MINUTES: The Minutes of April 28, 1993 Zoning
Administrator Meetings were approved.
ITEM 1: USE PERMIT NO, 93-28
Applicant: Angelo Lardas
16866 Beach Blvd.
Huntington Beach, CA 92648
Request: To permit a Temporary Outdoor Event for a "Ronald
McDonald Big Show" within the parking lot on May 13,
1993 from 6-7 p.m. pursuant to Section 9730.64 of the
Huntington Beach Ordinance Code.
Location: 16866 Beach Blvd.
Wayne Carvalho, Staff Planner, reported that the proposed request
was to permit a temporary outdoor event for a one hour "Ronald
McDonald" performance including magic tricks on May 13, 1993. Staff
concluded by recommending approval with findings and conditions of
approval.
THE PUBLIC HEARING WAS OPENED.
Angelo Lardas, the applicant, was present. He said that the event
was scheduled for a Thursday evening and that the show had been held
at above location in the past. He concluded by stating that
previous events did not result in any problems.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 93-28 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH
THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING
ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING
ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TWO
CALENDAR (2) DAYS.
FINDINGS FOR APPROVAL:
1. The temporary outdoor event will not be detrimental to:
a. The general welfare of persons residing or working in the
vicinity. With the conditions imposed, impacts to on -site
circulation and streets will be alleviated.
b. Property and improvements in the vicinity of such use or
building. The event is a temporary use.
2. The granting of Use Permit No. 92-38 will not adversely affect
the General Plan of the City of Huntington Beach. The
temporary outdoor event is consistent with the General
Commercial Land Use designation of the General Plan.
SPECIAL CONDITIONS OF -APPROVAL:
1. The site plan received and dated April 21, 1993 shall be the
conceptually approved layout.
2. Fire access lanes shall be maintained. If fire lane violations
occur and the services of the Fire Department are required, the
applicant will be liable for expenses incurred.
3. A detailed site plan shall be submitted to the Huntington Beach
Fire Department for approval.
4. The applicant shall obtain all necessary Fire Department
permits and comply with all provisions of Article 32 of the
Uniform Fire Code.
5. The applicant's request shall include necessary permits for
temporary signs during the day of the event.
6. McDonald's shall provide personnel to direct on -site traffic
during the event.

INFORMATION OF SPECIFIC CODE REQUIREMENTS:
1. The event shall comply with all applicable provisions of the
Ordinance Codes, Building Division and Fire Department.
2. The applicant shall meet all applicable local, State and
Federal Fire Codes, Ordinances and standards.
3. The Zoning Administrator reserves the right to revoke Use
Permit No. 93-28 if any violations of these conditions or the
Huntington Beach Ordinance Code occurs.
4. The applicant shall submit all future temporary outdoor event
applications a minimum of thirty (30) days prior to the event.
Failure to provide adequate notice shall result in denial of
the request.
ITEM2: USE PERMIT NO. 92-67/CONDITIONAL EXCEPTION NO, 92-46
Applicant: Winston Tire Company
900 W. Alameda Avenue
Burbank, CA 91506
Request: To permit the demolition of a 1,092 square foot
building and construction of a new 1,170 square foot
building resulting in an eight (8) space parking
variance pursuant to Sections 9220.1(c) and 9602.2 of
the Huntington Beach Ordinance Code.
Location: 17141 Beach Blvd.
Wayne Carvalho, Staff Planner, reported that the request is to
demolish an existing structure and construct a new 1,170 square foot
structure to the rear of the lot. He advised that the site plan had
been revised several times in an attempt to meet Code requirements.
Staff reported that the existing structure is non -conforming to
parking requirements and the proposed construction would result in
an eight space parking variance. He indicated that there is parking
in the service bays; however, Code does not allow the bays to be
calculated into the parking requirements.
Staff reported that a noise study was conducted which determined
that the new structure would reduce noise.
Staff concluded by recommending denial of the parking variance
because a finding of hardship could not be determined.

THE PUBLIC HEARING WAS OPENED.
Jacques Hunter, representing the applicant, was present. He said
that Winston Tire Company would like to portray a better image in
the City by the demolishing the old structure and constructing a new
more attractive structure. He advised that they had made
arrangements for their employees to park in the adjacent lot thereby
creating more parking for customers.
Tom Davis, representing the applicant, said that the new project
would also result in an increase in parking. He advised that they
propose putting in a thirty inch grafitti wall.
There were no other persons present to speak for or against the
request and the public hearing was closed.
USE PERMIT NO. 92-67/CONDITIONAL EXCEPTION NO. 92-46 WAS APPROVED
BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND
CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE
ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE
PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS.
FINDINGS FOR APPROVAL -USE PERMIT NO 92-67:
1. The establishment, maintenance and operation of the proposed
1,170 square foot building will not be detrimental to:
a. The general welfare of persons residing or working in
the vicinity. The demolition and addition to the
existing Winston Tire building will provide more
parking than present. Furthermore, the new building
will be oriented in a manner to reduce noise impacts to
the abutting residential property.
b. Property and improvements in the vicinity of such use
or building. The proposed building will include
additional landscaping and parking on -site. The
applicant/property owner will be required to remove and
replace street improvements at the site.
2. The granting of Use Permit No. 92-67 will not adversely affect
the General Plan of the City of Huntington Beach. The proposed
1,170 square foot commercial building is consistent with the
goals and objectives of the General Commercial Land Use
designation of the General Plan.

FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO, 92-46:
1. The granting of Conditional Exception No. 92-46 will not
constitute a grant of special privilege inconsistent upon other
properties in the vicinity and under an identical zone
classification. The property is sub -standard in lot size and
width and is located on a corner. There are six (6) parking
spaces available in the service bays and street parking on
Cypress Avenue. Furthermore, the project directly across the
street was approved with required parking in the service bays.
2. Because of special circumstances applicable to the subject
property, including size, shape, topography, location or
surroundings, the strict application of the Zoning Ordinance is
found to deprive the subject property of privileges enjoyed by
other properties in the vicinity and under identical zone
classifications. The existing parcel is non -conforming in
terms of lot size and width. In addition, with the required
setbacks, and existing drainage patterns, the design and area
available for the building is limited.
3. The granting of Conditional Exception No. 92-46 is necessary
in order to preserve the enjoyment of one or more substantial
property rights. The granting of Conditional Exception No.
92-46 will provide a new three bay tire service building with
additional parking on -site.
4. The granting of Conditional Exception No. 92-46 will not be
materially detrimental to the public welfare, or injurious to
property in the same zone classifications. The location, site
layout, and design of the proposed building properly adapts the
proposed structures to streets, driveways, and other adjacent
structures and uses in a harmonious manner.
5. The granting of Conditional Exception No. 92-46 will not
adversely affect the General Plan of the City of Huntington
Beach. The 1,170 square foot building is consistent with the
General Commercial Land Use Designation of the General Plan.
SPECIAL CONDITIONS OF APPROVAL:
1. The site plan, floor plans, and elevations received and dated
March 3, 1993 shall be the conceptually approved layout with
the following modifications:
a. Site plan shall reflect Public Works comments in terms
of proper scale and radius.
b. Maximum eight (8) foot high CMU wall at west property
line.
2. A revised site plan shall be submitted depicting the
modifications described above.

3. The Zoning Administrator shall be notified in writing if any
changes in building height, floor area, setbacks, building
elevations or open space are proposed as a result of the plan
check process. Building permits shall not be issued until the
Zoning Administrator has reviewed and approved the proposed
changes. The Zoning Administrator reserves the right to
require that an amendment to the original entitlement be
processed if the proposed changes are of a substantial nature.
4. Conditions of approval shall be printed verbatim on the cover
sheet of all working drawing sets submitted for plancheck.
5. Colors and materials shall be approved by the Design Review
Board prior to submittal for building permits.
6. Prior to issuance of building permits, the following plans and
items shall be submitted and/or completed by the applicant:
a. Four (4) sets of landscape and irrigation plans to the
Department of Community Development and Public Works for
review and approval.
b. Rooftop Mechanical Equipment Plan. Said plan shall
indicate screening of all rooftop mechanical equipment and
shall delineate the type of material proposed to screen
said equipment.
c. Street improvement plan shall be submitted and approved by
the Public Works Department.
7. Installation of required landscaping and irrigation systems
shall be completed prior to final inspection/within twelve (12)
months.
8. Fire Department Requirements:
a. Building walls adjacent to the trash area shall be
constructed of non-combustible masonry.
b. An automatic fire sprinkler system shall be approved and
installed pursuant to Fire Department regulations.
c. Service roads and fire lanes, as determined by the Fire
Department, shall be posted and marked.
d. Building address signs shall comply with Fire Department
regulations.
9. Applicant shall pursue CalTrans approval of radius type
driveways on Beach Boulevard. Driveway on Beach Boulevard
shall have a minimum width of thirty feet (30').

10. There shall be no outside storage of vehicles, vehicle parts,
equipment or trailers.
11. All repair work shall be conducted wholly within the building.
12. All building spoils, such as unusable lumber, wire, pipe, and
other surplus or unusable material, shall be disposed of at an
off -site facility equipped to handle them.
13. If lighting is included in the parking lot, high-pressure
sodium vapor lamps shall be used for energy savings. All
outside lighting shall be directed to prevent "spillage" onto
adjacent properties.
INFORMATION ON SPECIFIC CODE REQUIREMENTS:
1. The development shall comply with all applicable provisions of
the Ordinance Code, Building Division, and Fire Department.
2. The applicant shall meet all applicable local, State, and
Federal Fire Codes, Ordinances, and standards.
3. The applicant shall obtain the necessary permits from the South
Coast Air Quality Management District.
4. All applicable Public Works fees shall be paid prior to
issuance of building permits.
5. "The applicant/owner shall be responsible for payment of
Traffic Impact fees prior to issuance of a Certificate of
Occupancy and/or final building permit approval."
6. Driveway approaches shall be a minimum of twenty-seven feet
(27') in width and shall be of radius type construction.
7. The major identification sign shall be removed or altered to
comply with Article 961 within 120 days of the approval date.
8. Landscaping shall comply with Section 9607 of the Huntington
Beach Ordinance Code.
9. The applicant shall restripe the parking lot so that it
conforms to provisions of Article 960 of the Huntington Beach
Ordinance Code.
10. The Zoning Administrator reserves the right to revoke
Use Permit No. 92-67/Conditional Exception No. 92-46 if any
violation of these conditions or the Huntington Beach Ordinance
Code occurs.
