ITEM 1• COASTAL DEVELOPMENT PERMIT NO 93-7/USE PERMIT NO. 93-29 Applicant: Camelot Construction 7451 Warner Ave. Huntington Beach, CA 92647 Request: To permit the construction of a 450 square foot third story addition to an existing two (2) story single family attached residence pursuant to Sections 989.5.2 and 9110.4(c) of the Huntington Beach Ordinance Code. Location: 4012 Montego Drive Wayne Carvalho, Staff Planner, reported that the request was continued from the June 23, 1993 Zoning Administrator Meeting at the applicant's request. Staff advised that the property is located in the harbor and the request was required because the addition exceeds ten percent of the existing floor area and is located on the water. Staff said that the request meets all provisions of the zoning code, and that the property owners association had reviewed and approved the proposed addition. Staff concluded by recommending approval with findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Cliff Camelot, the applicant, was present and concurred with the suggested conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. COASTAL DEVELOPMENT PERMIT NO. 93-7/USE PERMIT NO. 93-29 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. HE STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN (10) WORKING DAYS AND ANOTHER TEN (10) WORKING DAYS TO THE COASTAL COMMISSION. FINDINGS FOR APPROVAL - COASTAL DEVELOPMENT PERMIT NO. 93-7: 1. The request to permit the remodel and 450 square foot third story addition to an existing two-story single family residence conforms with the plans, policies, requirements and standards of The Coastal Element of the General Plan. The proposed third story addition will not impact public views or access. 2. Coastal Development Permit No. 93-7 is consistent with the CZ suffix zoning requirements, the R1 Zoning District, as well as other provisions of the Huntington Beach Ordinance Code applicable to the property. The proposed development will conform with all applicable City codes. 3. At the time of occupancy, the proposed remodel and addition to an existing two-story single family residence will be provided with infrastructure in a manner that is consistent with the Coastal Element of the General Plan. All infrastructure currently exist to the site. 4. The proposed remodel and 450 square foot third story addition to an existing two story single family residence conforms with the public access and public recreation policies of Chapter 3 of the California Coastal Act. FINDINGS FOR APPROVAL -USE PERMIT NO 93-29: 1. The establishment, maintenance and operation of the 450 square foot third story addition will not have a detrimental effect on the general health, safety, or welfare or privacy of surrounding residents, or on surrounding property values. 2. The location, site plan and building design will be harmonious and compatible with the streets, driveways, property lines, and surrounding neighborhood. 3. The granting of Use Permit No. 93-29 will not adversely affect the General Plan of the City of Huntington Beach. The proposed third story addition is consistent with the goals and objectives of the Low Density Residential Land Use designation of the General Plan. ZA Minutes - 6/30/93 -2- (7149d) 1 F� SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated April 26, 1993 shall be the conceptually approved layout. 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. All proposed dock and ramp improvements shall require separate permits for the improvements located within the public waterways. 4. All proposed cantilevered deck improvements require separate permits for the improvements. 5. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 6. Proposed structures shall be architecturally compatible with existing structures. 7. Water service shall be upgraded to include a backflow device pursuant to Public Works standards. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall meet all applicable local, State, and Federal Fire Codes, Ordinances, and standards. 