ZONING ADMINISTRATOR: Mike Strange STAFF MEMBER: Wayne Carvalho MINUTES• The Minutes of June 9, 1993 Zoning Administrator Meeting were continued. ITEM 1 USE PERMIT NO, 92 47/CONDITIONAL EXCEPTION NO. 92-40 (ONE YEAR EXTENSION OF TIME) Applicant: Donley -Bennett Architects 12821 Newport Avenue Tustin, CA 92680 Request: To permit a one (1) year extension of time for the following: Use Permit: To construct twenty (20) additional apartment units to an existing 448 unit complex (Casa Del Sol Apartments) pursuant to Section 9120.1(c) of the Huntington Beach Ordinance Code. The request also includes expansion of the existing recreational building and facilities, construction of a 800 square foot car wash and the modification to the existing parking layout, resulting in additional open parking spaces, garages and driveway. Conditional Exception: To allow open guest parking spaces within the front fifty (50) feet of the lot pursuant to Section 9603.8 of the Huntington Beach Ordinance Code. Location: 21661 Brookhurst Street (Casa Del Sol Apartments) Wayne Carvalho, Staff Planner, reported that the request is for a one year extension of time of a use permit and conditional exception which permitted twenty additional apartment units and allowed open guest parking spaces. Staff recommended approval with conditions of approval. THE PUBLIC HEARING WAS OPENED. There were no persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 92-47/CONDITIONAL EXCEPTION (ONE YEAR EXTENSION OF TIME) WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. CONDITIONS OF APPROVAL - USE PERMIT NO 92 47/CONDITIONAL EXCEPTION NO. 92-40: 1. All previous conditions of approval shall remain in effect. 2. Use Permit No. 92-47/Conditional Exception No. 92-40 shall expire on November 4, 1994 unless an extension of time is granted by the Zoning Administrator. A request for an extension shall be received by the Department of Community Development at least thirty (30) days prior to expiration. ITEM 2: CONDITIONAL EXCEPTION NO 93 17 Applicant: Sean M. McGroarty 5951 Nugget Circle Huntington Beach, CA 92647 Request: To permit a 500 square foot room addition with reduced front yard setbacks (1016" in lieu of minimum 151) pursuant to Section 9110.6 of the Huntington Beach Ordinance Code. Location: 5951 Nugget Circle Wayne Carvalho, Staff Planner, reported that the request was to permit a 500 square foot room addition with reduced front yard setbacks. Staff recommended approval based on the configuration of the lot. THE PUBLIC HEARING WAS OPENED. There were no persons present to speak for or against the request and the public hearing was closed. CONDITIONAL EXCEPTION NO. 93-19 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. �l 1 ZA Minutes - 6/16/93 -2- (7047d) LI 1 FINDINGS FOR APPROVAL CONDITIONAL EXCEPTION NO 93-19: 1. The granting of Conditional Exception No. 93-19 for a 17'4" front entry garage setback will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. There were similar variances granted for properties with odd -shaped lots. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. The subject property has an odd -shaped lot and is located at the end of a cul-de-sac which restricts design of the new addition. With the conditions imposed, the garage addition will provide six (6) off-street parking spaces. 3. The granting of Conditional Exception No. 93-19 is necessary in order to preserve the enjoyment of one or more substantial property rights. The granting of Conditional Exception No. 93-19 will allow for a 140 square foot garage addition to an existing single family residence. 4. The granting of Conditional Exception No. 93-19 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. The garage addition will provide three enclosed and three open parking spaces on -site. 5. The granting of Conditional Exception No. 93-19 will not adversely affect the General Plan of the City of Huntington Beach. The proposed garage addition is consistent with the Low Density Residential Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated May 13, 1993 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. ZA Minutes - 6/16/93 -3- (7047d) 4. All building spoils, such as unusable lumber, wire' -pipe, and - other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 5. The remodeled garage shall be equipped with automatic roll -up type garage doors. The two doors shall be compatible with one another. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. All applicable Public Works fees shall be paid prior to issuance of building permits. 4. The Zoning Administrator reserves the right to revoke Conditional Exception No. 93-19 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ITEM 3: CONDITIONAL EXCEPTION NO 93-19 Applicant: Robert J. Geraci 18197 Leaf Circle Huntington Beach, CA 92648 Request: To permit a 140 square foot garage addition resulting in a 17'4" front entry garage setback in lieu of a minimum 22' pursuant to Section 9110.6 of the Huntington Beach Ordinance Code. Location: 18197 Leaf Circle Wayne Carvalho, Staff Planner, reported that the residence is located at the end of a cul-de-sac. Staff recommended approval with findings and suggested conditions of approval based on the irregular shaped lot. THE PUBLIC HEARING WAS OPENED. Robert Geraci, the applicant, advised that they had a second story addition over the garage which eliminated the eaves and the request was for additional space in the garage for storage.
