occupants residing in residences
along the project area, the Department of Public Works shall
assure compliance with acoustical standards set forth in
Chapter 8.40 of the Huntington Beach Municipal Code. Evidence
of compliance shall be submitted prior to installation of
street improvements and shall consist of an acoustical analysis
report prepared under the supervision of a person experienced
in the field of acoustical engineering.
3. To minimize impacts to emergency access as a result of
temporary lane closures, the applicant shall notify the City of
Huntington Beach Fire and Police Departments of any street lane
closures a minimum of 24-hours prior to the initiation of
street improvement activities.
4. To minimize impacts to circulation conflicts as a result of
construction traffic:
a. The applicant shall submit and implement a construction
traffic circulation plan identifying the routes which
construction equipment and trucks will use to access and
depart from the area. The plan shall use routes to
generate the minimum number of circulation conflicts with
residential, pedestrian, bicycle and vehicle traffic.
b. The Department of Public Works shall work with property
owners at 8041, 8071 and 8101 Ellis Avenue to provide safe
vehicle egress from their properties. The Public Works
Department shall assist the property owners in designing
and installing adequate turn -around areas on -site to
minimize traffic visibility and access impacts created by
the loss of driveway length by allowing vehicles adequate
space to turn -around and head out of driveways. If safe
access from the properties can not be attained, the
Department of Public Works shall pursue acquisition of the
subject property(ies) or other strategies.

ITEM 2: USE PERMIT NO. 93-25:
Applicant: Ron Buysse

Request: To permit a Temporary Outdoor Event for a three
(3) day book sale in the center's parking lot on
April 23-25, 1993 pursuant to Section 9730 of
the Huntington Beach Ordinance Code.
Location:
15902 Springdale
John Johnston, Staff Planner, reported that the request was for a
three day book sale. Staff advised the applicant that an electrical
permit would be required. Staff concluded by recommending approval
with findings and suggested conditions of approval.
Ron Buysse, the applicant, was present and concurred with the
suggested conditions of approval.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 93-25 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO
CALENDAR (2) DAYS.
FINDINGS FOR APPROVAL:
1. The temporary outdoor event will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity. The three day book sale will not impact on -site
circulation nor access to existing businesses.
b. Property and improvements in the vicinity of such use or
building. The event is a temporary use.
2. The granting of Use Permit No. 93-25 will not adversely affect
the General Plan of the City of Huntington Beach.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan received and dated April 9, 1993 shall be the
conceptually approved layout.
2. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.

3. Fire access lanes shall be a minimum with of (20) twenty feet.
4. A detailed site plan shall be submitted to the Huntington -.Beach
Fire Department for approval (show table locations, tents,
barriers, etc.).
5. The applicant shall obtain all necessary Fire Department
permits and comply with all provisions of Article 32 of the
Uniform Fire Code.
6. The applicant's request shall include necessary permits for
temporary signs.
7. The proposed tent shall be of fire retardant material. Proof
of Certification shall be submitted to the Fire Department for
approval prior to the tent's installation on the site.
8. The proposed tent shall be secured against collapsing to the
satisfaction of the Fire Department.
9. "No Smoking" signs shall be posted in conspicuous locations.
10. Fire extinguishers shall be provided in number and locations
specified by the Fire Department.
11. A minimum of two (2) exits shall be provided and maintained.
12. Stand by personnel shall be on site to safeguard premises.
13. An overnight security guard shall be provided to protect
merchandise left overnight. The Huntington Beach Police
Department shall be notified 24 hours prior to the event.
INFORMATION OF SPECIFIC CODE REQUIREMENTS:
1. The event shall comply with all applicable provisions of the
Ordinance Codes, Building Division and Fire Department.
2. The applicant shall meet all applicable local, State and
Federal Fire Codes, Ordinances and standards.
3. The Zoning Administrator reserves the right to revoke Use
Permit No. 93-25 if any violations of these conditions or the
Huntington Beach Ordinance Code occurs.
4. The applicant shall submit all future temporary outdoor event
applications a minimum of thirty (30) days prior to the event.
Failure to provide adequate notice shall result in denial of
the request.

Applicant: Old World German Restaurant

Huntington Beach, CA 92647
Request: Annual review of Oktoberfest (from Mid -September to
November 7, 1993) as required by Conditional Use
Permit 88-22.
Location: 7561 Center Ave., Unit 49-
Wayne Carvalho, Staff Planner, reported that the annual review was a
requirement of the conditional use permit for the event. Staff
indicated that a letter was received requesting that Old World's
security staff enforce the parking conditions. Staff advised that
formal comments had not been received from the Police Department and
recommended a one week continuance.
THE PUBLIC HEARING WAS OPENED.
Bernie Bischoff, representing the applicant, was present and agreed
to the one week continuance.
There were no other persons present to speak for or against the
request and the public hearing was continued.
USE PERMIT NO. 93-20 WAS CONTINUED TO THE ZONING ADMINISTRATOR
MEETING OF APRIL 21, 1993, BY THE ZONING ADMINISTRATOR.
ITEM 4: USE PERMIT NO. 93-8
Applicant: Tom Kauffmann

Fountain Valley, CA 92708
Request: To permit the installation of access gates -and
perimeter fencing around an existing apartment
complex pursuant to Section 9604.2 of the
Huntington Beach Ordinance Code. The project
consists of wrought iron fences with stucco
pilasters, and automatic entry gates.
Wayne Carvalho, Staff Planner, reported that the request for the
access gates and perimeter fencing was required because the fence is
on the property line and parking controls require an approved use
permit. Staff recommended approval with findings and suggested
conditions of approval.

Tom Kauffmann, the applicant, advised that the intent of the request
was to improve the property and reduce crime in the apartment
complex.
Donald Akeo, 6361 St. Paul Circle, spoke in opposition to the
request. His main concerns were residents of the apartments parking
in front of his residence and trash being discarded on his
property. He requested that trash receptacles be placed at the
gates.
Tom Kauffmann, the applicant, indicated that some of the people
parking in front of Mr. Akeo's home were residents of the apartment
complex across the street.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 93-8 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN
CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO 93 8:
1. The establishment, maintenance and operation of the proposed
entry gates and perimeter fences will not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity. With the conditions imposed, the fence
will meet the requirements specified in the Uniform
Building Code. The gates and fences will not impact
pedestrian or motorist vision.
b. Property and improvements in the vicinity of such use
or building. The fence will be compatible with the
existing apartment complex and surrounding properties
as the fence will be setback from the property lines at
several locations to soften the street scene.
Furthermore, the perimeter fence/entry gate will
provide additional privacy and security for the tenants
and their property.
2. The granting of Use Permit No. 93-8 will not adversely affect
the General Plan of the City of Huntington Beach. The entry
gate and security fences are consistent with the goals and
objectives of the Medium Density Residential Land Use
designation of the General Plan.

SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
February 8, 1993 shall be the conceptually approved layout with
the following modifications:
a. All proposed wood fences along Warner Avenue shall be
replaced with wrought iron or stucco fences.
b. Stucco pilasters shall be provided along St. George a
minimum forty (40) feet on center.
2. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
3. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawing sets submitted for plancheck.
4. All applicable Public Works fees shall be paid prior to
issuance of building permits.
5. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
6. All gates shall be equipped with a Knox System per Fire
Department standards.
7. A remote gate opener system shall be used on all access gates
to reduce stacking impacts on public streets.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