3. The applicant shall pay all applicable Public Works fees. 4. The Zoning Administrator reserves the right to revoke Coastal Development Permit No. 93-7 and Use Permit No. 93-29 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ZA Minutes - 6/30/93 -3- (7149d) ITEM 2: USE PERMIT NO._93-43 Applicant: Chuong Sweeney 8851 Atlanta Ave. Huntington Beach, CA 92646 Request: To permit the establishment of an arcade in conjunction with a sandwich bar pursuant to Section 9220.11 of the Huntington Beach Ordinance Code. Location: 8851 Atlanta Wayne Carvalho, Staff Planner, reported that the request to permit an arcade and sandwich bar was to move the business from one suite to a smaller suite in the same business center. Staff advised that the City had not received citizen complaints after the six month review in which revised conditions of approval were imposed. Staff concluded by recommending approval with the same conditions as previously imposed on the business. THE PUBLIC HEARING WAS OPENED. Chuong Sweeney, the applicant, was present and said that the request to move to a smaller suite was for financial reasons. Ms. J. Whitney, 8855 Atlanta Avenue, spoke in opposition to the request. She advised that Mr. Sweeney had never installed the second bicycle rack per the revised conditions of approval. She said that the arcade was not a compatible use in the center. Ms. Sue Pohl, 8861 Atlanta Avenue, spoke in opposition to the request. She said the business would be moving next to her business and was concerned about negative impact on her business. Mike Strange, the Zoning Administrator, advised that the second bike rack must be installed prior to opening the business. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 93-43 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. With the conditions imposed, video games will not be operational during school hours which will minimize the potential for truancy. b. Property and improvements in the vicinity of such use or building. The business will occupy a 1,200 square foot suite within an existing commercial center. 2. -The granting of Use Permit No. 93-43 will not adversely affect the General Plan of the City of Huntington Beach. The proposed arcade is consistent with the goals and objectives of the General Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated June 10, 1993 shall be the conceptually approved layout with the following modifications: 2. There shall be a maximum of 25 games (including billiard tables). 3. Video games shall not be operational during school hours. Games may be operational during the high school's lunch hour (12:00-12:30 p.m.) and after 2:30 p.m. 4. Hours of operation shall be as follows: a. Monday -Thursday 10:00 a.m. - 10:00 p.m. b. Friday -Saturday 10:00 a.m. - 11:00 p.m. c. Sundays 10:00 a.m. - 3:00 p.m. 5. One supervisory employee eighteen (18) years or older shall be in attendance during operating hours. 6. Two (2) bicycle racks shall be provided adjacent to the business (on west side if possible) and shall not obstruct the entire sidewalk. 7. Stereos shall be prohibited from operation before 6:00 p.m. 8. The Zoning Administrator reserves the right to revoke Use Permit No. 93-43 if any violation of these conditions or the Huntington Beach Ordinance Code occurs. ZA Minutes - 6/30/93 -5- (7149d) ITEM 3: USE PERMIT NO. 93-32 Applicant: Robert Hidey Architects 5 Corporate Park, #270 Irvine, CA 92714 Request: To permit the remodel and 450 square foot addition to an existing 5,500 square foot commercial building pursuant to Section 9220.1(c) of the Huntington Beach Ordinance Code. Location: 19022 Beach Blvd. Wayne Carvalho, Staff Planner, reported that the request was to renovate an existing building. Staff advised that the request had been heard by the Design Review Board who recommended approval as submitted. Staff concluded by recommending approval with modification to the parking, findings and suggested conditions of approval. THE PUBLIC HEARING WAS OPENED. Doug Mansfield, representing the applicant, agreed to the suggested conditions of approval; however, said they would prefer to maintain the proposed parking layout. There were no other persons present to speak for or against the request and the public hearing was closed. USE PERMIT NO. 93-32 WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. ITEM 4: CONDITIONAL EXCEPTION NO. 93-16 Applicant: KHR Associates 18500 Von Karmon Ave., Ste. 300 Irvine, CA 92715 Request: To permit variances for reduced landscaping requirements and canopy encroachments into the required setbacks (2' and 5' in lieu of minimum 71) pursuant to Sections 9220.14(e) and 9607.7 of the Huntington Beach Ordinance Code. Location: 16001 Beach Blvd. Wayne Carvalho, Staff Planner, reported that the request was for reduced landscaping requirements and canopy encroachments. Staff advised that the applicant's plan was for 1,358 square feet of landscaping and recommended that it be brought up to Code requirement of 1,384 square feet. Staff concluded by recommending approval with findings and suggested conditions of approval. ZA Minutes - 6/30/93 -7- (7149d) THE PUBLIC HEARING WAS OPENED. Brain Bell, representing the applicant, was present and concurred with the suggested conditions of approval. There were no other persons present to speak for or against the request and the public hearing was closed. CONDITIONAL EXCEPTION NO. 93-16WAS APPROVED BY THE ZONING ADMINISTRATOR WITH THE FOLLOWING FINDINGS AND CONDITIONS OF APPROVAL. THE ZONING ADMINISTRATOR STATED THAT THE ACTION TAKEN BY THE ZONING ADMINISTRATOR CAN BE APPEALED TO THE PLANNING COMMISSION WITHIN TEN CALENDAR (10) DAYS. FINDINGS FOR APPROVAL - CONDITIONAL EXCEPTION NO. 93-16: 1. The granting of Conditional Exception No. 93-16 to allow reduced landscaping, and canopy encroachments into required setbacks will not constitute a grant of special privilege inconsistent upon other properties in the vicinity and under an identical zone classification. 2. Because of special circumstances applicable to the subject property, including size, shape, topography, location or surroundings, the strict application of the Zoning Ordinance is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classifications. Due to the site layout, the existing pumps are located closer to the street, requiring the canopies to encroach several feet into the setback. 3. The granting of Conditional Exception No. 93-16 is necessary in order to preserve the enjoyment of one or more substantial property rights. The granting of Conditional Exception No. 93-16 will allow for upgrading of the existing canopies and added landscaping. 4. The granting of Conditional Exception No. 93-16 will not be materially detrimental to the public welfare, or injurious to property in the same zone classifications. The remodel will not impact traffic on arterials, nor on -site circulation. 5. The granting of Conditional Exception No. 93-16 will not adversely affect the General Plan of the City of Huntington Beach. The remodel of the existing gas station is consistent with the General Commercial Land Use designation of the General Plan. SPECIAL CONDITIONS OF APPROVAL: 1. The site plan, floor plans, and elevations received and dated April 26, 1993 shall be the conceptually approved layout. ZA Minutes - 6/30/93 -8- (7149d) 2. The Zoning Administrator shall be notified in writing if any changes in building height, floor area, setbacks, building elevations or open space are proposed as a result of the plan check process. Building permits shall not be issued until the Zoning Administrator has reviewed and approved the proposed changes. The Zoning Administrator reserves the right to require that an amendment to the original entitlement be processed if the proposed changes are of a substantial nature. 3. Conditions of approval shall be printed verbatim on the cover sheet of all working drawing sets submitted for plancheck. 4. Prior to issuance of building permits, four (4) sets of landscape and irrigation plans shall be submitted to the Department of Community Development and Public Works for review and approval. 5. Fire Department Requirements: a. Fire extinguishers shall be provided in number and at locations specified by the Fire Department. b. Building address numbers shall be installed in an area approved by the Fire Department to comply with Specification 428. c. All fuel dispensing systems shall comply with Article 79, Division 9 requirements of the 1991 Uniform Fire Code. 6. There shall be no outside storage of vehicles, vehicle parts, equipment or trailers. 7. All repair work shall be conducted wholly within the building. 8. The site shall be restricted to servicing of automobiles and sale of automobile -related products. A convenience market or "mini -market" shall not be permitted without the approval of a Conditional Use Permit by the Planning Commission. 9. All building spoils, such as unusable lumber, wire, pipe, and other surplus or unusable material, shall be disposed of at an off -site facility equipped to handle them. 10. The major identification sign (on corner) shall be removed or altered to comply with Article 961 within ninety (90) days of the approval date. INFORMATION ON SPECIFIC CODE REQUIREMENTS: 1. The development shall comply with all applicable provisions of the Ordinance Code, Building Division, and Fire Department. 2. The applicant shall obtain the necessary permits from the South Coast Air Quality Management District. 4. Development shall meet all local and State regulations regarding installation and operation of all underground storage tanks. 5. All applicable Public Works fees shall be paid prior to issuance of building permits. 6. The Zoning Administrator reserves the right to revoke Conditional Exception No. 93-16 if any violation of these conditions or the Huntington Beach Ordinance Code occurs.
